What punishment could Brij Bhushan Singh face if found guilty in sexual harassment case? | Explained

After Supreme Court's order, Delhi Police filed 2 FIRs against former WFI chief Brij Bhushan Sharan Singh on April 28th after protesting wrestlers accused the 6-time MP of sexual harassment.

The FIR mentions 6 adult wrestlers and a minor who have accused the Kaiserganj MP of molestation.

While Singh has been booked under multiple sections of law in the FIRs, his former assistant secretary Vinod Tomar has also been named.

Section 10 of POCSO
(Cognisable & non-bailable)

The offender in this section is booked under the offense of aggravated sexual assault -- committing sexual assault on a child whose age is less than 18 in public premises by any public servant or by someone who has custody of the child. The offender, in this case, shall face a punishment of no less than 5 years and up to 7 years. The offender shall also be liable to pay a fine.

Section 354 of IPC

As per Indian Code, if a person assaults or uses criminal force with the intention of outraging a woman's modesty, the person shall face a punishment of no less than a year and up to 5 years.

Section 354A of IPC

India code notes, if a person demands sexual favours, shows pornography against a woman's will, makes sexually coloured remarks, or makes any unwelcomed physical contact, the person shall face a 3-year imprisonment and a fine or both.

Section 354D of IPC

If a person stalks a woman on the internet or follows her despite a clear indication of disinterest by her, the person shall be punished for up to 3 years on the first conviction and up to 5 years on the 2nd conviction. The accused shall also have to pay a fine.

Section 34 of IPC

If a criminal act is done by more than one person, each person will be liable for that act and shall face imprisonment for a term not exceeding 6 months or a fine or both.
