In a major boost for the Aam Aadmi Party, the Supreme Court on May 11, 2023, ruled that the Delhi government has control over the posting and transfer of officers.
A 5-judge constitution bench of the top court said that the Delhi government, and not the Lieutenant Governor, has legislative and executive powers over administrative services.
It refused to agree with the 2019 judgement of Justice Ashok Bhushan that the city government has no power over the issue of services.
The bench, which also comprised Justices M R Shah, Krishna Murari, Hima Kohli and P S Narasimha, said democracy and federal structure are part of the basic structure of the Constitution.
The constitution bench was set up to hear the legal issue concerning the scope of legislative and executive powers of the Centre and the National Capital Territory government over control of services in Delhi.&nbsp;

In an escalation of the tussle between the Delhi government and the Lieutenant Governor, the ruling Aam Aadmi Party on 16 March 2023 released a video claiming that it showed LG VK Saxena leading a violent mob in Gujarat in 2002.
AAP MP Sanjay Singh claimed that the video showed Saxena inciting and leading the mob which attacked the Sabarmati Ashram in Ahmedabad to target activist Medha Patkar.
The party asked Prime Minister Narendra Modi to ensure that the Lieutenant Governor is held accountable for his "crimes", and asked whether he deserves to continue as LG.
Saxena was named "Accused No. 4" in the FIR filed in connection with the incident, Singh said. He went on to accuse Saxena of rioting, voluntarily causing hurt, wrongful restraint, criminal intimidation, unlawful assembly, and intentional insult with intent to provoke breach of peace citing the FIR.
"It is shameful for the entire country that a goon who led a violent mob attack on Medha Patkar, who has received many international honours for her contribution to upholding human rights, including the Mother Teresa Award for Social Justice, was made the Lieutenant General of Delhi," he said.
Singh also said that Saxena has filed an affidavit in the case, arguing that a criminal trial against him be kept in abeyance till he continues to occupy the office of LG.

The tussle between the Aam Aadmi Party and the Lieutenant Governor of Delhi is intensifying.
A day after reports that the capital's ruling party had been asked to reimburse ₹163 crore for allegedly publishing party advertisements as government advertisements, the AAP's reply came to light.
The Arvind Kejriwal-led outfit said that the demand of ₹163 crore is "arbitrary, perverse, and contrary to facts and provisions of law, and extant policies as such not accepted by AAP".

In what could turn into a fresh flashpoint between the Delhi government and the Lieutenant Governor, the LG has ordered the recovery of ₹97 crore from the Aam Aadmi Party (AAP).
LG VK Saxena wants AAP to pay for political advertisements which were published in the guise of government advertisements, according to sources quoted by news agency PTI.

The Delhi government's Directorate of Information and Publicity (DIP), acting on a 2016 directive from a Committee on Content Regulation in Government Advertising set up by the Ministry of Information and Broadcasting, had notified that Rs 97.14 crore (Rs 97,14,69,137) had been spent or booked on account of "non-conforming advertisements", sources said.
"Of this, while payments amounting to over Rs 42.26 crore had already been released by the DIP, Rs 54.87 crore for advertisements published were still pending disbursal," sources said.

Saxena's letter comes days after Deputy Chief Minister Manish Sisodia accused him of interfering in AAP government's functioning and "unconstitutionally" setting up probes on its decisions and works.
In a cheeky reply to Saxena, Kejriwal in a tweet on Saturday said: “Another love letter has come.” Kejriwal had earlier too taken a dig at the LG in a tweet saying he was scolded by Saxena more than he is scolded by his wife.
The LG said that his letters and instructions were meant to caution the government against "errors and shortcomings" in its functioning yet he was personally attacked and became target of "baseless allegations." In his letter, the LG flagged his instructions regarding a probe in the now scrapped excise policy, absence of Kejriwal or his ministers at an event attended by the President, power subsidy, recruitment of teachers, and several other points, and asked was he wrong in doing that.
Saxena accused Kejriwal and his associates of levelling false allegations and spreading them through social media causing "irreparable loss" to the people they targetted.
Including himself in the list, Saxena mentioned former Finance Minister Arun Jaitley, Union minister Nitin Gadkari, and former Punjab minister Vikramjeet Singh Majeethia, as people whom Kejriwal accused something of and later apologised.
