Chief Minister Mamata Banerjee asserts that backwardness, not religion, is the basis for OBC status in West Bengal. Affected by a High Court decision, the state seeks to appeal for preservation of OBC inclusions.

Mamata Banerjee affirms that OBC status in West Bengal is determined only by socio-economic factors, not religion. This follows a High Court ruling nullifying certain OBC statuses, prompting a Supreme Court appeal.

West Bengal Chief Minister Mamata Banerjee on Tuesday told the state assembly that backwardness is the only benchmark to decide the OBC status of people.
Maintaining that a disinformation campaign was continuing on social media by some quarters, she said there is no connection with religion in deciding the inclusion of any person in the OBC category.
Noting that the only benchmark for deciding OBC status in the state is backwardness, Banerjee said a commission set up by the government is conducting a survey on 50 new subsections for inclusion in that category.
The chief minister said 49 subsections have been included under the OBC-A and 91 under OBC-B categories.
She said while more backward sections of people have been included under OBC-A, the less backward category come under OBC-B.
The CM addressed the House after laying the annual report of the West Bengal Commission for Backward Classes for the financial year 2024-25.
Banerjee said all inclusions have been done after extensive field surveys, and on the basis of recommendations by the commission.
The chief minister said that a May 22, 2024 order of the Calcutta High Court struck down the OBC status of several categories in West Bengal granted since 2010.
The state government has appealed against the order before the Supreme Court, she said.
Banerjee also said that the West Bengal government started working with the permission of the apex court for inclusion in the OBC list.
She said as per the Calcutta High Court's direction, a public notification was issued for the purpose of inclusion in the OBC category in the state.
Following the completion of forming the OBC category list, recruitment processes in various state government institutions can be started again, Banerjee stated.
"All inclusions were done by the state government only on the recommendation of the West Bengal Commission for Backward Classes," she said.
The Calcutta High Court had in May 2024 struck down the Other Backward Classes (OBC) status of several classes in West Bengal granted since 2010, finding such reservations to vacancies in services and posts in the state illegal.
The court struck down 77 classes of reservation granted between April 2010 and September 2010 and 37 classes created based on the state's reservation act of 2012.
The CPI(M)-led Left Front was in power in West Bengal till May 2011.

Over 13,600 reserved category students dropped out from central universities, Indian Institutes of Technology (IITs) and Indian Institutes of Management (IIMs) over the last five years, Lok Sabha was informed on Monday.
Union Minister of State for Education Subhas Sarkar shared the statistics in a written reply to a query by BSP member in Lok Sabha Ritesh Pandey.
In the case of Central Universities (CUs), Sarkar said that as many as 4596 OBC, 2424 SC, and 2622 ST students dropped out in the last five years.
In IITs, 2066 OBCs, 1068 SC and 408 ST students dropped out. In IIMs, the figure remained at 163, 188, and 91 for OBC, SC and ST students, respectively.
"In the higher education sector, students have multiple options and they choose to migrate across institutions and from one course/programme to another in the same institution.
"The migration/withdrawal, if any, is mainly on account of securing seats by the students in other departments or institutions of their choice or on any personal ground," he said.
The minister informed that National Law Universities (NLUs) have been established under the Acts enacted by the respective state legislatures and as such they are the state Universities.
"No such data on dropout students of NLUs is maintained by the central government," he said.
Responding further to the query on what the government is doing to address the issue, Sarkar said that the government has taken various steps like fee reduction, the establishment of more institutes, scholarships, and priority access to national-level scholarships to aid the students with poor financial backgrounds to pursue their education.
"For the welfare of SC and ST students, schemes like 'waiver of tuition fees in IITs&rsquo;, grant of national scholarships under Central Sector Scheme, scholarships in Institutes etc. are also there,&rdquo; he said.

While 14,446 students from the three categories dropped out from Central Universities during the period, 4,444 students dropped out from IITs, and 366 from IIMs, the minister said.

