Bilkis thanked the top court which quashed the remission of 11 men convicted of gangraping her and murdering seven of her family members during the 2002 Gujarat riots.

This is what justice feels like, Bilkis Bano said after the Supreme Court on Monday quashed the remission granted to 11 men convicted of raping her and murdering seven members of her family during the 2002 riots in Gujarat.
While quashing the Gujarat government's decision to grant remission, the apex court also said the state government's order was "stereotyped" and passed without application of mind.
In a statement issued through her lawyer Shobha Gupta, Bano thanked the top court for the verdict and said "today is truly the New Year for me".
"I have wept tears of relief. I have smiled for the first time in over a year and half. I have hugged my children. It feels like a stone the size of a mountain has been lifted from my chest, and I can breathe again," Bano said.
"This is what justice feels like. I thank the honourable Supreme Court of India for giving me, my children and women everywhere this vindication and hope in the promise of equal justice for all," Bano said. Accusing the Gujarat government of abusing its power, the Supreme Court also ordered that the 11 men be sent back to jail within two weeks.
In the statement, Bano also said that journeys like that of hers can never be made alone.
"I have had my husband and my children by my side. I have had my friends who have given me so much love at a time of such hate, and held my hand at each difficult turn. I have had an extraordinary lawyer, Advocate Shobha Gupta, who has walked with me unwaveringly for over 20 long years, and who never allowed me to lose hope in the idea of justice," she said.
She said that "a year and half ago, on August 15, 2022, when those who had destroyed my family and terrorised my very existence, were given an early release, I simply collapsed".
Bano said she felt she had exhausted her "reservoir of courage", until a "million solidarities" came her way.
"Thousands of ordinary people and women of India came forward. They stood with me, spoke for me, and filed PIL petitions in the Supreme Court. 6,000 people from all over, and 8,500 people from Mumbai wrote appeals, 10,000 people wrote an Open Letter, as did 40,000 people from 29 districts of Karnataka," she said.
"To each of these people, my gratitude for your precious solidarity and strength. You gave me the will to struggle, to rescue the idea of justice not just for me, but for every woman in India. I thank you," Bano said.
She said even as she absorbs the full meaning of this verdict "for my own life, and for my children's lives, the 'dua' that emerges from my heart today is simple -- the rule of law, above all else and equality before law, for all".

&nbsp;The Supreme Court on Monday quashed the Gujarat government's decision to grant remission to 11 convicts in the case of gangrape of Bilkis Bano and murder of seven of her family members during the 2002 riots in the state,

The Supreme Court on Monday set aside the remission order of Bilkis Bano's rapists while ruling that the Gujarat government was not the competent authority to pass the orders. The top court has directed all 11 rapists to surrender within two weeks.&nbsp;
The men were convicted for raping a pregnant Bilkis Bano, who was 21 at the time, and murdering 7 of her family members, including her 3-year-old daughter, in 2002 during the Godhra riots. The Gujarat government granted them remission in August 2022 and ordered their early release.
While overturning the decision, the bench, comprising Justices BV Nagarathna and Ujjal Bhuyan,&nbsp;argued that since the rapists were convicted and sentenced in Maharashtra, Gujarat "had no jurisdiction to entertain the application for remission or pass the orders as it was not the appropriate government&rdquo;.
"We need not have gone into the other issues. But for sake of completion, we have. Rule of law is breached because the Gujarat government usurped power not vested in it and abused its power. On that ground also, the remission orders deserve to be quashed," the bench said while pronouncing the judgement which spanned over 100 pages.
The court also noted that its May 2022 order allowing the Gujarat government to apply for remission and order the premature release of the convicts was secured by fraud and deemed invalid.
"We strike down the remission orders on the ground of usurpation of power by Gujarat government," the bench said.
On August 15 last year, the Gujarat government released the 11 convicts under its 1992 remission and premature release policy. This happened after one of the convicts, Radheshyam Shah, who was sentenced to life imprisonment by a CBI court in Mumbai in 2008, approached the apex court after completing 15 years and four months in jail.
Following the release of her rapists, Bano filed a plea in the SC objecting to the premature release of the convicts. In her petiton, she said that she was "shell shocked, completely numb&hellip;&rdquo; after the convicts were released.
The top court had reserved the verdict on October 12 last year after holding hearings for 11 days.&nbsp;

Bilkis Bano has challenged the remission of sentence and subsequent release of 11 convicts in the gangrape and murder case.

