Union Home Minister Amit Shah on Monday clarified that the first case under the Bharatiya Nyaya Sanhita was filed in Madhya Pradesh's Gwalior and not the one filed against a street vendor in Delhi.
"The first case [under the new law] has been registered at a police station in Gwalior. It was a case of theft, someone's motorcycle worth ₹1.8 lakh was stolen. The case was registered at 12.10 am," said Shah.
"As far as the case against a vendor [registered at a police station in Delhi] is concerned, there were provisions for the same earlier too and it is not a new provision. Police used the provision to review it and dismissed that case," added Shah.
The three new criminal laws - Bharatiya Nyaya Sanhita, Bharatiya Nagarik Suraksha Sanhita and Bharatiya Sakshya Adhiniyam - came into force on Monday.

Three new criminal laws - the Bharatiya Nyaya Sanhita, Bharatiya Nagarik Suraksha Sanhita and the Bharatiya Sakshya Adhiniyam - came into force on Monday, replacing the British-era laws. Under Bharatiya Nyaya Sanhita, terrorism has been redefined and a strict provision for mob lynching has been introduced.
Section 113 of the Bharat Nyaya Sanhita says: "Whoever, with intent to endanger or is likely to endanger the unity, integrity, sovereignty, security or economic security or sovereignty of India or to cause or spread terror amongst the public or any section of the public in India or in any foreign country, commits any act using bombs, dynamite, explosive substances, poisonous gases, nuclear with intent to cause death to any person or persons, damage to property, or manufacture or smuggling of currency or so, commits terrorist acts."
Under the new law, mob lynching can attract a maximum punishment of death sentence. The law states that when a group of five or more persons acting in concert commits murder on the ground of race, caste or community, sex, place of birth, language, personal belief or any other ground, each member of such group shall be punished with death or with imprisonment for life or imprisonment for a term which shall not be less than seven years, and shall also be liable to fine.

The vendor was booked under section 285 of the Bharatiya Nyaya Sanhita for creating obstruction by selling tobacco on main road.

The first FIR under the newly implemented Bharatiya Nyaya Sanhita in Delhi was reportedly registered against a street vendor on Monday.
The vendor, identified as Pankaj Kumar hailing from Bihar, was booked under Section 285 of the BNS for allegedly creating obstruction under foot over bridge of New Delhi Railway Station.
According to the FIR, Kumar was selling tobacco and water on a cart near the main road which was causing hindrance to the commuters. The FIR further said that Kumar ignored officials' order to remove the cart.
The new criminal law that came into force on Monday has replaced the British-era Indian Penal Code.