More than 19,000 students from OBC, SC and ST categories dropped out from Central Universities, IITs, and IIMs during 2018-2023, according to the Ministry of Education.
The data was shared by Union Minister of State for Education, Subhas Sarkar, in response to a written question in Rajya Sabha.
According to available records, the number of drop out students from 2018 to 2023 in Central Universities (CUs), Indian Institutes of Technology (IITs) and Indian Institutes of Management (IIMs) in various courses is 19,256.
While 14,446 students from the three categories dropped out from Central Universities during the period, 4,444 students dropped out from IITs, and 366 from IIMs, the minister said.

No case of caste discrimination and alienation of SC and ST students have been reported from IITs in the last five years, Mr. Sarkar informed the Rajya Sabha in response to a written question.
The Minister informed that seven cases of suicides by SC and ST students have been reported in IITs while the same number of students from the two categories in Central Universities died by suicide since 2018.

Earlier, The Lucknow bench of Allahabad High Court on Tuesday quashed the state government's notification on urban local body elections and ordered holding the polls without reservation for the Other Backward Classes.
The two judge bench which was hearing a bunch of PILs challenging the preparation of the OBC reservation draft, annulled the December 5 notification issued by the Adityanath government saying OBC reservations cannot be notified till conditions laid down by the SC were fulfilled.
The Court also rejected UP govt's rapid OBC survey.&nbsp;

The Lucknow bench of Allahabad High Court on Tuesday quashed the state government's draft notification on urban local body elections and ordered holding the polls without reservation for the OBCs.
The verdict was passed by a division bench of Justice DK Upadhyay and Justice Saurav Lavania.
A division bench of Justice DK Upadhyay and Justice Saurav Lavania also annulled the draft notification issued by the Uttar Pradesh government on December 5 for reservation of Other Backward Classes (OBCs) in the urban local body elections.
The verdict comes on the back of PILs challenging the preparation of the OBC reservation draft without following the triple test formula prescribed by the Supreme Court.
The petitioners had pleaded that the state government must follow the apex court formula and constitute a dedicated commission to study the political backwardness of OBCs before fixing the reservation.
The state government pleaded that it had conducted a rapid survey and said it was as good as the triple test formula.

The state government had earlier this month issued a provisional list of reserved seats for mayors of 17 municipal corporations, chairpersons of 200 municipal councils and 545 nagar panchayats for the three-tier urban local body elections and sought suggestions/objections within seven days.
According to the December 5 draft, four mayoral seats -&ndash; Aligarh, Mathura-Vrindavan, Meerut and Prayagraj -- were reserved for OBC candidates. Of these, the mayor's posts in Aligarh and Mathura-Vrindavan were reserved for OBC women.
Additionally, 54 chairpersons' seats in the 200 municipal councils were reserved for OBCs, including 18 for OBC women. For the chairpersons' seats in 545 nagar panchayats, 147 seats were reserved for OBC candidates, including 49 for OBC women.

At least a dozen rebel BJP MLAs, including three ministers in the Yogi Adityanath Cabinet, are set to join the Samajwadi Party today, after a massive OBC exodus from the ruling party just a month before the Uttar Pradesh Assembly Elections.
The OBC revolt against the Yogi government was triggered by powerful Backward leader Swami Prasad Maurya who quit the Cabinet citing injustice to Dalits and OBCs.
Since Maurya's exit, two more ministers and 9 MLAs have turned against the BJP on Maurya's cue and are headed the SP way.
Maurya met with SP chief Akhilesh Yadav on Thursday evening and said that there will be a joint declaration on Friday.
Maurya, who is a 5-time MLA with influence in the eastern and central region of Uttar Pradesh, declared that there is a "tsunami against the BJP in UP and it will be decimated".
The former labour minister also said that ministers, lawmakers and leaders who resigned from the BJP and were loyal to him were introduced to Yadav on Thursday. A discussion was held on the strategy, campaign and fielding of candidates, Maurya added.
