Delhi High Court Seeks Clarity on 'Udaipur Files' Release Context

New Delhi, Jul 10 (PTI) — The Delhi High Court has requested clarification regarding the Supreme Court's comments concerning the movie "Udaipur Files," which is based on the murder of Kanhaiya Lal, a tailor from Udaipur. The top court, consisting of Justices Sudhanshu Dhulia and Joymalya Bagchi, on Wednesday, chose not to urgently schedule a petition challenging the film's release and orally remarked: "Let the film be released". A counsel representing one of the defendants in the murder case argued that the film's release could influence the trial. On the previous day, the high court instructed the movie's producer to facilitate a screening for those advocating its ban, in light of its scheduled release on July 11. On Thursday, a division bench led by Chief Justice DK Upadhyaya and Justice Anish Dayal sought clarity on the Supreme Court's remarks, questioning whether the film's release had been permitted. "We saw in newspapers that the matter was at the Supreme Court, which was denied, saying 'let the screening go on'," the HC bench noted. Senior advocate Kapil Sibal, representing the petitioners seeking to block the movie's release, clarified that the Supreme Court was only asked to schedule the matter, not to impose a stay. "Only the request for mentioning was denied, not for a stay. The SC didn't even review the case file," Sibal remarked, requesting time to seek further clarification from the top court. Media outlets have reported on the apex court's observations. The high court is scheduled to revisit the plea at 2.30 PM. Kanhaiya Lal, a tailor from Udaipur, was killed in June 2022, allegedly by Mohammad Riyaz and Mohammad Ghous. The assailants reportedly released a video claiming the act was retaliation for the tailor's alleged support of former BJP leader Nupur Sharma following her contentious statements about Prophet Mohammed. The incident was investigated by the National Investigation Agency, with the accused charged under both the Unlawful Activities Prevention Act (UAPA) and the Indian Penal Code. The trial is currently underway in a special NIA court in Jaipur.
