The Delhi High Court on Monday issued a summons to the British Broadcasting Corporation (BBC) on a defamation suit filed by an NGO claiming that its documentary cast a slur on the reputation of India, its judiciary and Prime Minister Narendra Modi.
Besides the BBC (UK), Justice Sachin Datta also issued notice to the BBC (India) seeking its response on the suit filed by Gujarat-based NGO Justice for Trial.
The plea said BBC (India) is the local operation office and BBC (UK) has released the documentary -- "India: The Modi Question" -- which has two episodes.
Senior advocate Harish Salve, appearing for the NGO, said the suit for defamation against the BBC is in relation to the documentary which has "defamed" India and the whole system including the judiciary.
He contended that the documentary also makes insinuations against the prime minister.
The high court said, "Issue notice to the respondents through all permissible modes" and listed it for further hearing on September 15.&nbsp;

The Gujarat Assembly on Friday passed a resolution requesting the Centre to take strict action against BBC for tarnishing the image and popularity of Prime Minister Narendra Modi with its documentary on the 2002 riots in the state.
The controversial two-part series by the British Broadcasting Corporation titled 'India: The Modi Question' misrepresents the events of 2002 in a malicious and low-level attempt to tarnish India's image globally, Bharatiya Janata Party MLA Vipul Patel said in the House while moving the resolution.
The documentary claims to have probed certain aspects of the riots, which took place after the Godhra train burning incident when Modi was Gujarat chief minister.
The documentary was banned in India soon after its release.
Patel's resolution was supported by BJP MLAs Manisha Vakil, Amit Thaker, Dhavalsinh Zala and minister Harsh Sanghavi.
It was passed by voice vote in the absence of Congress MLAs who were expelled from the House earlier in the day.
After passing the resolution unanimously, Speaker Shanker Chaudhary said the attempt by BBC is "reprehensible" and is "condemned vehemently," adding the House passed the resolution to send its message to the Centre.

The BBC is not driven by an "agenda" but by purpose and will not be put off reporting impartially and without fear or favour, the UK-headquartered media organisation's chief has said days after the income tax department survey operation at its New Delhi and Mumbai offices.
In an email to BBC staff in India reported on Thursday by the broadcaster, Director General Tim Davie thanked them for their courage as he stressed that nothing was more important than reporting impartially. He added that the BBC would help staff in India do their jobs effectively and safely.
"Nothing is more important than our ability to report without fear or favour,&rdquo; Davie said in the email, reported by the BBC.
"Our duty to our audiences around the world is to pursue the facts through independent and impartial journalism, and to produce and distribute the very best creative content. We won't be put off from that task. I'd like to be clear: the BBC does not have an agenda &ndash; we are driven by purpose. And our first public purpose is to provide impartial news and information to help people understand and engage with the world around them," he said.
The income tax survey came weeks after the London-headquartered public broadcaster aired a controversial two-part documentary in the UK, &lsquo;India: The Modi Question&rsquo;, referencing Prime Minister Narendra Modi and the 2002 Gujarat riots.
The email from Davie came a week after I-T officials spent three days carrying out what they called a "survey" at the BBC offices. In an official statement at the end of the searches, the BBC said that it will "continue to cooperate" with the authorities and hopes matters are resolved as soon as possible.
In its statement following the survey, the Central Board of Direct Taxes (CBDT) said it had found discrepancies and that the income and profits disclosed by the organisation's units were "not commensurate with the scale of operations in India".
Earlier this week, the British government strongly defended the BBC and its editorial freedom in Parliament to say: "We stand up for the BBC. We fund the BBC. We think the BBC World Service is vital." David Rutley, a UK Foreign Office minister, was responding to an urgent question raised in the House of Commons by the Opposition parties, some of whom branded the action a "deliberate act of intimidation following the release of an unflattering documentary about the country's leader" and sharply criticised the UK government for failing to make a statement on the issue sooner.

