The Supreme Court said it will not pursue contempt action against advocate Rakesh Kishore, who hurled a shoe at CJI BR Gavai on October 6.

The Supreme Court on Monday said it is not inclined to initiate contempt action against a lawyer who had hurled a shoe towards Chief Justice of India BR Gavai, noting that the CJI himself refused to proceed against him.
A bench of Justices Surya Kant and Joymalya Bagchi said shouting slogans in court and hurling shoes are clear cases of contempt of court but it all depends on the judge concerned under the law whether to proceed or not.
"Issuing contempt notice will only give undue importance to the lawyer who had hurled shoe at the CJI and would increase the shelf life of the incident," the bench said, adding the incident should be allowed to die its own natural death.
The bench was hearing a plea of the Supreme Court Bar Association (SCBA) seeking contempt action against 71-year-old advocate Rakesh Kishore, who hurled the shoe towards the CJI on October 6 during court proceedings.
The top court said it will consider laying down guidelines to prevent such incidents. It asked Solicitor General Tushar Mehta to collate details of incidents like shoe-throwing incidents in different courts.
On October 16, the top court said the right to speech and expression cannot be exercised at the cost of others' dignity and integrity as it cautioned about the dangers of "unregulated" social media, saying incidents like the recent hurling of shoe towards the CJI are nothing but "money-spinning ventures".
On October 6, in a shocking security breach, Kishore hurled a shoe towards the CJI in his courtroom which prompted the Bar Council of India to suspend his license with immediate effect.
The CJI, who remained unfazed during and after the unprecedented incident during the court proceedings, asked the court officials and the security personnel present inside the courtroom to "just ignore" it and to let off the errant lawyer with a warning.
The incident has sparked widespread condemnation across different sections of society, with Prime Minister Narendra Modi speaking to the CJI.

Justice Surya Kant, the second senior-most Supreme Court judge after the incumbent CJI Gavai, is set to become the 53rd chief justice of India on November 24 after CJI Gavai's retirement on November 23.
CJI Gavai, who was sworn in on May 14 this year, recommended to the Union law ministry to appoint Justice Surya Kant as the next CJI, sources said.
Justice Surya Kant, who was elevated as a judge of the Supreme Court on May 24, 2019, would have a tenure of over 1.2 years as the CJI. He is due to retire on February 9, 2027.
The retirement age of Supreme Court judges is 65 years.
According to the memorandum of procedure, a set of documents, which guide the appointment, transfer and elevation of Supreme Court and high court judges, states that appointment to the office of the chief justice of India should be the senior-most judge of the Supreme Court considered fit to hold the office.
The Union law minister would, "at the appropriate time", seek the recommendation of the outgoing CJI for the appointment of his successor.
Conventionally, the letter is sent a month before the incumbent CJI retires on attaining the age of 65 years.
Justice Surya Kant, born in a middle-class family on February 10, 1962, in Hisar district of Haryana, became a top court judge on May 24, 2019.
Justice Surya Kant brings to the country's top judicial office a wealth of experience spanning two decades on the bench, marked by landmark verdicts on abrogation of Article 370, free speech, democracy, corruption, environment and gender equality.
Justice Surya Kant was part of the bench that kept the colonial-era sedition law in abeyance, directing that no new FIRs be registered under it until a government review.
In an order that underlined transparency in the poll process, he nudged the Election Commission to disclose the details of 65 lakh names excluded from the draft electoral rolls after the Special Intensive Revision (SIR) in Bihar.
Justice Surya Kant is also credited with directing that one-third of seats in bar associations, including the Supreme Court Bar Association, be reserved for women.
He upheld the One Rank-One Pension (OROP) scheme for defence forces, calling it constitutionally valid, and continues to hear petitions of women officers in the armed forces seeking parity in permanent commission.
Justice Surya Kant was on the seven-judge bench that overruled the 1967 Aligarh Muslim University judgment, opening the way for reconsideration of the institution's minority status.
He was part of the bench that heard the Pegasus spyware case, which appointed a panel of cyber experts to probe allegations of unlawful surveillance, famously stating that the state cannot get a "free pass under the guise of national security."
Justice Surya Kant was part of the bench that appointed a five-member committee headed by former Supreme Court Justice Indu Malhotra to probe the security breach during Prime Minister Narendra Modi's 2022 Punjab visit, saying such matters required "a judicially trained mind."

