Digital and social media need to be mandatorily regulated in the country to preserve the rule of law under the Constitution, Supreme Court Judge Justice J B Pardiwala said on Sunday, terming as “dangerous” the crossing of ‘Lakshman rekha’ on these platforms for “personalised, agenda-driven attacks" on the judges.
The remarks by Justice Pardiwala come amid an uproar by a section over the strong oral observations of a vacation bench, in which he was a member, against suspended BJP leader Nupur Sharma for her controversial comments against Prophet Mohammed. The apex court had said that her "loose tongue" has "set the entire country on fire" and she should apologise.
The observations of the bench, which had also refused to club the FIRs lodged against Sharma across the country, sparked a debate, including on digital and social media platforms, leading to some uncharitable comments against the judges also.
“In India, which cannot be classified as mature and an informed democracy, social and digital media is employed frequently to politicise purely legal and constitutional issues,” Justice Pardiwala said and gave the illustration of the Ayodhya land dispute case.
He said the trials by digital media are an undue interference in the justice dispensation system. "Crossing that ‘Lakshman rekha’ many times, this is especially more worrisome,” the judge, who has recently been elevated to the top court, said.
Justice Pardiwala was speaking at the second Justice HR Khanna Memorial National Symposium organised by Dr Ram Manohar Lohiya National Law University, Lucknow & National Law University, Odisha along with the Confederation of Alumni for National Law Universities (CAN Foundation).

Speaking on the subject of ‘Vox Populi vs. Rule of Law: Supreme Court of India', Justice Pardiwala said, “Judicial verdicts cannot be the reflection of the influence of public opinion”.
Observing that the rule of law has to prevail over the popular public sentiment, the apex court judge said that balancing the intent of the majority populace on one hand and meeting its demand and affirming the rule of law on the other is an “arduous exercise”.

Following the Eknath Shinde-led Maharashtra government's move to overturn Maha Vikas Aghadi's Aarey metro car shed decision, activists and environment lovers voiced their discontentment.  Aarey, nestled in Mumbai's suburbs is a vast green cover that was deemed a protected forest by the MVA government. 
Thackeray cousins Amit and Aaditya, sons of Raj and Uddhav also took to social media to express their displeasure and worry over the Shinde government's move. 
Calling it a shocking move, Amit Thackeray wrote, 'The new decision by the new government is shocking for me and innumerable environment activists and lovers. The youth of the state had earlier struggled hard against the move. Some were even put in jail.' 
He urged the new government to reconsider its move stating that though development is necessary it should not be done at the cost of the environment. 
Amit's cousin Aaditya, who was at the forefront of Aarey protests in 2019 and also a former Environment Minister of Maharashtra wrote on Twitter, 'I humbly urge new government to reconsider its decision. Don’t cast the hate for us, on to our beloved Mumbai.'
The Shiv Sena scion further said that he will not be able to attend protests organised at Aarey on July 03 as he is due to attend the special Assembly session which saw BJP MLA Rahul Narvekar elected as the new Speaker of Maharashtra Legislative Assembly.
'Consider the proposal of having Metro-3 carshed at Kanjurmarg. I am requesting with folded hands, don’t insist on making the carshed at Aarey,' Aaditya added.
This comes after Aaditya's father Uddhav Thackeray said that he was upset with the Shinde government's move and he too asked them to not take out their anger for him on the people of Mumbai.

The Maha Vikas Aghadi government had shifted the car shed project to Kanjur Marg soon after assuming power however the decision has been reversed.

"We are happy that the probe has been handed over to NIA. We think that the matter will reach its conclusion soon and all the accused will be arrested soon," Mahesh Kolhe, brother of Umesh Kolhe, said. 
"Through the Police note, we found out that my brother was murdered over his post on Nupur Sharma...He was good friends with Yusuf Khan (arrested accused), a practicing veterinarian. We knew him since 2006," Umesh said. 
Mastermind has been arrested, so the pace of the investigation will increase undoubtedly. Others who were involved will also be apprehended. We have one demand that the trial be done in a fast-track court and the maximum possible punishment be given: Mahesh Kolhe

