Parliament on Thursday passed The Promotion and Regulation of Online Gaming Bill, 2025, with the Rajya Sabha approving it without debate amid din.
The bill, piloted by Minister of Electronics and IT Ashwini Vaishnaw, seeks to ban all forms of online money games while promoting eSports and online social gaming.
It was approved by the Upper House after rejecting amendments moved by Opposition members. The bill was passed by the Lok Sabha on Wednesday.
It also seeks to prohibit advertisements related to online money games and bar banks and financial institutions from facilitating or transferring funds for any of such games.
Online money games are played by depositing money in expectation of winning monetary and other rewards.&nbsp;

Union Minister Ashwini Vaishnaw introduced the Promotion and Regulation of Online Gaming Bill, 2025 in Lok Sabha, proposing a complete ban on online money games, their advertisement, and financial facilitation.

The government on Wednesday moved a legislation in the Lok Sabha to ban online games played with money as it looks to check rising instances of addiction, money laundering, and financial frauds through such applications.
The Promotion and Regulation of Online Gaming Bill, 2025 also seeks to prohibit advertisement related to online money games as well as bars banks and financial institutions from facilitating or transferring funds for any of such games.
Online money game is one played by a user by depositing money in expectation of winning monetary and other enrichment.
Union Minister Ashwini Vaishnaw introduced the bill in the Lok Sabha amid sloganeering by MPs belonging to opposition parties in protest against alleged irregularities in electoral roll revision in Bihar.
The bill outlaws all online betting and gambling (satta and jua) activities -- from online fantasy sports to online gambling (like Poker, Rummy and other Card games) and online lotteries.
Once the legislation is passed by both Houses of Parliament, offering or facilitating online money gaming will be punishable by imprisonment of up to 3 years and/or fine up to Rs 1 crore.
Advertising of money games can attract imprisonment up to two years and/or fine up to Rs 50 lakh. Facilitating financial transactions related to money games can lead to imprisonment up to three years and/or fine up to Rs 1 crore.
Repeat offences attract enhanced penalties, including 3-5 years' imprisonment and fines up to Rs 2 crore.
Importantly, offences under key sections are sought to be made cognizable and non-bailable.
Endorsements by top cricketers and film stars have incited interest in real money gaming apps such as fantasy sports betting games offered by Dream11, Games24X7, and Mobile Premier League.
A senior government source said the bill has been brought as there is a realisation that online real money gaming has become a major problem for society. The government decided to keep the welfare of people above revenue loss from its ban.
Industry bodies representing real money game players -- India Gaming Federation (AIGF), the E-Gaming Federation (EGF), and the Federation of Indian Fantasy Sports (FIFS) in a letter to Home Minister Amit Shah raised concerns over the bill saying the online skill gaming industry is a sunrise sector with an enterprise valuation of over Rs 2 lakh crore and annual revenue exceeding Rs 31,000 crore.
It contributes over Rs 20,000 crore in direct and indirect taxes annually and is projected to grow at a 20 per cent compound annual growth rate (CAGR), doubling by 2028, the industry bodies said.
The bill also recommends a regulator for e-sports, educational platforms, and social games.
It seeks to completely ban offering, operating, or facilitating online money games, irrespective of whether based on skill, chance, or both.
All advertising and promotion of money games across all forms of media will be banned and so will be financial transactions linked to online money games. Banks and payment systems will be barred from processing such payments.
The objectives of the legislation are "to promote and regulate the online gaming sector, including e-sports, educational games and social gaming" as also to "provide for the appointment of an Authority for coordinated policy support, strategic development and regulatory oversight of the sector".
It "prohibit(s) the offering, operation, facilitation, advertisement, promotion and participation in online money games through any computer resource, mobile device or the internet, particularly where such activities operate across state borders or from foreign jurisdictions; to protect individuals, especially youth and vulnerable populations, from the adverse social, economic, psychological and privacy-related impacts of such games".
The bill seeks to "ensure the responsible use of digital technologies", "maintain public order and protect public health" and "safeguard the integrity of financial systems and the security and sovereignty of the state".
The government believes that harms of addiction, financial losses, and even extreme consequences such as suicides associated with online money gaming can be prevented by prohibition of such activities.
Additionally, online money gaming platforms are often misused for financial fraud, money laundering, terror financing, and messaging activities that compromise national security.
The legislation aligns digital domain with existing laws for corresponding activities in the physical world, wherein betting and gambling are restricted or punishable -- such as in the Bharatiya Nyaya Sanhita, 2023 as well as various state government legislations.
The bill recognised e-sports as a legitimate form of competitive sport in India, for which the Ministry of Sports will frame guidelines and standards for conduct of such events.
For online social games, the Ministry of Electronics and IT (MeitY) and the Ministry of Information and Broadcasting (MIB) will extend support to online games that foster educational and cultural values, skill development and social engagement.
Citing "psychological and financial harm" that can be caused by such games, the bill says that no person "shall offer, aid, abet, induce or otherwise indulge or engage in" the offering of online money games and such services.

