Cyrus Mistry accident: case filed against doctor who was driving

Two months after former Tata Sons chairman Cyrus Mistry died in a car accident, police in Maharashtra's Palghar district on Saturday registered a case against Dr Anahita Pandole for alleged rash driving.

54-year-old Mistry and his friend Jahangir Pandole died in a car crash on a bridge on the Surya river on the Mumbai-Ahmedabad highway in Palghar district adjoining Mumbai on September 4, 2022.

Two months after former Tata Sons chairman Cyrus Mistry died in a car accident, police in Maharashtra's Palghar district on Saturday registered a case against Dr Anahita Pandole for alleged rash driving.
A case under Indian Penal Code sections 304(A) (causing death by rash and negligent act), 279 (rash driving on a public road), 337 (causing death by act endangering life and personal safety of others) besides the Motor Vehicles Act at Kasa police station, officials said.
Mistry (54) and his friend Jahangir Pandole died in a car crash on a bridge on the Surya river on the Mumbai-Ahmedabad highway in Palghar district adjoining Mumbai on September 4, 2022. They were riding in the back seat of the Mercedes car.
Anahita Pandole, a Mumbai gynaecologist who was driving the car, and her husband Darius Pandole who was sitting next to her, were seriously injured.
During the investigation, witnesses were questioned and reports were obtained from the Regional Transport Office and Mercedes Benz India Pune, said a police release here.
"Based on the reports and probe it has been established that the accident was the result of rash and negligent driving," and hence a case was registered against Dr Anahita Pandole, it added.
A police official had claimed on Friday that Darius Pandole (60) told police in his statement that his wife Dr Anahita could not merge the vehicle into the second lane from the third lane of the road that turned narrow near the Surya river bridge.

Darius Pandole was discharged from a Mumbai hospital last week.
"In his statement, Darius Pandole said his wife Anahita was driving the Mercedes-Benz car when they were on their way to Mumbai. A car which was ahead of their vehicle went to the second lane from the third and Anahita also tried to follow the same," the official said.
When she tried to take the car to the second lane, she found that there was a truck on the right side (in the second lane) due to which she was not able to merge into that lane, he said, adding the lane turned narrow near the bridge.
The statement of Anahita Pandole was yet to be recorded as she was still recovering, police had said.

Union Minister Nitin Gadkari on Tuesday announced that seatbelts will be mandatory for all passengers including the ones sitting in rear seat.
Citing business tycoon Cyrus Mistry's fatal accident, the minister said the government has taken the decision to ensure safety of backseat passengers as well. He added that a seatbelt beep system for the rear seats will also be made functional in vehicles.
Speaking to NDTV, Gadkari said that those violating the rules will be fined Rs 1000, stressing that at no cost should lives be risked.

Union Transport Minister Nitin Gadkari has announced new rules to ensure safety of the passengers sitting in the back seat.
Citing business tycoon Cyrus Mistry's fatal accident, the minister said the government has decided to make it mandatory for passengers sitting in rear seat to wear seatbelt as well.
He added that the government will issue a notification in three days specifying the penalty for not wearing a seatbelt in the rear.
There is already a penalty of Rs 1000 if passengers in the back are not wearing the contraception but the compliance and enforcement is negligible.
Gadkari also said that his ministry is also in talks with car manufacturers to introduce seatbelt beep system for the rear seats
Earlier, Gadkari had also slammed car manufacturers for limiting airbags to only 4 in India, while having 6 airbags in the exported vehicles
According to the data released by highway police, over 59,000 people have died and about 80,000 severly injured in road accidents in Maharashtra in less than 5 years.&nbsp;

Former Tata Sons chairman Cyrus Mistry was on Sunday killed in a road accident after his car hit a divider in Maharashtra's Palghar district neighbouring Mumbai, a senior police officer said.
He was 54. Mistry was travelling from Ahmedabad to Mumbai in a Mercedes car, he said.
“The accident took place around 3.15 pm, when Mistry was travelling to Mumbai from Ahmedabad. The accident took place on a bridge over the Surya river. It seems an accident,” said Palghar district superintendent of police, Balasaheb Patil.
The other two persons travelling with him, including the car driver, were injured. All the injured persons have been shifted to a hospital in Gujarat, he said.
More details will be obtained from them, the SP added.
A Kasa police station officer said the accident occurred at Charoti Naka on the Surya river bridge under the Kasa police station limits.
The body of Mistry has been shifted to the Kasa Rural Hospital for postmortem.

It was the finale episode of a 4 year old corporate saga in the Supreme Court as the Chief Justice led Bench ruled in favour of the Tata Group in the Tata vs Mistry case.
The Apex court set aside the NCLAT order and has answered all the appeals in favour of the Tata Group. The court also dismissed Pallonji Group appeals against the Tata Group alleging mismanagement.
The only loose end remains the matter of valuing Mistry&rsquo;s stake in Tata Sons. The Pallonji group holds over 18% in Tata Sons and the court has thrown the issue back to the brawling boardroom to decide the valuation of the Tata Sons&rsquo; shares. The Chief Justice stated " We leave it to Tata Sons, Mistry to take legal route to resolve issue of shares. Value of Tata Sons shares depends on equity&rdquo;
