In a recent interview on NBC&rsquo;s Meet the Press, Trump described the current policy as &ldquo;ridiculous,&rdquo; arguing that it promotes illegal immigration and &ldquo;birth tourism.&rdquo; However, this proposed move is expected to face significant legal and constitutional challenges, potentially affecting millions, including Indian immigrants in the United States.
What is Birthright Citizenship?
Birthright citizenship, enshrined in the 14th Amendment to the US Constitution, grants automatic citizenship to anyone born on US soil, irrespective of their parents' immigration status. This longstanding practice, ratified in 1868, was originally designed to ensure citizenship for formerly enslaved people and their descendants. The amendment explicitly states:
"All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside."
Currently, the United States is among the few countries worldwide to offer this unconditional right. Critics, including Trump, argue that the policy is exploited by undocumented immigrants and foreign nationals who travel to the US solely to secure citizenship for their children. On the contrary, advocates view this as a fundamental right that prevents the creation of a stateless underclass and facilitates the integration of immigrant families.
Trump&rsquo;s Argument and Proposed Changes
Trump has been vocal about eliminating birthright citizenship, stating that it incentivizes illegal immigration and poses a financial burden on the country. His proposal includes using an executive order to limit citizenship to children born to at least one parent who is either a US citizen or a lawful permanent resident.

Indians are among the fastest-growing immigrant communities in the United States, with over 5.4 million Indian-Americans accounting for 1.47% of the population. Of these, approximately two-thirds are immigrants, while 34% are US-born. Trump&rsquo;s proposed changes could disproportionately impact this community, especially those on temporary visas or undocumented statuses.
Russell A. Stamets, a partner at Circle of Counsels, emphasized the broader implications of Trump&rsquo;s anti-immigration agenda:
"The threatened end of birthright citizenship makes emigrating, working, or remaining in the United States much more difficult and unpredictable for all immigrants, Indians included."

The Migration Policy Institute estimates that 5.5 million children under 18 live with at least one undocumented parent, most of whom are US citizens. Removing birthright citizenship could exacerbate illegal immigration issues and create a permanent class of residents excluded from full social and political rights.
Can Trump Succeed?
Despite Trump&rsquo;s determination, experts remain skeptical about his ability to eliminate birthright citizenship through executive action. Alex Nowrasteh, Vice President at the pro-immigration Cato Institute, dismissed the likelihood of success:
"I don&rsquo;t take his statements very seriously. He has been saying things like this for almost a decade. He didn&rsquo;t do anything to further this agenda when he was president before."
Legal challenges, public opposition, and entrenched constitutional protections suggest that Trump&rsquo;s proposal is more likely to instill fear and uncertainty than effectuate substantive policy changes.

2022 saw the highest number of Indians renouncing their citizenship in the last 12 years, the Parliament was informed on 9 February 2023.
2,25,620 Indians gave up their citizenship last year. Since 2011, 16 lakh people have renounced their Indian citizenship. External Affairs Minister S. Jaishankar also provided a list of 135 countries whose citizenship was acquired by these individuals.
Jaishankar said the number of Indians who renounced their Indian citizenship in 2015 was 1,31,489, while 1,41,603 people gave it up in 2016 and 1,33,049 in 2017. In 2018, the number was 1,34,561, while 1,44,017 renounced their citizenship in 2019, 85,256 in 2020 and 1,63,370 in 2021. The number in 2022 was 2,25,620, according to the minister.
For reference purposes, Jaishankar said the data for 2011 was 1,22,819, while it was 1,20,923 in 2012, 1,31,405 in 2013 and 1,29,328 in 2014.
The total number of Indians who gave up their Indian citizenship since 2011 comes to 16,63,440.

The resolutions were moved by JD(U) legislator Joykishan as he raised concerns over the alleged infiltration of so-called outsiders into Manipur.&nbsp;

The resolutions were moved by JD(U) legislator Kh Joykishan on Friday, the last day of the budget session of the state assembly.
He claimed that the hill areas of the state saw a population growth of 153.3 per cent between 1971 and 2001, and it mounted to 250.9 per cent during the 2001-2011 period.
The valley areas also recorded a population growth of 94.8 per cent from 1971 to 2001 and around 125 per cent from 2001 to 2011, Joykishan stated. The JD(U) MLA raised his concern over the alleged infiltration of outsiders into Manipur.
He claimed that there are restrictions on people from the valley districts for settling in the hills, and the whopping population growth, particularly in the hills, could be attributed to the alleged influx of people from outside.
