&nbsp;The Supreme Court on Wednesday refused to entertain submissions seeking an early setting up of a fresh bench to hear Bilkis Bano's plea challenging the remission of sentence of 11 convicts by the Gujarat government in her gang-rape case A bench comprising Chief Justice D Y Chandrachud and Justice P S Narasimha was urged by lawyer Shobha Gupta, appearing for Bano, that another bench was needed to be constituted to hear the case.
&ldquo;The writ (petition) will be listed. Please, do not keep mentioning the same thing again and again. It is very irritating,&rdquo; the CJI said.
Supreme Court judge Bela M Trivedi on Tuesday recused herself from hearing a plea filed by Bano.

The CJI will now have to set up a fresh bench, to which Justice Trivedi will not be a part, to hear Bano&rsquo;s case.
All the 11 convicts were granted remission by the state government and released on August 15 this year.
Bilkis Bano was 21-years-old and five months pregnant when she was gang-raped while fleeing the riots that broke out after the Godhra train burning incident. Her three-year-old daughter was among seven family members killed at that time.
The investigation in the case was handed over to the CBI and the trial was transferred to a Maharashtra court by the Supreme Court.
A special CBI court in Mumbai had on January 21, 2008 sentenced the 11 to life imprisonment.
Their conviction was later upheld by the Bombay High Court and the Supreme Court.
The 11 men convicted in the case walked out of the Godhra sub-jail on August 15 after the Gujarat government allowed their release under its remission policy. They had completed more than 15 years in jail.

Rahul on Bilkis Bano case: talk of respect for women from Red Fort but 'support' for rapists

A day after the Gujarat government told the Supreme Court that it obtained "suitable orders" from the Centre for granting remission to the convicts in the Bikis Bano gang rape case, Congress leader Rahul Gandhi on Tuesday attacked Prime Minister Narendra Modi, alleging that while there was talk of respect for women from the Red Fort, but in reality there was "support" for rapists.
The Gujarat government on Monday had told the Supreme Court that petitioners challenging the remission given to 11 convicts in the Bilkis Bano gang rape case are nothing but an "interloper" and a "busybody".
"Talk of respect for women from the ramparts of the Red Fort but in reality support for 'rapists'," Gandhi said in a tweet in Hindi.
"The difference between the Prime Minister's promises and intentions is clear, PM has only betrayed women," he said.
His attack came after the Gujarat government also told the Supreme Court that since the investigation in the case was carried out by the CBI, it had obtained "suitable orders" for grant of remission to the convicts from the Centre.

Days after eleven men convicted of raping Bilkis Bano and killing her family during the 2002 Gujarat riotswalked free, Justice UD Salvi, now-retired who convited the accused 14 years ago has raised questions on decision to set them free. 
Justice UD Salvi (retired) has even criticised the way all convicts were welcomed as heroes with garlands and sweets. 
‘Whoever took this decision should reconsider this, that's all I can say," Justice UD Salvi said while addressing the media in Mumbai on Tuesday. I don’t think the government considered the severity of crime, he added. 
All the men walked out of a Gujarat jail on 15 Aug as India celebrated its 75th Independence Day after the state government allowed the release of convicted men under remission policy. 
The state and Centre government drew massive criticism from opposition over the decision.“The government should have considered the punishment given to the convicts, the crimes they committed, and also the victim. I do not think any of this was done. I heard the guidelines followed while granting remission were from the 1992 policy and not the new policy formulated in 2014. The new policy does not have provisions for remission in such offenses,” Justice Salvi pointed out.
Justice Salvi mentioned that although the government has the right to give remission as per law, it should have been used thoughtfully.

The National Human Rights Commission is likely to take up on Monday the release from Godhra sub-jail of 11 convicts serving life imprisonment in the Bilkis Bano gangrape and murder case from the 2002 Gujarat riots, as per a report by The Indian Express. 

The report holds significance given the crucial role the NHRC played in assisting Bano in her fight for justice.

