The Bombay High Court on Tuesday granted bail to the accused juvenile in connection with the Pune Porsche car accident case.&nbsp;
Terming the remand order illegal, the court ordered the release of the minor into the care and custody of his paternal aunt, who is also the petitioner in the case. &nbsp;The aunt had claimed that he was sent to custody in an &ldquo;unlawful and arbitrary&rdquo; manner.&nbsp;
The court also directed that the minor's sessions with the psychologist should continue.
"Minor can't be kept in observation home," the court observed.
The minor has been accused of driving a Porsche car at a very high speed in an inebriated state when the vehicle crashed into a bike, killing two software engineers, Aneesh Awadhiya and Ashwini Koshta, in Pune&rsquo;s Kalyani Nagar.
A division bench of Justices Bharati Dangre and Manjusha Deshpande quashed the orders issued by the Juvenile Justice Board (JJB) remanding the minor to the observation home.
"We allow the petition and order his release. The CCL (Child in Conflict with Law) shall be in the care and custody of the petitioner (paternal aunt)," the court said.
The bench noted the JJB's remand orders were illegal and passed without jurisdiction.
The court said amid the "immediate reaction to the accident, the kneejerk reaction and the public outcry, the CCL's age was not considered." "The CCL is under 18 years old. His age needs to be considered," the bench said.
It said the court was bound by law, the aims and objectives of the Juvenile Justice Act and must treat him as any child in conflict with law separately from adult, despite the seriousness of the crime.
"CCLs are to be considered differently," the HC said.
The court said the accused is already under rehabilitation, which is the primary objective, and he is already referred to a psychologist and the same shall be continued.
The order was passed in a plea filed by the 17-year-old boy's paternal aunt, who claimed he was illegally detained and sought his immediate release.
The accident took place in the early hours of May 19. The boy was granted bail the same day by the JJB and ordered to be under the care and supervision of his parents and grandfather.
The police later filed an application before the JJB, seeking amendment of the bail order.
On May 22, the board ordered the boy to be taken into custody and remanded him to an observation home.
The boy's aunt in the plea claimed that because of the public uproar coupled with political agenda, the police deviated from the right course of investigation with regard to the minor boy, thus defeating the entire purpose of the Juvenile Justice (Care and Protection of Children) Act.

The mother of the 17-year-old accused involved in the Porsche car accident case has been arrested, Pune's Police Commissioner Amitesh Kumar told ANI news agency on Saturday.
The accused's mother came under the radar after it was reported that the doctors at state-run Sasson Hospital used her blood to swap with the teen to fudge the report to show that he wasn't drunk while driving during the accident.&nbsp;
Two doctors and a staffer of that hospital were later arrested for producing fake blood report. The father of the 17-year-old was also caught for allegedly bribing them.&nbsp;
The Pune police moved the application for the juvenile's father's custody in connection with the alleged swapping of blood samples. The juvenile's father is an accused in the blood swap case along with two doctors of the Sassoon General Hospital.
"We have moved an application to take custody of the juvenile's father on a production warrant from Yerawada Central Jail, where he was sent after being remanded in judicial custody today. Once we receive his custody on a production warrant, we will produce him in the court and seek his custody to investigate," a senior Crime Branch official told PTI news agency.
As per police, some 12 calls were made between the juvenile's father and Dr Ajay Taware, one of the doctors arrested in the blood swap case, while samples were being collected for testing for alcohol consumption.
As per the police, the blood sample of the minor was replaced with that of a woman to destroy evidence of alcohol consumption.
The juvenile has been sent to an observation home till June 5.&nbsp;

