The Supreme Court on Thursday refused to entertain a plea claiming that several seriously injured survivors of the 1984 Bhopal gas tragedy were under-compensated because they were "misclassified" as having temporary disablement or minor injuries.
A bench comprising Chief Justice B R Gavai and Justice K Vinod Chandran gave the petitioner organisations the liberty to approach the jurisdictional high court on the matter.
The bench also made it clear that the apex court has not considered the merits of the matter.
Highly toxic gas methyl isocyanate leaked from the Union Carbide factory during the intervening night of December 2-3, 1984, eventually killing 5,479 people and maiming over five lakh. It is considered to be among the worst industrial disasters in the world.
When the matter came up for hearing before the bench, the CJI said decades have already gone by.
"Do we possess the expertise that a person should have been classified in A category or B category?" the bench asked.
The counsel for the petitioner organisations said they have made a limited prayer in the plea and are not seeking to reopen anything.
The petitioners sought directions to the Centre and the Madhya Pradesh government to take suitable steps to identify and compensate those who were under-compensated because of them having been misclassified as 'temporary disablement' or 'minor injury' under the provisions of the Bhopal Gas Leak Disaster (Processing of Claims) Act, 1985 and the scheme.
The counsel said a large number of people suffered from kidney failure and cancer due to the gas disaster and were being treated as minor injury cases.

The Madhya Pradesh High Court has directed the Union Health Ministry Secretary, the Chief Secretary of Madhya Pradesh, and the Bhopal Memorial Hospital and Research Centre to finalize an action plan within a week for digitizing medical records of survivors from the 1984 Bhopal gas tragedy.
The court issued this order on January 6, and it was made public on Wednesday. A bench comprising Chief Justice SK Kait and Justice Vivek Jain was hearing a contempt petition filed by the Bhopal Gas Peedith Mahila Udyog Sanghathan concerning the rehabilitation of the gas tragedy survivors. The court expressed concern over the lack of seriousness in executing the task and ordered that the responsible officials meet within a week to finalize a timeline for completing the digitization.
In its order, the court stressed the urgency of ensuring funds are allocated for the project and ordered the submission of daily progress reports. The respondents&rsquo; affidavit, filed in response to a December 9, 2024, court directive, mentioned that medical records from before 2014 were in poor condition, with only 3,000 pages being scanned daily. This means the work could take around 550 days, but exact timelines will be clearer once the process starts.
Additionally, the National Informatics Centre (NIC) has submitted a proposal for setting up a cloud server under the e-hospital project. The financial approval from the Finance Department is pending, with funding expected in the 2025-26 fiscal year. Once approved, the scanned records will be uploaded to the server, and the digitization work should be completed in approximately 12 months.

Amid protests over the shifting of waste from the Union Carbide factory here to Dhar for disposal, Madhya Pradesh Chief Minister Mohan Yadav on Thursday said it was not poisonous and there should be no politics over it.
Addressing a press conference in Bhopal, Yadav said scientific studies have been carried out and a safe technology will be used in the incineration process.
Politics should not be done over the issue, the chief minister said.
Dhar guardian minister Kailash Vijayvargiya will talk to the people in that district and share information that the waste was "not at all poisonous" or harmful, he said.
Forty years after the Bhopal gas tragedy, 377 tons of waste has been shifted from the defunct Union Carbide factory for its disposal at a unit in Dhar district.
It was transported at around 9 pm on Wednesday in 12 sealed container trucks via a 'green corridor' from Bhopal to Pithampur industrial area in Dhar district, located 250 km away.
Amid tight security, the vehicles reached around 4.30 am on Thursday at a factory in Pithampur where the waste will be disposed of, a senior police official said in earlier in the day.
A group of people led by an organisation took out a protest rally in Pithampur against shifting of the waste there.
They claimed the waste disposal in Pithampur was unsafe for its residents and the environment.
The protesters also called for 'Pithampur Bandh' on Friday.
A large number of people on Sunday also took out a protest march in Pithampur to oppose the disposal of Union Carbide waste in the city, having a population of about 1.75 lakh and located 30 km from Indore.

The HC set a four-week deadline to shift the waste, observing that even 40 years after the gas tragedy, authorities were in a "state of inertia".
The high court had warned the government of contempt proceedings if its directive was not followed.
"If everything is found to be fine, the waste will be incinerated within three months. Otherwise, it might take up to nine months," Bhopal Gas Tragedy Relief and Rehabilitation Department Director Swatantra Kumar Singh said on Wednesday.
Initially, some of the waste will be burnt at the disposal unit in Pithampur and the residue (ash) will be examined to find whether any harmful elements are left, he said.
The smoke from the incinerator will pass through special four-layer filters so that the surrounding air is not polluted, he added.
Once it is confirmed that no traces of toxic elements are left, the ash will be covered by a two-layer membrane and buried to ensure it does not come in contact with soil and water in any way.
A team of experts under the supervision of officials of the Central Pollution Control Board and State Pollution Control Board will carry out the process, Singh said.

A monitoring committee appointed by the Supreme Court to look into the Bhopal gas tragedy has flagged glaring inefficiencies in the aid provided to the victims over the years.
According to Indian Express, the panel raised several red flags before the Madhya Pradesh High Court, which has started a contempt proceedings against three senior state officials.
The committee revealed that the medical records in gas relief hospitals were not digitised. The panel also flagged vacant posts in the hospitals run by the Bhopal Gas Tragedy Relief and Rehabilitation Department.
The panel found that there are 498 vacancies against 1,247 sanctioned posts in hospitals run by the department.
Despite Supreme Court's direction in 2012, about 4.6 lakh victims weren't given health booklets.
The gas leak which took place on the night of December 2-3, 1984, had killed thousands of people and lakhs suffered its long-term effects.
