Rajya Sabha Chairman Jagdeep Dhankhar on Monday said he has received a notice for the removal of High Court Judge Yashwant Varma and asked the Secretary General to take necessary steps.
Wads of burnt currency notes were recovered from the official residence of Justice Varma in Delhi in March this year. He was later transferred to the Allahabad High Court.
Dhankhar said that he has received a notice of motion under article 217 (1B), read with article 218, and article 124, sub-article 4 of the Constitution of India, along with section 31B of the Judges Enquiry Act 1968, to constitute a committee for removal of Justice Varma.
"This (notice) has been received by me today. It has been signed by more than 50 members of the Council of States. Thus, it meets the numerical requirement of signing by members of Parliament for setting in motion the process of removal of a high court judge," Dhankhar said.
On Law Minister Arjun Ram Meghwal's confirmation that a notice has also been submitted in the Lok Sabha, Dhankhar asked the Secretary General to "take necessary steps in this direction".

Concord, Jul 10 (AP) A federal judge in New Hampshire is set to hear arguments on Thursday regarding a potential class-action lawsuit that could encompass all infants impacted by former President Donald Trump's birthright citizenship restrictions.
The lawsuit, representing a pregnant woman, two parents, and their infants, is one of several legal challenges against Trump's January directive that denies citizenship to children born to parents who are living in the U.S. illegally or temporarily.
Supported by the American Civil Liberties Union and others, the plaintiffs are advocating for the case to be recognized as a class action while seeking to halt the enforcement of the order during ongoing litigation.
"Thousands of babies and their parents could be vulnerable to the harms of this order within weeks and urgently require an injunction," attorneys for the plaintiffs stated in court documents filed on Tuesday.
The central issue is the 14th Amendment of the U.S. Constitution, which declares, "All persons born or naturalized in the United States and subject to the jurisdiction thereof, are citizens of the United States.&rdquo; The Trump administration argues that the phrase &ldquo;subject to the jurisdiction thereof&rdquo; permits the U.S. to deny citizenship to children born to those in the country illegally, thereby altering what has long been considered an essential element of U.S. law.
"Previous misinterpretations of the citizenship clause have provided a flawed incentive for illegal immigration, adversely affecting this nation's sovereignty, national security, and economic stability," government lawyers argued in the New Hampshire case.
"The Constitution does not include a windfall clause granting American citizenship to the children of those who have circumvented or defied federal immigration laws.&rdquo;
Legal disputes are unfolding across various states. Several federal judges have already issued nationwide injunctions to prevent Trump's order from being implemented, but the U.S. Supreme Court, in a June 27 ruling, restricted those injunctions, giving lower courts 30 days to make decisions. Fueled by this timeline, opponents quickly resumed court actions to prevent the directive.
New Jersey, along with more than a dozen states aligned in a Massachusetts federal court case, has requested the judge to determine whether their nationwide injunction remains applicable under the Supreme Court's decision. The judge has set a hearing for July 18.
"We're all aware of the 30-day deadline, so ideally, we want a resolution before it expires," stated New Jersey Attorney General Matt Platkin in a recent interview with The Associated Press.
In a Washington state case before the 9th U.S. Circuit Court of Appeals, the judges called upon the involved parties to submit briefs detailing the implications of the Supreme Court's decision. Washington, alongside other states in that legal proceeding, has requested the appeals court to return the issue to the lower court judge.
Similar to New Hampshire, a plaintiff in Maryland is attempting to establish a class-action lawsuit encompassing all individuals who could be affected by the directive. The judge assigned a Wednesday deadline for submission of written legal arguments while considering another nationwide injunction sought by CASA, a nonprofit immigrant rights group.
Ama Frimpong, CASA's legal director, emphasized to members and clients the importance of remaining calm.
"There's no immediate need for anyone to relocate," she noted. "We have multiple strategies in place to ensure that this executive order remains unenforced."
The New Hampshire plaintiffs, anonymously referred to by pseudonyms, include a woman from Honduras, who has an active asylum application and is due to give birth to her fourth child in October. She testified that her family came to the U.S. after being threatened by gangs.
"I don't want my child to live in fear and hiding. I don't want my child to be vulnerable to immigration enforcement," she stated. "I worry about the risk of our family being separated."
Another plaintiff, a Brazilian man, has resided in Florida with his wife for five years. Their first child was born in March, and they are actively pursuing permanent residency based on family ties, as his wife&rsquo;s father is a U.S. citizen.

