A Delhi court on Monday reserved its order on taking cognisance of the chargesheet filed by the Enforcement Directorate in the National Herald case.
Special Judge Vishal Gogne said the matter will be heard on July 29.
The Enforcement Directorate (ED) has accused Sonia Gandhi and Rahul Gandhi, late Congress leaders Motilal Vora and Oscar Fernandes, as well as Suman Dubey, Sam Pitroda and a private company, Young Indian, of conspiracy and money laundering over the fraudulent takeover of Rs 2,000 crore worth properties belonging to Associated Journals Limited (AJL), which published the National Herald newspaper.
ED alleges that Gandhis held the majority 76 per cent shares in Young Indian, which fraudulently usurped the assets of AJL in exchange for a Rs 90 crore loan.
The chargesheet names Sonia Gandhi and Rahul Gandhi, Sam Pitroda, Suman Dubey, Sunil Bhandari, Young Indian and Dotex Merchandise Pvt Ltd.

A Delhi court on Thursday deferred the hearing in the National Herald money laundering case involving Congress leaders Sonia Gandhi and Rahul Gandhi to May 21 and 22.
Special judge Vishal Gogne, after hearing the submissions of the Enforcement Directorate, noted that notices had been served upon all proposed accused persons in terms of its previous order.
The judge, however, said, "Since the notice has purportedly been served upon an alternative email ID upon the proposed accused 4 (Sam Pitroda) only today, it is appropriate that submissions on the aspect of cognisance are heard on the next date of hearing." The judge posted the hearings on May 21 and 22.
"Subramanian Swamy, who is the complainant in the proceedings relating to the predicate offence, has mentioned his presence and submitted that an application for being supplied with a copy of the present complaint and documents shall be moved by him in due course," the court added.
On May 2, the court issued notices to the Gandhis.
It also issued notice to Congress leader Pitroda and Suman Dubey, and "Young Indian", Dotex Merchandise Pvt Ltd and Sunil Bhandari.
The judge said that their "right to be heard" was available at the time of cognisance of the chargesheet.
"Right to be heard at any stage breathes life into fair trial," the judge had previously said.
The chargesheet in the matter was filed under Sections 3 (money laundering) and 4 (punishment for money laundering) of Prevention of Money Laundering Act (PMLA).
The ED, which filed its chargesheet recently, began its probe in 2021 after a magistrate court took cognisance of a private complaint filed by Swamy on June 26, 2014.
The complaint, the ED said, highlighted a "criminal conspiracy" by several prominent political figures, including the first family of the Congress party led by Sonia, her MP son Rahul, late Congress leaders Motilal Vora and Oscar Fernandes aside from Dubey, Pitroda and a private company Young Indian for their alleged involvement in money laundering in relation to the fraudulent takeover of properties valued over Rs 2,000 crore belonging to the Associated Journals Limited.
The Gandhis are majority shareholders of Young Indian, with 38 per cent shares held by each one of them. They were questioned for hours by the ED in this case a few years ago.

The Enforcement Directorate Tuesday said it has attached assets worth Rs 751.9 crore as part of its money laundering investigation against the Congress party-promoted Young Indian that owns the National Herald newspaper.
A provisional order has been issued under the Prevention of Money Laundering Act (PMLA) against the newspaper's publisher Associated Journals Ltd. and its holding company Young Indian, the central probe agency said in a statement.
"Investigation revealed that Associated Journals Ltd. (AJL) is in possession of proceeds of crime in the form of immovable properties spread across many cities of India such as Delhi, Mumbai and Lucknow to the tune of Rs 661.69 crore and Young Indian (YI) is in possession of proceeds of crime to the tune of Rs 90.21 crore in the form of investment in equity shares of AJL," it said in a statement.
The ED had questioned and recorded the statements of Congress' first family Sonia Gandhi, her son Rahul Gandhi and that of president Mallikarjun Kharge in this case.

