Chief Justice of India N V Ramana Saturday termed access to justice "a tool for social emancipation" and said only a small percentage of the population can approach courts while the majority suffers in silence, lacking awareness and necessary means.
Technology has emerged as a great enabler, the chief justice of India (CJI) said and urged the judiciary "to use modern technological tools to enhance the pace of justice delivery".
Justice Ramana was addressing the first All India District Legal Services Authorities Meet here in which Prime Minister Narendra Modi urged the judiciary to speed up the release of undertrials languishing in jails awaiting legal aid.
"Justice: Social, Economic and Political – that is the vision of justice which our Preamble promises to every Indian. The reality is, today, only a small percentage of our population can approach the justice delivery system, when in need. A majority of the people suffer in silence, lacking awareness and necessary means,” he said.
"Modern India was built around the goal of removing the disparities in society. Project democracy is about providing a space for the participation of all. Participation will not be possible without social emancipation. Access to justice is a tool for social emancipation," the CJI said.
Echoing the prime minister's views on providing legal aid and ensuring the release of undertrial prisoners, he said one of the most important aspects which calls for active consideration and intervention of the legal services authorities in the country is the condition of undertrials.
"The prime minister and the attorney general have also rightly flagged this issue in the recently held conference of Chief Ministers and Chief Justices. I am happy to note that NALSA (National Legal Services Authority) is actively collaborating with all stakeholders in securing the much-deserved relief for undertrials." Justice Ramana said India, the second most populous country in the world with an average age of 29 years, has a large workforce.
"However, skilled workers are estimated to be only three per cent of our total workforce. We need to harness the full potential of the youthful demographic profile of our country. With the western world increasingly falling short of skilled human resources, it is India's turn to fill the gap, globally," he said.
The CJI termed the district judiciary the backbone of the justice delivery system of the world's largest democracy.
They are the first point of contact for much of the population and its strengthening is "the need of the hour", he said.
"Without any doubt, the district judiciary is the driving force behind the legal aid movement in India," he said, adding public opinion about the judiciary is primarily based on their experiences with the district judiciary.
This casts a great responsibility on the district judiciary which must undertake multi-faceted tasks and roles as they are best placed to understand people’s problems and social issues," the BJI said.
Justice Ramana hailed the services provided by NALSA following its inception 27 years ago and said, "The fact that it is aimed at offering free legal aid to 70 per cent of our population, makes NALSA the largest legal aid provider in the world." Many of the objectives of NALSA have been translated to social realities and this was made possible because of the sincere effort of dedicated judges and advocates, he said.
The CJI also stressed the need for strengthening alternate dispute redressal (ADR) mechanisms like Lok Adalat, mediation and arbitration centres.
These ADR mechanisms have the potential to transform the legal landscape of India by providing millions of people a platform to settle their grievances, he said.
"Matters ranging from matrimonial and intergovernmental disputes, government contracts and land acquisition can be attempted to be resolved through mandatory ADR. This will not only reduce pendency and backlog but also will provide a much-needed speedy justice to affected parties," Justice Ramana said.
The two-day meet, organised by NALSA, is being attended by over 1200 delegates across the nation including the principal district and sessions judge of all the judicial districts and ex officio chairpersons of DLSAs and would discuss the implementation of the Unified business process for providing effective legal aid to marginalised and poor.

The Supreme Court collegium, headed by Chief Justice of India N V Ramana, met on Tuesday to discuss the appointment of the next Chief Justice as the CJI is set to retire on August 26. 

Supreme Court collegium meets to decide on next CJI

Justice U.U. Lalit, the senior-most judge of the Supreme Court, is next in line to be appointed the Chief Justice of India.

