A priest performed pooja and aarti in the 'Vyas Ji ka Tehkhana' in Varanasi's Gyanvapi mosque complex early on February 1st following the permission granted by the district court.
The district authorities held a meeting late night, ahead of the commencement of the pooja.
A passage was cleared to allow devotees access to the southern cellar where the rituals were conducted.
The district court on Wednesday ruled that a priest can perform prayers before the idols in a cellar of the Gyanvapi Masjid here, a significant development in the legal battle over the mosque adjacent to the Kashi Vishwanath temple.
While the VHP welcomed the order, Muslim side counsel Mumtaz Ahmed said they will challenge it in the high court.&nbsp;

The Varanasi district court on Wednesday granted the family of a late priest the right to worship Hindu deities in the Gyanvapi mosque cellar, Hindu side counsel Madan Mohan Yadav said.
The order was passed by judge A K Vishvesh who directed the district magistrate to make arrangements within seven days to facilitate puja there, Yadav said, adding the prayers will be facilitated by the Kashi Vishwanath Trust.
According to the petition, priest Somnath Vyas used to perform prayers there till 1993 when the cellar was closed by the authorities.
Shailendra Kumar Pathak, maternal grandson of Somnath Vyas, had sought the right to worship the deities there.
He said the barricades before the Nandi statue in front of the 'wazu khana' -- where where ablutions are performed before offering namaz -- in the mosque complex will be removed to make way for the petitioner to perform puja.
The Hindu side counsel said the puja of deities there was stopped during the rule of chief minister Mulayam Singh Yadav.
The Muslim side has argued that the cellar is part of the mosque complex, and hence permission to perform puja there should not be granted.
The Varanasi district court had on July 21 last year directed the ASI to conduct a "detailed scientific survey" -- including excavations, wherever necessary -- to determine if the mosque located next to the Kashi Vishwanath temple was built on the remains of a temple.
According to the Hindu side, the report of the scientific survey suggests the mosque was built on the remains of a pre-existing temple.

The Hindu side lawyer also claimed that the survey report has sufficient evidence of existence of a temple over which the mosque was built.

The ASI survey report on the Gyanvapi complex here suggests that the mosque was built on remains of a pre-existing temple, claimed counsel for the Hindu side Vishnu Shankar Jain on Thursday.
Jain told reporters that copies of the survey report consisting of 839 pages were made available to the parties concerned by the court late Thursday evening.
The survey report makes it clear that the mosque was built on remains of a pre-existing temple by demolishing it in the past, he said.
He also claimed that the survey report has sufficient evidence of existence of a temple over which the mosque was built.
A total of 11 people, including from both the Hindu and the Muslim sides, earlier in the day applied in the court to get the ASI survey report on the Gyanvapi complex adjoining the Kashi Vishwanath temple.&nbsp;

Chief Justice Pritinker Diwaker heard the matter in the afternoon session and reserved his verdict till August 3.
The high court was hearing a plea against a Varanasi district court order directing the ASI to conduct a survey to determine if the Gyanvapi mosque was built upon a temple.
The court heard the arguments from Anjuman Intezamia Masjid, which manages the mosque, and the Hindu side. Senior ASI officials were also present in the courtroom.
The high court on Wednesday said that it would take up the matter at 3:30 pm on Thursday, but Chief Justice Diwaker started hearing the case 15 minutes in advance and reserved its order before concluding the day's proceedings at 5 pm.

Earlier, the Supreme Court had ordered the protection of the area around the claimed 'shivling', found when a local court ordered a video survey of the complex.

&nbsp;A court in Varanasi on Friday directed the Archaeological Survey of India to conduct a scientific survey of the Gyanvapi mosque located next to the Kashi Vishwanath temple.&nbsp;
The 'wazukhana', where a structure claimed by Hindu litigants to be a 'shivling' exists, will not be part of the survey, following an earlier Supreme Court order related to the spot where Muslims perform ritual ablutions.
A throng of people outside the court received the news with slogans of "Har Har Mahadev". The order by the court of A K Vishvesh upheld the petition of a group of Hindus seeking a survey to determine if the Mughal-era mosque was built at the site of an earlier Hindu temple.
The court fixed August 4 as the next date of hearing, according to government counsel Rajesh Mishra.
The court had on July 14 reserved its order after hearing both Hindu and Muslim sides.
The petition filed by the Hindu group had sought direction to the ASI to survey the complex.
The mosque management's counsel Mohammed Tauhid Khan said it will challenge the order. "It is not acceptable and we will move to a higher court against it. This survey could cause damage to the mosque," he said.
The Muslim side filed its objection to the Hindu group's petition in May.
Vishnu Shankar Jain, the counsel for the Hindu side, had earlier argued that the Kashi Vishwanath temple-Gyanvapi mosque dispute can be resolved only by an archaeological investigation of the entire mosque complex.
He had said that the situation will become clear after examining the three domes of the Gyanvapi complex, the western wall of the complex and the entire complex in a modern way.
After an Allahabad High Court order, the Varanasi district court had on May 16 agreed to hear a plea for an ASI survey.
Earlier, the Supreme Court had ordered the protection of the area around the claimed 'shivling', found when a local court ordered a video survey of the complex.
The mosque management has maintained that the structure was part of the water fountain mechanism at the 'wazukhana', the reservoir where devotees performed ablutions before offering namaz.