Vice President Jagdeep Dhankhar on Thursday questioned the lack of an FIR in the discovery of wads of burnt cash case from the residence of a high court judge, wondering whether a "category beyond law" has secured immunity from prosecution.
The Supreme Court ordered an in-house probe into the alleged discovery of half-burnt wads of cash from Justice Yashwant Varma's residence after a fire on the night of Holi on March 14. Justice Varma has now been repatriated from the Delhi High Court to his parent high court of Allahabad.
Dhankhar also questioned the legal standing of the three-judge panel carrying out an in-house probe into the matter.
Referring to the case, he said every Indian is deeply concerned.
"If the event had taken place at his (common man's) house, the speed would have been an electronic rocket. Now it is not even a cattle cart." Dhankhar said while a committee of three judges is probing the matter, an investigation is the domain of the executive and not the judiciary.
He said the committee has not been set up under any provision of the Constitution or law.
"And what can the committee do? The committee can at the most make a recommendation. Recommendation to whom? And for what? "The kind of mechanism we have for judges, the only action finally that can be taken is by Parliament (by way of removal of the judge)," he said.
The committee report, Dhankhar said, "inherently lacks legal standing".
"It is now over a month. Even if it is a can of worms, even if there are skeletons in the cupboard, (it's) time to blow up the can, time for its lid to go out, and time for the cupboard to collapse. Let the worms and skeletons be in the public domain so that cleansing takes place," Dhankhar said here addressing a group of Rajya Sabha interns.
He said for seven days no one knew about the incident.
"We have to ask questions to ourselves. Is the delay explainable? Condonable? Does it not raise certain fundamental questions? In any ordinary situation, things would have been different," he said.
After the incident was confirmed by the top court, it became clear that something required to be investigated, he said.
"Now the nation waits with bated breath. The nation is restive because one of our institutions, to which people have looked up always with the highest respect and deference, was put in the dock," he said.
Emphasising the significance of the rule of law, he said in a democracy purity of its criminal justice system defines its direction.
He said no investigation under the law is in progress at the moment due to the lack of an FIR.
"It is law of the land that every cognisable offence is required to be reported to the police and failure to do so, and failure to report a cognisable offence is a crime. Therefore, you all will be wondering why there has been no FIR," he said.
An FIR, Dhankhar pointed out, can be registered against anyone, any constitutional functionary including the vice president.
"One has only to activate the rule of law. No permission is required. But if it is judges, their category, FIR cannot be straightaway registered. It has to be approved by the concerned in the judiciary," he said.
He underlined that the Constitution has accorded immunity from prosecution only to the president and the governors.
"So how come a category beyond law has secured this immunity?" he wondered.
Underscoring the importance of transparency, the vice president referred to a decision of a Lokpal bench that it possessed the jurisdiction to investigate corruption complaints against high court judges.
He said taking a suo motu cognisance, the apex court stayed the order on the grounds of independence of the judiciary.
"This independence is not a protection. This independence is not some kind of impregnable cover against inquiry, investigation or probe.
"Institutions thrive with transparency, with there being probe. The surest way to degenerate an institution or an individual is to give total guarantee there will be no inquiry, no scrutiny, no probe," Dhankhar said.

Justice Nagarathna is among the three women judges whose names have been cleared.
Born on October 30, 1962, Justice Nagarathna is the daughter of former CJI ES Venkataramiah.
She enrolled as an advocate on October 28, 1987 at Bangalore and practiced in the field pertaining to &ldquo;constitution, commerce, insurance and service, etc&rdquo;.
She was appointed as an additional judge in the Karnataka High Court in February 2008.&nbsp;
In 2012, Justice Nagarathna delivered a crucial judgment, on the need to regulate electronic media.