'Petty vendetta tactics': Congress on seizing National Herald assets

The Congress leader said the action of the Enforcement Directorate was aimed at diverting people's attention in the middle of polls.

&nbsp;After the ED attached assets of the party-promoted National Herald newspaper, the Congress on Tuesday said such "petty vendetta tactics" cannot frighten it and dubbed the probe agency a "coalition partner" of the BJP.
Congress spokesperson Abhishek Singhvi said the property attachment order reflected the BJP's desperation to divert attention from its certain defeat in the ongoing assembly polls in five states.
"No BJP coalition partner - CBI, ED or I-T Department - can prevent the impending defeat of the BJP.... These petty vendetta tactics shall not frighten the Indian National Congress in any way," he said in a statement.
"An assignment of loan without transfer of any immovable property or movement of money is being dressed up to justify attachment and freezing of assets of a company which runs an iconic voice of the Indian independence movement - the National Herald - only because it is linked to the Congress party and its legacy," he said.
The Congress leader said the action of the Enforcement Directorate (ED) was aimed at diverting people's attention in the middle of polls.
"There are no proceeds of crime. Indeed, there is no complainant who claims to have been cheated: not a single one!! This is a prefabricated structure of deceit, lies and falsehood, of, by and for the BJP, to divert, distract and digress in the middle of elections," he said.
In a statement, the ED said a provisional attachment order has been issued by the federal probe agency under the Prevention of Money Laundering Act (PMLA) against Associated Journals Ltd. (AJL) and Young Indian (YI).
The ED said it has issued the order to provisionally attach properties worth Rs 751.9 crore in the money laundering case being investigated by it.
The federal probe agency also alleged in the statement that the shareholders and donors of the Congress were "cheated" by the office-bearers of AJL and the party.

Congress's Rajya Sabha member Vivek Tankha said even a "peaceful satyagraha" is banned in this country.

Ahead of Sonia Gandhi's questioning by the ED, the party alleged that the Delhi Police is preventing the media from entering the AICC headquarters and said this "high-handedness" reflects the mindset of the Narendra Modi government.
"From the early hours of this morning the Delhi Police -- obviously taking orders from the Union Home Minister -- is preventing the media from entering the Congress party headquarters," Ramesh said in another tweet.

The questioning will be conducted keeping in mind Covid protocols and the session will be conducted by the same assistant director-level investigation officer who questioned Rahul Gandhi. The questioning team will also have a woman officer and all of them have obtained 'covid negative' certificates in order to participate in the session, sources said.
The move to question the Gandhis was initiated after the ED late last year registered a fresh case under the criminal provisions of the PMLA after a trial court here took cognisance of an Income tax department probe against Young Indian on the basis of a private criminal complaint filed by BJP MP Subramanian Swamy in 2013.
Sonia and Rahul Gandhi are among the promoters and majority shareholders of Young Indian. Like her son, the Congress president too has 38 per cent shareholding.
Swamy had accused the Gandhis and others of conspiring to cheat and misappropriate funds, with YI paying only Rs 50 lakh to obtain the right to recover Rs 90.25 crore that AJL owed to the Congress.
In February last year, the Delhi High Court issued a notice to the Gandhis for their response on Swamy's plea, seeking to lead evidence in the matter before the trial court.
Congress leaders Mallikarjun Kharge and Pawan Bansal were questioned by the ED in this case in April.
The Congress party has maintained that there has been no wrongdoing and that Young Indian is a "not-for-profit" company established under section 25 of the Companies Act and hence there can be no question of money laundering.
It is understood that Rahul Gandhi, during his deposition before the ED, stuck to the position that there was no personal acquisition of assets by himself or his family as Young Indian was a "not-for-profit" company and that despite he being a majority shareholder various financial decisions taken to revive the National Herald newspaper was taken collectively by senior Congress party leaders.
The ED, sources said, wanted to understand how the loan was extended to AJL by the Congress party and if the provisions of the Companies Act and the anti-money laundering law were contravened in this AJL-Congress-Young Indian deal.
The ED says that assets worth about Rs 800 crore are "owned" by the AJL and it wants to know from the Gandhis how a not-for-profit company like Young Indian was undertaking commercial activities of renting out its land and building assets.
A loan of Rs one crore taken by YI from a Kolkata-based company in February 2011 is also under the scanner of the ED.
The party had said AJL, which was established in 1937, faced huge debts and the Congress, from 2002 to 2011, gave Rs 90 crore to the National Herald newspaper, out of which Rs 66 crore was used to pay salaries/VRS of journalists and staffers who worked there.