Two doctors were arrested on May 27 morning for allegedly tampering with the blood sample of the 17-year-old boy involved in the Porsche car accident case.
Speaking to ANI news agency, Pune Police Commissioner Amitesh Kumar said that the two doctors of state-run Sassoon Hospital were caught by the Crime Branch. One of the arrested is the head of the hospital's forensic department.
The minor was taken to the Sassoon Hospital to get tested for alcohol following the fatal crash. According to reports, the doctors had switched the blood sample of the minor with that of another person who had not consumed alcohol.
"They have been arrested for alleged manipulation of blood samples and destruction of evidence in the case," a senior police officer told PTI news agency.
Those held have been identified as Dr Ajay Taware and Shrihari Harnor, the official said.
The case is currently being probed by the crime branch.
Two IT professionals died after their motorcycle was hit by a speeding Porsche allegedly driven by the minor in the early hours of May 19.
The police claim the teenager was drunk at the time of the accident.
The teenager was initially granted bail by the Juvenile Justice Board, which also asked him to write an essay on road accidents, but following outrage over the lenient treatment and a review application by the police, he was sent to an observation home till June 5.
The police have arrested the teenager's father, who is a realtor, and his grandfather in connection with the accident.

Police commissioner Amitesh Kumar told PTI news agency on 24th of May that the crime branch was already investigating the offence registered against the father of the juvenile, Vishal Agarwal, and the owner and staffers of two liquor bars who allegedly served liquor to the boy before the accident.
Meanwhile, a local court remanded Agarwal, father of the boy, and five other accused in the case in judicial custody till June 7.
The prosecution had demanded extension of their police custody for further probe.
But the court remanded Agarwal and others including the owner and employees of two liquor-serving establishments -- where the teenager had allegedly consumed alcohol before his Porsche car knocked down two software professionals on a motorbike -- in judicial custody instead.

Agarwal, a real estate developer, was arrested under sections 75 and 77 of the Juvenile Justice Act, while the others were booked for allegedly serving alcohol to an underage person.
Section 75 deals with "willful neglect of a child, or exposing a child to mental or physical illnesses," while section 77 deals with supplying a child with intoxicating liquor or drugs.
According to the FIR , despite knowing that his son did not have a valid driving license, Agarwal (50) gave him the car, thus endangering the teenager's life, and allowed him to party even when Agarwal knew that he consumed liquor.
During the hearing on Friday, the prosecution while seeking extension of the police custody told the court that the juvenile had paid a bill of Rs 47,000 at Cosie Restaurant that night, and the police wanted to find out details of the bank account from which the payment was made.
Section 420 (cheating) of the IPC has been added to the charges against Agarwal over non-payment of RTO fees towards the Porsche's registration, the prosecutor said.

Two officials attached to the Yerawada police station here were suspended on Friday for alleged dereliction of duty in connection with an accident involving a 17-year-old juvenile whose Porsche knocked down and killed two persons in the early hours of May 19.
Inspector Rahul Jagdale and assistant police inspector Vishwanath Todkari were suspended for "late reporting" and "dereliction of duty", said additional commissioner of police Manoj Patil.
The accident case was registered at the Yerwada police station following the car crash in Kalyani Nagar area of the city.
Pune police commissioner Amitesh Kumar had said earlier in the day that internal inquiry pointed to lapses on the part of police officials while registering the case.
He admitted that there was a delay in collecting the blood samples of the juvenile who had allegedly consumed alcohol at two pubs before the accident.
While the accident took place around 3 am on Sunday, the blood samples were collected at 11 pm, the commissioner said.
Also, the offence was initially registered under section 304 (A) (death caused by negligence ) of IPC and later section 304 (culpable homicide not amounting to murder) was added, Kumar said.

