The Bombay High Court in its detailed order granting bail to Aryan Khan, Arbaaz Merchant and Munmun Dhamecha said that 'there is hardly any positive evidence on record to convince the Court that all the accused persons with common intention agreed to commit drug-related offences'

'Merely because Aryan Khan, Arbaaz Merchant, and Munmun Dhamecha were travelling in the same cruise, that by itself cannot be a foundation for the charge of conspiracy against them,' the Bombay High Court stated in its bail order.

A single-judge bench had granted bail to the three on October 28 after they were arrested on October 2 following a raid on a cruise by the NCB.

The 14-page detailed order was released on Saturday afternoon.

The court also rejected NCB's claims that alleged Whatsapp chats recovered from Aryan Khan's phone were proof of their involvement in drugs.

It said nothing objectionable was found in those chats to prove conspiracy to commit the crime they are being accused of.
