California may become the first state in the United States to outlaw caste-based bias, a safeguard people of South Asian descent say is necessary to protect them from discrimination in housing, education and the tech sector where they hold key roles.
State Sen. Aisha Wahab, the first Muslim and Afghan American elected to the state legislature, introduced the bill Wednesday. It adds caste &mdash; a division of people related to birth or descent &mdash; as a protected category in the state's anti-discrimination laws.
Those at the lowest strata of the caste system known as Dalits, have been increasingly calling for such legislation saying they have faced this kind of discrimination in the United States. But such policies remain divisive.
Wahab said caste discrimination is &ldquo;a social justice and civil rights issue.&rdquo; &ldquo;People came to this country so they can be free and can pursue their American dream without any disruption to their lives," Wahab said, adding that she heard about this form of discrimination growing up in Fremont, California, and living in the San Francisco Bay Area.
But some groups such as the Hindu American Foundation and the Coalition of Hindus of North America oppose such policies. They argue these measures will hurt a community that already faces hate and discrimination, and will specifically target Hindus and Indian Americans who are commonly associated with the caste system. The legislation is being backed by other groups such as Hindus for Human Rights and Hindus for Caste Equity.
A United Nations report in 2016 said at least 250 million people worldwide still face caste discrimination in Asia, Africa, the Middle East and Pacific regions, as well as in various diaspora communities. Caste systems are found among Buddhists, Christians, Hindus, Jains, Muslims and Sikhs.

Madhya Pradesh: several hurt, 100 booked after clash breaks out over entering temples on Mahashivratri 

The official said the dispute started two days back when the Dalit community members wanted to set up a statue of Dr B R Ambedkar on land near the temple and they also cut a tree.

Police have registered cases against more than 100 people following two disputes over entering temples at different places in Madhya Pradesh's Khargone district, officials said on Sunday.
One of the incidents took place on Saturday in Chhapra village under Sanawad police station limits when people reached the temple to offer prayer on the occasion of Mahashivratri, they said, adding both the sides pelted each other with stones.
Besides, a similar incident occurred on Saturday under Kasrawad police station limits in the district, the officials said.
In Chhapra village, the dispute occurred when some members belonging to the Dalit community tried to enter into the temple constructed by people of three other communities, Sub Divisional Officer of Police Vinod Dixit said.
Stones were pelted from both the sides during the incident, he said.
The official said the dispute started two days back when the Dalit community members wanted to set up a statue of Dr B R Ambedkar on a land near the temple and they also cut a tree. The district and police administration officials had later reached the spot and settled the issue, he said.

However, the Dalit community members alleged they were stopped from entering the temple on Saturday and beaten up by the other group, the official said.
Following a complaint by one Premlal, a case was registered against 17 named persons and 25 others under various provisions of the Indian Penal Code (IPC) and the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, Dixit said.
Based on a complaint of Ravindra Rao Maratha from another group, a case was registered under relevant IPC provisions against 33 named people and 25 others for the alleged attacked through weapons and stones by Premlal and others, he added.
In another case, a Dalit woman complained that she was not allowed to enter a temple under Kasrawad police station limits in the district, Sub Divisional Officer of Police Manohar Gawli said.
Later, the woman offered prayers at the temple under police protection, he said. A case was registered against four women and a man under provisions of the SC/ST Act and the IPC, he added.