CCTV footages showed that Dhanbad judge&nbsp;Uttam Anand , was jogging on one side of a fairly wide road early on Wednesday when a heavy auto-rickshaw veered towards him, hit him from behind and fled the scene.

The CCTV footage shows the Jharkhand judge Uttam Anand jogging by the roadside when the tempo starts moving from the middle of the road towards the sidewalk even when the entire road looks empty.
The tempo then hits the judge and speeds away. The tempo&nbsp;driver has been arrested.
Judge Anand was found lying on the road, bleeding, by a man who took him to hospital, where he died later.
The incident was raised in the Supreme Court on Thursday. Chief Justice of India NV Ramana said he had spoken to the Jharkhand High Court and asserted: "We are aware of the case and we will take care."

Recalling his judgement in the case of Republic Editor Arnab Goswami, the judge said that courts must ensure that they continue to remain the "first line of defence against the deprivation of liberty of citizens".
"Deprivation of liberty for even a single day is one too many. We must always be mindful of the deeper systemic issues of our decisions," he added.
The remarks are significant as they come amid outrage over the death of 84-year-old activist Stan Swamy in jail. Swamy was arrested under UAPA in the Elgar Parishad case last year and died last week in jail fighting for bail on health grounds.
A number of activists and students are currently languishing in jails on terror charges without bail.

Student who accused Chinmayanand of rape turns hostile in court

A 23-year-old law student, who had last year accused former BJP MP Chinmayanand of rape, turned hostile at a hearing in a special court in Lucknow on Tuesday. The LLM student categorically denied that she had levelled any allegation against the former Union minister. The student now faces a perjury charge. 72-year-old Chinmayanand was arrested last year in the rape case, and was granted bail in February. Earlier in her statement to cops and then before a magistrate the woman had accused Chinmayanand&nbsp;of sexually abusing and threatening her.&nbsp;

Lucknow, PTI: In a courtroom twist Tuesday to the high-profile case, a law student who had accused former Union minister Chinmayanand of sexually exploiting her disowned her statements to police and now faces a perjury charge.
Appearing before an MP-MLA court in Lucknow, the LLM student categorically denied that she had levelled any allegation against the former Union minister as the prosecution had charged.
At this, the prosecution immediately moved an application under Section 340 of the CrPC, seeking action against her for perjury.
Judge P K Rai directed his office to register the application and asked the prosecution to furnish a copy of the application to the victim and the accused.
The court fixed October 15 for hearing on the application.
The Allahabad High Court in February this year granted bail to Chinmayanand, whose trust runs the Shahjahanpur law college where the woman studied. He was arrested in September last year.
The case was registered under Section 376-C of the IPC, an offence pertaining to the abuse of one's position by a person in authority to "induce or seduce" a woman under his charge to have "sexual intercourse not amounting to the offence of rape".
Chinmayanand (72) also faced charges under Sections 342 (wrongful confinement), 354-D (stalking) and 506 (criminal intimidation) of the IPC.
According to government lawyer Abhay Tripathi, the victim had lodged an FIR in this regard with the Lodhi Colony police station of New Delhi on September 5, 2019.
Her father lodged another complaint in Shahjahanpur and both FIRs were merged.
An SIT had recorded her statement. Later, her statement under Section 164 of the CrPC was recorded in Shahjahanpur.
In both statements, she had supported the FIR version but now during the trial, she changed her statement and denied the facts mentioned in the complaint.
&ldquo;Since she has turned hostile, I have moved an application under Section 340 of the CrPC,&rdquo; Tripathi said.
Earlier, the investigation officer had cited 33 witnesses and 29 documentary evidence in the 13-page charge sheet.
The Allahabad high court had on February 3, 2020 transferred the trial from Shahjahanpur to the Lucknow's MP-MLA court.
The case first came to light after the woman went missing on August 24, a day after she posted a video on social media alleging that a "senior leader of the sant community" was harassing and threatening to kill her.
