Four District Judges to be elevated as Madras HC Judges after SC Collegium's recommendation 

The collegium, which comprises Justices Sanjay Kishan Kaul and KM Joseph, recommended the names of R Sakthivel, P Dhanabal, Chinnasamy Kumarappan, and K Rajasekar.

&nbsp;The Supreme Court Collegium headed by Chief Justice DY Chandrachud has recommended the names of four district judges for appointment as judges of the Madras High Court.
The collegium, which comprises Justices Sanjay Kishan Kaul and KM Joseph, recommended the names of R Sakthivel, P Dhanabal, Chinnasamy Kumarappan, and K Rajasekar.
The resolution dated March 21 stated that the recommendation made by the High Court Collegium on August 10, 2022, for the appointment of the four judicial officers as judges of the Madras High Court has the concurrence of the chief minister and the governor of Tamil Nadu.
The file was received from the Department of Justice on January 5 this year, it said.
"In order to ascertain the fitness and suitability of the above-named judicial officers for elevation to the high court.

CJI Chandrachud's latest remarks on formation of collegium for appointment of judges

Speaking at the India Today Conclave, in 2023, the CJI said the judiciary has to be protected from outside influences if it has to be independent.

Not every system is perfect but this is the best system available, Chief Justice of India D Y Chandrachud said on Saturday while defending the Collegium system of judges appointing judges, a major bone of contention between the government and judiciary.
Speaking at the India Today Conclave, 2023, the CJI said judiciary has to be protected from outside influences if it has to be independent.
"Not every system is perfect but this is the best system we have developed. But the object was to protect the independence of the judiciary, which is a cardinal value. We have to insulate the judiciary from outside influences if the judiciary has to be independent," Chandrachud said.
The CJI also responded to Law Minister Kiren Rijiju voicing displeasure over the Supreme Court Collegium revealing the government's reasons for not approving the names recommended by it for appointment as judges of constitutional courts.
"What is wrong about having a difference in perception? But, I have to deal with such differences with a sense of robust constitutional statesmanship. I do not want to join issues with the law minister, we are bound to have differences of perceptions," the CJI said.

The Supreme Court collegium had recommended the names of the two new judges on 31 January 2023.

The Centre on Friday assured the Supreme Court that the Collegium's recommendation of December last year for the appointment of five judges in the apex court will be cleared soon.
Attorney General R Venkataramani told a bench of justices S K Kaul and A S Oka that warrant of appointments of these five names is expected to be issued shortly.
During the hearing, the Supreme Court also expressed displeasure over the delay by the Centre in clearing recommendations for transfer of high court judges, saying "it is a very very serious issue".
"Don't make us take a stand which will be very uncomfortable," the bench told the attorney general.
The Supreme Court was hearing a matter related to the Centre's alleged delay in clearing names recommended by the Collegium for appointment as judges to the Supreme Court and high courts.

The Supreme Court Collegium on December 13 last year recommended five judges for elevation to the apex court -- Rajasthan High Court Chief Justice Pankaj Mithal, Patna High Court Chief Justice Sanjay Karol, Manipur High Court Chief Justice P V Sanjay Kumar, Patna High Court judge Ahsanuddin Amanullah and Allahabad High Court judge Manoj Misra.
Later, on January 31, the Collegium headed by Chief Justice D Y Chandrachud recommended to the Centre the names of Allahabad High Court Chief Justice Rajesh Bindal and Gujarat High Court Chief Justice Aravind Kumar for elevation as apex court judges. The top court, which has a sanctioned strength of 34 judges including the Chief Justice of India (CJI), is currently functioning with 27 judges.

Former Supreme Court judge Rohinton Fali Nariman has slammed Union Law Minister Kiren Rijiju for his "diatribe" against the collegium system for appointment of judges, and said the government sitting on the names of judges recommended by the collegium was "deadly" for democracy.
Nariman also said that if the last bastion of independent judiciary falls, then the country would enter the "abyss of a new dark age". What is the independence of the judiciary if independent and fearless judges are not being appointed, he said.
He was speaking on Friday at the Mumbai University while delivering the seventh Chief Justice M C Chagla Memorial Lecture.
The former apex court judge also called for a special five-judge bench to be formed and for it to pass a judgment that once a name is sent by the collegium to the government and if the latter has nothing to say within a period of 30 days, then it will be taken as it has nothing to say.
"This sitting on names is a very deadly thing against democracy of this country. Because what you are merely doing is you are waiting for a particular collegium and hoping that the next collegium changes its mind. Appointment must be done within a reasonable time period," Nariman said.
"It is how a constitution works. If you don't have fearless and independent judges say goodbye&hellip;There is nothing left&hellip;As a matter of fact, according to me if finally this last bastion falls or was to fall we would enter the abyss of a new dark age, in which R K Laxman's Common Man will ask himself only one question: if the salt has lost its savour, wherewith will shall it be salted?..." he said.
Nariman was part of the Supreme Court collegium till he retired in August 2021.

Comprehensive consultations with stakeholders must for electoral reforms: Kiren Rijiju

Earlier this month, the Election Commission had held consultations with recognised political parties on this matter.