The Supreme Court said on 22 March 2023 that it would constitute a special bench to hear the petition filed by Bilkis Bano, who was gang-raped and whose family was murdered during the 2002 Gujarat riots.
Chief Justice of India DY Chandrachud said that he will look into constituting the bench later in the day.
Bilkis Bano has challenged the remission of sentence and subsequent release of 11 convicts in the gangrape and murder case. Besides the plea challenging the release of the convicts, the gang rape survivor had also filed a separate petition seeking a review of the apex court's May 13, 2022 order on a plea by a convict.
Seven members of Bilkis Bano's family were also killed during the 2002 Gujarat riots.
In its May 13, 2022 order, the apex court had asked the state government to consider the plea of a convict for premature release in terms of its policy of July 9, 1992 which was applicable on the date of conviction and decide it within a period of two months.

The Supreme Court has dismissed a plea filed by Bilkis Bano, seeking a review of its earlier order by which it had asked the Gujarat government to consider the petitions for remission of sentences of 11 convicts in the gang-rape case.

According to procedures, review pleas against apex court judgments are decided in chambers by circulation by the judges who were part of the judgment under review.
The review plea came up for in-chamber consideration on December 13 before a bench of justices Ajay Rastogi and Vikram Nath.

The gang-rape survivor had sought a review of the top court's May 13 order on a plea moved by a convict.
The top court had asked the state government to consider the plea for a premature release of the convicts in terms of its policy of July 9, 1992 about deciding a remission petition within a period of two months.
All the 11 convicts were granted remission by the Gujarat government and released on August 15.

&ldquo;The writ (petition) will be listed. Please, do not keep mentioning the same thing again and again. It is very irritating,&rdquo; the CJI said.
Supreme Court judge Bela M Trivedi on Tuesday recused herself from hearing a plea filed by Bano.

All the 11 convicts were granted remission by the state government and released on August 15 this year.
Bilkis Bano was 21-years-old and five months pregnant when she was gang-raped while fleeing the riots that broke out after the Godhra train burning incident. Her three-year-old daughter was among seven family members killed at that time.
The investigation in the case was handed over to the CBI and the trial was transferred to a Maharashtra court by the Supreme Court.
A special CBI court in Mumbai had on January 21, 2008 sentenced the 11 to life imprisonment.
Their conviction was later upheld by the Bombay High Court and the Supreme Court.
The 11 men convicted in the case walked out of the Godhra sub-jail on August 15 after the Gujarat government allowed their release under its remission policy. They had completed more than 15 years in jail.

The Bharatiya Janata Party (BJP) has won the Limkheda Assembly seat in Gujarat's Dahod district where 2002 riots victim Bilkis Bano once lived.
The candidate of the opposition Congress which had promised to revoke the remission granted by the BJP-led state government to 11 convicts in the Bilkis Bano gangrape case ended up third, polling 8,000 votes.
Bano was a resident of Randhikpur village in the tribal-dominated Dahod district.
Sitting BJP MLA Shailesh Bhabhor defeated his closest rival, Aam Aadmi Party's Naresh Baria by nearly 4,000 votes.
The premature release of 11 convicts in the Bilkis Bano case became an issue in the election campaign, with the Congress mentioning it in its manifesto and vowing to ensure justice for her.
Following the remission, the 11 men walked out of the Godhra sub-jail on August 15.
Some activists and observers had predicted that as the AAP leaders remained silent on the issue while Congress leaders like Jingnesh Mevani were vocal about it, Muslims would vote for the Congress.
But ahead of the polls, Shailesh Bhabhor had confidently claimed that Bilkis Bano was never a poll issue and even Muslims supported the BJP.

Ahead of the Gujarat elections, the Congress targeted the BJP over the release of men convicted for the gangrape of Bilkis Bano and murder of her family during the 2002 riots.
Despite allegations of bias against the minority community, the BJP managed to win most of the constituencies considered Muslim-majority areas.
There are at least 12 Muslim-dominated seats, according to reports, and BJP won ten of them.

The Congress bagged the other two Muslim-majority seats of Danilimda and Jamalpur-Khadia.