In a joint letter, the federations warned that such a blanket prohibition would be a "death knell" for the industry, destroying jobs and pushing crores of users towards illegal offshore betting and gambling platforms.
The letter, dated August 19, was sent on behalf of the All India Gaming Federation (AIGF), the E-Gaming Federation (EGF), and the Federation of Indian Fantasy Sports (FIFS).
The letter stated that the online skill gaming industry is a "sunrise sector" with an enterprise valuation of over Rs 2 lakh crore and annual revenue exceeding Rs 31,000 crore. It contributes over Rs 20,000 crore in direct and indirect taxes annually and is projected to grow at a 20 per cent compound annual growth rate (CAGR), doubling by 2028.
The total number of Indian online gamers grew from 36 crore in 2020 to over 50 crore in 2024, it noted, adding that the industry has attracted Foreign Direct Investment (FDI) of over Rs 25,000 crore till June 2022 and currently supports over two lakh direct and indirect jobs.
"Such a blanket prohibition would strike a death knell for this legitimate, job-creating industry, and would cause serious harm to Indian users and citizens.
&ldquo;This Bill, if passed, will cause serious harm to Indian users and citizens. By shutting down regulated and responsible Indian platforms, it will drive crores of players into the hands of illegal matka networks, offshore gambling websites, and fly-by-night operators who operate without any safeguards, consumer protections, or taxation,&rdquo; the industry bodies said.
The industry bodies asserted that a ban would also deter global investment and investor sentiment, result in over 400 companies shutting down, and weaken India's position as a digital innovator.
The letter cautioned that instead of protecting people, the Bill risks exposing them to "fraud, exploitation, and unsafe practices," which may end up helping illegal offshore operators.
&ldquo;Our sector represents not just entertainment, but the creation of an indigenous, future-ready industry at the intersection of emerging technology, creativity, and entrepreneurship. Today, thousands of startups, young engineers, and content creators rely on this ecosystem.
&ldquo;The only beneficiary of this bill will be the illegal offshore gambling operators. If legitimate Indian businesses are shut down, unregulated actors will fill the vacuum. This will erode state and national tax revenues while leaving Indian users exposed to unregulated platforms,&rdquo; it added.
Arguing for "progressive regulation and not prohibition," the bodies requested a meeting with the minister to present their case and discuss solutions that would ensure responsible gaming while protecting users and the industry.
The letter was signed by Roland Landers, Chief Executive Officer of AIGF; Joy Bhattacharjya, Director General of FIFS; and Anuraag Saxena, Chief Executive Officer of EGF.

The Indian online gaming industry, valued at over $3.5 billion, has called on the government to reconsider the 28% GST on Contest Entry Amount (CEA). The Skill Online Games Institute (SOGI) argues that this high tax rate hampers domestic companies and restricts the industry's growth potential.

SOGI Founder President Amrit Kiran Singh noted that the shift from an 18% tax on gross gaming revenue to CEA in October has not only financially burdened legitimate domestic platforms but also inadvertently promoted illegal offshore betting and gambling activities. Singh emphasized the need to reassess the GST policy to curb these unintended consequences and support the domestic industry's growth.
"The shift from 18 per cent on gross gaming revenue to CEA in October last is not just a financial burden on legitimate domestic platforms but also unintentionally bolstered illegal offshore betting and gambling activities," SOGI Founder President Amrit Kiran Singh said.
Singh expressed concerns that the high tax rate is pushing Indian companies out of business, while foreign companies, especially those from China where such taxes are absent, gain a competitive advantage. He mentioned that the government had agreed to review GST rates on online gaming post-election and urged that this review be conducted with a comprehensive study of the Indian and global online gaming landscape.
Singh also requested that the government consider the taxation models of other countries like the US, the UK, and China. To this end, SOGI is collaborating with the University of Oxford to study global regulations and tax structures for online gaming.
The industry highlights its potential for job creation and economic growth, currently employing over 2 lakh people and growing at a rapid pace of 35% CAGR over the last five years. With the right regulatory framework, SOGI believes the industry could grow five to sixfold in the near future.
SOGI stresses that a supportive tax policy is crucial for the continued expansion and success of the domestic online gaming sector, which has significant potential for contributing to the Indian economy.

