<p>The Karnataka High Court has granted an interim stay on criminal proceedings initiated against BJP leader Amit Malviya and Republic TV's Editor-in-Chief Arnab Goswami, in connection with allegations of spreading false claims that the Indian National Congress (INC) operates an office in Istanbul, Turkiye.</p>
<p>Justice S Rachiah passed the order on Thursday while hearing petitions filed by both Malviya and Goswami, seeking the quashing of the cases lodged against them. The stay will remain in effect until the next hearing.</p>
<p>Malviya is also facing a separate case over a controversial social media post in which he shared a morphed image showing half the face of Gandhi merged with that of Pakistan's Army Chief Asim Munir.</p>
<p>The caption alleged that Gandhi was aligning with Pakistan's narrative, particularly in the wake of India's military offensive Operation Sindoor, in response to the April 22 Pahalgam terror attack. Malviya's post further questioned whether Gandhi was aspiring for the Nishan-e-Pakistan, Pakistan's highest civilian award.</p>
<p>Both cases have now been stayed following petitions to quash them.</p>
<p>The Congress had filed multiple complaints across the country, including in Karnataka, accusing Malviya and Goswami of orchestrating a "criminally motivated campaign" to spread fabricated claims that the Istanbul Congress Centre in Turkiye is an official Congress office.</p>
<p>The party alleged that the misinformation was aimed at defaming the INC, inciting unrest, and compromising national security, particularly sensitive in light of strained diplomatic ties between India and Turkiye following the Pahalgam attack and India's retaliatory action.</p>
<p>On May 20, Republic TV issued a public correction, stating that an image used in its digital coverage, which was purportedly linked to the alleged Congress office in Turkey, was mistakenly included by a video editor. The channel clarified that the image had no relevance to the broadcast content and was never aired on Goswami's primetime debate show. The error, the channel said, occurred after the live show had ended and was swiftly corrected. Republic TV extended an "unconditional and sincere" apology.</p>
<p>The next day, a post on Malviya's 'X' handle reiterated that the Congress had opened an office in Turkiye in 2019, shortly after it voiced support for Pakistan on the Kashmir issue at the UN. He dismissed the legal actions as evasive and insisted the party had yet to provide a credible explanation.</p>
<p>During Thursday's court proceedings, Senior Advocate Aruna Shyam, representing Malviya and Goswami, argued that the cases were politically driven and lacked substance. He highlighted inconsistencies in the application of legal provisions, particularly how an initially bailable charge under Section 352 of the Bharatiya Nyaya Sanhita (BNS) was reportedly upgraded to a non-bailable one under Section 353 after police approached a magistrate. Section 353 pertains to statements intended to incite public disorder.</p>
<p>Shyam questioned the applicability of Section 353, stating, "He (Gandhi) is not a government functionary but the opposition leader," suggesting that the legal escalation was politically motivated.</p>
<p>The State's counsel responded that the investigation was at a preliminary stage and only notices had been issued, with no intention of making arrests. He urged the court to allow the inquiry to proceed to ascertain the nature and context of the disseminated information.</p>

<p>Addressing party leaders after the inauguration of the Congress' new headquarters at 9A, Kotla Road here, Gandhi said, "Do not think that we are fighting a fair fight. There is no fairness in this. If you believe that we are fighting a political organisation called the BJP, that we are fighting a political organisation called the RSS, you have not understood what is going on.</p>
<p>"The BJP and the RSS have captured every single institution of our country. We are now fighting the BJP, the RSS and the Indian state itself," he said.</p>
<p>Sharing a video clip of Gandhi's remarks, BJP IT department head Amit Malviya said, "Rahul Gandhi has now declared an open war against the Indian State itself. This is straight out of George Soros&rsquo;s playbook."</p>
<p>In his remarks, Gandhi said, "I clearly stated that something went wrong in the Maharashtra elections. We are uncomfortable with the way the Election Commission operates. The sudden appearance of almost one crore new voters between the Lok Sabha and Vidhan Sabha elections in Maharashtra is problematic".</p>
<p>Gandhi said it is the Election Commission's duty to provide a voters' list with names and addresses of those who voted in the Vidhan Sabha election.</p>
<p>However, the commission has refused to provide this information, he said.</p>
<p>"Why would the Election Commission refuse to make the voters' list transparent? What purpose does it serve by not providing us with the list, and why are they withholding it? It is the Election Commission's duty to provide transparency, and it is their sacred responsibility to explain why this has happened," he said.</p>
<p>"This is something that every Congressman and every opposition member must keep in mind. There is a serious problem with our election system, and it is the Election Commission's duty to be transparent," he said.</p>

<p>A single social media post has triggered a row between the top brass of the BJP and opposition Congress and TMC.</p>
<p>Kolkata-based lawyer and RSS member Santanu Sinha allegedly suggested that BJP IT cell chief Amit Malviya was involved in sexual exploitation of women.</p>
<p>&ldquo;Is Amit Malviya still waiting at a 5-star hotel in Kolkata to procure a beautiful woman or have the leaders of West Bengal BJP stopped the competition of who has more beautiful women to secure the State President post?&rdquo; he had posted in Bengali.</p>
<p>The charge that was quickly amplified by the Congress. In an all-out political attack, the grand old party said Malviya should be sacked from his post in the BJP and be subject to an independent inquiry.</p>
<p>An enraged Malviya sent a legal notice to Sinha for "false and defamatory allegations" and demanded a retraction of the statement along with a public apology. He also sought damages worth Rs 10 crore for mental harassment, agony and loss of reputation.</p>
<p>Sinha on his part refused to take down the social media post and denied an apology. But in doing so, he hit out at the Congress, not Malviya.</p>
<p>Sinha claims his post was misinterpreted to create a hate campaign against Malviya. He said the post was not intended to malign the BJP leader's reputation but to caution him against a 'honeytrap'. Sinha did express his 'heartfelt sorrow' for any hurt caused to Malviya.</p>
<p>But Malviya refused to back down. He threatened to file a criminal defamation case against Sinha for making 'slanderous' comments against him. The BJP leader said Sinha's "purported apology is deeply problematic and reductionist".</p>
<p>He added that Sinha's clarification statement was qualified and not unequivocal and does not meet the demands listed in the legal notice.</p>

<p>An FIR has been registered against Amit Malviya, in-charge of BJP's IT department, for distorting Tamil Nadu Youth Welfare Minister Udhaynidhi Stalin's remark on Sanatan Dharma, police said on Wednesday.</p>
<p>Days after Malviya posted on X that the DMK leader had called for "genocide" of 80 per cent population who follow Sanatan Dharma, Tiruchirappalli police said a case has been registered under IPC sections for deliberately misrepresenting Udhayanidhi's remark to cause disharmony and create enmity among different sections of people.</p>
<p>The FIR was registered following a complaint, they said and did not elaborate.</p>
<p>On September 2, DMK leader and state minister Udhayanidhi, who also holds the sports portfolio alleged that Sanatan Dharma is against social justice and equality and it should hence be "eradicated."</p>
