The HC observed that the basic dignity of a person in custody has to be upheld, which had been flouted in this case.

The Delhi High Court has noted that a virginity test conducted on a female detainee or accused under investigation whether in judicial or police custody is unconstitutional.

The Indian Express reported that a single judge bench of Justice Swarana Kanta Sharma held that the virginity test conducted on on a Kerala nun, who was convicted for the murder of a fellow nun in 1992, was unconstitutional.

The HC observed that the basic dignity of a person in custody has to be upheld, which had been flouted in this case.

Justice Sharma granted liberty to the convicted nun to seek compensation for the violation of her human rights after the criminal case is over.
