The BJP accused the Congress of spreading misleading claims over the trial court order in the National Herald case, asserting that proceedings remain pending and the ED can continue its investigation.

The BJP on Wednesday accused the Congress of running misleading propaganda over the trial court's decision in the National Herald case and said the court refused to take cognisance of the complaint but did not set aside the case.
The case is still pending trial in the Delhi High Court, and the trial court in its order on Tuesday said that the Enforcement Directorate (ED) can continue its investigation, BJP national spokesperson Gaurav Bhatia asserted.
"The court yesterday (Tuesday) said that since it is a private complaint and no FIR has been lodged, it will not take cognisance of it. It's a technical matter. The court also said that ED can continue its investigation further. The court did not set it aside," Bhatia told a press conference at the BJP headquarters in Delhi.

"Its (National Herald) trial is still going on. Sonia Gandhi is still Accused Number-1 and Rahul Gandhi Accused Number-2," the BJP spokesperson said, alleging, "The Gandhi family thrives on deceit, deception, and propaganda."
The BJP spokesperson also lashed out at the Congress over its leader Pawan Khera accusing the "gangs of Gandhinagar" of misusing central probe agencies, and demanded an apology from him and the opposition party president Mallikarjun Kharge for such remarks.
"Every Indian, especially those in Gandhinagar, is pained by his remarks. What kind of language is this? If we were to respond in their language, the people of India call them 'dacoits of Italy'. These people come to plunder India. Without becoming a citizen, they try to cast a vote and insult Gandhinagar's honest, hardworking and patriotic people," Bhatia said.
Hitting out at the government on Tuesday, Khera said that the trial court order exposed how the "gangs of Gandhinagar" are misusing the central ED, CBI, Income Tax department and Election Commission like a "private army."
"I won't use the word government. I won't use the word prime minister. I won't say home minister. Pardon me, I will say gangs of Gandhinagar," the Congress head of the media and publicity department had told the reporters.
Bhatia also dismissed the Congress's allegation of "political vendetta" and said the National Herald case against the Gandhis was born out of a private complaint, and neither the High Court nor the Supreme Court quashed the proceedings in the matter when Sonia and Rahul Gandhi approached the courts seeking relief.
The BJP spokesperson alleged that the Gandhi family is the "most corrupt family" in politics across the world and said, "They are out on bail but still accused in the case."
Bhatia said that if anybody feels that an investigation agency is acting contrary to the law and there is a case of political vendetta, they are free to move the High Court or the Supreme Court.
He said that 14 parties had earlier moved the Supreme Court alleging that central agencies were acting contrary to the law, however, the petition was dismissed by the top court.
But the Congress hailing the trial court's order shows its "double standards," he charged.
"Today they are appreciating the judiciary just like they felt about the Election Commission when the poll results in Telangana, Karnataka and Himachal Pradesh came in their favour. When the poll results did not come in their favour in Haryana, Maharashtra and Delhi, the Election Commission became bad for them," Bhatia said.
Such double standards show the Congress has become "hollow from inside", he said.
"Since the trial in the National Herald case is yet to be over, I hope the Congress and its leaders will express similar faith in the judiciary when accused persons in the case are sentenced to seven years of imprisonment, which is possible," Bhatia added.