Child labour, caste-based discrimination and poverty are closely inter-linked in India, according to a UN report which highlighted contemporary forms of slavery, including severe discrimination against Dalit women in South Asia due to which they are systematically denied choices and freedoms in all spheres of life.
Human Rights Council Special Rapporteur Tomoya Obokata in his report on contemporary forms of slavery, including its causes and consequences, said that deep-rooted intersecting forms of discrimination, in combination with multiple other factors, are the main causes of contemporary forms of slavery affecting minorities.
They are often the result of historical legacies, such as slavery and colonisation, systems of inherited status, and formalised and State-sponsored discrimination, he said.
Obokata said in the report to the UN General Assembly Wednesday that child labour (among children 5 to 17 years of age), including its worst forms, exists in all regions of the world.
In Asia and the Pacific, the Middle East, the Americas and Europe, between 4 and 6 per cent of children are said to be in child labour, and the percentage is much higher in Africa (21.6 per cent), with the highest rate in sub-Saharan Africa (23.9 per cent).
“In India, child labour, caste-based discrimination and poverty are closely interlinked. Child labour among minority and migrant children have also been reported in Angola, Costa Rica, Honduras and Kazakhstan, in various sectors,” the report said.
The report also notes that systematic discrimination has profound implications for the ability of affected individuals and communities to live a life of dignity and enjoy human rights on equal footing with others. Marginaliaed communities often remain overlooked in public policies and national budgetary allocations, and their access to justice and remedies in cases of human rights violations, including contemporary forms of slavery, is generally limited.
It said that the stigmatisation of some communities is perpetuated by negative stereotypes in the media, textbooks, or on the Internet, which contributes to their disempowerment.
People discriminated against on the basis of work and descent represent one example. They are bound by their inherited status and subjected to dehumanizing discourses that refer to “pollution” or “untouchability”, with no respect for human dignity and equality.
"Consequently, such people have limited freedom to renounce inherited occupations or degrading or hazardous work and are often subjected to debt bondage without sufficient access to justice,” the report said.
“Additional intersectional factors, such as class, gender and religion are also affected by caste realities. Dalit women in South Asia face severe discrimination, and as a result they are systematically denied choices and freedoms in all spheres of life,” it said, adding that consequently their access to services and resources is very limited, increasing their risk of being subjected to contemporary forms of slavery.
The report further notes that bonded labour continues to be prevalent among people discriminated against on the basis of work and descent, such as Dalits in South Asia.
Dalits in Bangladesh are forced to undertake certain types of labour as a consequence of their assigned caste status and are almost exclusively working in “unclean” jobs in urban areas, like street sweeping and burying the dead.
“Manual scavenging, predominantly carried out by Dalit women, is widely regarded as forced labour and a contemporary form of slavery, entailing harsh working conditions that have a negative impact on mental and physical health.” Obokata said in the report rates of child marriage spike among marginalized communities in particular, such as Roma girls in South-Eastern Europe.
Official data collected by the Forced Marriage Unit of the United Kingdom and Northern Ireland suggests that a large majority of forced-marriage cases relate to Pakistan and, to a lower extent, to Afghanistan, Bangladesh, India and Somalia.
Forced marriage of women and girls is a concern in Asia, including Cambodia, India, Kazakhstan, Sri Lanka, and Vietnam.
It noted that various States have taken legislative and other measures to address inequality and discrimination experienced by minorities.
In the United States, federal contractors and subcontractors must take affirmative action to recruit and advance qualified minorities, and other initiatives including vocational training and outreach are simultaneously facilitated. Similar measures to enhance employability among minorities have been promoted in Albania, Australia, Belgium, India, Iraq, New Zealand and the United Kingdom.
Trade unions also make important contributions in advocating for the rights of minorities and migrant workers. It is “encouraging” that trade unions in Chile, Colombia, Ghana and India provide dedicated support and services for women workers.
It added that based on an independent assessment of available information, including submissions by stakeholders, independent academic research and testimonies of victims, the Special Rapporteur regards it as reasonable to conclude that forced labour among Uighur, Kazakh and other ethnic minorities in sectors such as agriculture and manufacturing has been occurring in the Xinjiang Uighur Autonomous Region of China.