The Supreme Court collegium, headed by Chief Justice of India N V Ramana, met on Tuesday to discuss the appointment of the next Chief Justice as the CJI is set to retire on August 26.&nbsp;
Besides the CJI, the collegium includes four other judges including Justices U.U. Lalit, D.Y. Chandrachud, Sanjay Kishan Kaul and Abdul Nazeer.&nbsp;
While the collegium did discuss potential candidates for appointments to the top court, it is yet to reach a consensus as some judges are, reportedly, of the view that they should wait till the next CJI takes over.
The collegium is likely to hold another meeting on Wednesday.&nbsp;
According to the Memorandum of Procedure (MoP) on the appointment of judges and the CJI, the Law Minister is supposed to ask the outgoing Chief Justice to recommend their successor and the process normally starts a month before the retirement of the incumbent CJI.&nbsp;
The Supreme Court is reportedly yet to receive a 'note' or a 'letter' from the law ministry regarding recommendation for the next CJI.
The CJI should be &ldquo;the senior-most judge of the Supreme Court considered fit to hold the office.&rdquo;&nbsp;

Justice U.U. Lalit, the senior-most judge of the Supreme Court, is next in line to be appointed the CJI, as per the MoP. He is expected to have a tenure of three months, retiring on November 8, 2022.
With CJI Ramana&rsquo;s retirement, the apex court will have 30 judges against a sanctioned strength of 34.&nbsp;

He also expressed disappointment that even after 75 years of Independence people have not understood the roles and responsibilities assigned by the Constitution to each Institution.
"As we celebrate 75th year of Independence this year and as our Republic turned 72, with some sense of regret I must add here that we still haven't learnt to appreciate wholly the roles and responsibilities assigned by the Constitution to each of the Institutions.
"The party in power believes that every Governmental action is entitled to judicial endorsement. The parties in opposition expect the judiciary to advance their political positions and causes", the CJI said at a felicitation function organised by the Association of Indian Americans in San Francisco, USA.
He added that this flawed thinking of all hues flourishes in the absence of proper understanding among people about the Constitution and the functioning of the democratic institutions.
"It is the vigorously promoted ignorance among the general public which is coming to the aid of such forces whose only aim is to run down the only independent organ i.e., the judiciary. Let me make it clear. We are answerable to the Constitution and Constitution alone”, he said.
CJI Ramana said that to enforce checks and balances envisioned in the Constitution, "we need to promote Constitutional culture in India. We need to spread awareness about the roles and responsibilities of individuals and institutions. Democracy is all about participation".
He quoted Abraham Lincoln and said, under the Constitution of India, it is the people who are entrusted with the task of passing judgment on the rulers, once every five years.
"...the people of India have done their job remarkably well so far. We should have no reason to doubt the collective wisdom of our people. Significantly, the voter in rural India is more proactive in discharging this task when compared to their urban, educated and well-to-do counterparts", he added.
CJI Raman said both India and the United States are known for their diversity which needs to be honoured and cherished, everywhere in the world.
"It is only because the United States honours and respects diversity, that you were all able to reach this country and make a mark through your hard work and extraordinary skills. Please remember. It is the tolerance and inclusive nature of American society that is able to attract the best talents from all over the world, which in turn is contributing to its growth", CJI Ramana said while addressing the Indian diaspora.
He added that honouring qualified talents from diverse backgrounds is also essential to sustain the confidence of all sections of the society in the system.
"This principle of inclusivity is universal. It needs to be honoured everywhere in the world, including in India. Inclusivity strengthens the unity in society which is key to peace and progress. We need to focus on issues that unite us. Not on those that divide us. In the 21st century, we cannot allow petty, narrow and divisive issues to dictate human and societal relationships. We have to rise above all the divisive issues to remain focused on human development. A non-inclusive approach is an invitation to disaster”, he said.
The CJI told the audience that they might have become millionaires and billionaires but to enjoy wealth, they need to have peace around them.
"Your parents back home also should be able to live in a peaceful society which is free from hate and violence. If you cannot take care of the well-being of your family and society back home, what is the use of your wealth and status here? You have to contribute your own way to improve your own society. What really matters is the honour and respect that you command in your homeland. This is the litmus test for your true success”, he said.
The CJI said that the Indian Diaspora in the United States has played an active role in building modern America from modest beginnings; they have transformed not only their identities but also the face of this nation.
Highly skilled Indian professionals in diverse fields are found today across the globe, the CJI said, adding that the unprecedented opportunities offered by the IT sector to women have changed how Indians perceive the role of women in our society.
Noting that more and more women from India found their wings in the emerging sector that helped them become empowered, independent and self-reliant, he said an empowered woman changes the dynamics of the family and society positively. "As they say, 'If you empower a man, you empower an individual. But, if you empower a woman, you empower a family and the nation'."