Climate activist Licypriya Kangujam on Saturday lauded Agra authorities for clearing plastic waste from the banks of the Yamuna river behind the Taj Mahal.
The 10-year-old activist from Manipur also shared on Twitter photos from her visits to the river bank last month and on Saturday.
In the photo from her last month's visit, Kangujam is seen standing amidst plastic waste and holding a placard reading "Behind the beauty of Taj Mahal is plastic pollution". In the photo from her visit on Saturday, the young activist is seen flashing the victory sign with no garbage around.
Talking to PTI, Kangujam said, "When I first visited the Taj Mahal, I found plastic bottles and single-use plastic waste lying in the garden, fountains and its surroundings. When I visited the banks of the Yamuna river behind the Taj Mahal... I found plastic bottles and wrappers lying there. I was shocked to see that people had littered the most iconic monument of the world."
"I wanted to give a message to the people of the entire world that 'behind the beauty of Taj Mahal is plastic pollution'. I tweeted this message and got immense support from people all over the world. Authorities launched a cleanliness drive after my tweet," she said.
"On Saturday, I visited the banks of Yamuna behind the Taj Mahal and was so happy to see that the plastic waste that was lying there during my first visit about 10 days ago was almost entirely cleared due to the efforts of the local authorities.
"I appreciate the swift action," she added.
Kangujam underlined that this change should be permanent and not be short-lived.
After Kangujam's tweet in June about the waste lying at the banks of Yamuna, the Agra Municipal Corporation (AMC) had fined the concerned sanitation company Rs 1 lakh for not keeping the premises clean.
A special cleanliness drive was launched on June 29 to make the Taj Mahal plastic-free. The drive will go on till July 3.

Climate activist Licypriya Kangujam on Saturday lauded Agra authorities for clearing plastic waste from the banks of the Yamuna river behind the Taj Mahal.
The 10-year-old activist from Manipur also shared on Twitter photos from her visits to the river bank last month and on Saturday.
In the photo from her last month's visit, Kangujam is seen standing amidst plastic waste and holding a placard reading "Behind the beauty of Taj Mahal is plastic pollution". In the photo from her visit on Saturday, the young activist is seen flashing the victory sign with no garbage around.
Talking to PTI, Kangujam said, "When I first visited the Taj Mahal, I found plastic bottles and single-use plastic waste lying in the garden, fountains and its surroundings. When I visited the banks of the Yamuna river behind the Taj Mahal... I found plastic bottles and wrappers lying there. I was shocked to see that people had littered the most iconic monument of the world."
"I wanted to give a message to the people of the entire world that 'behind the beauty of Taj Mahal is plastic pollution'. I tweeted this message and got immense support from people all over the world. Authorities launched a cleanliness drive after my tweet," she said.
"On Saturday, I visited the banks of Yamuna behind the Taj Mahal and was so happy to see that the plastic waste that was lying there during my first visit about 10 days ago was almost entirely cleared due to the efforts of the local authorities.

"I appreciate the swift action," she added.
Kangujam underlined that this change should be permanent and not be short-lived.
After Kangujam's tweet in June about the waste lying at the banks of Yamuna, the Agra Municipal Corporation (AMC) had fined the concerned sanitation company Rs 1 lakh for not keeping the premises clean.
A special cleanliness drive was launched on June 29 to make the Taj Mahal plastic-free. The drive will go on till July 3.&nbsp;

As the staff at the check-in counter asked them what was in their luggage, the irked husband said "bomb", triggering a panic, following which airport security was informed.
They were handed over to the Nedumbassery police.
The man was arrested and later released on station bail, the police said.

An FIR was registered in Jaipur against a TV news anchor, BJP national spokesperson Rajyavardhan Rathore and others for allegedly spreading falsehood by doctoring Congress leader Rahul Gandhi's comment in Kerala to appear as if it was a remark on the Udaipur tailor's murder.
The FIR was registered on a complaint lodged by local Congress leader Ram Singh at the Banpark police station under IPC sections 504 (intentional insult), 505 (criminal intimidation), 153A (promoting enmity between different groups on ground of religion, race, place of birth, etc.), 295A (deliberate and malicious acts, intended to outrage religious feelings of any class by insulting its religion or religious beliefs) and 120B (criminal conspiracy).
The development came hours after Rajasthan Chief Minister Ashok Gehlot criticised the channel for the same.
The complainant alleged that Zee News anchor Rohit Ranjan in his show aired a statement of Gandhi on the SFI violence on his Wayanad office and mischievously doctored it to make it seem like it was a comment on the heinous murder of Kanhaiya Lal in Udaipur.
He claimed that it was done by the media group in conspiracy with former Union minister Rathore, Major Surendra Poonia (retired) and Kamlesh Saini, who also shared the clip on Twitter to reap political advantage and trigger public sentiments.
"The anchor and the promoters of the TV channel were clearly aware that what Gandhi stated was for the youngsters in Wayanad and not the killers of Kanhaiya Lal," the complainant said in the FIR.
The channel, however, has issued an apology, with Ranjan saying, "Yesterday, in our show DNA, Rahul Gandhi's statement was taken in the wrong context by linking it to the Udaipur incident, it was a human error for which our team apologises." Earlier in the day, Chief Minister Gehlot criticised the channel for running the incorrect report.
"Gandhi had said that the children who did this (vandalised his office in Wayanad)… they've acted in an irresponsible way. They are kids, forgive them. But the TV channel and the anchor ran that Rahul Gandhi was saying those who killed Kanhaiya Lal in Udaipur were kids and should be forgiven," Gehlot said.
Gehlot was speaking at a meeting on the Eastern Rajasthan Canal Project with party MLAs and public representatives of 13 districts at his residence.

