The Madras High Court has dismissed Netflix India's plea to reject Dhanush's lawsuit, which accuses Netflix of using unauthorized behind-the-scenes footage from his film Naanum Rowdy Dhaan in the documentary Nayanthara: Beyond the Fairytale.

The Madras High Court has dismissed Netflix India's application to reject a lawsuit filed by actor-producer Dhanush's production company, Wunderbar Films, regarding alleged copyright infringement related to the documentary Nayanthara: Beyond the Fairytale.
Justice Abdul Quddhose ruled against Netflix India&rsquo;s plea and set the hearing for Wunderbar Films' interim injunction application on February 5, 2025.
Dhanush, who produced the film Naanum Rowdy Dhaan, claimed that behind-the-scenes footage from the movie was used in Nayanthara's documentary, produced by Netflix, without proper authorization.
Although Netflix India's office is based in Mumbai, outside the jurisdiction of the Madras High Court, Dhanush had obtained leave to sue the company in the High Court.
Netflix India argued that the plaintiff only sought permission to sue the fifth defendant (Netflix India &ndash; Los Gatos) and not the other defendants, as required by the Copyright Act and Letters Patent Act. The platform also pointed out that a photo featuring Nayanthara and Vignesh Sivan from the movie set was shared on social media in 2020, but Dhanush had not objected until after the documentary's release in 2024.
Netflix further argued that the lawsuit was filed a week after the documentary&rsquo;s release, showing no urgency and failing to justify bypassing the mandatory pre-suit mediation process under Section 12A of the Commercial Courts Act.
However, Senior Advocate PS Raman, representing Dhanush, countered that all materials related to the movie set, including costumes and behind-the-scenes footage, were the intellectual property of the producer. He argued that copyright infringement occurred when this unauthorized footage was used in the documentary.
Raman noted that after the documentary&rsquo;s trailer was released, an email was sent to the defendants asking them to desist from using the footage. However, it was only after the documentary's release that the full extent of the footage usage became clear, prompting the lawsuit.
He also highlighted that Nayanthara had signed a contract stating that her appearance in the film, including costumes and hairstyles, was the copyright of the producer. Therefore, any use of such material without permission was considered a copyright breach.
The court dismissed Netflix India's plea, allowing the case to proceed. The next hearing is set for February 5, 2025, where the court will consider Wunderbar Films' request for an interim injunction.
Earlier, Nayanthara shared an open letter on Instagram criticizing Dhanush for demanding Rs 10 crore in compensation for the use of a few seconds of footage, calling it an all-time low.

Nayanthara issued an apology via an Instagram post with Jai Shri Ram and the Hindu religious symbol Om written on the masthead. She said that the intention behind the film was to uplift and inspire and not cause distress. The actor added that over the last 2 decades, her journey in the industry has been guided by a singular intention- to spread positivity and foster learning from one another.
&lsquo;In our sincere attempt to share a positive message, we may have inadvertently caused hurt. We did not expect the removal of a censored film, previously showcased in theatres, from the OTT platform. In one of the movie scenes, Farhan persuades Annapoorani to try meat, asserting that even Lord Ram had consumed it, emphasizing that eating non-vegetarian food is not a sinful act.
Following this, Ramesh Solanki, the founder of the Hindu IT cell, took to X (formerly Twitter) to voice his disapproval of the film. He also lodged a complaint with the police, leading to the Mumbai Police filing an FIR.
The complaint targeted Nayanthara, Jai, the writer-director Nilesh Krishna, producers Jatin Sethi, R Ravindran, and Punit Goenka, Shariq Patel, the Chief Business Officer of Zee Studios, as well as Monika Shergill, the head of Netflix India.

Atlee&rsquo;s &lsquo;Jawan&rsquo; has been ruling the box office ever since its release and it has become one of the biggest Bollywood movies of all time. It is reported that &lsquo;Jawan&rsquo; has crossed the Rs 350 crore (gross) mark in India in less than a week.
According to industry tracker Sacnilk, &lsquo;Jawan&rsquo; earned Rs 26.50 crore in India on its sixth day. The film&rsquo;s total collection now stands at Rs 345.58 crore (nett).
&lsquo;Jawan&rsquo;, which was released in theatres worldwide on September 7, also stars Shah Rukh Khan and Vijay Sethupathi. Ridhi Dogra and Sanya Malhotra are among many others who play a pivotal role in the film.

In an interview with TV host Dhivyadarshini, the actor also indirectly addressed the comment of Malvika Mohanan on her make-up look in the hospital scene and said, 'There&rsquo;s this interview I saw of another heroine. She didn&rsquo;t take my name but hinted at me. She said that she saw a hospital scene where I was prim and proper with even my hairdo intact. She questioned how can someone be like that in a hospital scene. I am not saying one should be prim and proper in a hospital scene, but that doesn&rsquo;t mean one should be with tousled and unkempt hair. There will be people to take care of you and they obviously tie up your hair.'
She added, 'Also, there&rsquo;s a huge difference when you are doing a realistic film and when you are doing a commercial film. When you are doing a realistic film, you have to go all the way to look the part. But this example was from a commercial film&hellip; I went in with a look but my director told me not to look so sad. It is how they wanted to do the scene. So, when there&rsquo;s a commercial aspect to it, you get as realistic as required.'
In an earlier interview, Malavika said, 'I have seen like this really big superstar actress. She is in one hospital scene and she is almost dying&hellip; and she is in full makeup!'