A group of lawyers, including senior advocate Harish Salve and Bar Council of India chairperson Manan Kumar Mishra, have written to the Chief Justice of India, alleging that a "vested interest group" is trying to pressure the judiciary and defame courts "on the basis of frivolous logic and stale political agendas".
"Their pressure tactics are most obvious in political cases, particularly those involving political figures accused of corruption. These tactics are damaging to our courts and threaten our democratic fabric," their letter, dated March 26, addressed to CJI D Y Chandrachud said.
The letter, shared by official sources, targeted a section of lawyers without naming them and alleged that they defend politicians by the day and then try to influence judges through the media at night.
This interest group creates false narratives of a supposed better past and golden period of courts, contrasting it with the happenings in the present, the letter said, claiming that their comments are aimed at influencing courts and embarrassing them for political gains.
The group of lawyers, who are behind the letter titled "Judiciary Under Threat-Safeguarding Judiciary from Political and Professional Pressure", number around 600 and also include Adish Aggarwala, Chetan Mittal, Pinky Anand, Hitesh Jain, Ujjwala Pawar, Uday Holla and Swarupama Chaturvedi, the official sources said.
Though the lawyers behind the letter have mentioned no specific cases, the development comes at a time when courts are dealing with several high-profile criminal cases of corruption involving opposition leaders.
Opposition parties have accused the central government of targeting their leaders as part of its political vendetta, a charge refuted by the ruling BJP. These parties, whose ranks include some noted lawyers, have joined hands against the recent arrest of Delhi Chief Minister and AAP national convener Arvind Kejriwal in the Delhi excise policy-linked money laundering case.
Targeting critics, these lawyers have accused them of suggesting that courts in the past were easier to influence. This shakes the public's trust in courts, they said.
"Their antics are vitiating the atmosphere of trust and harmony, which characterises the functioning of the judiciary," they said in their letter to CJI Chandrachud.
They have also concocted an entire theory of "bench fixing" which is not just disrespectful and contemptuous but an attack on the honour and dignity of courts, the letter said.
"They have also stooped to the level of comparing our courts to those countries where there is no rule of law and accusing our judicial institutions with unfair practices," it said.
These critics have adopted the "my way or the highway" approach at work as they hail the decisions they agree with, but any decision they disagree with, is trashed, smeared and disregarded, they said.
"This two-faced behaviour is harmful to the respect a common man should have for our legal system," the letter said and claimed that this cherry picking has been visible in very recent judgments too.
"Some elements are trying to influence who the judges are in their cases and spread lies on social media to put pressure on them to decide in a particular way," they alleged in the letter.
Questioning the timing, the lawyers said it is all happening when the country is headed for the elections.
"We are reminded of similar antics in 2018-2019 when they took to their 'hit and run' activities, including fabricating wrong narratives. These efforts to belittle and manipulate the courts for personal and political reasons cannot be allowed under any circumstances," they said.
They urged the Supreme Court to stand strong and take steps to protect courts from these alleged attacks.
"Staying silent or doing nothing could accidentally give more power to those who mean to do harm. This is not the time to maintain dignified silence as such efforts are happening since few years and too frequently," they said, adding that the CJI's leadership is crucial in these "tough times".&nbsp;

It all began when Advocate Mukul Rohatgi was arguing on behalf of ASSOCHAM, FICCI and CII. During this time, advocate Mathews Nedumpara intervened and said that the SC's judgement in the electoral bonds case was delivered behind the backs of the citizens. It is not clear who Nedumpara was representing but the court declined to hear him.
"This was a policy matter and not for the courts to get into. That is why people feel this judgment was given behind their back," he said.
At this time, the Chief Justice kept asking him to pause and listen. To which Nedumpara, replied, "I am a citizen of this country."
Justice Chandrachud then retorted saying, "One second, don't shout at me."&nbsp;
Nedumpara, visibly taken aback, said, "No, no, I am very soft."
The Chief Justice then said, "This is not a Hyde Park corner meeting, you are in the court. You want to move an application, file an application. You have got my decision as Chief Justice, we are not hearing you. If you want to file an application, move it on the email. That's the rule in this court."
When Nedumpara kept speaking, Justice BR Gavai intervened saying, "You are obstructing in the process of administration of justice!"&nbsp;
When he was reminded of his history of getting contempt notice, &nbsp; the lawyer still did not back down.&nbsp;
As he kept speaking, the bench said, "That's all, we will not hear you till you follow the procedure prescribed."&nbsp;

Justice Chandrachud will demit office on November 10, 2024.
On October 7, the government had sent a letter to CJI Lalit, who is set to retire on November 8, to recommend his successor.
According to the Memorandum of Procedure (MoP), which governs the process of appointment of judges in the higher judiciary, the outgoing CJI initiates the process of naming the successor after getting a communication from the Law ministry.