The Samyukta Kisan Morcha (SKM) on Sunday expressed its disappointment against the Union government and accused the Centre of completely reneging on the written promises made to the farmers when the protest was lifted on December 9 last year.
Three important decisions regarding the farmers' movement were taken at the national meet of representatives of all the farmers' organizations associated with the SKM, held in Ghaziabad on Sunday.
In a statement issued by the SKM, the farmers' body claimed that neither the committee on Minimum Support Price (MSP) has been formed, nor the "false" cases registered against the farmers during the agitation been withdrawn.
It also accused the government of not being ready to consider the biggest demand of the farmers -- a legal guarantee on MSP.
In protest against this alleged "betrayal" by the government, "Protest Against Betrayal" public meetings will be organized at district level, from the beginning of the monsoon session of Parliament on July 18 till July 31 -- the martyrdom day of Shaheed Udham Singh -- across the country, the SKM said in its statement.
The SKM has also announced that at the end of this campaign, on July 31, a chakka jam of all the major highways across the country will be organized from 11 am to 3 pm.
It has also been decided in the meet that the farm organizations will mobilize unemployed youth and ex-servicemen against the Agnipath military recruitment scheme, which is "anti-national and anti-youth as well as anti-farmer".
"To expose the Agnipath scheme, 'Jai Jawan, Jai Kisan' conferences will be organized across the country from August 7 to August 14, in which ex-servicemen and unemployed youth will also be invited," the statement read.
On the 75th anniversary of Independence, a 75-hour mass dharna will be held in Lakhimpur Kheri from August 18 to August 20, demanding sacking of Union Minister of State for Home Ajay Mishra, it stated.
Eight people, including four farmers, were killed in Lakhimpur Kheri during the violence that erupted when farmers were protesting against Uttar Pradesh Deputy Chief Minister Keshav Prasad Maurya's visit to the area on October 3 last year.

In a major blow to the Uddhav Thackeray faction a day before the crucial trust vote of the Eknath Shinde-BJP government, the newly-appointed speaker of the Maharashtra Assembly on Sunday night removed Shiv Sena MLA Ajay Chaudhary as the legislative party leader.
A letter issued by the office of Speaker Rahul Narvekar reinstates Shinde as the Shiv Sena's legislative party leader and also recognises the appointment of Bharat Gogawale from the Shinde camp as the chief whip of the Sena, removing Sunil Prabhu, who belongs to the Thackeray faction.
The Shiv Sena said the decision will be challenged in court. The letter addressed to Shiv Sena rebel MLA and Chief Minister Eknath Shinde stated that the Maharashtra Vidhan Bhavan administration had received a letter from his faction on June 22 objecting to Shinde's removal as the group leader of the Shiv Sena Legislative Party by the party chief Uddhav Thackeray.
The letter issued by the office of Speaker Rahul Narvekar on Sunday night stated that after discussing the legalities of the matter, the Speaker rejects the appointment of Sena MLA Ajay Chaudhary as the group leader of the legislative unit of the party.
The letter, a copy of which is with PTI, reinstates Shinde as the leader of the House of Shiv Sena and also recognises the appointment of Bharat Gogawale as the chief whip of the party, replacing Sunil Prabhu.
The development comes as a major setback to the Thackeray faction comprising 16 MLAs who will be bound by the whip to be issued by Gogawale for Monday's trust vote.
If these 16 MLAs refuse to follow the whip, they may face disqualification.
Reacting to the development, Shiv Sena chief spokesperson and MP Arvind Sawant said they will challenge this "unconstitutional" decision in court.
“Former Secretary General of Lok Sabha P D T Acharya has given directives that the party leader (chief) has the right to appoint the group leader of the legislative unit of that party. How can you say that (Eknath Shinde) is the (legislative) party leader?" “We will challenge this decision in court. This is highly unfortunate. The decision is taken on Sunday late night which speaks volumes about how it must have been taken,” said Sawant.
He alleged that the decision amounts to trampling the Constitution and democratic norms. "The BJP is marching towards autocracy,” Sawant added.
Ousted Shiv Sena group leader Ajay Chaudhary said the new Speaker did not even conduct any hearing over the objections of both sides.
"When my name was proposed for the Shiv Sena group leader's post, it was signed by Shiv Sena MLAs Dada Bhuse and Sanjay Rathod. They both later joined the Shinde camp. How can the speaker ignore these facts? When my appointment was recognised by acting speaker Narhari Zirwal, how come the newly-appointed speaker Rahul Narvekar can intervene?" he asked.
Earlier in the day, Rahul Narvekar of the BJP was elected Speaker of the Maharashtra Assembly on the first day of its special session.
Narvekar, who polled 164 votes, defeated Uddhav Thackeray-led Shiv Sena candidate Rajan Salvi, who got 107 votes.
The Speaker's post was lying vacant since February last year after Nana Patole of the Congress resigned.
Going by the votes polled in the Speaker's election, it seems the numbers are stacked in favour of the Shinde-BJP government for the floor test.
The 288-member Assembly has one vacancy due to the death of Sena's Ramesh Latke.
Out of the 287 legislators, 271 voted, while three MLAs - two of SP and one belonging to AIMIM- abstained from voting.

