The Madras High Court on Tuesday directed the Tamil Nadu HR&amp;CE department to install boards in all Hindu temples stating non-Hindus were not permitted beyond the 'Kodimaram' (flagpole) area in the respective shrines and said Hindus also have fundamental right to profess and practice their religion.
Justice S Srimathy of the HC's Madurai Bench gave the judgement while hearing a plea from D Senthilkumar, who sought directions to the respondents to permit Hindus alone to the Arulmigu Palani Dhandayuthapani Swamy temple and its sub temples. He also wanted that display boards to that effect in all entrances be set up.
The famous Lord Murugan temple is located in Palani in Dindigul district.
The respondents were the TN government, represented by Principal Secretary, Department of Tourism, Culture and Religious Endowments, The Commissioner, Hindu Religious and Charitable Endowments Department (HR&amp;CE) and the Executive Officer of the Palani temple.
The HR&amp;CE department administers Hindu temples in Tamil Nadu.
Admitting the petition, the court directed the respondents to install boards indicating "non-Hindus are not allowed inside temple after Kodimaram" in the entrance of the temples, near the flagpole and at prominent places in the shrine.
"The respondents are directed not to allow the non-Hindus who do not believe in Hindu religion. If any Non-Hindu claims to visit particular deity in the temple, then the respondents shall obtain undertaking from the said non-Hindu that he is having faith in the deity and he would follow the customs and practices of Hindu religion and also abide by the temple customs and on such undertaking the said non-Hindu may be allowed to visit the temple," the court ruled.
Further, whenever a such a person is allowed based on the undertaking the same shall be entered in the register which shall be maintained by the temple.
"The respondents shall maintain the temple premises by strictly following the agamas (temple rules), customs and practices of the temple," the judge said.
The respondents submitted the said writ petition was filed only for the Palani temple and the order may be restricted to it alone.
"But the issue raised is larger issue and the same ought to be applicable to all Hindu temples, hence the plea of the respondents is rejected. As stated supra these restrictions would ensure communal harmony among different religions and ensure peace in the society. Therefore the State Government, the HR&amp;CE department, the respondents and all persons who are involved in temple administration are directed to follow the directions to all Hindu temples," the court said.
The people belonging to Hindu religion have right to profess and practice the faith.
"Likewise, people belonging to other religions have right to profess and practice their religion. But the customs and practice of their respective religion cannot be interfering with and any interference ought to be curtailed. The temple is not (a) picnic spot or tourist spot. Even in Arulmighu Brahadeeswarar Temple, Thanjavur the other religion people are allowed to admire and appreciate the architectural monuments of the temple, but not after Kodimaram." "While admiring the architectural monuments the people cannot use the premises as picnic spot or tourist spot and the temples premises ought to be maintained with reverence and as per agamas. Therefore, the rights guaranteed under the Articles is not granting any right to the respondents to allow the other religion people if they do not have any faith and belief in the Hindu religion. Moreover, the rights are guaranteed to all religions and there cannot be any bias in applying such right," the court added.
The HC also referred to certain incidents of non-Hindus allegedly entering temples.
"It was also reported that in Arulmighu Brahadeeswarar Temple a group of persons belonging to other religion had treated the temple premises as picnic spot and had non vegetarian food inside the temple premises. Likewise, recently on 11.01.2024 a newspaper had reported that a group of persons belonging to the other religion had entered the Arulmighu Meenakshi Sundareswarar Temple, Madurai with "their sacred book" near sanctum and sanctorum and was attempting to do their prayers" there.
These incidents are absolutely interfering with the fundamental rights guaranteed to the Hindus under the Constitution, the judge said.
"The Hindus also have fundamental right to profess and practice their religion freely and propagate their religion without interfering in their way of practice. Therefore, the Hindus have right to maintain their temples as per their customs, practices and Hindu Religious and Charitable Endowment Department is having duty to protect the temples from such unwanted incidents." "In fact, in the above narrated incidents the Department had failed to protect the fundamental rights guaranteed under the constitution," the court added.

&ldquo;A person who claims to be a rakshak of Santana Dharma should not use unsavoury words such as Vesi, which refers to sex workers, on social media platforms. We cannot but object to the use of the word Vesi for it admittedly refers to sex workers. Use of such unpalatable words cannot be encouraged,&rdquo; the court said as per Bar and Bench.