The Enforcement Directorate (ED) has asked Congress president Sonia Gandhi to depose before it on July 21 for questioning in the National Herald newspaper-linked money-laundering case, officials said on Monday.
Gandhi was issued a second summons for June 23 by the agency, but the 75-year-old Congress leader could not keep the date as she was "strictly advised to rest at home following her hospitalisation on account of COVID-19 and a lung infection".
Gandhi had sought postponing of the summons by four weeks and hence, she has been asked to depose before the agency on July 21, the officials said.

Gandhi was issued a second summons for June 23 by the agency, but the 75-year-old Congress leader could not keep the date as she was "strictly advised to rest at home following her hospitalisation on account of COVID-19 and a lung infection".
Gandhi had sought postponing of the summons by four weeks and hence, she has been asked to depose before the agency on July 21, the officials said.

Gandhi is being questioned by the Enforcement Directorate (ED) in the National Herald money laundering case and will appear before the agency for the fourth time on Monday.
In a series of tweets on Monday, the Delhi Traffic Police informed commuters about road closures.
Due to special traffic arrangements, inward movement of buses will be restricted in New Delhi beyond Gol Dak Khana Junction, Patel Chowk, Windsor Place, Teen Murti Chowk and Prithviraj Road, it said.
"Kindly avoid Gol Methi junction, Tughlak Road Junction, Claridges Junction, Q-point Junction, Sunehri Masjid Junction, Maulana Azad Road Junction & Man Singh Road Junction between 0800 hrs & 1200 hrs. Due to special arrangements there will be heavy traffic movement on these roads," it added.
The traffic police also advised commuters to avoid Motilal Nehru Marg, Akbar Road, Janpath and Man Singh Road between 8 am and 12 pm.
The ED probe pertains to alleged financial irregularities in the Congress-promoted Young Indian Private Limited, which owns the National Herald newspaper.

Top Congress leaders detained on Monday during the party's protest in solidarity with Rahul Gandhi, who was grilled by the ED in a money-laundering probe linked to the National Herald newspaper, were released from various police stations after almost 11 hours.
Sources said many Congress MPs who were detained for violating CrPC Section 144 were released around 11.30 pm soon after Rahul Gandhi left the Enforcement Directorate office after over 10 hours of questioning.
The MPs who were detained for over 11 hours include Adhir Ranjan Chowdhury, K C Venugopal, Randeep Surjewala and Harish Rawat.
Surjewala had earlier alleged that were kept under "illegal" detention in violation of the law under the Narendra Modi regime. A video showed Chowdhury and Venugopal asking the police to either arrest them or release them immediately.
"We are Members of Parliament. How can you detain us? Arrest us. We are ready to go to the court," Venugopal was heard telling the police in the video.
Chowdhury told the police, "You cannot illegally detain us like this. Either arrest us or release us now." Harish Rawat also put out a video saying they were not released from police detention and have to wait till Rahul Gandhi leaves the ED office. Soon after, the police opened the gates of the Tughlak Road police station, releasing around 10 MPs.
Congress whip in the Lok Sabha Manickam Tagore, in a tweet, said, "We were released at 11.45 pm from Mandir Marg Police Station. If Shah and gang think that they can silence the Congress then it's completely wrong. We will fight back. Our leader is Rahul Gandhi." The Delhi Police on Monday detained 459 Congress workers and senior leaders, including Adhir Ranjan Chowdhury, K C Venugopal and Mallikarjun Kharge, for not following police directions for the maintenance of law and order in the national capital, officials said.
They also said that allegations of manhandling and injuries to protesting Congress leaders during police action will be diligently looked into.
Hundreds of Congress workers in Delhi took to the streets and several senior leaders were detained amid a massive show of strength by the party which had called for a Satyagrah march against the ED's questioning of Rahul Gandhi.
The opposition party alleged that some of its leaders were manhandled by the police. It lashed out at the government for "not allowing" peaceful protests.
Taking to Twitter, senior Congress leader P Chidambaran said, "When three big, burly policemen crash into you, you are lucky to get away with a suspected hairline crack! Doctors have said that if there is a hairline crack, it will heal by itself in about 10 days. I am fine and I will go about my work tomorrow."