The British government has strongly defended the BBC and its editorial freedom in Parliament after the Income-Tax department's survey operations on the UK-headquartered media corporation&rsquo;s New Delhi and Mumbai offices over three days last week.
A Foreign, Commonwealth and Development Office (FCDO) junior minister responded to an urgent question raised in the House of Commons on Tuesday to say that the government cannot comment on the allegations made by the I-T department over an &ldquo;ongoing investigation&rdquo; but stressed that media freedom and freedom of speech are essential elements of &ldquo;robust democracies&rdquo;.
David Rutley, Parliamentary Under-Secretary of the FCDO, pointed to a &ldquo;broad and deep relationship&rdquo; with India which meant the UK was able to discuss a wide range of issues in a "constructive manner".
&ldquo;We stand up for the BBC. We fund the BBC. We think the BBC World Service is vital. We want the BBC to have that editorial freedom,&rdquo; said Rutley.
&ldquo;It criticises us (government), it criticises the (Opposition) Labour party, and it has that freedom that we believe is so important. That freedom is key, and we want to be able to communicate its importance to our friends across the world, including the government in India,&rdquo; he said.
Updating the Commons on the issue, the minister said India&rsquo;s I-T department conducted what has been described as a survey on the BBC&rsquo;s offices in New Delhi and Mumbai, beginning on February 14 and finishing after three days, on February 16.
Highlighting that the BBC is &ldquo;operationally and editorially independent&rdquo;, the minister said the public broadcaster plays an important role and the FCDO funds services in 12 languages, including four Indian languages: Gujarati, Marathi, Punjabi and Telugu.
"It will continue to do so, because it is important to ensure that our voice &mdash; and an independent voice, through the BBC &mdash; is heard throughout the world,&rdquo; he said.
The minister, however, declined to comment on &ldquo;an ongoing investigation that the BBC is actively engaged in&rdquo;.
The I-T department said in a statement following the survey that the income and profits disclosed by the organisation's units were "not commensurate with the scale of operations in India".&nbsp;

According to an Indian Express report, an I-T survey is carried out mainly under Section 133A of the I-T Act while a search or raid is carried out under Section 132 of the Act.
While the scope of 'survey' is limited to the inspection of books and verification of cash &amp; inventory, during a 'search' officials can inspect entire premises to unravel undisclosed assets.
Moreover, officials can seize any books of accounts, documents or other valuable items during a search while on the other hand, approval from a senior officer is required to retain such books during a survey for more than 15 days.

It refers to the value attached to transfers of goods, services and technology between related entities''.
It also refers to the value attached to transfers between unrelated parties which are controlled by a common entity.

Reacting to the Indian IT department's action, the UK-based British public broadcaster said that it was "fully cooperating" with the authorities and hoped that the situation will be resolved "as soon as possible".
While there has been no official statement from the UK government related to the action, British sources said they are "closely monitoring" reports of tax surveys conducted at the offices of the BBC in India.
In New Delhi, officials said the survey was being carried out to investigate issues related to international taxation and transfer pricing of BBC subsidiary companies, and alleged that the BBC had been served with notices in the past but was "defiant and non-compliant" and had significantly diverted its profits.
The IT action against the BBC comes weeks after the broadcaster aired a controversial two-part documentary -"India: The Modi Question"- on Prime Minister Narendra Modi and 2002 Gujarat riots.
"The Income Tax Authorities are currently at the BBC offices in New Delhi and Mumbai and we are fully cooperating," a BBC spokesperson said in a statement.
"We hope to have this situation resolved as soon as possible," the spokesperson said.
The BBC did not give further details of what has been described as "surveys" by the Income Tax (IT) department, which reportedly involved local BBC staff being prevented from leaving or entering the office premises and their mobile phones and other gadgets being seized.

At the outset of the proceedings, lawyer Sharma, who has filed a PIL in his personal capacity, mentioned the plea, saying that people were being arrested.
"It will be listed on Monday," the CJI said.

He mentioned how the tweets by Ram and Bhushan were deleted allegedly by using emergency powers. He also said that students in Ajmer were rusticated for streaming the BBC documentary. "We will list," the CJI said.
Lawyer Sharma filed the PIL against the Centre's decision to block the documentary, alleging it was "malafide, arbitrary and unconstitutional".