The Supreme Court on Friday termed as “unfortunate” and rued the “new trend” of maligning judges by governments if judicial pronouncements are not as per their liking.
The stinging observations were made by a bench headed by Chief Justice N V Ramana while hearing two separate appeals filed by the Chhattisgarh government and an activist respectively challenging the high court’s decision to quash an FIR registered against a former IAS officer for allegedly amassing wealth beyond known sources of income.
The bench, also comprising justices Krishna Murari and Hima Kohli was miffed over some allegations made against the judiciary in the case.
"Whatever fight you may take, that is alright. But do not try to malign the courts. I am watching in this court also, it is a new trend," the CJI observed.
Senior advocate Rakesh Dwivedi, appearing for the state government in one of the two appeals, said that he was not pressing “that point at all”.
"No, we are watching it every day. You are a senior counsel, you have seen this more than us. It is a new trend. The government has started maligning judges. It is unfortunate,” the CJI said.
Dwivedi said Aman Kumar Singh, who had joined the service in 2004, resigned and became a secretary on a contract basis and his officer wife also followed the same pattern.
When the officer joined the service he had one property worth Rs 11 lakh and later became the owner of seven properties worth Rs 2.76 crore, the senior counsel for the state government said.
Another senior advocate Siddharth Dave, appearing for anti-corruption activist Uchit Sharma, assailed the high court verdict quashing the FIR as a judgement based on “probability”.
The allegation was amassing disproportionate assets and the inquiry would be closed automatically the moment the person concerned explained the assets, he said.
"Based on surmises and your allegations we cannot allow this kind of victimization,” the bench said and fixed the case for further hearing on April 18.
Dave said the probe was not based on surmises as the allegations were that the officer in question has accumulated Rs 2,500 crores.
The bench expressed amazement and said this appeal is “an exaggeration”.
"Don't generalise people like that. Tomorrow when the government changes and another government comes then lakhs become thousand...,” the CJI said.
Quashing the FIR, the Chhattisgarh high court had said that the case was based on probabilities and "on the basis of probability any person cannot be prosecuted".
It had also held that the government failed to file documents to substantiate its case.

The Supreme Court on Friday termed as &ldquo;unfortunate&rdquo; and rued the &ldquo;new trend&rdquo; of maligning judges by governments if judicial pronouncements are not as per their liking.
The stinging observations were made by a bench headed by Chief Justice N V Ramana while hearing two separate appeals filed by the Chhattisgarh government and an activist respectively challenging the high court&rsquo;s decision to quash an FIR registered against a former IAS officer for allegedly amassing wealth beyond known sources of income.
The bench, also comprising justices Krishna Murari and Hima Kohli was miffed over some allegations made against the judiciary in the case.
"Whatever fight you may take, that is alright. But do not try to malign the courts. I am watching in this court also, it is a new trend," the CJI observed.
Senior advocate Rakesh Dwivedi, appearing for the state government in one of the two appeals, said that he was not pressing &ldquo;that point at all&rdquo;.
"No, we are watching it every day. You are a senior counsel, you have seen this more than us. It is a new trend. The government has started maligning judges. It is unfortunate,&rdquo; the CJI said.
Dwivedi said Aman Kumar Singh, who had joined the service in 2004, resigned and became a secretary on a contract basis and his officer wife also followed the same pattern.
When the officer joined the service he had one property worth Rs 11 lakh and later became the owner of seven properties worth Rs 2.76 crore, the senior counsel for the state government said.
Another senior advocate Siddharth Dave, appearing for anti-corruption activist Uchit Sharma, assailed the high court verdict quashing the FIR as a judgement based on &ldquo;probability&rdquo;.
The allegation was amassing disproportionate assets and the inquiry would be closed automatically the moment the person concerned explained the assets, he said.
"Based on surmises and your allegations we cannot allow this kind of victimization,&rdquo; the bench said and fixed the case for further hearing on April 18.
Dave said the probe was not based on surmises as the allegations were that the officer in question has accumulated Rs 2,500 crores. The bench expressed amazement and said this appeal is &ldquo;an exaggeration&rdquo;.
"Don't generalise people like that. Tomorrow when the government changes and another government comes then lakhs become thousand...,&rdquo; the CJI said.
Quashing the FIR, the Chhattisgarh high court had said that the case was based on probabilities and "on the basis of probability any person cannot be prosecuted".
It had also held that the government failed to file documents to substantiate its case.