"Obviously, they're not following the law &amp; in a democracy, we are entitled to protest... is there any BJP leader against whom the ED has registered a case in the last 4-5 years? Is there any BJP-ruled state where the ED has registered a case?," the Congress leader asked.&nbsp; Chidambaram, who along with party colleagues participated in a protest march as Rahul Gandhi appeared before the ED, said three big, burly policemen crashed into him and he was lucky to get away with a "suspected hairline crack". Hundreds of Congress workers in Delhi and state capitals took to the streets and several senior leaders, including Rajasthan Chief Minister Ashok Gehlot, Chhattisgarh Chief Minister Bhupesh Baghel, Randeep Surjewala and K C Venugopal, were detained here amid a massive show of strength by the party which had called for the Satyagraha march against the ED summons. The ED recently registered a fresh case under the criminal provisions of the PMLA after a trial court took cognisance of an Income Tax Department probe against Young Indian Pvt Ltd based on a private criminal complaint filed by BJP MP Subramanian Swamy in 2013. 
About the ED summons to Rahul Gandhi and Sonia Gandhi and the Congress' decision of a show of strength, Chidambaram said, "I speak as a Congress member and an advocate. The ED's summons to Rahul Gandhi under PMLA (Prevention of Money Laundering Act) is baseless." Pointing out that the offence of money laundering requires 'money' and "laundering of money", the former home minister said in the National Herald debt-to-equity conversion, something which lending banks do on a regular basis, there was no transaction of money.
Therefore, how can there be money laundering, he posed.

The former Congress president left for the ED office from the Congress headquarters on Akbar Road in the morning and was accompanied by party leaders, including Priyanka Gandhi Vadra, Rajasthan Chief Minister Ashok Gehlot, Chhattisgarh Chief Minister Bhupesh Baghel and former Union finance minister P Chidambaram.
Priyanka Gandhi sat with Rahul Gandhi in a vehicle as the convoy of seven SUVs, escorted by armed CRPF personnel, entered the ED office at APJ Abdul Kalam Road.

Ahead of Rahul Gandhi's appearance before the Enforcement Directorate, the Congress on Monday said the Modi government has imposed an "undeclared emergency" in Delhi and alleged that thousands of its workers and leaders have been arrested or placed under house arrest.
Addressing a press conference at the party headquarters, Congress chief spokesperson Randeep Surjewala asked why the Modi government was scared of Rahul Gandhi or the Congress as they only planned to march towards the ED's office when their leader appears before the agency for questioning.
He said the Congress is fighting for the truth, which cannot be suppressed and they will continue with this fight against "injustice".
"The Modi government has imposed an undeclared emergency in Delhi and thousands of barricades have come up and thousands of our Congress workers have been arrested since last night," he told reporters.
"We will answer every question that the 'Election Department', the 'puppet ED' will ask. For, the truth will win in the court of untruth and tyranny," he said.
Surjewala alleged that the "descendants of Godse" are once again challenging Gandhi and his descendants.
"Neither Godse could kill Gandhi nor will his descendants be able to kill his ideology today," he said.
Asking why thousands of policemen have been deployed in central Delhi ahead of Rahul Gandhi's visit to the ED office, he said, "Is there any threat to the Modi government? Why are you so scared?" Surjewala alleged that a "scared and cowardly" Modi government is trying to suppress the voice of the truth.
"We will continue our 'Satyagrah' fearlessly against the undeterred draconian subjugation of civil rights and democracy by the Modi government. We will fight undeterred, we will fight fearlessly and we will fight for the people of the country, the downtrodden and the middle class against all-round inflation and joblessness," he said.