Hundreds representing different Indian diaspora organisations gathered outside the BBC headquarters in central London on Sunday to protest against what they branded as "fake news" behind the broadcaster's controversial series on Prime Minister Narendra Modi.
The "Chalo BBC" protests were coordinated across BBC studios in London, Manchester, Birmingham, Glasgow and Newcastle and brought together groups such as Indian Diaspora UK (IDUK), Friends of India Society International (FISI) UK, Insight UK and Hindu Forum of Britain (HFB), among others.
The protesters waved placards reading "Boycott BBC", "British Bias Corporation" and "Stop the Hinduphobic Narrative", and chanted slogans such as "Shame on BBC" and "Bharat Mata Ki Jai".

'Desh ko todne ke kai...': PM Modi cautions against attempts to create divisions in the country

Prime Minister Narendra Modi on Saturday cautioned against attempts to sow differences and create divisions in the country and asserted that such efforts will not succeed.
Addressing a rally of the National Cadet Corps (NCC) at the Cariappa Ground in Delhi Cantonment, Modi said the mantra of unity was the only way for India to achieve grandeur.
The prime minister said that the entire world was looking towards India because of the youth of the country. Modi said his government had unleashed digital, start-up and innovation revolutions which are benefiting the youth.
"This is the time of new opportunities for the youth of India. Everywhere it is evident that India's time has arrived," he said addressing the NCC cadets who took part in the Republic Day celebrations.

At the same time, the prime minister urged caution against attempts to divide the country.
"Desh ko todne ke kai bahane dhoonde jaate hein. Bhaanti, bhaanti ki baatein nikaal kar, Maa Bharti ki santaano ke beech main doodh mein daraar karne ki koshishe ho rahi hein (Several pretexts are being raised to break the country. Several issues are raked up to create divisions among the children of Mother India)," the prime minister said.
"Despite such efforts, there will never be differences among the people of India," he said. "Maa ke doodh main kabhi darar nahi ho sakti," Modi said.
"The mantra of unity is the ultimate antidote. The mantra of unity is a pledge as well as India&rsquo;s strength. This is the only way India will achieve grandeur," the prime minister said.
The prime minister's remarks came against the backdrop of the raging controversy over a BBC documentary on the 2002 Gujarat riots that has been banned in India.
Modi lauded the NCC cadets who participated in the Republic Day celebration and said the priority for the country would always be the young people who are brimming with energy and enthusiasm.

The second advisory was issued by the institute on Saturday afternoon after reports surfaced that a group of students were planning to screen the controversial documentary.
Following the screening of the documentary, the ABVP and the BJYM staged a protest outside the campus.&nbsp;

DU forms panel to probe Jan 27 ruckus outside Arts Faculty over BBC film screening

In a notification, the university said the vice-chancellor has constituted the committee to enforce discipline and maintain law and order on the campus.

The Delhi University on Saturday formed a 7-member committee to investigate the ruckus outside the Arts Faculty building over the screening of a BBC documentary on the 2002 Gujarat riots.
The committee, headed by DU Proctor Rajini Abbi, has been asked to submit its report to Vice Chancellor Yogesh Singh by 5 pm on January 30.
In a notification, the university said the vice-chancellor has constituted the committee to enforce discipline and maintain law and order on the campus.
The other members of the committee are Professor Ajay Kumar Singh of the Department of Commerce, Professor Manoj Kumar Singh, Joint Proctor, Professor Sanjoy Roy of the Department of Social Work, Professor Rama, Principal of Hansraj College, Professor Dinesh Khattar, Principal of Kirorimal College, and Gaje Singh, Chief Security Officer, it added.
"The Committee may specifically look into the incident of the 27th of January, 2023 which occurred outside the Faculty of Arts and opposite gate No. 4, University of Delhi," the notification said.
A commotion erupted at the Delhi University on Friday as students attempted to screen the controversial BBC documentary, even as police and the university administration intervened to scuttle the move.
Twenty-four students affiliated with the National Students' Union of India (NSUI) were detained from the Delhi University's Arts Faculty and a heavy police deployment was maintained in the North Campus.
The university claimed that "outsiders" were trying to screen the documentary and the police was called to maintain law and order.&nbsp;
