Article 370 verdict | Jammu and Kashmir didn't retain sovereignty when it acceded to India: SC

Announcing the verdict on Article 370, the Supreme Court said that Jammu and Kashmir did not retain sovereignty when it acceded to India.

Citing the Instrument of Accession, CJI DY Chandrachud said that Jammu and Kashmir did not retain an element of sovereignty when it joined the Union of India.

He added that a proclamation issued by Yuvraj Karan Singh in 1949 said the Constitution of India would supersede all other constitutionals provisions in the state.

The proclamation reflects the full and final surrender of sovereignty by Jammu and Kashmir to its sovereign ruler India, said Chandrachud.

The CJI further said that the Constitution of Jammu and Kashmir was only to further define the relationship between the Union of India and the state of Jammu and Kashmir.