Ahead of Rahul Gandhi's appearance before the Enforcement Directorate, the Congress on Monday said the Modi government has imposed an "undeclared emergency" in Delhi and alleged that thousands of its workers and leaders have been arrested or placed under house arrest.
Addressing a press conference at the party headquarters, Congress chief spokesperson Randeep Surjewala asked why the Modi government was scared of Rahul Gandhi or the Congress as they only planned to march towards the ED's office when their leader appears before the agency for questioning.
He said the Congress is fighting for the truth, which cannot be suppressed and they will continue with this fight against "injustice".
"The Modi government has imposed an undeclared emergency in Delhi and thousands of barricades have come up and thousands of our Congress workers have been arrested since last night," he told reporters.
"We will answer every question that the 'Election Department', the 'puppet ED' will ask. For, the truth will win in the court of untruth and tyranny," he said.
Surjewala alleged that the "descendants of Godse" are once again challenging Gandhi and his descendants.
"Neither Godse could kill Gandhi nor will his descendants be able to kill his ideology today," he said.

Asking why thousands of policemen have been deployed in central Delhi ahead of Rahul Gandhi's visit to the ED office, he said, "Is there any threat to the Modi government? Why are you so scared?" Surjewala alleged that a "scared and cowardly" Modi government is trying to suppress the voice of the truth.
"We will continue our 'Satyagrah' fearlessly against the undeterred draconian subjugation of civil rights and democracy by the Modi government. We will fight undeterred, we will fight fearlessly and we will fight for the people of the country, the downtrodden and the middle class against all-round inflation and joblessness," he said.

 Perhaps it was this thought, that pushed our first prime minister Jawahar Lal Nehru to launch the Associated Journals ten years before India attained freedom at midnight.
A year later, the Associated Journals, which was a public limited company, published National Herald newspaper for the first time.
From chronicling India&rsquo;s independence movement to facing accusations of being a Congress mouthpiece, the publication shut shop in 2008 when the United Progressive Alliance was in power.
Two years later, the Congress in a bid to revive the defunct newspaper formed a not-for-profit company, called the Young India Ltd with UPA chief Sonia Gandhi and her son Rahul Gandhi owning the majority share.
The ostensible reason for setting up the new public company being the revival of the National Herald, the Congress argued that the resurrection was needed as the publication had played a significant role in the freedom movement.
So how did the Congress plan the revival of National Herald and why are the probe agencies calling it a scam.
Over a period of time, the grand old party had loaned Rupees 90 crore to the Associated Journals&mdash;just for a recap the entity Nehru founded to launch National Herald and Qaumi Awaz.
After its creation in 2010, the Congress transferred this loan to Young India Ltd-- recall Sonia and Rahul own majority share of this company.
As the Associated Journal was a ship at the bottom of a tumultuous sea, unsurprisingly it could not pay the debt. The public company formed before the independence could only manage to transfer just Rupees 50 lakh to Sonia and Rahul&rsquo;s Young India ltd. But like the antiques hidden in a sunk ship are of great value, so were the Associated Journal&rsquo;s prime properties valuing over Rupees 2,000 crores in Delhi, Lucknow and Patna.
Young India ltd took over these assets, therefore Congress took over assets of the defunct firm which was a public limited company. Simply put the Enforcement Directorate argues that Congress shifted assets of a company owned by Indian public to Rahul and Sonia.
So how did the issue reach the court?
In 2012, BJP leader Subramanian Swamy filed a private complaint alleging fraud in the acquisition. The BJP leader said the loan given by Congress to Associated Journals was &lsquo;illegal&rsquo; as it was taken from party funds and the Income Tax Act prohibits political organisations from making financial transactions with a third party.
Even the Associated Journal shareholders, who were the descendants of freedom fighters, including former law minister Shanti Bhusan and former high court chief justice Markandey Katju alleged that they had no clue, neither were sent notice when Young India acquired Associated Journal.
A case was then registered and an inquiry opened up against Sonia Gandhi, her son Rahul Gandhi, their trusted aide Moti Lal Vohra, Suman Dubey, Sam Pitroda, Suman Dubey and Oscar Fernandes.
However, the Congress too has a defence.
The grand old party maintains that the Young India was formed with the &lsquo;aim of charity&rsquo; and not for profit and that its transactions were not financial but &lsquo;commercial&rsquo; in nature.