The National Human Rights Commission is likely to take up on Monday the release from Godhra sub-jail of 11 convicts serving life imprisonment in the Bilkis Bano gangrape and murder case from the 2002 Gujarat riots, as per a report by The Indian Express.
The office of the NHRC chairperson Justice Arun Mishra, when contacted by the daily confirmed the report.
The 11 convicts, who were sentenced to life for raping a 5-months pregnant Bilkis Bano and murdering her five-year-old daughter and 13 others, were released on August 15 under the Gujarat government's remission policy. The government was advised by a 10-member committee. Of these 10 members, 5 have links with the ruling Bharatiya Janata Party (BJP), reported NDTV.
The report holds significance given the crucial role the NHRC played in assisting Bano in her fight for justice. In 2003, after the Gujarat police had closed the case, it was the human rights body that provided legal assistance to Bano in her appeal to the Supreme Court.
The NHRC, under former Chief Justice of India J S Verma, had met her during a visit to a relief camp in Godhra in March 2002 and appointed senior advocate and former Solicitor General Harish Salve to represent her before the top court.

The CBI special court on January 21, 2008, convicted 13 accused, sentencing 11 to life imprisonment on the charge of gangrape and murder. The conviction was upheld by the Bombay High Court in May 2017.
Meanwhile, the US Commission of International Religious Freedom (USCIRF) on Friday strongly condemned the &ldquo;unjustified&rdquo; early release of the convicts. Calling the early release of the convicts a &ldquo;travesty of justice&rdquo;, USCIRF Commissioner Stephen Schneck said it was part of a &ldquo;pattern of impunity&rdquo; for those involved in the violence against religious minorities in India.
On August 17, two days after the convicts were released, Bano issued a statement through her lawyer stating, "The release of these convicts has taken from me my peace and shaken my faith in justice.&rdquo;&nbsp; &nbsp;

Speaking to The Indian Express, Bano's husband Yakub Rasool told the publication that they were left numb, shocked and shaken upon hearing the news.
The battle which they fought for so many years has been wrapped up in one moment, he said adding that they had never even heard of the word ‘remission’.
When contacted by the newspaper, Bilkis requested them to leave her alone as she was unable to talk to anyone.
The couple is also feared for the safety of their family.

He further asked the Prime Minister if he was not ashamed of playing such politics.

In its 2018 order upholding the conviction of the accused persons, the Bombay High Court set aside the acquittal of seven persons.
The Supreme Court, in April 2019, directed the Gujarat government to pay Rs 50 lakh compensation, a job, and a house to Bilkis Bano.

Trinamool Congress MP Mahua Mitra has reacted to Gujarat government's decision to allow early release of 11 convicts in the Bilkis Bano rape case during 2002 Gujarat riots.&nbsp; Mitra, who is an outspoken critic of the BJP, wrote on twitter the nation should decide if 'Bilkis Bano is a woman or a Muslim'.
A pregnant Bilkis Bano, who was gang-raped in the 2002 Godhra riots, issued a statement saying the release of the convicts had shaken her faith in the justice system. She appealed to the Gujarat government to 'undo the harm' and give her back the right to live her life.

Bilkis Bano, a survivor of 2002 Gujarat riots, only had questions and a request as she spoke after the 11 men who were convicted of raping her and murdering her family members were released from Gujarat’s Godhra jail. 
Speaking to NDTV, Bano said that trauma of the past 20 years washed over her again when she heard that the 11 men who devastated her family and took her 3-year-old daughter away from her had walked free. 
She questioned how justice for any woman can end in this manner. Bano added that the release of these convicts had taken away her peace and shaken her faith in justice. 
Saying that nobody asked her before taking such a big decision, she appealed Gujarat govt to undo the harm and give her back her right to live without fear and in peace. 
All the eleven convicts sentenced to life imprisonment for the 2002 post-Godhra Bilkis Bano gang rape and murder of seven members of her family on Monday walked out of Godhra sub-jail after the Gujarat government allowed their release under its remission policy. 
Bilkis Bano was 21 years old and five months pregnant when she was raped while fleeing the violence that broke out post the Sabarmati train incident in Godhra.

