The Right to Information provision which fulfills citizen requests for government information has now been availed by a wife to seek information on her husband's salary.

In matters of marital disputes, when the assets are divided between the two, and especially when the divorce is not mutual, the wife may ask for husband's salary details and demand compensation.

A similar demand was made by one Sanju Gupta from Uttar Pradesh, who filed an RTI (Right to Information) after her husband's refusal to share his salary details.

She had filed an application at the Central Public Information Officer (CPIO), Bareilly, Income Tax Department that also refused to provide details under RTI citing husband's dissent.

Gupta then sought details from the First Appellate Authority (FAA) which also upheld CPIO's order.

The move prompted Gupta to file an appeal at Central Information Commission, which after reviewing previous judgements of the top court and high courts directed CPIO to provide the woman with the details of her husband's income.

The order cited that CPIO should disclose husband's next taxablae/gross income avaiable with them within 15 daus from the date of receit. the order was passed on September 19, 2022.