"We are fighting politically. We will keep fighting them, both inside and outside Parliament, and also on the streets and will teach them a lesson," party president Mallikarjun Kharge said at a press conference.
In a relief to Sonia Gandhi, Rahul Gandhi and five others, a Delhi court on Tuesday refused to take cognisance of the Enforcement Directorate's money laundering charge against them in the National Herald case, holding that the agency's probe stemmed from a private complaint and not an FIR.
"I want to say that after this judgement Modi and Shah should resign because the court decision is like a slap on their face. They should give resignation as they should not harass people like this," Kharge said at the press conference, which he addressed with party leaders K C Venugopal, Abhishek Singhvi, Jairam Ramesh, and Pawan Khera.
"They should know that if they do such things people will not tolerate it and will not sit quiet, and they will face insult from people," he said.
Kharge said the Congress has been fighting the issue politically by taking out marches since its top leadership was summoned by the probe agencies. "We have been fighting on the streets, in Parliament, outside it, and will continue to do it and teach them a lesson," he said, while welcoming the court verdict and thanking party workers.
He also said that for over past 11 years, there have been more than 50 such key opposition leaders whom the Modi government has made full efforts to intimidate and blackmail by misusing the ED, CBI, and IT. Kharge claimed the National Herald newspaper was started in 1938 and its motto is "Freedom is in Peril, Defend it with All Your Might."
The December 16 court ruling has completely exposed the false allegations, conspiracy, and vengeful intent levelled by the Modi government against the leaders of his party, he said.
Venugopal asserted that the Congress will expose the "vendetta politics" of the Modi government. The entire Congress cadre is agitated and will show its strength all over India against the "misuse of agencies," he said.
"We will expose this vendetta politics on the streets of the country. The entire nation is now agitating. For the past seven years, the Congress party has faced continuous harassment by the ED. Our senior and supreme leadership is being targeted through vendetta politics, and this has agitated every karyakarta.
"We will demonstrate our strength across India. Because this is clearly an example of how ED is systematically misused by the central government to target the opposition leaders," Venugopal said, when asked about the party's further action in the matter.
Singhvi said the law has spoken louder than noise, and termed the National Herald case a story of political vendetta and harassment.
"Today, the law has spoken louder than noise and fiction. They made a money-laundering mansion on the quicksand of an absent, elusive FIR. There is no FIR. Investigative overreach has met judicial oversight. Courts are not theatres for political scripts.
"Events that had happened much before 2014 led to a private complaint by Subramanian Swamy-with a summoning order in 2014. From 2014 to 2021 - seven long years - there are written opinions sought and given by CBI and ED, mentioning that no predicate offence was made out. Obviously, that's why after 2014, they never filed an official complaint," he noted.
Suddenly, he said, a few days before June 30, 2021, "Command comes from the skies - which you can guess where it came from - to register an ECIR." From 2021 to 2025, Sonia Gandhi, Rahul Gandhi, Mallikarjun Kharge, and many others, have been interrogated for almost 90 hours, "only to harass them, and to embarrass them, and to create a climate against them," Singhvi said.
The party leader said that on October 3, 2025, a new FIR came because "they" want to keep the pot boiling.
"Today's order is a reminder that criminal law is not a political press release. You cannot weaponise the PMLA and then plead ignorance of a condition of the law itself. This case has always been long on rhetoric and short on legs.
"This is the first one-trick wonder of its kind in PMLA, where they say there is allegedly money laundering, but not one paisa has moved an inch, nor has one property moved one foot," Singhvi said.
Delivering his order in a case that has been marked by a political slugfest and legal battles for several years, Special Judge Vishal Gogne said the cognisance of the ED's prosecution complaint relating to the offence of money laundering was "impermissible in law."
The ED complaint was based on an investigation into a complaint by a private person, Subramanian Swamy, and not on an FIR of a predicate offence, the judge said.

In a statement, Congress spokesperson Supriya Shrinate said the ED's proceedings against Congress leadership -- Sonia Gandhi and Rahul Gandhi -- in the case have been found to be "completely illegal and mala fide" by the court.
"The mala fide and illegality of the Modi government stands fully exposed. The court has ruled that the ED case is without jurisdiction; it has no FIR, without which there is no case. This politically motivated prosecution by the Modi government over the last decade of the principal opposition party stands exposed before the people of India," she said.
"No case of money laundering, no proceeds of crime and no movement of property; all baseless charges that have been a part of a political witch hunt, propaganda, reputation assassination and campaign which stands defeated today," Shrinate said.
She said the Congress party and its leadership are committed to fighting for the truth and for the rights of every Indian. "We cannot, and will not ever be intimidated, because we fight for the truth," she added.
Party general secretary K C Venugopal said, "Through this judgment, the court has exposed the illegal and mala fide political targeting by the Narendra Modi government."
"From day one, the opposition, especially Sonia Gandhi and Rahul Gandhi, has been targeted without any legal basis or wrongdoing. This judgment clearly vindicates our stand," he added.
Refusing to take cognisance of the federal probe agency's money laundering charge against Congress leaders Rahul Gandhi, Sonia Gandhi, and five others in the National Herald case, the court noted that the chargesheet filed is based on a probe into a complaint by a private person and not on an FIR of a predicate offence.
Its cognisance is impermissible in law, the judge said.
Reading out the operative part from the order, the judge said the Delhi Police's Economic Offences Wing has already lodged an FIR in the case, and hence it will be premature to adjudicate on ED's arguments in the case based on merits.