A day after the Gujarat government told the Supreme Court that it obtained "suitable orders" from the Centre for granting remission to the convicts in the Bikis Bano gang rape case, Congress leader Rahul Gandhi on Tuesday attacked Prime Minister Narendra Modi, alleging that while there was talk of respect for women from the Red Fort, but in reality there was "support" for rapists.
The Gujarat government on Monday had told the Supreme Court that petitioners challenging the remission given to 11 convicts in the Bilkis Bano gang rape case are nothing but an "interloper" and a "busybody".
"Talk of respect for women from the ramparts of the Red Fort but in reality support for 'rapists'," Gandhi said in a tweet in Hindi.
"The difference between the Prime Minister's promises and intentions is clear, PM has only betrayed women," he said.
His attack came after the Gujarat government also told the Supreme Court that since the investigation in the case was carried out by the CBI, it had obtained "suitable orders" for grant of remission to the convicts from the Centre.

The activists will march under the banner of 'Hindu Muslim Ekta Samiti' and cover the 180-kilometre distance between September 26 and October 4, with social activist Sandeep Pandey and MLA Jignesh Mevani set to participate along with 25 others, organising committee member Kalim Siddique said.
The release of the convicts is a matter of shame in a country that is identified the world over for its spirituality and the values and virtues of Mahatma Gandhi, the group said in a release.
"It is a shame that Gujarat, which produced a global stalwart like Mahatma Gandhi, is silent today on people who have committed heinous crimes," it added.
There was need to speak out "so that humanity survives, so that moral values and ethical standards are respected, so that innocent people feel safe and criminals are discouraged", the group said.
It said the march was to tell Bilkis Bano that "we're sorry" and to hope that such a fate does not befall anyone else.

Days after eleven men convicted of raping Bilkis Bano and killing her family during the 2002 Gujarat riotswalked free, Justice UD Salvi, now-retired who convited the accused 14 years ago has raised questions on decision to set them free. 
Justice UD Salvi (retired) has even criticised the way all convicts were welcomed as heroes with garlands and sweets. 
‘Whoever took this decision should reconsider this, that's all I can say," Justice UD Salvi said while addressing the media in Mumbai on Tuesday. I don’t think the government considered the severity of crime, he added. 
All the men walked out of a Gujarat jail on 15 Aug as India celebrated its 75th Independence Day after the state government allowed the release of convicted men under remission policy.

Some of the convicts in the Bilkis Bano case of the 2002 Gujarat riots are "Brahmins" with good 'sanskaar' or values and it is possible they may have been fixed due to their past family activities, a BJP MLA, who was a part of the state government panel that recommended remission to all the 11 men found guilty, said on Thursday.
C K Raulji, the Bharatiya Janata Party (BJP) MLA from Godhra, said he does not know whether the convicts, released after spending more than 15 years in jail, were involved in the crime.
On August 15, all the 11 convicts sentenced to life imprisonment in the 2002 case of Bilkis Bano's gang rape and murder of her seven family members during the communal riots walked out of the Godhra sub-jail after the BJP government in Gujarat allowed their release under its remission policy.
"We took the decision on the basis of a Supreme Court order. We were asked to look at their (convicts') behaviour and decide (on their early release)," Raulji, who was one of the members of the government-appointed committee that recommended granting of remission to the convicts, told a news portal.
"We asked the jailer and learnt that their behaviour was good in the prison...also (some of the convicts) are Brahmins. They have good 'sanskaar' (values)," said the ruling party legislator.
The Gujarat government's decision has invited sharp criticism from the opposition parties who have said the move was against the Centre's guidelines.
However, Raulji said the convicts may have been fixed.
"It is possible that they (the convicts) might have been fixed in the case due to their past family activities. When such riots take place it happens that those who are not involved are named. But I don't know if they committed the crime, we decided (on remission) based on their behaviour," he said.
Asked about the welcome accorded to the 11 men after their release from prison, he said they had not welcomed them.
The Gujarat government released the 11 convicts after the Supreme Court directed it to consider their plea for relief under the state's 1992 remission policy.
A special CBI court in Mumbai had on January 21, 2008, sentenced to life imprisonment all the 11 accused in the case for murder of seven family members of Bilkis Bano, a riots survivor, and her gang rape. Their conviction was later upheld by Bombay High Court.
These convicts served more than 15 years in prison after which one of them approached the Supreme Court with a plea for his premature release.
The apex court had directed the Gujarat government to look into the issue of remission of his sentence as per its 1992 policy on the basis of the date of his conviction. Thereafter, the government formed a committee which took the decision to allow release of all the convicts.
On March 3, 2002, Bilkis Bano's family was attacked by a mob at Randhikpur village in Limkheda taluka of Dahod district. Bilkis, who was five months pregnant at the time, was gang raped and seven members of her family were killed during the riots triggered by the Godhra train burning incident.