Attempts were made to project that the 17-year-old minor who allegedly crashed his Porsche car into a motorbike killing two persons was not at the wheel at the time of the accident, said Pune Police Commissioner Amitesh Kumar on Friday.
The city police chief told reporters that an internal inquiry has pointed to lapses on the part of some cops while registering the case and action will be taken against them.
&ldquo;During our investigation, it has clearly emerged that the juvenile was driving the car and we have already collected all the necessary chronological evidence. For example, when the juvenile left the house, the entry on the security register shows that he left the house with the car,&rdquo; he said.
On the basis of technical and CCTV evidence, it is confirmed that the car was being driven by the juvenile, the police chief said. Eyewitnesses have also corroborated that the teenager was behind the wheel at the time of the accident, he said.
Kumar said attempts were made to show that an adult (the family driver) was driving the car and not the teen when the vehicle fatally knocked down two persons in the city&rsquo;s Kalyani Nagar area around 3 am on Sunday.
&ldquo;We are investigating these things and will take action against those who made such attempts, under section 201 (destruction of evidence) of the IPC,&rdquo; he said.
Asked about the blood samples, Kumar said the juvenile was sent to Sassoon Hospital around 9 am on Sunday after an offence was registered. &ldquo;There was a delay in taking blood samples as they were collected at 11 pm but the blood report is not the pillar of our case,&rdquo; he admitted.
He said the case has been registered under IPC section 304 (culpable homicide not amounting to murder) and the juvenile was fully aware that driving in an inebriated condition would lead to this kind of offence and people&rsquo;s lives would be lost.
He also said special counsels will be appointed to aggressively put forth the police side in court.

In a video message, the teen&rsquo;s mother stressed that the clip had nothing to do with her son and that it was fake.
&ldquo;The video which is being circulated is not of my son. That is a fake video. My son is in the detention centre,&rdquo; says the teen&rsquo;s mother in her message.
Appealing to the police to &ldquo;protect&rdquo; her son, the mother breaks down, shows her video message. Unable to gather herself, she then walks away from the camera.
A rap song purportedly featuring the teenager, boasting about how he got away with the car crash, went viral on social media, but Pune police have clarified that it was a fake account and that the teenager had no role in the video.

In a new twist to the Pune Porsche car accident case, the 17-year-old boy involved the crash and his father have claimed that the family driver was behind the wheel when the accident took place.
According to an India Today report, &nbsp;two friends of the teen who were with him at the time of the accident have also backed their claims.
Meanwhile, the Pune Police on May 23 questioned the teen's grandfather and the family driver in the case. &nbsp;
According to PTI report, when the minor's grandfather was being taken to confront his son at the police commissioner, some reporters tried to ask him questions, following which a man accompanying him heckled and obstructed them.
It led to a heated exchange of words before the police intervened. It was a team of police personnel who whisked away the man inside a room to ensure that the situation did not escalate further.
The boy's grandfather and his son, who is already in police custody, were confronted as some facts related to the case needed to be corroborated, the official said.
"Since the luxury car is in the name of the realty firm owned by the Agarwals, the grandfather of the minor, who is one of the owners of the firm, was questioned in regards to the ownership of the car," he said.
A friend of the minor who was with him in the car was also questioned to verify and corroborate the sequence of events that took place in the intervening night of Saturday and Sunday, he added.
The police, while seeking the custody of the minor's father, had told the court on Wednesday that as the juvenile wanted to drive the car, the driver called his employer (minor's father) and told him about his son's demand and it was his dad who told the driver to let his son drive the car.
The officer said that the driver may be presented in the court as a witness in the case.
Meanwhile, the cops are collecting CCTV footage of the entire route through which the car traversed - from residence to Cosie restaurant, then to Blak Club and from there to the accident spot, to see who was driving the car.
A forensic team also carried out an examination of the Porsche car which was involved in the accident.
"A team today conducted the examination of the car, which is in the possession of the Yerawada police station. We have already carried out the forensic examination of the spot and now the car has also been examined. The technical aspects such as GPS, the cameras around the car were examined," said another senior police officer, who is currently monitoring the investigation.
The police said that they have seized one phone belonging to the minor's father who is currently in police custody.
Meanwhile, BJP leader and Rajya Sabha member Medha Kulkarni posted on X saying that the accident showed the Juvenile Justice Act needs to be reviewed as so-called minors like this boy are using the law to get away with serious crimes.