The judge, however, said, "Since the notice has purportedly been served upon an alternative email ID upon the proposed accused 4 (Sam Pitroda) only today, it is appropriate that submissions on the aspect of cognisance are heard on the next date of hearing." The judge posted the hearings on May 21 and 22.
"Subramanian Swamy, who is the complainant in the proceedings relating to the predicate offence, has mentioned his presence and submitted that an application for being supplied with a copy of the present complaint and documents shall be moved by him in due course," the court added.
On May 2, the court issued notices to the Gandhis.
It also issued notice to Congress leader Pitroda and Suman Dubey, and "Young Indian", Dotex Merchandise Pvt Ltd and Sunil Bhandari.
The judge said that their "right to be heard" was available at the time of cognisance of the chargesheet.
"Right to be heard at any stage breathes life into fair trial," the judge had previously said.
The chargesheet in the matter was filed under Sections 3 (money laundering) and 4 (punishment for money laundering) of Prevention of Money Laundering Act (PMLA).
The ED, which filed its chargesheet recently, began its probe in 2021 after a magistrate court took cognisance of a private complaint filed by Swamy on June 26, 2014.
The complaint, the ED said, highlighted a "criminal conspiracy" by several prominent political figures, including the first family of the Congress party led by Sonia, her MP son Rahul, late Congress leaders Motilal Vora and Oscar Fernandes aside from Dubey, Pitroda and a private company Young Indian for their alleged involvement in money laundering in relation to the fraudulent takeover of properties valued over Rs 2,000 crore belonging to the Associated Journals Limited.
The Gandhis are majority shareholders of Young Indian, with 38 per cent shares held by each one of them. They were questioned for hours by the ED in this case a few years ago.

A provisional order has been issued under the Prevention of Money Laundering Act (PMLA) against the newspaper's publisher Associated Journals Ltd. and its holding company Young Indian, the central probe agency said in a statement.
"Investigation revealed that Associated Journals Ltd. (AJL) is in possession of proceeds of crime in the form of immovable properties spread across many cities of India such as Delhi, Mumbai and Lucknow to the tune of Rs 661.69 crore and Young Indian (YI) is in possession of proceeds of crime to the tune of Rs 90.21 crore in the form of investment in equity shares of AJL," it said in a statement.
The ED had questioned and recorded the statements of Congress' first family Sonia Gandhi, her son Rahul Gandhi and that of president Mallikarjun Kharge in this case.

'Petty vendetta tactics': Congress on seizing National Herald assets

The Congress leader said the action of the Enforcement Directorate was aimed at diverting people's attention in the middle of polls.

&nbsp;After the ED attached assets of the party-promoted National Herald newspaper, the Congress on Tuesday said such "petty vendetta tactics" cannot frighten it and dubbed the probe agency a "coalition partner" of the BJP.
Congress spokesperson Abhishek Singhvi said the property attachment order reflected the BJP's desperation to divert attention from its certain defeat in the ongoing assembly polls in five states.
"No BJP coalition partner - CBI, ED or I-T Department - can prevent the impending defeat of the BJP.... These petty vendetta tactics shall not frighten the Indian National Congress in any way," he said in a statement.
"An assignment of loan without transfer of any immovable property or movement of money is being dressed up to justify attachment and freezing of assets of a company which runs an iconic voice of the Indian independence movement - the National Herald - only because it is linked to the Congress party and its legacy," he said.
The Congress leader said the action of the Enforcement Directorate (ED) was aimed at diverting people's attention in the middle of polls.
"There are no proceeds of crime. Indeed, there is no complainant who claims to have been cheated: not a single one!! This is a prefabricated structure of deceit, lies and falsehood, of, by and for the BJP, to divert, distract and digress in the middle of elections," he said.
In a statement, the ED said a provisional attachment order has been issued by the federal probe agency under the Prevention of Money Laundering Act (PMLA) against Associated Journals Ltd. (AJL) and Young Indian (YI).
The ED said it has issued the order to provisionally attach properties worth Rs 751.9 crore in the money laundering case being investigated by it.
The federal probe agency also alleged in the statement that the shareholders and donors of the Congress were "cheated" by the office-bearers of AJL and the party.
"Investigation revealed that Associated Journals Ltd. (AJL) is in possession of proceeds of crime in the form of immovable properties spread across many cities of India such as Delhi, Mumbai and Lucknow to the tune of Rs. 661.69 crore and Young Indian (YI) is in possession of proceeds of crime to the tune of Rs. 90.21 crore in the form of investment in equity shares of AJL," it said.

