Former Chief Justice of India D.Y. Chandrachud on Sunday (January 18, 2026) said bail before conviction should be a matter of right, but asserted that it is a court's duty to examine a case in depth where national security is involved before granting such a relief.
He made the remarks at the ongoing Jaipur Literature Festival in response to a question from senior journalist Vir Sanghvi, who raised the issue of the Supreme Court recently denying the bail plea of activist Umar Khalid in the 2020 Delhi riots conspiracy case.
Khalid and fellow activist Sharjeel Imam have been incarcerated since 2020. Denying bail to both, the top court on January 5 observed that they were involved in the "planning, mobilisation and strategic direction" of the northeast Delhi riots.
Faced with the question from Sanghvi during a session titled &lsquo;Ideas of Justice&rsquo;, Justice Chandrachud (retired) said, &ldquo;Bail before conviction should be a matter of right. Our law is based on a presumption, and that presumption is that everyone is innocent until proven guilty.&rdquo; &ldquo;Because, if someone remains an undertrial prisoner for five or seven years and is finally proven innocent, how will you compensate for the time lost?&rdquo; Giving examples from various cases, the former chief justice of India said that bail can be denied if there is a possibility of the accused returning to society and committing the crime again, tampering with evidence, or using the benefit of bail to escape the clutches of the law.
&ldquo;If these three grounds are not present, then bail must be granted. I think that where national security is involved, it is the court&rsquo;s duty to examine the case in depth. Otherwise, what is happening is that people remain imprisoned for years,&rdquo; he said.
Justice Chandrachud termed the denial of bail by sessions and district courts a matter of concern and said judges fear that their integrity might be questioned. &ldquo;This is the reason why bail cases reach the Supreme Court,&rdquo; he said.
Expressing concern over the delay in disposal of cases by the Indian criminal justice system, he said the Constitution is the supreme law, and there is no concrete exception in the matter. &ldquo;If there is a delay in a speedy trial, the accused is entitled to bail.&rdquo; Listing landmark Supreme Court decisions during his tenure, Justice Chandrachud mentioned the grant of permanent commission to women in the armed forces, decriminalisation of homosexuality, and striking down the electoral bonds scheme.
In response to a question, the former CJI suggested including eminent persons from civil society in the collegium for the appointment of judges in high courts and the Supreme Court to ensure transparency and strengthen people&rsquo;s faith in the judiciary.
On the question of not accepting any post after retirement, Justice Chandrachud said that at present, he is enjoying the life of a private citizen.
Asked about any regrets he had, the former CJI said that marital rape has not been criminalised even over seven decades since Independence and strongly advocated for changes in the law for this.
He also expressed happiness over his efforts to make the Supreme Court a &ldquo;people&rsquo;s court&rdquo;. During his tenure, the live telecast of Supreme Court proceedings was started not only in Hindi but also in all Indian languages listed in the Eighth Schedule of the Constitution.&nbsp;

Aditi Mishra, Jawaharlal Nehru University Students' Union president, said that every year, students hold a protest to condemn the violence which occurred on the campus on January 5, 2020.
"All of the slogans raised in the protest were ideological and do not attack anyone personally. They were not directed towards anyone," Mishra told PTI.
A senior police officer said no complaint has been received so far in this matter.
Delhi ministers Ashish Sood and Manjinder Singh Sirsa, however, condemned the incident and blamed the Opposition for supporting those who indulge in such acts.
"Sharjeel Imam spoke about separating Northeast India. Umar Khalid raised slogans of 'India will be broken into pieces,' and his involvement was found in the 2020 riots. Such people are shown sympathy because there are people in this Assembly who shared a stage with Sharjeel Imam," Sood told reporters, ahead of the second day of the Winter Session of the Delhi Assembly.
He said when such people are given patronage, such things are bound to happen.
"What has happened in JNU, where Sharjeel Imam and Umar Khalid have been supported..., is condemnable and against the nation. You can fight over policy matters, but there is no place for violence in democracy," Sood added.
Echoing similar sentiments, Sirsa alleged that those who raised slogans have no regard for the Constitution or law.
"These are separatist people. Raising such slogans against prime minister and home minister is extremely shameful. The AAP and Congress have always supported such people," he told reporters.
Violence erupted on the campus on January 5, 2020, when a mob of masked men stormed the campus and targeted students in three hostels, unleashing mayhem with sticks, stones and iron rods, hitting inmates and breaking windows, furniture and personal belongings.
At least 28 people, including then JNU Students' Union president Aishe Ghosh, were injured as chaos reigned on the campus for nearly two hours.
The Delhi Police had come under attack for not acting when the mob was running riot on the campus, and especially for naming student union leaders, including Ghosh, in the two FIRs related to vandalism on the campus.

