Bihar Chief Minister Nitish Kumar is all set to face the floor test in the state assembly on February 12 to prove that his government has the majority.
The recently-formed state government is being led by Kumar's Janata Dal (United), the Bharatiya Janata Party (BJP), and the Hindustani Awam Morcha (Secular) (HAMS). These parties, along with the lone independent, together have 128 MLAs. For a majority, an alliance needs 122 MLAs.
While the new government is expected to sail through without any hiccups, three JDU MLAs were found absent during a meeting called on February 11. JD(U), however, downplayed their absence.
&ldquo;We are assured of proving our majority. Two-three MLAs did not come but they had informed the party. All of them would be here by morning. Our (NDA) strength is 128 and we will prove it,&rdquo; Chowdhary told media persons.
&ldquo;We will get the majority with ease. There is no need to worry,&rdquo; the CM told the meeting, as quoted by Chowdhary. The meeting lasted for more than 90 minutes.
Giving details of the Monday proceedings, &nbsp;Chowdhary said that after the governor&rsquo;s address, the first proposal would be brought for the removal of the speaker.
&ldquo;As per the rules, the Speaker would ask as to how many legislators do support the proposal to remove the Speaker. As per legislative rules, if 38 or more MLAs support the proposal, it gets accepted, and then in this scenario, it is expected that the speaker vacates his chair till the proposal is defeated. The deputy speaker takes over the chair and takes up the proposal to remove the Speaker. Then the trust vote will be taken up,&rdquo; he said.

JD(U) leader Nitish Kumar on Sunday was sworn in as the chief minister of Bihar for a record 9th time. Joining Nitish were BJP's Samrat Choudhary and Vijay Sinha. Both are expected to be made deputy chief ministers of the state.
Apart from them, six other ministers were also sworn in by Governor Rajendra Arlekar at Raj Bhawan.
Among the eight ministers, three each are from the BJP and the JD(U). One is from Jitharam Manjhi's Hindustani Awam Morcha, while another is an independent MLA.
Speaking to the reporters after being sworn in, Nitish said, "We will stay together. 8 leaders took oath as ministers today and the rest will be inducted soon. Samrat Choudhary and Vijay Sinha have been appointed as Deputy Chief Ministers."
Prime Minister Narendra Modi later congratulated Kumar and the new Bihar government.
&nbsp;"The NDA government formed in Bihar will leave no stone unturned for the development of the state and to fulfill the aspirations of its people," he posted on X in Hindi, shortly after the swearing-in ceremony.
"Congratulate @NitishKumar ji on becoming Chief Minister and Samrat Chaudhary ji and Vijay Sinha ji on taking oath as Deputy Chief Ministers. I am confident that this team will serve my family members of the state with full dedication. @samrat4bjp @VijayKrSinhaBih," the prime minister added.
Earlier, the 72-year-old leader hinted at his unhappiness with the way the INDIA alliance was functioning. Nitish is believed to be the architect of the opposition alliance.&nbsp;
"You all know how I came to this alliance and also how I worked to bring together so many parties. But of late, things were not working well. It was not going down well with those in my party as well", he said.
"Nobody was doing anything after the alliance was formed. INDIA bloc failed my expectations," Nitish added.

Congress leader Jairam Ramesh on January 27 said that he was hopeful of Mamata Banerjee and Nitish Kumar remaining within the INDIA bloc amidst reports of Nitish Kumar joining the BJP in Bihar.
Speaking to reporters about the Bihar political crisis, he said that the "situation is tense but under control", and that it is not good for the image of the INDIA alliance.
He further said that Congress chief Mallikarjun Kharge made several attempts to speak with Kumar, but no conversation could be held as both of them were very busy.&nbsp;
&ldquo;There will be a time&hellip;they have called back but no conversation could be held between them so far&hellip;this happens sometimes," &nbsp;Ramesh said.
The comments come at a time when Congress is trying hard to hold the alliance together amidst West Bengal Chief Minister Mamata Banerjee going solo for Lok sabha elections, and reports of Kumar ditching the Mahagathbandhan alliance in Bihar.&nbsp; &nbsp; &nbsp;
Meanwhile, Congress president said that he would speak to Kumar only after getting proper information.
"Those interested in saving democracy will not change their minds and will stay with us," said Kharge, adding that he would have full information once he reaches Delhi.
"I wrote a letter and tried to talk with them... What they have in mind is not clear. I am travelling to Dehradun tomorrow, then move to Delhi. I will get full information. Otherwise, it creates confusion. Let us see what will happen. We don't know...if they are approaching Governor," Kharge told reporters in Karnataka's Kalaburagi, reports ANI news agency.

