Banks of photographers and camera crews gathered outside London's High Court in anticipation of Harry's arrival for opening speeches in the case.
But his lawyer, David Sherborne, said Harry will not take the stand until Tuesday, as he had been celebrating his daughter Princess Lilibet's second birthday and only flew to the UK late Sunday.
That earned him a rebuke from the judge Timothy Fancourt, who said he was "a little surprised" that the prince was not in court on Monday.
Sherborne said stories about Harry were clearly a money spinner for tabloids and started when he was aged 11.
The pursuit of stories by illegal methods even continued after "the tragic death of his mother" Princess Diana in a Paris car crash in 1997 while she was being pursued by photographers.
"No aspect of the young prince's life was safe" from press intrusion and Harry's phone "would have been hacked on multiple occasions", he submitted.
MGN's lawyer Andrew Green said there was "no evidence" the prince's phone was hacked "let alone on a habitual basis" and that payment records used in the claim "do not demonstrate" unlawful information-gathering.

&ldquo;Both my wife [Queen Camilla] and I have been most profoundly shocked and saddened by the news of such a dreadful accident outside Balasore. I would like to express our deepest possible condolences to the families of all those who have so tragically lost their lives,&rdquo; Charles was quoted as saying in a statement issued by Buckingham Palace.
In the statement that was also posted across the royal social media channels, the 74-year-old monarch speaks of the special place in his heart for India and reflects upon his fond memories of a visit to Odisha 43 years ago.
&ldquo;I do hope you know what a special place India and the people of India have in our hearts. I have particularly fond memories of visiting Odisha in 1980 and meeting some of its people on that occasion," it said.
"I pray, therefore, that you may be able to convey our most heartfelt prayers and sympathy to all those who have been affected by this appalling tragedy, together with our special thoughts for the people of Odisha,&rdquo; the King concludes.
The message follows several condolence messages from the UK government, including from Prime Minister Rishi Sunak who extended his &ldquo;heartfelt support and admiration to the survivors and those working tirelessly to respond&rdquo; to the accident.
On Sunday, British Foreign Secretary James Cleverly also expressed condolences to the families of the victims of the Odisha train tragedy.

"We have a lot of cows back home and this one can be considered excess, so we are bringing it here... to return it back to God," he told AFP.
"This is also an act of gratitude to God for giving us prosperity... We return it back to God so we can come back here next year."
The calf had a lucky escape as it was handed to a villager after Slamet's prayers instead of being sacrificed to the volcanic cauldron.
Some villagers who do not belong to the Tengger tribe took to the crater's steep slopes equipped with nets in an attempt to intercept offerings thrown into the abyss and avoid them going to waste.
Farmer Joko Priyanto brought some of his own produce in the form of cabbages and carrots to lob down into the smoky void.
"I hope I will receive a reward from the almighty God," the 36-year-old said.

Monday's ritual was the first time since the Covid-19 pandemic that authorities had allowed tourists to the site after the festival was limited to worshippers last year.
The event has its roots in 15th-century folklore from the Majapahit kingdom, a Javanese Hindu-Buddhist empire that stretched across Southeast Asia.
Legend has it that Princess Roro Anteng and her husband, unable to bear children after years of marriage, begged the gods for help.
Their prayers were answered when they were promised 25 children, as long as they agreed to sacrifice their youngest child by throwing him into Mount Bromo.
Their son is said to have willingly jumped into the volcano to guarantee the prosperity of the Tengger people.
For shopkeeper Rohim, who travelled from a nearby Javan city on Monday to launch potatoes, leeks and cash into the lava, it was a chance to pray for good luck. He said his fortunes had improved following previous visits.
"Business has been better than before, hence my coming here," the 32-year-old said.
"I'm hoping my business can improve so next year I can come back."

79-year-old Robert Hanssen was found unconscious in his cell at a federal prison in Florence, Colorado, and was later pronounced dead, the Associated Press reported. He is believed to have died of natural causes.
Hanssen started giving classified information to Moscow in 1985, and in return got $1.4 million in cash, diamonds and bank funds over 16 years, as per the FBI.
He had been serving a sentence of life in prison without parole after pleading guilty to 15 counts of espionage and other charges in 2001.
The FBI has been notified of Hanssen's death, according to the Bureau of Prisons. He had been serving time in Colorado since July 2002.

John Kirby, Coordinator for Strategic Communications at the National Security Council in the White House, made the comments on June 5, 2023. He said that the strength and health of democratic institutions will be part of the discussions between Modi and US President Joe Biden.
"Look, we never shy away. And you can do that with friends. You're supposed to do that with friends. You never shy away from expressing concerns that we might have with anyone around the world. But this (State) visit is really about advancing what is now and what we hope will be a deeper, stronger partnership and friendship going forward," Kirby said in response to a question.
"There are innumerable reasons why India certainly matters, not just bilaterally between the two of our nations, but multilaterally on very many levels. And the president is looking forward very much to having Prime Minister Modi here to talk about all those issues and to advance and deepen that partnership and that friendship," Kirby said.
