In a similar vein, back in 2021, despite being in prison, Akhil Gogoi, after winning from Sibsagar, Assam, was permitted by an NIA court to briefly leave confinement for his Assam Legislative Assembly oath-taking ceremony.
It's crucial to understand that being granted permission to take oath doesn't equate to bail release but rather signifies a special parole for the day. Subsequently, the jailed lawmaker must inform the Speaker of their inability to attend proceedings, as per Article 101(4) of the Constitution, which mandates seat vacancy if an MP misses over 60 days without permission.
For participation in Parliament sessions or voting, the lawmaker must seek court approval. However, only a conviction resulting in a two-year or longer sentence would lead to parliamentary disqualification.

The ruling National Democratic Alliance (NDA) won a majority in the Lok Sabha election.

President Droupadi Murmu dissolved the 17th Lok Sabha on Wednesday on the advice of the Prime Minister Narendra Modi-led Cabinet, according to the Rashtrapati Bhavan.
The Cabinet, in its meeting held on Wednesday, advised the President to dissolve the current Lok Sabha with immediate effect, it said.
"The President has accepted the advice of the Cabinet on 05.06.2024 and signed the Order dissolving the 17th Lok Sabha in exercise of the powers conferred upon her by Sub-clause (b) of Clause (2) of Article 85 of the Constitution," a communique issued by the Rashtrapati Bhavan read.
The term of the current Lok Sabha was to end on June 16.
Earlier in the day, Prime Minister Modi tendered his resignation to President Murmu, who accepted it and asked him to continue till the new government assumes office.

TDP president N Chandrababu Naidu, JD(U) leader and Bihar Chief Minister Nitish Kumar, Shiv Sena leader and Maharashtra Chief Minister Eknath Shinde and LJP (Ram Vilas) leader Chirag Paswan were among those who were present at the meeting chaired by Modi. Senior BJP leaders were also in attendance.
The TDP, JD(U), Shinde-led Shiv Sena and the LJP (Ram Vilas) have won 16, 12, seven and five seats respectively and will play a crucial role in the government formation.
Sources said National Democratic Alliance (NDA) leaders are expected to formally repose their faith in Modi's leadership and that MPs of the coalition's constituents may meet in a couple of days to elect him as their leader.
"I have not come here to demand anything. I have come here to support Modiji in forming the government. Modiji has got a majority. The NDA will form the government under Modiji's leadership," Shinde told reporters at the airport here.
Though there was no official word on the date for the oath-taking ceremony, there is a view among some members of the alliance that it may take place over the weekend if the contours of the new government are quickly worked out.
Parties like the TDP and the JD(U) are expected to demand some key portfolios as their support will be crucial for government formation and survival.
Modi is set for a record-equalling third term at the helm, though the new government is likely to be different in composition and character with a bigger share for the BJP's allies.

I have done my very best for my constituents and I will continue doing so but there are ways of serving in public life without necessarily having to do it that way. I think if the election is five years from hence, I don't really see myself at that stage wanting to have another go at the Lok Sabha," the former Union minister said.
Tharoor added that but for now, there are five years to serve and he is determined to do his best for the people he represents during that time.
Asked about the close fight and if the Left made it difficult for him, Tharoor said CPI candidate Pannyan Raveendran took two and a half lakh votes.
"But the other is the three areas that are represented by the CPI(M), the CPI candidate came last and the BJP candidate came first. There are some legitimate questions being asked as to how exactly and why exactly that happened. But you know at the end of the day, a victory is a victory and we are savouring it as sweet," Tharoor told PTI.
On the BJP winning its first seat in Kerala with actor-politician Suresh Gopi winning the Thrissur seat by a huge margin, Tharoor said it needs to be taken seriously as for the first time one seat has gone to the BJP.
"But I must say Suresh Gopi, whom I know well and he supported me in 2009 is not a typical BJP candidate. He went out of his way to declare his secular credentials, appealed overtly to the minority voters in Thrissur particularly to the Christian community, and had this personal quality of being a celebrity candidate, a well regarded movie star as well as the host of the Malayalam edition of the Kaun Banega Crorepati," Tharoor said.
"All of these make him a very unusual figure and it may not be that easily replicable elsewhere. Certainly if the BJP is going to abandon its communal message and go for the kind of secular campaign that Gopi led, perhaps they might do better but right now they have just gone from being a 13 per cent party in keral to a 16 per cent party in Kerala," Tharoor said.

In the race for the new Chief Minister of Odisha, speculation is rife around five prominent BJP leaders. As the ruling Biju Janata Dal (BJD) juggernaut faces a significant challenge, attention turns towards potential successors.
According to Hindustan Times, among the frontrunners is the current Leader of Opposition, Pradipta Kumar Naik. Known for his vocal criticism of the state government, Naik has emerged as a strong contender for the coveted position.
Following closely behind is the former Union Minister, Jual Oram, who enjoys widespread support within the party ranks. Oram's experience and political acumen make him a formidable candidate.
Another heavyweight in contention is the BJP state president, Samir Mohanty. With a robust organizational network and grassroots support, Mohanty presents a compelling case for leadership.
Additionally, the state's tribal face and senior leader, Biswabhusan Harichandan, garners attention as a potential Chief Ministerial candidate. Harichandan's rapport with tribal communities and administrative experience bolster his candidacy.
Lastly, the BJP's national spokesperson and Odisha in-charge, Sambit Patra, is also in the mix. Patra's articulate communication skills and national prominence lend weight to his candidacy.

India is likely to invite leaders of a number of its neighbouring countries, including Sri Lanka and Bangladesh, to the swearing-in ceremony of Prime Minister Narendra Modi over the weekend, people familiar with the matter said on Wednesday.
Modi is all set to take charge as the prime minister for a historic third consecutive term with the Bharatiya Janata Party-led National Democratic Alliance (NDA) winning 293 seats in the Lok Sabha polls.
The people cited above said top leaders of Bangladesh, Sri Lanka, Bhutan, Nepal and Mauritius are likely to be among the foreign leaders to be invited for Modi's oath-taking ceremony.
The media division of Sri Lankan President Ranil Wickremesinghe's office said Modi invited him to the swearing-in ceremony. It said Wickremesinghe accepted the invite.
It said Wickremesinghe congratulated Modi on the electoral victory in a phone call.
"During the conversation, Prime Minister @narendramodi invited President Wickremesinghe to his swearing-in ceremony, which President @RW_UNP accepted," it said.
Modi also had a phone conversation with Bangladesh Prime Minister Sheikh Hasina.
In the phone conversation, Modi invited Hasina to attend his swearing-in ceremony and she accepted it, diplomatic sources said.
The people cited above said Nepalese Prime Minister Pushpa Kamal Dahal 'Prachanda', Bhutanese Prime Minister Tshering Tobgay and Prime Minister of Mauritius Pravind Jugnauth are set to be invited to Modi's swearing-in ceremony.
Modi had a separate phone conversations with Prachanda.
The formal invitations are set to be sent on Thursday, said one of the people cited above.
The leaders of regional grouping SAARC (South Asian Association for Regional Cooperation) countries attended Modi's first swearing-in ceremony when he took the reins as the prime minister after a massive electoral victory for the BJP.
Leaders of the BIMSTEC countries attended Modi's swearing-in ceremony in 2019 when he became prime minister for the second consecutive term.
Modi is likely to take oath on June 8.
Though the BJP could not get a majority on its own in the polls, the party-led alliance secured 293 seats out of 543. The majority mark in the Lower House is 272.&nbsp;
