State NCP president Jayant Patil, whose party is a constituent of the MVA along with the Sena and Congress, in a tweet said, &ldquo;A serious case of challenging the legitimacy of the Eknath Shinde government is being heard by a Constitutional Bench of the Supreme Court.&rdquo; &ldquo;In such a case, it is improper that Shinde shares stage with the Chief Justice of India. This is not as per protocol.&rdquo; CJI Lalit was on Saturday felicitated at an event in Mumbai where Union Law Minister Kiren Rijiju was present.&nbsp;
Maharashtra CM Shinde, who was also present on the occasion, had said it was a proud moment for the state as its &ldquo;son&rdquo; became the Chief Justice of India.&nbsp;
Posting pictures of Saturday&rsquo;s event, Congress spokesman Sachin Sawant tweeted, &ldquo;When legitimacy and legality of the Shinde-Fadnavis government is being examined by Hon&rsquo;ble SC itself and not only the current state government but also the man heading it can be disqualified, the dais looks rather incongruous.&rdquo; Shiv Sena spokesperson Arvind Sawant claimed nothing was happening these days as per norms, rules and law.&nbsp;

&ldquo;This is the reason we say democracy is in danger,&rdquo; he added.&nbsp; Shinde had led a revolt against the Shiv Sena leadership in June this year which resulted in the collapse of the Thackeray-led MVA government.&nbsp;
Later, Shinde was sworn in as the CM on June 30 along with BJP&rsquo;s Devendra Fadnavis as his deputy.&nbsp;

Chief Justice of India-designate Justice U U Lalit on Friday highlighted three areas on which he intends to work during his 74-day tenure as the head of the judiciary and said he would strive hard to ensure that at least one constitution bench is functioning in the Supreme Court throughout the year.
Justice Lalit, who will become the 49th CJI on Saturday, said the other two areas are -- listing cases for hearing in the apex court and mentioning urgent matters.
Speaking at a function organised by the Supreme Court Bar Association (SCBA) to bid farewell to outgoing CJI N V Ramana, Justice Lalit said he has always believed that role of the top court is to lay down law with clarity and the best possible way to do it is to have larger benches as early as possible so that the issues get clarified immediately.
"So, we will strive hard to say that yes, we will always have at least one constitution bench functioning all throughout the year," he said.
Justice Lalit said one of the areas in which he intends to work is about the listing of cases before the constitution benches and matters which are specially referred to three-judge benches.
On the issue of listing of matters, he said, "….I must assure you that we will strive hard to make the listing as simple, as clear, and as transparent as possible".
Regarding mentioning urgent matters, Justice Lalit said he would certainly look into it.
"I will have a word with all my learned colleagues on the bench and we will certainly sort that out and very shortly, you will have a clear-cut regime where any urgent matter can freely be mentioned before the respective courts," he said.
Justice Lalit said, "I have always believed that the role of the Supreme Court is to lay down law with clarity, consistency, and the best possible way to do it is to have larger benches as early as possible, wherever the matters are referred to such benches so that the issues get clarified immediately, the matter has consistency and the people are well aware of what exactly are the contours of the peculiar positions in law."
While hailing Justice Ramana, who became the CJI on April 24 last year, Justice Lalit pointed out two "stand out" achievements, including that over 250 appointments of judges in the high courts across the country were made as a result of recommendations made by the apex court collegium in the last about 14 months or so.

 Justice UU Lalit sworn in as 49th CJI

Speaking at a farewell function on Friday, Justice Lalit said he has always believed that the role of the top court is to lay down law with clarity.

Justice Uday Umesh Lalit was on Saturday sworn in as the 49th Chief Justice of India (CJI).
President Droupadi Murmu administered him the oath during a brief ceremony held at the Rashtrapati Bhavan.
"Congratulations," President Murmu said after Justice Lalit signed the register of oath following the swearing-in.
Vice President Jagdeep Dhankhar, Prime Minister Narendra Modi, former president Ram Nath Kovind, former vice president M Venkaiah Naidu and Union ministers, including Kiren Rijiju, were present at the ceremony.
Justice Lalit's predecessor, Justice N V Ramana, was also present.
After being sworn in, Justice Lalit sought the blessings of his family elders by touching their feet, including that of his 90-year-old father and former high court judge Umesh Ranganath Lalit.
As the CJI, Justice Lalit will have a tenure of 74 days and would demit office on November 8 on attaining the age of 65 years.
Justice D Y Chandrachud, the senior-most judge after Justice Lalit, is next in line to be the chief justice of India.

During Justice Lalit's tenure as the CJI, several important cases, including Constitution bench matters, are likely to come up for adjudication before the apex court.
The top court had recently notified that 25 five-judge Constitution bench matters would be listed from August 29.
Among the important five-judge bench matters which have been listed is a plea challenging the Constitution (One Hundred and Third Amendment) Act, 2019 which provided reservation to Economically Weaker Sections, the challenge to the WhatsApp privacy policy, and the issue of parliamentarians or legislators claiming immunity from criminal prosecution for taking a bribe to give a speech or a vote in the House.

Justice Ramana, the 48th CJI who had succeeded S A Bobde on April 24, 2021, was delivering his address at a function organised by the Supreme Court Bar Association (SCBA) to bid him adieu on completion of his over 16-month-long tenure as head of the judiciary. 
Justice Ramana, who served as a judge for over two decades in the higher judiciary, expressed satisfaction over his journey and said that he never claimed himself to be “a scholarly judge or a great judge”, but always believed that the ultimate purpose of the justice delivery system is to provide justice to the common man.
On his retirement day, the CJI hinted toward the malicious campaign aimed at him and his family also just before his elevation to the top post.
“From the date, I joined the bench till I reached the highest possible position in the judiciary, I was subjected to conspiratorial scrutiny. My family and I suffered in silence. But ultimately, the truth will always prevail. ‘Satyameva Jayate’,” he said.
The CJI referred to the packed auditorium and the good words spoken about him by CJI-designate Justice U U Lalit, Solicitor General Tushar Mehta and SCBA president Vikas Singh and other Bar leaders and said that he was searching for words to adequately express his gratitude.
On the issue of the Indianisation of the legal system, he said the judicial system, practices, rules, being colonial in origin, may not be best suited to the needs of the Indian population.
“I mean the need to adapt to the practical realities of our society and localise our justice delivery system. I have pushed for the modernisation of judicial infrastructure as a means for providing access to justice,” he said.
He said the problems faced by the judiciary cannot be looked at in isolation.
“The judiciary is independent when it comes to adjudication of cases, but with respect to finances or appointments, it is still dependent on the Government. To coordinate and get cooperation from the Government, interaction is inevitable. But interaction does not mean influence. I hope this dialogue between the judiciary and the public will continue,” he said.
He told the audience about the idea behind his weekend travels to the courts across the country and said, “I felt it was my Constitutional duty to dispel these notions and bring the Court closer to the people, by way of generating awareness and building confidence among people about the judiciary.”
The popular perception is that the Indian judiciary was “alien and quite distant” to the general public and there are still millions with suppressed judicial needs who are apprehensive to approach the judiciary in times of need, he said.