Gyanvapi mosque case: Hindu petitioner says he is withdrawing, alleges harassment

One of the main litigants from the Hindu side Jitendra Singh Visen has announced that he and his family are withdrawing from all cases related Gynavapi issue due to alleged "harassment".

He alleged that he was facing harassment from various quarters including from the Hindu side and felt humiliated.

"I and my family (wife Kiran Singh and niece Rakhi Singh) are withdrawing from all Gyanvapi-related cases that we had filed in the interest of the country and religion in various courts," Visen, who heads the Vishwa Vedic Sanatan Sangh, said in a statement issued on Saturday.
He alleged that they were facing harassment from various quarters including from the Hindu side and felt humiliated.
"In such a situation, due to limited strength and resources, I cannot fight this battle for 'dharma' anymore and that's why I am leaving this.
"Perhaps the biggest mistake I made in my life was by starting this 'dharmayudh'. This society is only with those who mislead by playing gimmicks in the name of religion," he said.
Visen's lawyer Gaur, who had left the case earlier, in a separate statement said that due to a communication gap with plaintiffs, he was withdrawing from the Gyanvapi case, which he is contesting from 2021, and Krishna Janmabhoomi case, which he took up in 2022.
He said that he did not get any fee after May 2022 for contesting these cases.

The Supreme Court on Friday extended till further orders the protection of the area where a 'Shivling' was stated to be found at the Gyanvapi-Shringar Gauri complex premises in Varanasi.

On May 17, the top court had passed an interim order directing the district magistrate of Varanasi to ensure protection of the area inside the Gyanvapi-Shringar Gauri complex where the 'Shivling' was said to be found in the survey.

On May 17, the top court had passed an interim order directing the district magistrate of Varanasi to ensure protection of the area inside the Gyanvapi-Shringar Gauri complex where the 'Shivling' was said to be found in the survey.
It had said its earlier interim order of May 17, directing protection of the area where the "Shivling" is said to be found and allowing Muslims to offer namaz on the mosque premises, shall remain in operation till the maintainability of the suit is decided by the district judge and thereafter, for eight weeks to allow the aggrieved parties to approach a higher court.
A bench of Chief Justice DY Chandrachud and justices Surya Kant and PS Narasimha allowed the Hindu parties to move an application before the Varanasi district judge for consolidation of all the lawsuit filed on the Gyanvapi row.
It also directed the Hindu parties to file their replies within three weeks on the appeal filed by the management committee of the Anjuman Intezamia Masjid challenging the Allahabad High Court order on the appointment of a survey commissioner.

On May 20, the top court had transferred a civil suit filed by Hindu devotees on the Gyanvapi mosque from the civil judge (senior division) to the district judge of Varanasi, saying looking at the "complexities" and the "sensitivity" of the issue, it is better if a senior judicial officer with more than 25-30 years of experience handles the case.

A city court on Saturday granted bail to Delhi University Associate Professor Ratan Lal, arrested for alleged objectionable remarks on social media related to claims of a 'Shivling' at Varanasi's Gyanvapi mosque, saying his post, though reprehensible, does not indicate an attempt to promote hatred between communities.
The court directed Lal to “strictly refrain from posting any social media posts or interviews regarding the controversy which resulted in the present FIR”, while allowing his release on furnishing a personal bond of Rs 50,000 and one surety of the like amount.
Lal was arrested on Friday night by the Delhi Police under Indian Penal Code sections 153A (promoting enmity between different groups on grounds of religion, race, place of birth, residence, language, etc., and doing acts prejudicial to maintenance of harmony) and 295A  (deliberate act to outrage religious feelings of any class by insulting its religion).
Chief Metropolitan Magistrate Siddhartha Malik said that the feeling of hurt felt by an individual cannot represent the entire group or community and any such complaint regarding hurt feeling has to be seen in its context, considering the entire spectrum of facts and circumstances.
The court said that the Indian civilisation is one of the oldest in the world and is known to be tolerant and accepting of all religions, adding that the presence or absence of intention to create animosity by words was subjective in nature as was the perception of the recipient who reads or hears a statement.
“India is a country of more than 130 crore people and any subject can have 130 crore different views and perceptions,” it said.
The court noted that the social media post of Lal, who teaches History at the Hindu College, may appear to be a failed attempt at satire regarding a controversial subject that has backfired, resulting in the FlR.
It further noted that the accused, in personal life, was a proud follower of the Hindu religion.
“For another person, the same post can appear to be shameful but may not incite the feeling of hatred towards another community. Similarly, different persons may consider the post differently without being enraged and may in fact feel sorry for the accused to have made an unwanted comment without considering the repercussions,” the court said.
It noted that it was true that the accused did an act that was avoidable considering the sensibilities of persons around the him, and the public at large.
“However, the post, though reprehensible, does not indicate an attempt to promote hatred between communities,” the court said.
The judge, meanwhile, said that the anxiety of police could be understood as the police are tasked to maintain peace and order and at the slightest hint of unrest would come into action to prevent the situation from going out of hand.
However, the court has to employ higher standards while considering the need to send a person to custody, it said.
“The present accused is a person of good repute with no criminal antecedent and there is no likelihood of the accused fleeing the course of law.
"In view of the aforesaid, the court sees no need to send the accused to judicial custody,” the judge said.
During the argument, the defence counsel told the court that the accused had no intention to hurt the religious feeling of any person or group and he had simply made a light-hearted comment on a matter which was still pending before various courts in the country.
The prosecution opposed the bail plea and sought his judicial custody, saying that the Facebook post was “clearly meant to incite hatred between religious groups”.
It said the accused had given various interviews after the post where he has again made the same derogatory remarks.
An FIR was lodged against Lal on Tuesday night based on a complaint filed by a Delhi-based lawyer.
In his complaint, advocate Vineet Jindal alleged that Lal had recently shared a "derogatory, inciting and provocating tweet on the Shivling".