The teenage boy's father, a real estate developer, and employees of Black Club pub Nitesh Shevani and Jayesh Gavkar, were produced before additional sessions judge S P Ponkshe.
The boy, before the accident, had allegedly consumed alcohol at the pub.
Police registered a case against the teenager's father under sections 75 and 77 of the Juvenile Justice Act, and against the owner and employees of two bars which the boy had visited before Sunday's accident for `serving alcohol to an underage person.' Section 75 deals with "willful neglect of a child, or exposing a child to mental or physical illnesses," while section 77 deals with supplying a child with intoxicating liquor or drugs.
According to the FIR, the real estate developer gave his son the car despite knowing that the boy did not have a driving license, thus endangering his life, and allowed him to party even while knowing that he drinks alcohol.
A group of friends were returning on motorbikes around 3.15 am on Sunday after a party when the speeding Porsche allegedly driven by the boy hit one of the motorcycles at Kalyani Nagar junction, killing two riders, a man and a woman, both 24 years old.

The lawyer representing the 17-year-old responsible for knocking down two techies in Pune questioned the legality of the father's arrest in the case.
In an interview with NDTV, lawyer Prashant Patil on Tuesday said the police need to produce evidence that the teen's father Vishal Agarwal was aware of his son's activities. &nbsp;
&ldquo;For any action under criminal law, one needs knowledge. There has to be evidence that the father had complete knowledge whether the child was taking out the car or not&mdash; whatever the case may be,&rdquo; he told NDTV.
Agarwal, a realtor, was arrested from Chhatrapati Sambhajinagar in Aurangabad on Tuesday morning. He was charged under sections 75 and 77 of the Juvenile Justice Act and relevant sections of the Indian Penal Code and the Motor Vehicles Act.
He said in civil or criminal law, the issue of accountability as a parent has been defined by the Juvenile Justice Act and the charges against the father have little to do with the case.

"Section 75 deals with wilful neglect of a child, or exposing a child to mental or physical illnesses, while Section 77 deals with supplying a child with intoxicating liquor or drugs."
&ldquo;Then, at the cost of some burden, if we go through the sections even as a layman &ndash; we will see they talk about a physical assault or abuse or wilful neglect,&rdquo; he told NDTV.
On the intervening night of Saturday and Sunday, the accused juvenile along with his friends went to the two establishments between 9.30 pm and 1 am and allegedly consumed liquor, police had said.
While passing the order on Sunday, the board stated the Child-in-Conflict with Law (CCL) is released on bail on executing his personal bond and surety bond of Rs 7,500 with conditions that his parents shall take care of him and he will never get involved in offences in future.
It also directed him to visit the Regional Transport Office and study traffic rules, and submit a presentation to the board within 15 days.
"The CCL will write an essay of 300 words on the topic of road accidents and their solutions," the order read.

The court was informed that the accused served liquor to the 17-year-old and his friends without confirming their age.

A local court hearing the luxury car accident case on Tuesday remanded three accused in police custody till May 24, and directed the pub and bar operators to decide a limit on how much liquor should be served to their customers as the latter use their own vehicles to drive back home afterwards.
The court remanded the three accused - an owner and two managers of different restaurants - in police custody in the case of a car accident allegedly involving a 17-year-old boy that claimed the lives of two persons in the early hours of Sunday.
While seeking their custody for seven days, the prosecution told the court that the establishments owned or managed by the accused served liquor to the boy and his friends without confirming his age.
Expressing concern over the loss of two lives in the accident, the judge, while remanding the three accused into police custody, came down heavily on the pub and bar operators.
On the intervening night of Saturday and Sunday, the accused juvenile along with his friends went to the two establishments between 9.30 am and 1 am and allegedly consumed liquor, the police said.
After hearing the arguments of the prosecution and the defence, Additional Sessions Court Judge S P Ponkshe expressed concern over the loss of two lives in the accident, and said, "...If the person is highly drunk, make arrangements for his stay there. What should people walking on the road do? Those who have come to the pub would not go home walking. They will go driving their vehicles. A change has to be there somewhere." She asked the establishments to decide on the limit to serve the liquor to the patrons.
"They must be aware how much should be served. Decide a limit on it," she said.
Adv S K Jain, the defence counsel representing the three accused, opposed the police custody and said that section 77 of Juvenile Justice Act is non-cognisable, and argued that there is no need of the police custody as the investigation in the case was already done.
The prosecution, however, said that the police need to investigate the case and for that they need the custody of the accused.