Congress's Rajya Sabha member Vivek Tankha said even a "peaceful satyagraha" is banned in this country.

Ahead of Sonia Gandhi's questioning by the ED, the party alleged that the Delhi Police is preventing the media from entering the AICC headquarters and said this "high-handedness" reflects the mindset of the Narendra Modi government.
"From the early hours of this morning the Delhi Police -- obviously taking orders from the Union Home Minister -- is preventing the media from entering the Congress party headquarters," Ramesh said in another tweet.
"This high-handedness was only to be expected and reflects the mindset of the Modi Sarkar," he added.
Ramesh had said on Wednesday that the Congress will stage demonstrations across the country in "a most telling manner" against what he described as political vendetta.
When Rahul Gandhi was questioned by the ED, the police had made elaborate arrangements. A large number of Congress leaders were detained, taken to far-away locations and released only at midnight.

The agency, according to sources, will give her an option to either write down or dictate her answers to an ED staffer over computer, who will be present along with the investigating officer of the case.

Her son and Congress MP Rahul Gandhi has been questioned by the agency in the case for over 50 hours in sessions spread across five days last month.
The questioning will be conducted keeping in mind Covid protocols and the session will be conducted by the same assistant director-level investigation officer who questioned Rahul Gandhi. The questioning team will also have a woman officer and all of them have obtained 'covid negative' certificates in order to participate in the session, sources said.
The move to question the Gandhis was initiated after the ED late last year registered a fresh case under the criminal provisions of the PMLA after a trial court here took cognisance of an Income tax department probe against Young Indian on the basis of a private criminal complaint filed by BJP MP Subramanian Swamy in 2013.
Sonia and Rahul Gandhi are among the promoters and majority shareholders of Young Indian. Like her son, the Congress president too has 38 per cent shareholding.
Swamy had accused the Gandhis and others of conspiring to cheat and misappropriate funds, with YI paying only Rs 50 lakh to obtain the right to recover Rs 90.25 crore that AJL owed to the Congress.
In February last year, the Delhi High Court issued a notice to the Gandhis for their response on Swamy's plea, seeking to lead evidence in the matter before the trial court.
Congress leaders Mallikarjun Kharge and Pawan Bansal were questioned by the ED in this case in April.
The Congress party has maintained that there has been no wrongdoing and that Young Indian is a "not-for-profit" company established under section 25 of the Companies Act and hence there can be no question of money laundering.
It is understood that Rahul Gandhi, during his deposition before the ED, stuck to the position that there was no personal acquisition of assets by himself or his family as Young Indian was a "not-for-profit" company and that despite he being a majority shareholder various financial decisions taken to revive the National Herald newspaper was taken collectively by senior Congress party leaders.
The ED, sources said, wanted to understand how the loan was extended to AJL by the Congress party and if the provisions of the Companies Act and the anti-money laundering law were contravened in this AJL-Congress-Young Indian deal.
The ED says that assets worth about Rs 800 crore are "owned" by the AJL and it wants to know from the Gandhis how a not-for-profit company like Young Indian was undertaking commercial activities of renting out its land and building assets.
A loan of Rs one crore taken by YI from a Kolkata-based company in February 2011 is also under the scanner of the ED.
The party had said AJL, which was established in 1937, faced huge debts and the Congress, from 2002 to 2011, gave Rs 90 crore to the National Herald newspaper, out of which Rs 66 crore was used to pay salaries/VRS of journalists and staffers who worked there.