The Supreme Court on Monday refused bail to activists Umar Khalid and Sharjeel Imam in the 2020 Delhi riots conspiracy case but granted it to five others, citing "hierarchy of participation" and saying all accused in the case do not stand on the same footing.
There was a prima facie case against Khalid and Imam under the Unlawful Activities (Prevention) Act, a bench of Justices Aravind Kumar and N V Anjaria said.
While the two will remain in jail, activists Gulfisha Fatima, Meeran Haider, Shifa Ur Rehman, Mohd. Saleem Khan and Shadab Ahmad have been given bail.
According to the court, delay in trial does not operate as a "trump card" which automatically displaces statutory safeguards.
"All the appellants do not stand on equal footing as regards culpability. The hierarchy of participation emerging from the prosecutions case requires the court to examine each application individually," the bench said, adding that the roles attributed to them are different.
"This court is satisfied that the prosecution material disclosed a prima facie allegation against the appellants Umar Khalid and Sharjeel Imam... This stage of proceedings does not justify their enlargement on bail," the apex court said.

Strongly opposing the bail pleas, Delhi Police said the riots were not spontaneous but an orchestrated, pre-planned and well-designed attack on India's sovereignty.
Raju contended that all the participants are liable for each other's acts in a conspiracy. Acts of one conspirator can be attributed to others. Imam's speeches can be attributed to Umar Khalid. And Imam's case will be considered as evidence against the others, he told the bench, which conducted hearings on the bail pleas on multiple days.
The additional solicitor general argued that Khalid deliberately planned to leave Delhi before the riots as he wanted to deflect responsibility.
Seeking bail, Imam expressed anguish before the apex court for being labelled a "dangerous intellectual terrorist" without a full-fledged trial or a single conviction.
Senior advocate Siddharth Dave, appearing for Imam, contended that he was arrested on January 28, 2020, which was before the communal violence rocked northeast Delhi, for his speeches that alone cannot constitute the offence of criminal conspiracy in the riots case.
All seven accused were booked under the stringent anti-terror UAPA and provisions of the Indian Penal Code (IPC) for allegedly being the "masterminds" of the riots.
According to Section 16 of the UAPA, "Whoever commits a terrorist act shall, if such act has resulted in the death of any person, be punishable with death or imprisonment for life, and shall also be liable to fine."
The violence erupted during widespread protests against the Citizenship (Amendment) Act (CAA) and the National Register of Citizens (NRC).
The accused moved the apex court, challenging the Delhi High Court's September 2 order denying them bail in the larger conspiracy case of the February 2020 riots.

Khalid and few others have been booked under the stringent anti-terror law Unlawful Activities (Prevention) Act, 1967 (UAPA) and provisions of the Indian Penal Code (IPC) for allegedly being the "masterminds" of the February 2020 Delhi riots, which left 53 people dead and more than 700 injured.
Meanwhile, a group of US lawmakers has written to Indian Ambassador to the US Vinay Kwatra urging that Khalid be granted bail and a &ldquo;fair, timely trial in accordance with international law.&rdquo; US Representatives Jim McGovern and Jamie Raskin are among eight lawmakers who wrote to Kwatra expressing &ldquo;our continued concern regarding the prolonged pre-trial detention of individuals charged in connection with the February 2020 violence in Delhi,&rdquo; including Khalid.
&ldquo;The US and India share a long standing strategic partnership that has historically been rooted in democratic values, constitutional governance and strong people-to-people ties,&rdquo; the letter said adding that as the world's largest democracies, both nations have an interest in protecting and upholding freedom, the rule of law, human rights and pluralism.
&ldquo;It is in this spirit&rdquo; that the lawmakers said they are raising their concerns regarding Khalid&rsquo;s detention.
The lawmakers claimed that human rights organisations, legal experts and global media have raised questions about the fairness of the investigation and legal process related to Khalid&rsquo;s detention.
He "has been detained without bail for five years for charges levied under the Unlawful Activities Prevention Act, which independent human rights experts have warned may contravene international standards of equality before the law, due process and proportionality.&rdquo;
The US Representatives further added that they understand that these matters are presently under consideration before the Supreme Court of India and welcomed the news that Khalid received temporary bail to attend his sister's wedding.
They urged that Khalid be granted bail and released for the duration of the court's proceedings. &ldquo;With respect for India's democratic institutions and its role as a key partner of the US, we request that your Government share the steps being taken to ensure that the judicial proceedings against Khalid and those of his co-accused who remain in detention comport with international standards,&rdquo; the lawmakers said.