The MoP says the senior-most judge of the apex court is considered fit to hold the office of the CJI and the views of the outgoing head of the judiciary have to be sought "at an appropriate time".
The MoP, however, does not specify the time limit for the initiation of the process of recommending the name of the successor CJI.

He has since been involved in delivery of several landmark judgements of the apex court.

Speaking at a function organised by the Supreme Court Bar Association (SCBA) to bid farewell to outgoing CJI N V Ramana, Justice Lalit said he has always believed that role of the top court is to lay down law with clarity and the best possible way to do it is to have larger benches as early as possible so that the issues get clarified immediately.
"So, we will strive hard to say that yes, we will always have at least one constitution bench functioning all throughout the year," he said.
Justice Lalit said one of the areas in which he intends to work is about the listing of cases before the constitution benches and matters which are specially referred to three-judge benches.
On the issue of listing of matters, he said, "….I must assure you that we will strive hard to make the listing as simple, as clear, and as transparent as possible".
Regarding mentioning urgent matters, Justice Lalit said he would certainly look into it.
"I will have a word with all my learned colleagues on the bench and we will certainly sort that out and very shortly, you will have a clear-cut regime where any urgent matter can freely be mentioned before the respective courts," he said.
Justice Lalit said, "I have always believed that the role of the Supreme Court is to lay down law with clarity, consistency, and the best possible way to do it is to have larger benches as early as possible, wherever the matters are referred to such benches so that the issues get clarified immediately, the matter has consistency and the people are well aware of what exactly are the contours of the peculiar positions in law."
While hailing Justice Ramana, who became the CJI on April 24 last year, Justice Lalit pointed out two "stand out" achievements, including that over 250 appointments of judges in the high courts across the country were made as a result of recommendations made by the apex court collegium in the last about 14 months or so.

Speaking at a function organised by the Supreme Court Bar Association (SCBA) to bid farewell to outgoing CJI N V Ramana, Justice Lalit said he has always believed that role of the top court is to lay down law with clarity and the best possible way to do it is to have larger benches as early as possible so that the issues get clarified immediately.
"So, we will strive hard to say that yes, we will always have at least one constitution bench functioning all throughout the year," he said.
Justice Lalit said one of the areas in which he intends to work is about the listing of cases before the constitution benches and matters which are specially referred to three-judge benches.
On the issue of listing of matters, he said, "&hellip;.I must assure you that we will strive hard to make the listing as simple, as clear, and as transparent as possible".

Regarding mentioning urgent matters, Justice Lalit said he would certainly look into it.
"I will have a word with all my learned colleagues on the bench and we will certainly sort that out and very shortly, you will have a clear-cut regime where any urgent matter can freely be mentioned before the respective courts," he said.
Justice Lalit said, "I have always believed that the role of the Supreme Court is to lay down law with clarity, consistency, and the best possible way to do it is to have larger benches as early as possible, wherever the matters are referred to such benches so that the issues get clarified immediately, the matter has consistency and the people are well aware of what exactly are the contours of the peculiar positions in law."
While hailing Justice Ramana, who became the CJI on April 24 last year, Justice Lalit pointed out two "stand out" achievements, including that over 250 appointments of judges in the high courts across the country were made as a result of recommendations made by the apex court collegium in the last about 14 months or so.

Justice Uday Umesh Lalit was on Saturday sworn in as the 49th Chief Justice of India (CJI).
President Droupadi Murmu administered him the oath during a brief ceremony held at the Rashtrapati Bhavan.
"Congratulations," President Murmu said after Justice Lalit signed the register of oath following the swearing-in.
Vice President Jagdeep Dhankhar, Prime Minister Narendra Modi, former president Ram Nath Kovind, former vice president M Venkaiah Naidu and Union ministers, including Kiren Rijiju, were present at the ceremony.
Justice Lalit's predecessor, Justice N V Ramana, was also present.
After being sworn in, Justice Lalit sought the blessings of his family elders by touching their feet, including that of his 90-year-old father and former high court judge Umesh Ranganath Lalit.
As the CJI, Justice Lalit will have a tenure of 74 days and would demit office on November 8 on attaining the age of 65 years.
Justice D Y Chandrachud, the senior-most judge after Justice Lalit, is next in line to be the chief justice of India.

