Same-sex marriage verdict: what Supreme Court said on queer couples' adoption rights

The 5-judge bench of the Supreme Court delivering its verdict on the legalisation of same-sex marriages was divided in its judgements on the rights of queer couples to adopt.

While Chief Justice of India DY Chandrachud said that same-sex and transgender couples had the right to adopt, Justice Ravindra Bhat disagreed. Justice Sanjay Kishan Kaul agreed with the Chief Justice while Justices Hima Kohli and PS Narasimha concurred with Justice Bhat.

Chief Justice DY Chandrachud that sections of the Central Adoption Resource Authority that bar queer couples from jointly adopting a child violate Article 15 of the Constitution by discrimination against them.

Justice Bhat said that CARA regulations were not void for not allowing queer couples to adopt jointly.