The Delhi Police told a court here Tuesday that former JNU student Umar Khalid amplified a false narrative in his favour through social media, completing its arguments against his bail plea in the 2020 Delhi riots case.
Khalid is an accused in the alleged larger conspiracy behind the 2020 northeast Delhi communal riots. He has been booked under the stringent Unlawful Activities (Prevention) Act (UAPA).
The arguments against Khalid's bail plea were made on Tuesday before Additional Sessions Judge Sameer Bajpai.
Special Public Prosecutor Amit Prasad said Khalid's mobile phone data revealed he was in contact with some actors, politicians, activists and celebrities and sent them some links by certain news portals against the Delhi Police.
These links were sent with a request to share them on their social media accounts to set a particular narrative and amplify it.
Citing his chats with these people -- who have a considerable social media following -- Prasad said Khalid amplified his narrative as part of a conspiracy.
The SPP also played a video clip in the court, where Khalid's father was being interviewed by a news portal.
The SPP said his father told the portal that they did not have faith in the Supreme Court. "They don't have faith in the Supreme Court, and, therefore they came to the trial court. This is how they are creating a narrative (in his favour)," he said.
The SPP said Khalid had requested members of a WhatsApp group to schedule protests after a particular top court proceeding.
He also rejected the contention of Khalid seeking parity with other co-accused, who have been granted bail.
The matter has been posted for Wednesday for rebuttal by Khalid's counsel.

The Supreme Court on Wednesday said it would hear on July 24 a plea by former JNU student Umar Khalid seeking bail in a UAPA case related to the alleged conspiracy behind the riots here in February 2020.
The Delhi Police sought time to respond to the petition during the hearing before a bench of Justices A S Bopanna and M M Sundresh.
Advocate Rajat Nair, appearing for the Delhi Police, urged the bench to grant him some time to file a counter affidavit in the matter.
"In a bail matter, what counter is to be filed. The man is inside for two years and 10 months," said senior advocate Kapil Sibal, representing Khalid.
Nair said he is praying for a short time to file counter in the matter.
"The charge sheet is voluminous. It runs into thousands of pages," he said, while requesting the bench to grant them some "reasonable time".
"It should have been ready today," the bench observed and posted the matter for hearing on July 24.
On May 18, the apex court had sought response of the Delhi Police on Khalid's plea.
In his appeal, Khalid has challenged the Delhi High Court order refusing him bail in the case.

A court here on Monday granted one-week interim bail to former JNU student Umar Khalid, arrested in a case related to the northeast Delhi riots, for attending his sister's wedding.
Additional Sessions Judge Amitabh Rawat granted relief to Khalid from December 23 to 30.
He has to surrender on December 30 and no extension can be granted, a court source told PTI.
The detailed order is awaited.
Khalid had moved an application seeking two weeks' interim bail -- from December 20 to January 3 -- for his sister's wedding.
Khalid was booked under the anti-terror law Unlawful Activities (Prevention) Act (UAPA) and provisions of the Indian Penal Code for allegedly being a mastermind of the 2020 Northeast Delhi riots, which had left 53 people dead and over 700 injured.

The violence had erupted during the protests against the Citizenship (Amendment) Act (CAA) and the National Register of Citizens (NRC).
Khalid was arrested by the Delhi Police in September 2020.
He was discharged in a case related to the riots on December 3.

The court said that Khalid had been chargesheeted on insignificant material which is unwarranted, adding that there is no evidence of Khalid&rsquo;s presence at the scene of crime.
Opposing his bail, the prosecution had argued that many people related to the &lsquo;riotous mob&rsquo; are yet to be identified, but the Court said that Khalid cannot be incarcerated in jail for infinity just because others who were part of the mob have not yet been identified and arrested.
The charge sheet also accused Umar&nbsp;Khalid of &lsquo;criminal conspiracy&rsquo; in connection with former AAP counsellor&nbsp;Tahir Hussain and alleged that he had planned violence during the former US President Donald Trump's visit to Delhi. The court went on to say that it could not find any rationale in the act of the police involving Khalid in this isolated case for the offence of conspiracy.
The court, however gave him bail on several conditions - Khalid has been asked to furnish a personal bond of Rs 20,000, appear before the Court on every date of hearing, furnish his mobile number to the police upon his release from the jail and also install the &ldquo;Aarogya Setu App&rdquo;.

The 17,000-page chargesheet, filed on September 17, contains a statement from a witness who said &lsquo;Umar Khalid, Salman Khurshid, Nadeem Khan would give provocative speeches at anti-CAA/NRC sit-ins and people would get mobilised.&rsquo;
&nbsp;Khurshid is the highest ranking politician named in police chargesheets so far. CPM leader Brinda Karat, lawyer Prashant Bhushan and activist Yogendra Yadav have also been named in the chargesheet.