Over the past month, several gaming companies in India have received tax notices from the government, including Dream11, Gameskraft and Delta Corp among others. Firms have challenged the restrospective nature of the tax notices, calling them unreasonable.
The GST authority also said that amendments to Integrated Goods and Services Tax would make it mandatory for offshore online gaming platforms to register in India and pay taxes in accordance with domestic law. However, as per reports, there is currently no data available regarding foreign gaming companies registering in India since October 1. &nbsp;
TAX NOTICES TO DELTA CORP
It may be noted that the Bombay High Court has directed the Directorate General of GST Intelligence, Hyderabad to not pass a final orders on ₹16,195 crore tax notice against Delta Corp without prior permission from the court, the gaming company said.
The order was passed by the Goa Bench of Bombay High Court.&nbsp; &nbsp; The company and its arms have over ₹23,000 crore tax payment notice from DG GST, over six times more than its overall market capitalisation of ₹4,000 crore.&nbsp;

This ambiguity has been under discussion in the GST council for four years, indicating confusion about how to tax the gaming industry. Lawyers argue that treating all online real money games as gambling is incorrect, reported Moneycontrol.
Dream Sports and Gameskraft, prominent gaming companies, are contesting tax demands from GST authorities in multiple courts. Gameskraft faces an alleged GST evasion demand of ₹21,000 crore, currently being heard in the Supreme Court. Simultaneously, Dream Sports, the parent company of Dream 11, has filed a writ petition in the Bombay High Court, challenging a claim estimated at ₹25,000 crore.
In August 2023, the GST council clarified that all online games involving wagers, irrespective of skill or chance, attract 28% GST on the full value of bets placed from October 1. However, retrospective tax demands seem to stem from these amendments, leading to legal challenges from gaming companies.
The government argues that any game played for a stake, whether skill-based or chance-based, is taxable at 28%. The courts will now determine the validity of the pre-October 1 tax notices, leaving the gaming industry and legal experts closely watching the outcome.

The online gaming companies that had classified themselves as platforms providing game of skill could be facing an additional tax outflow of Rs 45,000 crore, reported Economic Times.
As per the report, the Central Board of Indirect Taxes and Customs (CBIC) has assessed the pending GST liabilities of such companies at about this level since the 2017 rollout of the levy as they paid 18% on gross gaming revenue, being games of skill, instead of the 28% prescribed in the law, officials said. The differential taxation between games of skill and chance has come to an end.
"Our internal assessment says that the gaming industry alone has paid ₹45,000 crore less tax since the implementation of GST," a senior official from CBIC told Economic Times.

MPL Layoffs 2023: Gaming platform Mobile Premier League (MPL) is set to lay off 350 employees to tackle the 28% GST that is imposed on online gaming. This represents about 50% of the company's employees in India.&nbsp;
MPL co-founders Sai Srinivas and Shubh Malhotra said in an email that the new rules would increase the tax burden by as much as 350-400%. They added that due to this added pressure, the company is forced to take some tough decisions.
"The new rules will increase our tax burden by as much as 350 percent-400 percent. As a business, one can prepare for a 50 percent or even a 100 percent increase, but adjusting to a sudden increase of magnitude means we need to make some very tough decisions," MPL co-founders Sai Srinivas and Shubh Malhotra said in an email to employees.

The email also mentioned that their variable costs predominantly involve people, server and office infrastructure and that the company has already initiated work on revisiting their server and office infrastructure costs. "Despite this, we will still have to reduce our people related costs" the email read.
This will be the 2nd round of layoff by the gaming platform. In May 2022, the company had let go of more than 100 employees.

Online gamers' association on Tuesday requested finance minister Nirmala Sitharaman for a reduction of 28 per cent Goods and Services Tax (GST), saying high taxation would lead to mushrooming of illegal gaming firms.
Gamers from Tier II and Tier III cities under the aegis of 'Indian Gamers United' in an open letter to finance minister Nirmala Sitharaman said that high taxation will push the gamers towards illegal and offshore platforms where no tax is payable but will put the gamers into a very high risk.
The association also pitched for making a distinction between games of chance like gambling and games of skill like gaming.
Gaming is a skill-based activity and cannot be clubbed together with games of luck like gambling and horse racing so taxation requires a relook and making it tax friendly, 'Indian Gamers United&rsquo; said in a statement.
Since several of these games come with the option to earn monetary rewards, this is giving rise to a segment where young people are using their gaming skills to earn money in their free time and becoming part of the gig economy, it said.
An unviable rate of GST at the rate of 28 per cent on online games will have adverse impact on this growing industry, it said.
Meanwhile, the GST Council in its meeting on Wednesday will decide on modalities for implementing a 28 per cent Goods and Services Tax on online gaming, casino and horse racing.
In its 50th meeting earlier this month, the Council headed by finance minister Nirmala Sitharaman decided to levy the maximum 28 per cent tax on the full face value of bets in online gaming, casinos and horse racing.
The decision of the Council evoked criticism from the online gaming industry. Following this, minister of state for electronics and IT Rajeev Chandrasekhar said that the GST Council should reconsider its decision.
"We are still in the early stages of developing a sustainable and permissible online gaming framework. Once this framework is established, we will approach the GST Council and request their reconsideration based on the new regulatory guidelines," Chandrasekhar had said.
However, revenue secretary Sanjay Malhotra had said that the GST Council has taken a unanimous decision to impose a 28 per cent tax on online gaming, casino and horse racing based on the recommendation of the Group of Ministers (GoM).
The GoM had extensive consultations with all stakeholders from online gaming, casino, horse racing, etc. and arrived at this taxation.
"I really doubt (it) because this decision has been unanimous and the decision has been taken as I mentioned after due consultation and deliberation. So, I don't think there is any chance of a review as early as this," Malhotra had said.

