A Thane court sentenced a man for kidnapping a minor but acquitted him of rape due to lack of evidence. The case reveals the legal intricacies of proving sexual assault against minors.

A court in Maharashtra&rsquo;s Thane district has convicted a 47-year-old man for kidnapping a minor girl and sentenced him to 7 years in jail.
Additional Sessions Judge (Kalyan) P R Ashturkar, however, dropped rape charges pressed against Deepak, alias Ganesh Bhanudas Bhuktar, citing lack of evidence.
A copy of the order passed on April 8 was made available on Friday.
Ambernath resident Bhuktar was booked in March 2018 after being accused of kidnapping the 13-year-old girl and taking her to Chhatrapati Sambhajinagar, then Aurangabad.
Judge Ashturkar held that the minor&rsquo;s lack of consent or resistance was irrelevant in a kidnapping case. The court also said that Bhuktar had secretly given her a phone, which was &ldquo;indicative of malicious intent&rdquo;.
The kidnapping charge has been proved beyond reasonable doubt, the court held.
However, the court found the rape allegations lacked specific and clear evidence. It said the girl and her mother failed to provide any specific details regarding the alleged sexual assault, including date, time, or place.
Furthermore, the medical evidence did not support forceful sexual assault, the court said, acquitting Bhuktar of rape charges under the Indian Penal Code (IP) and Protection of Children From Sexual Offences (POCSO) Act.
The court then convicted Bhuktar of kidnapping and sentenced him to seven years in jail and imposed a fine of Rs 3,000 on him.
Additional Public Prosecutor Sachin Kulkarni said six prosecution witnesses, including the teenager and her mother, were examined during the trial.

Minor sodomised by 8 boys in UP school hostel

Eight students have been suspended by authorities and the victim was sent for medical examination.&nbsp;

A minor boy of the Navodaya Vidyalaya was allegedly sodomised after being beaten up by eight students of the school hostel in Uttar Pradesh's Shamli district, police said on Thursday.
The victim's family lodged a police complaint on Wednesday alleging that he was sodomised by eight boys in the hostel who beat him up and threatened him with dire consequences on August 17.
They had allegedly sodomised the minor on July 25 as well and the police are investigating the matter.
Shamli Superintendent of Police Abhishek told reporters that a case had been registered against the eight juveniles on the complaint of the victim's family and the victim sent for medical examination.
Meanwhile, the eight accused have been suspended for 15 days and an inquiry has been ordered into the incident by the school management.

Following the incident, all three accused were absconding. While Bobby and Pawan were arrested on Aug 26, Ali was nabbed on August 31.

Delhi Police nabbed the man who shot a 16-year-old girl in Sangam Vihar area of the national capital on August 25. The accused, identified as Amanat Ali, was apparently irked after the girl cut off all communication with him.&nbsp;
According to the police, the accused had plotted to kill the girl along with his two associates Bobby and Pawan. On the day of the incident, the trio chased the girl who was returning from her school and opened fire. The girl was later rushed to a hospital with a single shot injury. She is said to be out of danger.&nbsp;
According to police, the accused had befriended the girl through social media two years ago, but stopped talking to him around 6 months ago.&nbsp;
Following the incident, all three accused were absconding. While Bobby and Pawan were arrested on Aug 26, Ali was nabbed on August 31.&nbsp;

Assam government will withdraw one lakh minor cases, including those filed for social media posts, to reduce the burden on the lower judiciary, announced Chief Minister Himanta Biswa Sarma on Monday.

Speaking at an Independence Day event, Sarma said there are about four lakh cases pending in the lower judiciary.

Speaking at a flag hoisting ceremony held in Guwahati to mark the 76th Independence Day, Sarma said there are about four lakh cases pending in the lower judiciary.
He said the government has decided that minor cases registered before midnight of August 14, 2021, will be withdrawn, adding that this will enable the judiciary to focus on more heinous crimes such as rapes and murders.
In an apparent message to militant groups ULFA(I) and NSCN who called for a 'boycott'' of Independence Day celebrations and 'total shutdown' in Assam and other Northeastern states,&nbsp; Sarma asserted that Assam is an integral part of India and that those who are still dreaming of "sovereignty" should return to the discussion table.
The mass participation in the 'Har Ghar Tiranga' programme in the state since Saturday has brought to fore the patriotic feeling that is inherent in each person's heart, the chief minister said.

The girl had gone to a male friend's house for his birthday, when the two were photographed together by another boy. He then blackmailed the girl by saying that he would show the photograph to her parents. The blackmailer asked the girl to visit his house.
When she did so on 1 July, she was allegedly raped by 3 boys, and they made a video of the crime. When the boys started sharing the video, the girl confided in her mother, and police were informed.
The accused have been arrested, booked under the POCSO (Protection of Children from Sexual Offences) Act, and sent to an observation home since they're minors. A fourth boy has been booked for allegedly stalking the victim.

According to reports, visuals were made public by BJP MLA Raghunandan Rao, who alleges the presence of an AIMIM MLA's son in the car with the survivor. The police have so far refuted his claim. 
The minor was raped in the Jubilee Hills area of Hyderabad on May 28 and a complaint was registered by her father on May 31 in the case.

According to reports the man escaped after the attack and the police are yet to nab him.

Forcibly kissing someone on the lips, and touching private parts are not unnatural offences under Section 377 of the Indian Penal Code. The Bombay High Court reportedly said this while granting bail to a man accused of sexually assaulting a 14-year-old boy.
The man was arrested last year after the boy's father filed a police complaint. The boy used to visit the accused man's shop in Mumbai for recharging an online game 'Ola Party', according to news agency PTI.
The boy claimed that one day when he visited the shop, he was forcibly kissed, and his private parts were touched. Subsequently, the man was booked under IPC Section 377, and some sections of the Protection of Children from Sexual Offences, or POCSO, Act.
IPC 377 pertains to "carnal intercourse against the order of nature with any man, woman, or animal". It carries a maximum penalty of life imprisonment.