"Kindly avoid Gol Methi junction, Tughlak Road Junction, Claridges Junction, Q-point Junction, Sunehri Masjid Junction, Maulana Azad Road Junction & Man Singh Road Junction between 0800 hrs & 1200 hrs. Due to special arrangements there will be heavy traffic movement on these roads," it added.
The traffic police also advised commuters to avoid Motilal Nehru Marg, Akbar Road, Janpath and Man Singh Road between 8 am and 12 pm.

Rahul&nbsp;Gandhi is being interrogated by the Enforcement Directorate for a second day in an alleged money laundering case related to the National Herald Newspaper.&nbsp;

Several Congress leaders including&nbsp;Adhir&nbsp;Ranjan&nbsp;Chowdhury, KC Venugopal&nbsp;and Gaurav&nbsp;Gogoi&nbsp;were taken into police custody as they along with hundreds of party workers rallied behind Rahul&nbsp;Gandhi for a second consecutive day.&nbsp;

Congress leader Rahul Gandhi appeared before the ED on Tuesday for the second consecutive day of questioning in the National Herald money-laundering case.
Gandhi (51) arrived at the Enforcement Directorate (ED) headquarters on APJ Abdul Kalam Road in central Delhi with his "Z+" category CRPF security escort even as police personnel were deployed in huge numbers and section 144 of the Code of Criminal Procedure (CrPC) was imposed around the agency's office just like Monday.
Gandhi was accompanied by his sister and Congress general secretary Priyanka Gandhi Vadra.
The Congress MP from Wayanad spent over 10 hours at the federal agency's office on Monday, where he was questioned over multiple sessions and his statement recorded under the Prevention of Money Laundering Act (PMLA).
Officials said as Gandhi's questioning could not be completed on Monday, he was summoned again on Tuesday.
While agency sources informed that Gandhi recorded his statement and checked its transcript minutely, Congress leaders said the investigators took multiple breaks during his questioning.
The probe pertains to alleged financial irregularities in the Congress-promoted Young Indian Private Limited, which owns the National Herald newspaper.
The newspaper is published by Associated Journals Limited (AJL) and owned by Young Indian Private Limited.
Gandhi's mother and Congress president Sonia Gandhi, who is currently admitted to a hospital here due to Covid-related issues, has also been summoned by the agency for questioning in the case on June 23.
The Congress has accused the Centre of targeting opposition leaders by misusing investigative agencies.

Top Congress leaders detained on Monday during the party's protest in solidarity with Rahul Gandhi, who was grilled by the ED in a money-laundering probe linked to the National Herald newspaper, were released from various police stations after almost 11 hours.
Sources said many Congress MPs who were detained for violating CrPC Section 144 were released around 11.30 pm soon after Rahul Gandhi left the Enforcement Directorate office after over 10 hours of questioning.
The MPs who were detained for over 11 hours include Adhir Ranjan Chowdhury, K C Venugopal, Randeep Surjewala and Harish Rawat.
Surjewala had earlier alleged that were kept under "illegal" detention in violation of the law under the Narendra Modi regime. A video showed Chowdhury and Venugopal asking the police to either arrest them or release them immediately.
"We are Members of Parliament. How can you detain us? Arrest us. We are ready to go to the court," Venugopal was heard telling the police in the video.
Chowdhury told the police, "You cannot illegally detain us like this. Either arrest us or release us now." Harish Rawat also put out a video saying they were not released from police detention and have to wait till Rahul Gandhi leaves the ED office. Soon after, the police opened the gates of the Tughlak Road police station, releasing around 10 MPs.
Congress whip in the Lok Sabha Manickam Tagore, in a tweet, said, "We were released at 11.45 pm from Mandir Marg Police Station. If Shah and gang think that they can silence the Congress then it's completely wrong. We will fight back. Our leader is Rahul Gandhi." The Delhi Police on Monday detained 459 Congress workers and senior leaders, including Adhir Ranjan Chowdhury, K C Venugopal and Mallikarjun Kharge, for not following police directions for the maintenance of law and order in the national capital, officials said.
They also said that allegations of manhandling and injuries to protesting Congress leaders during police action will be diligently looked into.
Hundreds of Congress workers in Delhi took to the streets and several senior leaders were detained amid a massive show of strength by the party which had called for a Satyagrah march against the ED's questioning of Rahul Gandhi.
The opposition party alleged that some of its leaders were manhandled by the police. It lashed out at the government for "not allowing" peaceful protests.
Taking to Twitter, senior Congress leader P Chidambaran said, "When three big, burly policemen crash into you, you are lucky to get away with a suspected hairline crack! Doctors have said that if there is a hairline crack, it will heal by itself in about 10 days. I am fine and I will go about my work tomorrow."