However, the court has to employ higher standards while considering the need to send a person to custody, it said.
&ldquo;The present accused is a person of good repute with no criminal antecedent and there is no likelihood of the accused fleeing the course of law.
"In view of the aforesaid, the court sees no need to send the accused to judicial custody,&rdquo; the judge said.
During the argument, the defence counsel told the court that the accused had no intention to hurt the religious feeling of any person or group and he had simply made a light-hearted comment on a matter which was still pending before various courts in the country.
The prosecution opposed the bail plea and sought his judicial custody, saying that the Facebook post was &ldquo;clearly meant to incite hatred between religious groups&rdquo;.
It said the accused had given various interviews after the post where he has again made the same derogatory remarks.

The Supreme Court Friday transferred the civil suit filed by Hindu devotees on Gyanvapi mosque from civil judge (senior division) to district judge, Varanasi saying looking at the complexities and sensitivity of the issue, it is better for a senior judicial officer to handle the case.
A bench of Justices DY Chandrachud, Surya Kant, and PS Narasimha said that it is not casting any aspersion on the civil judge (senior division) who was earlier dealing with the suit.
The top court directed the district judge to first decide the application under Order 7 Rule 11 of CPC (on maintainability) filed by the Mosque committee saying the civil suit is barred by a law of Parliament be decided upon the transfer of papers from the civil judge (senior division).
The top court said that its earlier interim order of May 17 directing protection of the area where ‘Shivling’ is said to be found and allowing Muslims to offer ‘Namaz’ in mosque premises shall remain in operation till the maintainability of the suit is decided by the district judge and thereafter for eight weeks to allow the aggrieved parties approach the higher court.
The bench also directed the district magistrate to make adequate arrangements for ‘wazu’ (ablution) for the Muslims coming for offering Namaz in the mosque in consultation with the parties involved in the dispute.

Amid claims that a 'shivling' has been found at the Gyanvapi mosque in Varanasi, a political war of words broke out.
The Bharatiya Janata Party, which is currently in power in Uttar Pradesh, celebrated the news. However, Opposition leaders like Asaduddin Owaisi challenged the shivling claim.
The All India Majlis-e-Ittehadul Muslimeen chief said that the structure at Gyanvapi was a fountain, not a shivling. Owaisi said, "'Baba' has not been found. Regarding the claim that a shivling has been found, the mosque committee has said that it is a fountain. Every mosque has such a fountain. The other important point is that the court-appointed commissioner did not approach the court. The petitioners' lawyer rushed to court and the judge issued an order. If there was a shivling, then the court-appointed commissioner should have said it."
The AIMIM chief also questioned the validity of the court order to seal the 'wuzu' pond where the alleged shivling was found. He said, "The court's order to seal the mosque area is in violation of the 1991 Act passed by Parliament. Read paragraph 83 of the Supreme Court's verdict in Babri Masjid-Ram Janmabhoomi title suit. SC said that the 1991 Act is part of the Constitution's basic structure."
In response, Keshav Prasad Maurya, deputy chief minister of UP, said, "When Congress was in power, it used to bring laws which exacerbate such issues. At that time, the Ram Janmabhoomi campaign was taking place. (The 1991 Act was implemented) to prevent similar campaigns elsewhere. A shivling has not emerged there because of a campaign. A court was hearing a case, and upon its orders, a survey was done. According to the survey report, Baba Vishwanath has been found there. We are all celebrating. Statements by the Muslim side, or other politicians who practice appeasement, should stop. The situation in UP is very good."
The official report of the court-mandated survey of the mosque was not known by May 16. The claim that a shivling has been found was made by one of the petitioners.
A Varanasi court is currently hearing petitions filed by some Hindu women seeking permission to pray regularly at the Shringar Gauri shrine situated at one of the walls of the masjid.