In an interview with PTI, senior Congress leader P Chidambaram asserted the summons to the former party chief was "baseless" and said it appears that the ED's jurisdiction does not extend to the BJP members or to states ruled by it.
About the ED summons to Rahul Gandhi and Sonia Gandhi and the Congress' decision of a show of strength when the former appears before the probe agency on Monday, Chidambaram said, "I speak as a Congress member and an advocate. The ED's summons to Rahul Gandhi under PMLA (Prevention of Money Laundering Act) is baseless."
Pointing out that the offence of money laundering requires 'money' and "laundering of money", the former home minister said in the National Herald debt-to-equity conversion, something which lending banks do on a regular basis, there was no transaction of money.
Therefore, how can there be money laundering, he posed.
"It is like accusing a person of purse snatching when there was no purse and no snatching," Chidambaram argued.

The Congress on Sunday held a series of press conferences -- Sachin Pilot in Lucknow, Vivek Tankha in Raipur, Digvijaya Singh in Bhopal, Sanjay Nirupam in Shimla, Ranjeet Ranjan in Chandigarh, Pawan Khera in Ahmedabad and Alka Lamba in Dehradun -- to express solidarity with Rahul Gandhi and accuse the BJP of indulging in vendetta politics.
Congress veteran Digvijaya Singh said, "No FIR has been registered so far in this case. There is no proof... This is an effort to put political pressure on Sonia Gandhi and Rahul Gandhi." "This is politics of putting pressure. It has become the habit of the current regime to frame false cases for political vendetta," he alleged.
Congress leader and Rajya Sabha MP Ranjeet Ranjan alleged that the ED summonses were part of the BJP-led Centre's "tactic to muzzle the voice of the opposition and divert public attention from issues like inflation, unemployment and the deteriorating security situation in Kashmir".
Congress spokesperson Pawan Khera claimed that the BJP fears Rahul Gandhi as he has the courage to ask questions.
"You can't suppress Rahul Gandhi anywhere, that's why you are trying to tarnish the image of Rahul Gandhi," he said at a press conference in Ahmedabad.
In Shimla, Congress spokesperson Sanjay Nirupam accused the Narendra Modi government of "misusing" the CBI, ED and other central agencies to harass its political opponents.
The Congress also put out a series of tweets using the hashtag "BJP Vendetta Exposed".
"When the truth begins to come out, so does the ED. But the truth can't stay hidden for long because we will always fight for it," the party said.
In another tweet, it said India is raising its voice against the "hate instigated by the BJP".
"Now the ED has come in to silence this voice. But our voice against hate cannot be quelled. The fight goes on." When the "caretaker" of the country failed in his duty to protect the integrity of its borders, it sent in the ED to cover its failures, the Congress alleged. "But we will not allow the security of our country to be at risk." In another tweet, it said, the farmers of India won against the "tyrannical government" and Rahul Gandhi supported them from the start. "Now the ED is here, trying to suppress the voice that stood with them." One man has fought for justice for thousands of victims of the "insensitivity of the government", the Congress said.
The ED can't stop Rahul Gandhi from fighting for justice, it said, adding that he "won’t back down".
