Maharashtra tussle: SC says Governor erred, but court can't reinstate Uddhav Thackeray as CM

The Supreme Court on May 11, 2023, delivered its judgment on the heated political battle between former Maharashtra Chief Minister Uddhav Thackeray, and his friend-turned-foe Eknath Shinda, the current CM.

The top court said that after Shinde and his camp rebelled against Thackeray, the Maharashtra Governor was not justified in calling upon then-CM Uddhav to prove a majority in the Assembly in June 2022.

The judges also said that the Assembly Speaker's decision to appoint Bharat Gogawale of the Shinde faction as the whip of Shiv Sena was "illegal".

The court added that it cannot rule on Uddhav's plea to be restored as CM since he tendered his resignation voluntarily.