As more than 40,000 young Tamil Brahmin men are finding it difficult to find brides within the state, the Tamil Nadu based association for Brahmins has launched a special drive to look for suitable matches belonging to the same community in Uttar Pradesh and Bihar.
"We have launched a special movement on behalf of our Sangam," said Thamizhnadu Brahmin Association (Thambraas) president N Narayanan in an open letter published in the association's monthly Tamil magazine's November issue.
Quoting rough estimates, Narayanan said more than 40,000 Tamil Brahmin men, in the age group of 30-40, could not get married as they are unable to find brides from within Tamil Nadu.
Giving a ballpark figure, he said, "if there are 10 Brahmin boys in the marriageable age group, only six girls are available in the marriageable age group in Tamil Nadu." The association chief, in his letter said coordinators would be appointed in Delhi, Lucknow and Patna to take forward the initiative.
Asked on the move, Narayanan said a person who can read, write and speak in Hindi would be appointed at the association's headquarters to perform the coordination role.
The Thambraas chief told PTI that he is in touch with people in Lucknow and Patna, adding that the initiative is practicable. "I have commenced work in this regard," he said.
While several Brahmin people welcomed the move, there were also other views from within the community.
An educationist, M Parameswaran said, "though enough number of Tamil Brahmin girls are not available in the marriageable age group, that is not the one and only reason for boys not being able to find brides." He wondered why parents of prospective bridegrooms expect 'pomp and show' in weddings.
"Why parents of boys want marriages to be held in swanky marriage halls? What stops them from conducting marriage in a simple fashion? Why not in a temple or at home?" he asked.

The 'Mahaperiyava' preached simplicity in every walk of life and advised people to not use silk cloth, Parameswaran said.
Mahaperiyava, Mahaswami and Paramacharya are reverential references to late Shankaracharya, Sri Chandrasekharendra Saraswathi (1894-1994), the 68th pontiff of Kanchi Kamakoti Peetam, also known as Shankara Math.
Parameswaran said that the girl's family has to bear the entire expenditure of conducting the wedding and it is the bane of the Tamil Brahmin community.
"Big, fat weddings have become a status symbol and it is very unfortunate. The community must choose progression and reject retrogression." he said.
"Even in this day and age, Tamil Brahmin marriages stretch to two to three days, which includes the reception, and other pre and post wedding ceremonies." The total expenditure, including jewellery, rent for marriage hall, spendings on food and gifts would easily work out to at least Rs 12-15 lakh these days, he said.
"Undoubtedly, this is a huge economic burden for the bride's family. While some will be spending their life time savings, others will be debt ridden for the rest of their lives." "Here, we are not talking about those who can afford to spend. The problem is, such wealthy people are setting a benchmark and the society wants it to be emulated even by people who cannot afford it. The worst hit are the middle class, the lower middle class and poor Brahmins." "I personally know poor Brahmin families struggling for years to mop up funds for the marriage of their daughters. If well to do people are ready to discard their ego, they can find brides in Tamil Nadu. Only then, they can claim to be followers of dharma as enunciated by our sages and scriptures." The solution lies in being progressive and marriage ceremonies should be absolutely simple in sync with the times, Parameswaran said and also pointed out that some customs, though do not have express religious sanction, are continued that cause practical difficulties.
Parameswaran has served in educational institutions in southern and western parts of the country.
A Ajay, a young man on the lookout for a bride, said, "it is now not uncommon to see Tamil-Telugu Brahmin marriages or weddings between Kannada speaking Madhwas and Tamil speaking Smarthas. Something like this was unimaginable several decades ago." "Already, we have seen arranged marriages between north Indian and Tamil Brahmins," he said.
Madhwa Brahmins are a Vaishnavite sect and followers of Sri Madhwacharya. Smarthas, also known as 'Iyers' in Tamil Nadu accept worship of all deities and are followers of Sri Adi Shankara.
A Vaishnavite Tamil Brahmin, who did not want to be named said, "years ago, even marriages between Thenkalai and Vadakalai sects in the Iyengar community was impossible. Today, it is happening and this move of the association is welcome." PTI&nbsp;