The opposition party alleged that some of its leaders were manhandled by the police. It lashed out at the government for "not allowing" peaceful protests.

As Rahul&nbsp;Gandhi appeared before the Enforcement Directorate for the second straight day on Tuesday, his party colleague P Chidambaram&nbsp;spoke about the National Herald case being probed by the central probe agency. The former finance minister accused the ED of not following the law, saying why the probe agency which reports to the home ministry was not filing cases against BJP&nbsp;leaders or the states in which the saffron party is ruling. "Obviously, they're not following the law &amp; in a democracy, we are entitled to protest... is there any BJP leader against whom the ED has registered a case in the last 4-5 years? Is there any BJP-ruled state where the ED has registered a case?," the Congress leader asked.&nbsp; Chidambaram, who along with party colleagues participated in a protest march as Rahul Gandhi appeared before the ED, said three big, burly policemen crashed into him and he was lucky to get away with a "suspected hairline crack". Hundreds of Congress workers in Delhi and state capitals took to the streets and several senior leaders, including Rajasthan Chief Minister Ashok Gehlot, Chhattisgarh Chief Minister Bhupesh Baghel, Randeep Surjewala and K C Venugopal, were detained here amid a massive show of strength by the party which had called for the Satyagraha march against the ED summons. The ED recently registered a fresh case under the criminal provisions of the PMLA after a trial court took cognisance of an Income Tax Department probe against Young Indian Pvt Ltd based on a private criminal complaint filed by BJP MP Subramanian Swamy in 2013. 
About the ED summons to Rahul Gandhi and Sonia Gandhi and the Congress' decision of a show of strength, Chidambaram said, "I speak as a Congress member and an advocate. The ED's summons to Rahul Gandhi under PMLA (Prevention of Money Laundering Act) is baseless." Pointing out that the offence of money laundering requires 'money' and "laundering of money", the former home minister said in the National Herald debt-to-equity conversion, something which lending banks do on a regular basis, there was no transaction of money.
Therefore, how can there be money laundering, he posed.

Congress leader Rahul Gandhi is back in Enforcement Directorate office for a second round of questioning in the National Herald case. Earlier in the day, he was interrogated for over 2.5 hours by the agency. 
According to media reports, Rahul Gandhi has also given a written statement under the money laundering act. 
The former Congress president left for the ED office from the Congress headquarters on Akbar Road in the morning and was accompanied by party leaders, including Priyanka Gandhi Vadra, Rajasthan Chief Minister Ashok Gehlot, Chhattisgarh Chief Minister Bhupesh Baghel and former Union finance minister P Chidambaram.
Priyanka Gandhi sat with Rahul Gandhi in a vehicle as the convoy of seven SUVs, escorted by armed CRPF personnel, entered the ED office at APJ Abdul Kalam Road.
Rahul Gandhi, 51, is a Z+ category protectee of the CRPF after the Union government withdrew the Gandhi family's SPG cover in 2019.
The investigating officer of the case, an assistant director-rank officer of the ED, is understood to have put possible questions about the incorporation of the Young Indian company, the operations of the National Herald, the loan given by the Congress party to AJL and the funds transfer within the news media establishment.
The probe pertains to alleged financial irregularities in the party-promoted Young Indian that owns the National Herald newspaper.
The National Herald is published by the Associated Journals Limited (AJL) and owned by Young Indian Pvt Limited.