CBI's credibility has come under deep public scrutiny with the passage of time as its actions and inactions have raised questions in some cases, Chief Justice N V Ramana Friday said and called for creating an "independent umbrella institution" to bring various investigating agencies under one roof.
"When it comes to the CBI, it possessed immense trust of the public in its initial phase. In fact, the Judiciary used to be flooded with requests for transfer of investigations to the CBI, as it was a symbol of impartiality and independence.
"Whenever the citizenry doubted the skill and impartiality of its own state police, they sought an investigation by the CBI, as they wanted justice to be done. But, with the passage of time, like every other institution of repute, the CBI has also come under deep public scrutiny. Its actions and inactions have raised questions regarding its credibility, in some cases," Justice Ramana said.
The CJI, who was speaking at the 19th D P Kohli Memorial Lecture of CBI on "Democracy: Role and Responsibilities of Investigative Agencies," said there was an "immediate requirement for the creation of an independent umbrella institution for the investigating agencies to bring various agencies like CBI, SFIO, ED, etc under one roof".
Justice Ramana said the body was required to be "created under a statute" clearly defining its powers, functions, and duties.
He said such a law will also need too much needed "legislative oversight" for the "upright organisation" to be headed by an "independent and impartial authority" to be appointed by a committee which appoints the director of the CBI.
"The head of the organisation can be assisted by deputies who are specialists in different domains. This umbrella organisation will end a multiplicity of proceedings. A single instance these days gets investigated by multiple agencies often leading to dilution of evidence, contradictions in depositions, prolonged establishment of innocence. It will also save the institutions from being blamed as the tools of harassment," he said.
Once an instance is reported, the organisation should decide as to which specialised unit should take up the investigation, Justice Ramana said.
Justice Ramana said the Police and the investigative agencies may have De-Facto legitimacy, but yet, as institutions, they still have to gain social legitimacy.
"Police should work impartially and focus on crime prevention.&nbsp; They should also work in co-operation with the public to ensure law and order prevails in the society," he said.
Justice Ramana said institutions including the Police and the investigative bodies should not allow any authoritarian tendencies to creep in and need to function within the democratic framework as any deviation will hurt them and will weaken our democracy.
"All the institutions including the Police and the investigative bodies uphold and strengthen the democratic values. They should not allow any authoritarian tendencies to creep in.
"They need to function within the democratic framework as prescribed under the Constitution. Any deviation will hurt the institutions and will weaken our democracy," he said.
Justice Ramana said that as an institution, CBI has so many achievements to its credit and in the process, many of its personnel have put their health and lives at risk.
"Some have also made the supreme sacrifice. In spite of all this, it is ironical that people hesitate to approach the police in times of despair. The image of the institution of police is regrettably tarnished by allegations of corruption, police excesses, lack of impartiality, and close nexus with the political class.
"Often, the police officers approach us with the complaint that they are being harassed after the change in the regime. When you try to endear yourselves to the powers, you will have to face the consequences. The need of the hour is to reclaim social legitimacy and public trust," Justice Ramana said. The CJI said the first step to gain the same is to break the nexus with the political executive.
"Often the best of talents enter this system in expectation of recognition and accolades. But, if the threat of infection looms large, honest and upright officers find it difficult to stand by their oath," he said.
Justice Ramana praised CBI Director S K Jaiswal and said he comes across as an officer who is committed towards improving the functioning of the organisation.
"I remember the times when, CBI in its anxiety, used to conduct several press conferences even before conducting a proper investigation. I am happy to note that under the present leadership the organization is maintaining a low profile, as it should be.&nbsp; My only wish, Mr. Director, is that you abide by the rule book and stand by principles. I wish you, and all the officials of CBI, the best for the future," he said.
The CJI paid tributes to D P Kohli, the founding director of CBI, and said he was an exemplary officer.
"Shri Kohli was renowned for his courage, conviction, and remarkable efficiency. His vision turned CBI into the premier investigative agency of India. The tales of his unimpeachable integrity travelled far and wide," the CJI said.