As the suspense continues over Bihar Chief Minister Nitish Kumar joining hands with the BJP, Janata Dal (United) spokesperson KC Tyagi Saturday said that the INDIA bloc is on the verge of collapse.
He blamed the Congress' irresponsible and obstinate attitude for the impending implosion in the opposition camp.
"The INDIA alliance is on the brink of a collapse. We had succeeded in bringing all non-Congress parties together but the (alliance) is falling apart. In Punjab and Bihar, the (INDIA) alliance has nearly collapsed. Similarly, in West Bengal, the alliance is falling apart. Meanwhile, in Uttar Pradesh, Akhilesh Yadav has asked Congress to work with an open heart," Tyagi said.
The JD(U) also claimed that a section of the Congress leadership repeatedly insulted Kumar, who never sought a high position in the alliance.&nbsp;
Tyagi said he could not see as to how the INDIA bloc parties could fight the "all-powerful" BJP, reports PTI news agency.
The Bihar chief minister succeeded in bringing together several parties in Patna but the entire process became so limp that the INDIA bloc has had no joint meetings on leadership and agenda even though the Lok Sabha elections are now round the corner.&nbsp;
The JD(U) party's first reaction amidst the crisis comes as the Congress and RLD wait for Kumar to officially confirm his exit from from 'Mahaghatbandhan' in Bihar.

The petitioner, Akhilesh Kumar, has sought quashing of the notification dated June 6, 2022 issued by the Bihar government to conduct a caste survey in the state.

The Supreme Court on Thursday agreed to hear on January 20 a plea against the Bihar government's decision to conduct a caste census in the state.
A bench of Chief Justice DY Chandrachud and Justice P S Narasimha posted the matter for hearing after advocate Barun Kumar Sinha appearing for the petitioner mentioned the matter.
The apex court noted that a similar matter had been posted for hearing on January 20.

The plea contended that the subject of the census falls in List 1 of the 7th Schedule of the Constitution and only the Centre has the power to hold the exercise.
The PIL has alleged that the notification violated Article 14 of the Constitution which provides for equality before law and equal protection under the law, adding that the notification was illegal, arbitrary, irrational, and unconstitutional.
"If the proclaimed purpose of the caste-based survey is to accommodate the people of State suffering caste persecution, the distinction on the basis of caste and country of origin is irrational and unjustified.
"None of these distinctions correspond with the ostensible purpose of the law," the petition said.

 Eight persons, including two government officials, have been arrested for the illegal dismantling of a 60-feet-long iron bridge in Bihar, which made headlines, a senior police officer said on Sunday.
According to Rohtas Superintendent of Police, those arrested for the "stealth" of the metal bridge over a canal in the district include a sub-divisional officer and an official of the weather department.
"During investigations, we learnt that weather department official Arvind Kumar had led the group, armed with gas cutters and other equipment, which dismantled the structure a few days ago,” the SP said.
Villagers, who expressed curiosity were told, falsely, by Kumar and his associates that they were acting as per orders of the government.
Since the steel structure was in a state of disuse, nobody complained.
"We caught hold of Kumar and came to know that the area's SDO, Radhe Shyam Singh, was the mastermind. The SDO has been arrested along with six other accomplices,” he said.
The JCB machine and the pick-up van, besides gas cutters used in the illegal operation, have also been seized, the SP said, adding, further investigation is underway.

"And this is not the first time. In 2000 also, the JD(U) had won just 37 seats and the BJP won 68-69 seats. Despite this, the party accepted Nitish Kumar as the chief minister."
