The Supreme Court ordered video conferencing for Yasin Malik's trials in the 1989 Rubaiya Sayeed abduction and 1990 Srinagar shootout cases, directing updates from Jammu and Delhi courts by Feb 18, citing national security concerns.

The Supreme Court on Monday directed the registrar general of the Jammu and Kashmir High Court to ensure proper video conferencing facilities at the special court in Jammu hearing two high-profile cases involving Yasin Malik, the jailed chief of the banned Jammu and Kashmir Liberation Front (JKLF). The cases pertain to the 1989 abduction of Rubaiya Sayeed and the 1990 Srinagar shootout.
Additionally, the apex court instructed the registrar general of the Delhi High Court to ensure similar arrangements at Tihar Jail, where Malik is currently serving a life sentence in a terror financing case. Both registrars have been asked to submit status reports by February 18, with the matter scheduled for hearing on February 21.
A bench comprising Justices Abhay S Oka and Ujjal Bhuyan was considering a Central Bureau of Investigation (CBI) plea to transfer the trials from Jammu to New Delhi to avoid the need for Malik's physical presence in the Jammu court. The CBI has raised concerns about national security, stating that Malik, who faces trial in both cases, should not be transported outside Tihar Jail premises.
The Rubaiya Sayeed case involves her abduction on December 8, 1989, while she was the daughter of then Union Home Minister Mufti Mohammed Sayeed. Her release was secured after the government, led by Prime Minister V.P. Singh and supported by the BJP, agreed to release five terrorists in exchange. Sayeed, now residing in Tamil Nadu, is a key prosecution witness in the case.
The second case concerns the killing of four Indian Air Force personnel on January 25, 1990, in Srinagar. The Jammu trial court had previously ordered Malik's physical production to cross-examine witnesses in the Sayeed case, which the CBI has challenged.
Malik has been in Tihar Jail since May 2023, following his conviction in a terror funding case by a special National Investigation Agency (NIA) court. &nbsp;

Mullick will be the special assistant to the country's interim Prime Minister Anwaarul Haq Kakar.

The couple has a 10-year-old daughter who lives with her mother in Pakistan. Malik was arrested in early 2019 in connection with a terror-funding case. He remains incarcerated in a jail in New Delhi.

The presence of jailed JKLF chief Yasin Malik, serving a life term in Tihar jail, in a packed courtroom created a flutter in the Supreme Court on Friday.
Malik, who is in jail following his conviction and life sentence in a terror funding case, was brought to the high-security apex court premises in a prison van escorted by armed security personnel without the court's permission.
He walked into the courtroom to the utter surprise of all present.
Voicing surprise at his presence, Solicitor General Tushar Mehta told a bench of Justices Surya Kant and Dipankar Datta that there was a procedure for high-risk convicts to be allowed into the courtroom to argue their case personally.
The bench was hearing a CBI appeal against the September 20, 2022 order of a trial court in Jammu in the 1989 kidnapping case of Rubaiya Sayeed, the daughter of then union home minister Mufti Mohammad Sayeed, allowing Malik to personally appear in court and cross-examine the witnesses.
The CBI had told the court that Malik, the top leader of the Jammu and Kashmir Liberation Front, was a threat to national security and cannot be allowed to be taken outside the Tihar jail premises.

The court responded that there could be no comparison between Malik and Laden as the latter never faced trial.

The plea by the agency has been listed for hearing on May 29 before a bench of Justices Siddharth Mridul and Talwant Singh.
On May 24, 2022, a trial court had awarded life imprisonment to Malik, Jammu Kashmir Liberation Front (JKLF) chief, after holding him guilty for various offences under the stringent Unlawful Activities (Prevention) Act (UAPA) and the IPC.
The trial court, which had rejected the NIA's plea for capital punishment, had said the crimes committed by Malik struck at the "heart of the idea of India" and were intended to forcefully secede Jammu and Kashmir from Union of India.
&ldquo;These crimes were intended to strike at the heart of the idea of India and intended to forcefully secede J&amp;K from UOI. The crime becomes more serious as it was committed with the assistance of foreign powers and designated terrorists. The seriousness of crime is further increased by the fact that it was committed behind the smokescreen of an alleged peaceful political movement,&rdquo; the trial court had said.
It had noted that the case was not the &ldquo;rarest of rare&rdquo;, warranting death penalty.
The maximum punishment for such an offence is death penalty.
The life term was awarded for two offences - section 121 (waging war against government of India) of IPC and section 17 (raising funds for terrorist act) of the UAPA.

It had also awarded five-year jail term each under sections 13 (unlawful act), 38 (offence related to membership of terrorism) and 39 (support given to terrorism) of UAPA.
Malik had on May 10 last year told the Delhi court he was not contesting the charges levelled against him that included acts of terrorism and sedition.
The court had framed the charges against Kashmiri separatist leaders including Farooq Ahmed Dar alias Bitta Karate, Shabbir Shah, Masarat Alam, Md Yusuf Shah, Aftab Ahmad Shah, Altaf Ahmad Shah, Nayeem Khan, Md Akbar Khanday, Raja Mehrajuddin Kalwal, Bashir Ahmad Bhat, Zahoor Ahmad Shah Watali, Shabir Ahmad Shah, Abdul Rashid Sheikh and Naval Kishore Kapoor.
A charge sheet was also filed against Lashkar-e-Taiba (LeT) founder Hafiz Saeed and Hizbul Mujahideen chief Syed Salahuddin, both of whom have been declared proclaimed offenders in the case and are living in Pakistan.&nbsp;

On May 25, Yasin Malik was sentenced to life in prison in a terror funding case. The National Investigation Agency, which probed the case, had sought the death sentence.

The judge, however, said that since he has already been convicted, there was no point in arguing on the facts of the case and that he was already given the opportunity.

Special Judge Praveen Singh directed the NIA authorities to assess Malik's financial situation to determine the amount of fine to be imposed and posted the matter for arguments on quantum of sentence on May 25.  Malik had told the court that he was not contesting the charges levelled against him that included section 16 (terrorist act), 17 (raising funds for terrorist act), 18 (conspiracy to commit terrorist act) and 20 (being member of terrorist gang or organisation) of the UAPA and sections 120-B (criminal conspiracy) and 124-A (sedition) of the IPC.
The court had earlier also formally framed the charges against Kashmiri separatist leaders including Farooq Ahmed Dar alias Bitta Karate, Shabbir Shah, Masarat Alam, Md Yusuf Shah, Aftab Ahmad Shah, Altaf Ahmad Shah, Nayeem Khan, Md Akbar Khanday, Raja Mehrajuddin Kalwal, Bashir Ahmad Bhat, Zahoor Ahmad Shah Watali, Shabir Ahmad Shah, Abdul Rashid Sheikh and Naval Kishore Kapoor.
The charge sheet was also filed against Lashkar-e-Taiba (LeT) founder Hafiz Saeed and Hizbul Mujahideen chief Syed Salahuddin, who have been declared proclaimed offenders (PO) in the case.

A Delhi court on Thursday convicted Kashmiri separatist leader Yasin Malik, who had earlier pleaded guilty to all charges, including those under the stringent Unlawful Activities Prevention Act (UAPA), in a terror funding case.