During Justice Lalit's tenure as the CJI, several important cases, including Constitution bench matters, are likely to come up for adjudication before the apex court.
The top court had recently notified that 25 five-judge Constitution bench matters would be listed from August 29.
Among the important five-judge bench matters which have been listed is a plea challenging the Constitution (One Hundred and Third Amendment) Act, 2019 which provided reservation to Economically Weaker Sections, the challenge to the WhatsApp privacy policy, and the issue of parliamentarians or legislators claiming immunity from criminal prosecution for taking a bribe to give a speech or a vote in the House.

Justice Ramana, the 48th CJI who had succeeded S A Bobde on April 24, 2021, was delivering his address at a function organised by the Supreme Court Bar Association (SCBA) to bid him adieu on completion of his over 16-month-long tenure as head of the judiciary. 
Justice Ramana, who served as a judge for over two decades in the higher judiciary, expressed satisfaction over his journey and said that he never claimed himself to be “a scholarly judge or a great judge”, but always believed that the ultimate purpose of the justice delivery system is to provide justice to the common man.
On his retirement day, the CJI hinted toward the malicious campaign aimed at him and his family also just before his elevation to the top post.
“From the date, I joined the bench till I reached the highest possible position in the judiciary, I was subjected to conspiratorial scrutiny. My family and I suffered in silence. But ultimately, the truth will always prevail. ‘Satyameva Jayate’,” he said.
The CJI referred to the packed auditorium and the good words spoken about him by CJI-designate Justice U U Lalit, Solicitor General Tushar Mehta and SCBA president Vikas Singh and other Bar leaders and said that he was searching for words to adequately express his gratitude.
On the issue of the Indianisation of the legal system, he said the judicial system, practices, rules, being colonial in origin, may not be best suited to the needs of the Indian population.
“I mean the need to adapt to the practical realities of our society and localise our justice delivery system. I have pushed for the modernisation of judicial infrastructure as a means for providing access to justice,” he said.
He said the problems faced by the judiciary cannot be looked at in isolation.
“The judiciary is independent when it comes to adjudication of cases, but with respect to finances or appointments, it is still dependent on the Government. To coordinate and get cooperation from the Government, interaction is inevitable. But interaction does not mean influence. I hope this dialogue between the judiciary and the public will continue,” he said.
He told the audience about the idea behind his weekend travels to the courts across the country and said, “I felt it was my Constitutional duty to dispel these notions and bring the Court closer to the people, by way of generating awareness and building confidence among people about the judiciary.”
The popular perception is that the Indian judiciary was “alien and quite distant” to the general public and there are still millions with suppressed judicial needs who are apprehensive to approach the judiciary in times of need, he said.

CJI Ramana, who was speaking as the chief guest at an event by Eastern Book Company to celebrate the release of 'Supreme Court Cases (SCC) pre-1969', stated that the ultimate consumer of justice is the public and thus called for “simple” judgement writing by the judges as well as publication of important judgements of the Supreme Court and high courts in regional languages by law journals.
He said even a “small school kid” in the western countries is aware of his constitution and the laws and asserted “we need that kind of culture”.
“The lawyers and the public must know the constitutional provisions and the Constitution. It is unfortunate that we are now celebrating 75 years of independence but still only a few selected people in the urban areas or the legal professional are aware of the constitutional rights and duties and the constitutional principles,” CJI Ramana said.
“They (people) must know what the Constitution says and how they are entitled (under the laws). What are their rights, how to implement their rights, how to know their duties. It is necessary for us, especially (law journals) to try and introduce at least selected judgements of importance -- crux and not the entire judgement -- in regional languages to enable access in a simple language,” he added.
Acknowledging that translation of judgements in regional languages in a simple manner would entail a financial burden, CJI Ramana added, “I hope some governments can also give some money because they are now starting several projects for popularising the Constitution and the constitutional schemes. We can think of this issue also.” He further said being a judge for 22 years, he was aware of the criticism that judgements are at times “like a thesis” and requested all members of his fraternity to be simple.
"I request all the fraternity members as well as lawyers who are contributing by arguing to try to be simple in judgement (and write) concise, precise and short sentences. People must feel like they are reading a story,” he said.
“Ultimately, at the end of the day, the consumers of justice are the litigant, public or whoever it is, they must know the end result. That is more interesting than our own imaginations and philosophies. That way I think we can help the public a lot. The reasoning and the conclusion needs to be clear. I hope and trust this will happen,” he said.