He was delivering the fifth Sri Lavu Venkatewarlu Endowment Lecture on "Indian Judiciary - Challenges of future" at Siddhartha Law College, Vijayawada.
He also said that in recent times, physical attacks on judicial officers are on the rise and at times, there are concerted campaigns in the print and social media against judges if parties do not get a favourable order while these attacks appear to be "sponsored and synchronised." There is a need to liberate the institution of public prosecutors. Total independence must be granted to them and to make them answerable only to the Courts, he further said.
"It is nowadays fashionable to reiterate phrases such as 'judges are themselves appointing judges'. I consider this to be one of the widely propagated myths. The fact is the Judiciary is merely one of the many players involved in the process," Justice Ramana said.
Recently, Kerala MP John Brittas had reportedly said during a debate in Parliament on The High Court and Supreme Court Judges (Salaries and Conditions of Service) Amendment Bill, 2021 that Judges appointing judges is unheard of anywhere.
"Many authorities are involved, including the Union Law Ministry, State Governments, Governor, High Court Collegia, Intelligence Bureau, and lastly, the topmost executive, who all are designated to examine the suitability of a candidate. I am sad to note that the well-informed also propagate the aforesaid notion. After all, this narrative suits certain sections,” Justice Ramana said.
Appreciating the Centre for its efforts on appointing more judges, he said, some recommendations made by High Courts are yet to be transmitted to the Supreme Court by the Union Law Ministry. It is expected that the Government needs to strictly adhere to the timelines laid down in the Malik Mazhar Case.
The law enforcing agencies, particularly the specialised agencies, need to deal with malicious attacks on judiciary effectively, the CJI said, adding that it was unfortunate that unless the Court interfered and passed orders, the authorities generally do not proceed with the investigation.
"The Governments are expected and duty bound to create a secure environment so that the judges and judicial officers can function fearlessly," he said.
New media tools have enormous amplifying ability, but appear to be incapable of distinguishing between right and wrong, good and bad and the real and fake. Media trials cannot be a guiding factor in deciding cases, he further said.
He said historically, prosecutors in India have been under the control of the government.
"Hence it is not a surprise that they do not act independently. They do nothing to prevent frivolous and non-deserving cases from reaching the courts. Public Prosecutors automatically oppose bail applications without independently applying their mind. They attempt to suppress evidence during trial which could benefit the accused," Justice Ramana said.
A holistic rework needs to be undertaken. In order to insulate the Public Prosecutors, an independent selection committee may be constituted for their appointment. Best practices should be adopted after a comparative analysis of other jurisdictions, he opined.
While making legislations, the law makers must also think of providing effective remedies for issues which may arise out of the law and yet these principles seemingly are being ignored, he opined.
Citing the Bihar Prohibition Act in 2016 which resulted in the High Court being filled with a lot of bail applications, Justice Ramana said lack of foresight in legislating can directly result in the blockage of courts.

The CJI said the most obvious sacrifice to become a judge is monetary but one must be moved by the spirit of public duty to take such a decision.

Chief Justice NV Ramana&nbsp;on Thursday said that false narratives and misconceptions -- that judges supposedly lead an easy life -- need to be refuted by educating the public about the work put by them with limited resources.
The CJI said the most obvious sacrifice to become a judge is monetary but one must be moved by the spirit of public duty to take such a decision.
He said he would like to flag the amount of work judges put in day in and day out.
The CJI said there exists a misconception in the minds of the people that Judges stay in big bungalows, work only 10 am to 4 pm and enjoy their holidays and such a narrative is untrue.