Amid the online gaming industry raising concerns over the levy of 28% GST, Union Minister Rajeev Chandrasekhar said the government may request the GST Council to consider the facts of the new regulatory framework for the industry. The minister also mentioned that it took three years for the Council to reach a decision on online gaming.
Online gaming players have expressed disappointment with the decision of the Goods and Services Tax Council to levy a 28% tax on online games involving real money. The Minister of State for Electronics and IT during a CNN-News 18 Townhall programme said that the GST Council is not the government of India but it is truly a federal organisation representing state governments and the centre.
"We have to also recognize that the process of creating a regulatory framework for online gaming only started in January 2023. We are only in the early stages of creating a predictable, sustainable permissible online gaming framework. So, we will do that and we will go back to the GST Council and maybe request their consideration on the facts of the new regulatory framework," Chandrasekhar said.
Government levies GST based on recommendations of the GST Council. Online gaming players have shared that levying 28% GST on Gross Gaming Revenue (GGR) or the platform fee results in around 1,000% increase in tax on the industry and cause irreversible damage to the USD 2.5 billion investments in the Indian online gaming startup ecosystem.
A group of 127 online gaming players, including All India Gaming Federation, WnZo, E-Gaming Federation, Games 24X7 etc in an open letter has said that over 1 lakh direct jobs have been created by them till date with the expectation that over 5 lakh direct and indirect jobs would be created by the sector by 2025.

Fantasy sports' revenue is likely to grow over three-fold to ₹25,240 crore by FY2027, a joint report by the Federation of Indian Fantasy Sports and Deloitte India said on Tuesday.
The report claimed that India is the fastest-growing FS (fantasy sports) market in the world with over 300 fantasy sports platforms (FSPs) and 18 crore users.
'The industry grew by 31 per cent to ₹6,800 crore in FY22. It is expected to touch ₹25,240 crore by FY27,' the report said.
According to the report, the FS industry attracted ₹15,000 crore in FDI till FY22, which is likely to touch ₹25,000 crore by FY27.
The report claimed that the FS industry contributed ₹4,500 crore by the way of taxes and is expected to reach ₹26,000 crore in the next 5 years.
'GST contributions from the fantasy sports industry are expected to increase by 5 times in the next 5 years, from ₹2,800 crore in FY18-FY22 to ₹14,700 crore between FY23 and FY27,' the report said

The government has notified a new set of rules for the online gaming sector in a bid to prohibit betting and wagering on internet platforms. As per the new rules, the industry has to set up self regulatory bodies to govern games that include real-time money.
These bodies has to certify if a game that involves money is permissible or not. As per Business Standard, all online real-money games and the online gaming intermediary that enable access to such online real-money games must display a demonstrable and visible verification mark, stating the game is verified by the SRB consistent with the new rules.
The regulatory body will have a window of 3 months to decided if the game is permissible or not. It can rely on the information provided by the applicant for verification and declare the real-money game as permissible for a period not exceeding three months. Before accepting any cash deposits on the platform, the self regulatory body has to do a full KYC &nbsp;similar to the one followed by entities regulated by the Reserve Bank of India.&nbsp;
As per the notified rule set, the body has to appoint a chief compliance officer, a nodal contact person for coordination with law enforcement agencies, and a resident grievance officer. The companies offering real-money games should have a physical contact address in India published on their website or mobile application. Gaming platforms are also forbidden from financing by themselves.
The composition of the regulatory body includes experts from the online gaming industry, education, psychology, information and communications technology, and child rights organisations.&nbsp;
Online gaming platforms have largely welcomed the new set of rules notified by the government.

As several residents have been spending their earnings and savings on online game, on Monday approved an Ordinance to ban online games which involve betting which involve betting money. 
 The ordinance will be put into effect after the approval of the governor, a government statement said.
The committee also recommended that the state government ban advertisements that encourage people to play such online games.