The Madras High Court has said 'dogma' like preventing entry of a widow into a temple cannot happen in a civilised society governed by law and made it clear that a woman, by herself has an identity.
It observed it is quite unfortunate that archaic beliefs like that of a widowed woman entering a temple causing impurity to the shrine continue to prevail in the State.
Justice N Anand Venkatesh made the observation in his order dated August 4 while disposing of a petition filed by Thangamani. She sought a direction to the police to provide protection to her and her son in order to enter the Periyakaruparayan temple situated at Nambiyur Taluk in Erode District.
She wanted to participate in the two-day temple festival on August 9 and had given a representation in this connection last month.
The case of the petitioner was her deceased husband used to be the 'Poojari' (priest) of the said temple. During the ongoing Tamil 'Aadi' month, the temple committee decided to conduct a festival on August 9 and 10, 2023.
The petitioner and her son wanted to participate in the festival and offer worship. Two persons-- Aiyavu and Murali seemed to have threatened her stating she should not enter the temple since she is a widow. Hence, she made a representation to the authorities to give police protection and since there was no response, she moved the HC.
The judge said though reformers are attempting to break such senseless beliefs, it continues to be practiced in some villages.
The court directed the Inspector of Police, Siruvalur Police Station, to inform Aiyavu and Murali they cannot stop Thangamani and her son from entering the temple and attending the festival.

The defamation suit was filed by Dhoni against Sampath Kumar, for the IPS officer had implicated the star cricketer in the betting scam.
After the betting and spot-fixing scandal came to light in 2014, the Chennai Super Kings and Rajasthan Royals franchises were suspended for a period of two years, while Dhoni was given a clean chit.

The proposal to elevate the woman lawyer, who has been representing the Centre before the Madurai Bench of the Madras High Court, has been mired in controversy after reports emerged about her alleged affiliation to the BJP.

In a significant development, the Supreme Court on Monday advanced to February 7 the hearing on a plea challenging the appointment of lawyer Lekshmana Chandra Victoria Gowri as a judge of the Madras High Court, soon after the Centre notified her judgeship.
The apex court had earlier in the day agreed to hear on February 10 the petition against her elevation but the matter was mentioned again and the hearing was fixed for Tuesday by a bench headed by Chief Justice DY Chandrachud which said the collegium has taken note of &ldquo;certain developments&rdquo; after her name was recommended to the Centre.
During the second mention, the bench was apprised by senior advocate Raju Ramachandran that the Centre has notified the appointment of Gowri as an additional judge of the Madras High Court and urged for urgent intervention.

A group of advocates have accused advocate Lekshmana Chandra Victoria Gowri of spewing hate speech against Muslims and Christians.

The decision of the Supreme Court Collegium to elevate advocate Lekshmana Chandra Victoria Gowri as a judge at the Madras High Court has come under attack from a section of the High Court Bar.
A group of advocates have written to President Droupadi Murmu and the Supreme Court Collegium, accusing Gowri of spewing hate speech against Muslims and Christians. Critics have also highlighted that Gowri is the National General Secretary of the BJP Mahila Morcha.
The lawyers said that such appointments may pave the way for undermining the independence of the judiciary.
"In the context of Ms. Gowri's utterances, can any litigant belonging to Muslim or Christian community ever hope to get justice in her Court, if she becomes a Judge?" the advocates asked in their letter.
"The Collegium's recommendation of a person who harbours such strong antipathy towards the minority community is disturbing, to say the least," the letter added.

Mobile phones banned inside temple premises across Tamil Nadu 

It further directed the Hindu Religious &amp; Charitable Endowments (HR &amp; CE) Department to follow a decent dress code in all the temples in Tamil Nadu.

The Madurai bench of the Madras High Court on Friday directed the Commissioner of Hindu Religious &amp; Charities Endowments Department to prohibit the use of mobile phones inside the temple premises to maintain the purity and sanctity of temples in Tamil Nadu.
The court issued the order after hearing a public interest case filed by one Seetharaman, seeking a ban on the use of cell phones inside the Arulmigu Subramania Swamy Temple in the state's Tiruchendur.
While delivering the order, judges R. Mahadevan and J. Sathyanarayana Prasad said: "In order to ensure the safety of the devotees and protect the sanctity of the temple, the authorities should take steps to prevent the use of cell phones inside the temple premises. The use of cell phones and cameras distracts the devotees."

The CSK skipper has filed a contempt of court petition for Sampath&rsquo;s alleged statements against the Supreme Court and certain senior counsels in the matter pertaining to match-fixing. He is reportedly seeking Rs 100 crore in damages from the officer and a TV channel for making match-fixing allegations against him.
While the case was listed, it was not heard due to time constraints and is likely to be listed on Tuesday for hearing. As per an interim order passed on March 18, 2014, the court restrained Sampath Kumar from making any statement against Dhoni, linking him with match-fixing and spot-fixing. Despite the order, the IPS officer reportedly filed an affidavit before the Supreme Court containing disparaging remarks against the judiciary and the senior counsel representing the State in the cases against MS Dhoni.&nbsp;