Post their release, the convicts were given a grand welcome by their family members outside the jail.&nbsp;
The Gujarat government's decision evoked sharp reactions from the public with many questioning the grounds for granting remission to men who were convicted for raping a then pregnant Bilkis Bano and murdering her family members.&nbsp;
While there were many victims of the riots, Bano's case stood out for the sheer brutality that was unleashed on her and her family.&nbsp;
<h3>Who is Bilkis Bano and what is her story? &nbsp;&nbsp;</h3>
Bilkis Bano, and her family, were among the many victims of the 2002 riots that broke out in Gujarat a day after the Sabarmati Express caught fire in Godhra.&nbsp;
On February 28, 2002, Bilkis, a resident of Radhikpur village in Dahod district, Gujarat, was five months pregnant and was fleeing her village with her three-and-a-half-year-old daughter, Saleha, and 15 other family members to escape the violence that had erupted targeting Muslims.&nbsp;
Three days later, on March 3, 2002, the family reached Chapparwad village and took shelter in a field when about 20-30 people, including the 11 accused, armed with sickles, swords and sticks attacked Bilkis and her family, according to the chargesheet.&nbsp;
In the attack, five women including Bilkis and her mother were gangraped and thrashed. Of the 17 family members, eight died and six went missing. Only Bilkis, a man, and a three-year-old survived the attack. &nbsp;&nbsp;
Bilkis&rsquo; 3-year-old daughter was snatched by the attackers and was murdered when her head was smashed to the ground.&nbsp;
After regaining consciousness a few hours later, Bilkis borrowed clothes from an Adivasi woman as her clothes were torn by the mob.
She then met a home guard who took her to the Limkheda police station where she registered a complaint with head constable Somabhai Gori. &nbsp;
Gori was later charged by the Central Bureau of Investigation (CBI) for &ldquo;suppressing material facts&rdquo; and &ldquo;writing a distorted and truncated version&rdquo; of her complaint. &nbsp;

Facing lack of cooperation from the local police, Bano approached the National Human Rights Commission (NHRC) and filed a plea in the Supreme Court in December 2003. The top court heard the case and ordered a CBI probe into the incident.&nbsp;
<h3>What were the findings of CBI? &nbsp; &nbsp;</h3>
After taking over the investigation, the CBI exhumed the bodies of the seven killed in the attack as it felt that the postmortem was shoddily done to protect the accused. The agency found no skulls on any of the bodies as the heads of the corpses had been severed after postmortem to evade identification.&nbsp;
During the trial, the case was shifted from Gujarat to Maharashtra after Bano said she received death threats. In Mumbai, charges were filed against 19 men, including six police officers and a government doctor. &nbsp;
While seven persons were acquitted by the court citing lack of evidence including the policemen and doctors, one died during the course of the trial. &nbsp;&nbsp;
In January 2008, 11 persons were found guilty by the trial court for conspiring to rape a pregnant woman, murder and unlawful assembly and under other sections of the Indian Penal Code.&nbsp;
The court held that Jaswantbai Nai, Govindbhai Nai, Naresh Kumar Mordhiya (deceased) raped Bilkis while Shailesh Bhatt killed her daughter, Saleha, by &ldquo;smashing&rdquo; her on the ground. &nbsp;
The others convicted are Radheshyam Shah, Bipin Chandra Joshi, Kesarbhai Vohania, Pradeep Vohania, Bakabhai Vohania, Rajubhai Soni, Nitesh Bhatt, Ramesh Chandana and head constable of Limkheda police station, Somabhai Gori. &nbsp;
All 11 convicts were sentenced to life imprisonment by the court. &nbsp;&nbsp;
The Bombay High Court in May 2017 upheld the conviction and life imprisonment of 11 people in the gangrape case, while setting aside the acquittal of seven people, including the policemen and doctors.&nbsp;
On May 15, 2022, one of these convicts went before the Supreme Court and pleaded for an early release after serving more than 15 years.