Law Minister Kiren Rijiju on Wednesday said comprehensive consultations with stakeholders, including political parties, are essential for implementing electoral reforms.
His remarks came against the backdrop of a fresh push by the poll panel for electoral reforms, including the use of remote voting technology to allow migrant voters to exercise their franchise without going to their home states.
Earlier this month, the Election Commission had held consultations with recognised political parties on this matter.
Referring to various proposals on electoral reforms moved by the EC, he said consultations and discussions are "symbols" of a vibrant democracy.
Rijiju said the changes made in election laws a year ago have resulted in addition of over 1.5 crore new voters to the electoral list.

Four cut-off dates instead of the one earlier have helped young eligible citizens to register as voters once they turn 18, he said.
The minister also lauded the move to allow those above 17 years of age to register with the EC in advance. Once they turn 18, their names are added to the voters' list.
Addressing the 13th National Voters' Day event here in the presence of President Droupadi Murmu, Chief Election Commissioner Rajiv Kumar, companion election commissioners and representatives of various political parties, Rijiju recalled the role of various unsung heroes who have not been awarded but have made sacrifices while helping hold free and fair polls.
On the issue of electoral reforms, the minister said he is in constant touch with the Election Commission and has been holding meetings with officials of the poll panel on the issue.
The Legislative Department in the Union law ministry is the nodal agency for issues related to the poll panel, including election laws and related rules.

Law Minister Kiren Rijiju on Tuesday said it was a "matter of grave concern" that certain portions of sensitive reports of the Intelligence Bureau and Research and Analysis Wing were put in public domain by the Supreme Court Collegium.
He said intelligence agency officials work in a secret manner for the nation, and they would "think twice" in future if their reports are made public.
He was responding to questions on some recent Supreme Court Collegium resolutions, which contained potions of IB and RAW reports on certain names recommended by the top court for appointment as high court judges, being made public last week.
The Collegium had reiterated the names to the government earlier this month while rejecting intelligence inputs.
"Putting the sensitive or secret reports of RAW and IB in public domain is a matter of grave concern on which I will react at an appropriate time," Rijiju told reporters at a Law Ministry event in New Delhi.&nbsp;

In an interview, Justice (retd) Sodhi also said the apex court cannot frame laws as it does not have the right to do so. The right to frame laws belongs to Parliament, he said.

The government and the judiciary have been at loggerheads over the process of appointment of judges to the higher judiciary, Rijiju shared the video of an interview of Justice R S Sodhi (retd), a former judge of the Delhi Court, saying it is "voice of a judge" and that majority of people have similar "sane views".
Justice Sodhi said the right to frame laws lies with Parliament.
The law minister also said that "actually majority of the people have similar sane views. It's only those people who disregard the provisions of the Constitution and mandate of the people think that they are above the Constitution of India." "Real beauty of Indian Democracy is its success. People rule themselves through their representatives.Elected representatives represent the interests of the People &nbsp;&amp; make laws. Our Judiciary is independent and our Constitution is Supreme," the minister tweeted.

"... Whether you can amend the Constitution? Only Parliament will amend Constitution. But here I feel the Supreme Court for the first time 'hijacked' the Constitution. The appointment of judges to the Supreme Court and the high courts has become a major flashpoint between the Executive and the Judiciary.

The continuing tussle between the Union government and the Supreme Court over appointment of judges came up in the Parliament on 22 December 2022.
Union Law Minister Kiren Rijiju informed the Rajya Sabha that the government has been receiving representations from many sources alleging lack of transparency, objectivity and social diversity in the collegium system which appoints Supreme Court and High Court judges.
He added that as on 16 December 2022, the Supreme Court had 6 vacancies, and the High Courts had 333 vacancies.

"While every effort is made to fill up the existing vacancies expeditiously, vacancies of judges in high courts do keep on arising on account of retirement, resignation or elevation of judges and also due to increase in the strength of judges," Rijiju said.
Amid a standoff between the government and the Supreme Court Collegium over the appointment of judges, a parliamentary panel had recently asked the Executive and the Judiciary to come up with an &ldquo;out of box thinking&rdquo; to deal with the &ldquo;perennial problem&rdquo; of vacancies in high courts.
The committee also said that it is &ldquo;surprised&rdquo; to note that the Supreme Court and the government have failed to reach at a consensus on revision of the Memorandum of Procedure for appointment of judges to the Supreme Court and the high courts, though the same is under consideration of both for &ldquo;about seven years now&rdquo;.

SC dismisses plea seeking to disclose details of Collegium meeting under RTI Act 

"Collegium is a multi-member body whose tentative decision cannot be brought in the public domain," it said.

The Supreme Court on Friday dismissed a petition seeking details for the SC collegium's meeting held on December 12, 2018.
The plea was filed under the Right to Information Act.
The apex court in its observation said that SC collegium's discussion cannot be disclosed to the public and that only the final decision of the Collegium need to be uploaded in the website.
The petition was filed by RTI Activist Anjali Bharadwaj.

A bench of Justices MR Shah and CT Ravikumar said that only resolutions drawn and signed by all collegium members can be said to be a final decision. Tentative resolutions drawn upon discussion and consultation among the members cannot be said to be final unless they are signed by all of them, it said.
"Collegium is a multi-member body whose tentative decision cannot be brought in the public domain," it said.
The top court said it cannot place reliance on media reports and the interview of a former member of the collegium and doesn't want to comment on statements made by the former judge.