A letter issued by the office of Speaker Rahul Narvekar reinstates Shinde as the Shiv Sena's legislative party leader and also recognises the appointment of Bharat Gogawale from the Shinde camp as the chief whip of the Sena, removing Sunil Prabhu, who belongs to the Thackeray faction.
The Shiv Sena said the decision will be challenged in court. The letter addressed to Shiv Sena rebel MLA and Chief Minister Eknath Shinde stated that the Maharashtra Vidhan Bhavan administration had received a letter from his faction on June 22 objecting to Shinde's removal as the group leader of the Shiv Sena Legislative Party by the party chief Uddhav Thackeray.
The letter issued by the office of Speaker Rahul Narvekar on Sunday night stated that after discussing the legalities of the matter, the Speaker rejects the appointment of Sena MLA Ajay Chaudhary as the group leader of the legislative unit of the party.
The letter, a copy of which is with PTI, reinstates Shinde as the leader of the House of Shiv Sena and also recognises the appointment of Bharat Gogawale as the chief whip of the party, replacing Sunil Prabhu.
The development comes as a major setback to the Thackeray faction comprising 16 MLAs who will be bound by the whip to be issued by Gogawale for Monday's trust vote.
If these 16 MLAs refuse to follow the whip, they may face disqualification.
Reacting to the development, Shiv Sena chief spokesperson and MP Arvind Sawant said they will challenge this "unconstitutional" decision in court.

&ldquo;Former Secretary General of Lok Sabha P D T Acharya has given directives that the party leader (chief) has the right to appoint the group leader of the legislative unit of that party. How can you say that (Eknath Shinde) is the (legislative) party leader?" &ldquo;We will challenge this decision in court. This is highly unfortunate. The decision is taken on Sunday late night which speaks volumes about how it must have been taken,&rdquo; said Sawant.
He alleged that the decision amounts to trampling the Constitution and democratic norms. "The BJP is marching towards autocracy,&rdquo; Sawant added.
Ousted Shiv Sena group leader Ajay Chaudhary said the new Speaker did not even conduct any hearing over the objections of both sides.
"When my name was proposed for the Shiv Sena group leader's post, it was signed by Shiv Sena MLAs Dada Bhuse and Sanjay Rathod. They both later joined the Shinde camp. How can the speaker ignore these facts? When my appointment was recognised by acting speaker Narhari Zirwal, how come the newly-appointed speaker Rahul Narvekar can intervene?" he asked.
Earlier in the day, Rahul Narvekar of the BJP was elected Speaker of the Maharashtra Assembly on the first day of its special session.
Narvekar, who polled 164 votes, defeated Uddhav Thackeray-led Shiv Sena candidate Rajan Salvi, who got 107 votes.
The Speaker's post was lying vacant since February last year after Nana Patole of the Congress resigned.
Going by the votes polled in the Speaker's election, it seems the numbers are stacked in favour of the Shinde-BJP government for the floor test.
The 288-member Assembly has one vacancy due to the death of Sena's Ramesh Latke.
Out of the 287 legislators, 271 voted, while three MLAs - two of SP and one belonging to AIMIM- abstained from voting.

BJP's Rahul Narvekar was elected as the Speaker after winning the election on Sunday and will be presiding over floor test proceedings.
The BJP plus Sena govt is largely expected to win considering the alliance gathered 164 votes during Sunday's election for the Speaker of the Assembly.  The Maharashtra legislative assembly has 288 MLAs and the half-way mark is 145. 
The Maha Vikas Aghadi's Speaker candidate on the other hand got just 107 votes.

New Maharashtra chief minister Eknath Shinde will face a floor test on Monday to prove that his Shiv Sena faction along with the BJP has the majority in the Assembly.