On February 28, 2002, Bilkis, a resident of Radhikpur village in Dahod district, Gujarat, was five months pregnant and was fleeing her village with her three-and-a-half-year-old daughter, Saleha, and 15 other family members to escape the violence that had erupted targeting Muslims.&nbsp;
Three days later, on March 3, 2002, the family reached Chapparwad village and took shelter in a field when about 20-30 people, including the 11 accused, armed with sickles, swords and sticks attacked Bilkis and her family, according to the chargesheet.&nbsp;
In the attack, five women including Bilkis and her mother were gangraped and thrashed. Of the 17 family members, eight died and six went missing. Only Bilkis, a man, and a three-year-old survived the attack. &nbsp;&nbsp;
Bilkis&rsquo; 3-year-old daughter was snatched by the attackers and was murdered when her head was smashed to the ground.&nbsp;
After regaining consciousness a few hours later, Bilkis borrowed clothes from an Adivasi woman as her clothes were torn by the mob.
She then met a home guard who took her to the Limkheda police station where she registered a complaint with head constable Somabhai Gori. &nbsp;

<a href="https://www.editorji.com/india-news/video-sweets-tilak-for-convicts-in-bilkis-bano-rape-case-as-they-walk-out-of-jail-1660647529705">Bilkis Bano</a> was taken to the hospital for medical examination only after she took shelter in the Godhra relief camp. &nbsp;&nbsp;
Facing lack of cooperation from the local police, Bano approached the National Human Rights Commission (NHRC) and filed a plea in the Supreme Court in December 2003. The top court heard the case and ordered a CBI probe into the incident.&nbsp;
<h3>What were the findings of CBI? &nbsp; &nbsp;</h3>
After taking over the investigation, the CBI exhumed the bodies of the seven killed in the attack as it felt that the postmortem was shoddily done to protect the accused. The agency found no skulls on any of the bodies as the heads of the corpses had been severed after postmortem to evade identification.&nbsp;
During the trial, the case was shifted from Gujarat to Maharashtra after Bano said she received death threats. In Mumbai, charges were filed against 19 men, including six police officers and a government doctor. &nbsp;
While seven persons were acquitted by the court citing lack of evidence including the policemen and doctors, one died during the course of the trial. &nbsp;&nbsp;
In January 2008, 11 persons were found guilty by the trial court for conspiring to rape a pregnant woman, murder and unlawful assembly and under other sections of the Indian Penal Code.&nbsp;
The court held that Jaswantbai Nai, Govindbhai Nai, Naresh Kumar Mordhiya (deceased) raped Bilkis while Shailesh Bhatt killed her daughter, Saleha, by &ldquo;smashing&rdquo; her on the ground. &nbsp;
The others convicted are Radheshyam Shah, Bipin Chandra Joshi, Kesarbhai Vohania, Pradeep Vohania, Bakabhai Vohania, Rajubhai Soni, Nitesh Bhatt, Ramesh Chandana and head constable of Limkheda police station, Somabhai Gori. &nbsp;
All 11 convicts were sentenced to life imprisonment by the court. &nbsp;&nbsp;
The Bombay High Court in May 2017 upheld the conviction and life imprisonment of 11 people in the gangrape case, while setting aside the acquittal of seven people, including the policemen and doctors.&nbsp;
On May 15, 2022, one of these convicts went before the Supreme Court and pleaded for an early release after serving more than 15 years.

Eleven convicts had been sentenced to life imprisonment by a special CBI court in Mumbai in January 2008. The verdict was upheld by the Bombay High Court.
After having spent over 15 years in jail, one of the convicts reportedly approached the Supreme Court for premature release. The apex court asked the Gujarat government to decide the matter, and subsequently a committee was formed.
The panel recommended remission for the 11 convicts, and the state government accepted it. On 15 August, the 11 convicts walked out of the Godhra sub-jail.
