Chief Justice of India N V Ramana on Wednesday said it is unfortunate that even after 75 years of independence only a few are aware of the constitutional provisions and emphasised that the public must know their constitutional rights and duties.
CJI Ramana, who was speaking as the chief guest at an event by Eastern Book Company to celebrate the release of 'Supreme Court Cases (SCC) pre-1969', stated that the ultimate consumer of justice is the public and thus called for “simple” judgement writing by the judges as well as publication of important judgements of the Supreme Court and high courts in regional languages by law journals.
He said even a “small school kid” in the western countries is aware of his constitution and the laws and asserted “we need that kind of culture”.
“The lawyers and the public must know the constitutional provisions and the Constitution. It is unfortunate that we are now celebrating 75 years of independence but still only a few selected people in the urban areas or the legal professional are aware of the constitutional rights and duties and the constitutional principles,” CJI Ramana said.
“They (people) must know what the Constitution says and how they are entitled (under the laws). What are their rights, how to implement their rights, how to know their duties. It is necessary for us, especially (law journals) to try and introduce at least selected judgements of importance -- crux and not the entire judgement -- in regional languages to enable access in a simple language,” he added.
Acknowledging that translation of judgements in regional languages in a simple manner would entail a financial burden, CJI Ramana added, “I hope some governments can also give some money because they are now starting several projects for popularising the Constitution and the constitutional schemes. We can think of this issue also.” He further said being a judge for 22 years, he was aware of the criticism that judgements are at times “like a thesis” and requested all members of his fraternity to be simple.
"I request all the fraternity members as well as lawyers who are contributing by arguing to try to be simple in judgement (and write) concise, precise and short sentences. People must feel like they are reading a story,” he said.
“Ultimately, at the end of the day, the consumers of justice are the litigant, public or whoever it is, they must know the end result. That is more interesting than our own imaginations and philosophies. That way I think we can help the public a lot. The reasoning and the conclusion needs to be clear. I hope and trust this will happen,” he said.

Chief Justice NV Ramana on Saturday while highlighting the shortcomings in the criminal justice system said that the process becomes a punishment. 
He said issues like hasty, indiscriminate arrests, difficulty in obtaining bail and prolonged incarceration of under trials needs urgent attention. 
The Chief Justice spoke about a holistic approach to administration of justice and added that training and sensitisation of the police and modernisation of the prison system is one facet of improving the system. 
He also spoke about the political situation in the country and sais political opposition is translating into hostility which is not a sign of a healthy democracy and asserted that strong parliamentary democracy demands "strengthening the Opposition as well".
There used to be mutual respect between the government and the Opposition, but the space for opposition is diminishing and laws are being passed without detailed deliberation and scrutiny, he lamented at an event here.
The CJI said the people expect the court to stand as a counterweight to legislative and executive excess and this gains gravity, particularly whenever the Opposition is missing in action.
Instead of engaging in meaningful debates for furthering democracy, politics has become acrimonious, he said.
“The diversity of opinion enriches polity and society. Political opposition should not translate into hostility, which we are sadly witnessing these days. These are not signs of a healthy democracy,” CJI Ramana said.

The Supreme Court on Monday refused to look into a writ petition filed by the father of a gang-rape and murder victim from Bulandshahr. 
A bench headed by the Chief Justice of India granted liberty to the petitioner to approach the High Court. 'We can grant liberty to approach the High Court. Every writ petition I can't entertain',the CJI said.
Responding to the Bench's remarks the petitioner said, 'I am a labourer, can't go to High Court, to Supreme Court, I am a victim of the system, there's complete lawlessness in UP.' 
The Bench, also comprising Justice Krishna Murari and Justice Hima Kohli, made strong remarks against petitioner's approach of not moving High Court before Supreme Court. 
The petition filed was about the kidnap, gang-rape and murder of a minor in Uttar Pradesh's Bulandshahr on January 21, 2022. 
The Counsel representing the petitioner stated that the petitioner's minor daughter was kidnapped, gang-raped and murdered. The victim's parents were not even given a chance to perform their daughter's last rites as the police forcibly cremated her body at midnight. 
'Don't flood this court with these type of petitions, sorry. You can go to High Court and say the same. Why are you coming directly to Supreme Court straightaway?', CJI Ramana asked the counsel.
According to the Bench's observations, the Supreme Court could either grant liberty to the petitioner to approach the High Court or dismiss the petition. 
The petitioner's Counsel then sought liberty to approach the High Court after withdrawing the petition. 
As per the present writ petition filed through Advocate Varinder Kumar Sharma, no FIR was registered by the police despite the complaints of the girl's father. It is further contended that the police did not allow him to perform last ritual rights of his daughter and that the Police forcefully cremated her body at midnight. The victim's family was also not informed of the post-mortem, the petition states. 
Further, the petition sought directions to have a Special Investigation Team (SIT) set up or a CBI enquiry under a sitting or retiring High Court Judge. Requests for protection of witnesses and petitioner were also put forth in the petition. 
The petitioner also sought directions for court monitored investigation against the officials who were responsible for cremation of the victim's body, and illegal detention of victim's family members. 
According to the petitioner, these facts clearly show that there is no chance for fair investigation, hence a Court-Monitored investigation has been sought.

He added &lsquo;only 5 per cent of court complexes have basic medical aid, and 26 per cent of the courts don&rsquo;t have separate toilets for women. Sixteen per cent of the courts don&rsquo;t even have toilets for men. Nearly 50 per cent of the court complexes don&rsquo;t have a library, and 46 per cent don&rsquo;t have the facility to purify water.&rdquo;
Stressing that work cannot continue under the present condition, Ramana urged the Law Minister to make sure the proposal to set up the National Judicial Infrastructure Authority is taken up in the winter session of parliament.
Earlier, the CJI had sought a speedy approval from the government for recommendations made by Supreme Court collegium for the appointments of judges in high courts.