The Supreme Court collegium, headed by Chief Justice of India N V Ramana, met on Tuesday to discuss the appointment of the next Chief Justice as the CJI is set to retire on August 26. 

Supreme Court collegium meets to decide on next CJI

Justice U.U. Lalit, the senior-most judge of the Supreme Court, is next in line to be appointed the Chief Justice of India.

The Supreme Court collegium, headed by Chief Justice of India N V Ramana, met on Tuesday to discuss the appointment of the next Chief Justice as the CJI is set to retire on August 26.&nbsp;
Besides the CJI, the collegium includes four other judges including Justices U.U. Lalit, D.Y. Chandrachud, Sanjay Kishan Kaul and Abdul Nazeer.&nbsp;
While the collegium did discuss potential candidates for appointments to the top court, it is yet to reach a consensus as some judges are, reportedly, of the view that they should wait till the next CJI takes over.
The collegium is likely to hold another meeting on Wednesday.&nbsp;
According to the Memorandum of Procedure (MoP) on the appointment of judges and the CJI, the Law Minister is supposed to ask the outgoing Chief Justice to recommend their successor and the process normally starts a month before the retirement of the incumbent CJI.&nbsp;
The Supreme Court is reportedly yet to receive a 'note' or a 'letter' from the law ministry regarding recommendation for the next CJI.
The CJI should be &ldquo;the senior-most judge of the Supreme Court considered fit to hold the office.&rdquo;&nbsp;

Justice U.U. Lalit, the senior-most judge of the Supreme Court, is next in line to be appointed the CJI, as per the MoP. He is expected to have a tenure of three months, retiring on November 8, 2022.
With CJI Ramana&rsquo;s retirement, the apex court will have 30 judges against a sanctioned strength of 34.&nbsp;

Chief Justice NV Ramana on Saturday while highlighting the shortcomings in the criminal justice system said that the process becomes a punishment. 
He said issues like hasty, indiscriminate arrests, difficulty in obtaining bail and prolonged incarceration of under trials needs urgent attention. 
The Chief Justice spoke about a holistic approach to administration of justice and added that training and sensitisation of the police and modernisation of the prison system is one facet of improving the system. 
He also spoke about the political situation in the country and sais political opposition is translating into hostility which is not a sign of a healthy democracy and asserted that strong parliamentary democracy demands "strengthening the Opposition as well".
There used to be mutual respect between the government and the Opposition, but the space for opposition is diminishing and laws are being passed without detailed deliberation and scrutiny, he lamented at an event here.
The CJI said the people expect the court to stand as a counterweight to legislative and executive excess and this gains gravity, particularly whenever the Opposition is missing in action.
Instead of engaging in meaningful debates for furthering democracy, politics has become acrimonious, he said.
“The diversity of opinion enriches polity and society. Political opposition should not translate into hostility, which we are sadly witnessing these days. These are not signs of a healthy democracy,” CJI Ramana said.

The event, where bone-chilling calls to arms and violence were made was also attended by BJP leader Ashwini Upadhyay, who was earlier arrested in a case of anti-Muslim slogans at Delhi's Jantar Mantar.
"We are writing to your Lordship hoping for prompt action in your capacity as the head of the judicial wing of the State and knowing your Lordship's commitment to both the independence of Judiciary as also the constitutional values that are fundamental to the functioning of a multicultural nation such as ours," the advocates have appealed.

The religious assembly, being referred to as Haridwar "Hate Assembly", sparked a row after videos of Hindu leaders, including Yati Narsinghanand, making provocative speeches and inciting violence against minority communities surfaced on social media.
The event, where bone-chilling calls to arms and violence were made was also attended by BJP leader Ashwini Upadhyay, who was earlier arrested in a case of anti-Muslim slogans at Delhi's Jantar Mantar.
"We are writing to your Lordship hoping for prompt action in your capacity as the head of the judicial wing of the State and knowing your Lordship's commitment to both the independence of Judiciary as also the constitutional values that are fundamental to the functioning of a multicultural nation such as ours," the advocates have appealed.
