All India judicial service at the district judge level: Govt says no consensus on proposal yet

Article 312 of the Constitution provides for the setting up all India judicial service, which shall not include any post inferior to that of a district judge.

There is no consensus on a proposal to set up an all India judicial service at the district judge level, the government told Rajya Sabha on Thursday.
In a written reply, Law Minister Arjun Ram Meghwal said there was divergence of opinion among the state governments and the 25 high courts on the constitution of this judicial service.
"While some state governments and high courts favoured the proposal, some were not in favour of creation of All India Judicial Service ... some others wanted changes in the proposal formulated by the central government," he said.
In government's view, Meghwal noted, a properly framed all India judicial service is important to strengthen overall justice delivery system.
"This will give an opportunity for induction of suitably qualified fresh legal talent selected through a proper all-India merit selection system as well as address the issue of social inclusion by enabling suitable representation to marginalized and deprived sections of society," he said.&nbsp;

The BJP on Thursday criticised Telangana Chief Minister Revanth Reddy's "Bihar DNA" remark and demanded that the Congress and other members of the opposition INDIA bloc condemn his comment and ask him to apologise.
Reddy reportedly said during a recent interaction with journalists that K Chandrashekar Rao, the first chief minister of Telangana, has "Bihari genes", indicating that he was a better choice for the state than KCR.
"My DNA is Telangana. KCR's DNA is Bihar. He belongs to Bihar. KCR's caste is Kurmi. They migrated from Bihar to Vijayanagaram and from there to Telangana. Telangana DNA is better than Bihar DNA," Reddy had allegedly said.
Senior BJP leader Ravi Shankar Prasad termed Reddy's remarks "very shameful, divisive and arrogant" and demanded that the Congress and other INDIA bloc members condemn it.
He also demanded an apology from Reddy for making such remarks against the people of Bihar.
"I condemn his remarks," Prasad told PTI at the Parliament complex.
He further said, "Does he want to break the country? The big question here is why are the INDIA alliance members silent. Why has Nitish Kumar not said anything (on Reddy's remarks) so far? What are the Congress members in Bihar doing?" Prasad also questioned the silence of former Congress presidents Sonia Gandhi and Rahul Gandhi on Reddy's remarks.
"Your chief minister calls one region's DNA weak and makes very shameful casteist remarks against his own party leaders (who are in Bihar), this is very unfortunate. We condemn it. The Congress party should also condemn it if they have even a little understanding of the significance of unity in the country," he said.
The BJP's Buxar MP and Union Minister Ashwini Kumar Choubey said Reddy's "petty" remarks have hurt the sentiments of the people of Bihar and demanded that Chief Minister Nitish Kumar respond to it.
"Congress leaders are creating a dirty atmosphere in the country... The kind of petty remarks that the Congress leader, who is... the chief minister (of Telangana), has made, people will give them a befitting reply," Choubey told PTI.
BJP MP and former deputy chief minister of Bihar Sushil Modi also hit out at the Congress and its INDIA bloc allies over Reddy's remarks and demanded that they ask the Telangana chief minister to apologise.
He said, "The INDI Alliance members kept insulting Hindu Dharma and Sanatan Dharma. Now they have come to Bihar DNA. Is it appropriate to say that Telangana DNA is better than the Bihar DNA and make such insulting comments against the people of another state?"

A BJP MP from Haryana on Thursday called live-in relationships a "dangerous disease" that needs to be eradicated from society and urged the government to enact a law against it.
Raising the issue in the Lok Sabha during 'zero hour', Dharambir Singh also said divorce rates in love marriages were high and the consent of the parents of the bride and groom should therefore be made mandatory for such alliances.
"I want to bring to the notice of the government and Parliament a very serious issue. Indian culture is known for its philosophy of 'Vasudhaiva Kutumbakam (world is one family) and brotherhood. Our social fabric is different from others in the world. The whole world is impressed by our unity in diversity," the MP from Bhiwani-Mahendragarh said.
Noting that India has a long tradition of arranged marriages, Singh said a large section of society even to this day gives priority to marriages arranged by parents or relatives.
This has the consent of the bride and groom and arranged marriages are based on a match of several common factors such as social and individual values and likes as well as family backgrounds, he said.
"Marriage is considered a sacred relationship that continues for seven generations...The divorce rate is about 1.1 per cent in India as compared with America which has a rate of about 40 per cent. It has been observed that the rate of divorce in arranged marriages is very less. However, there is a lot of increase in divorce rate recently and the main reason for it is love marriages," Singh said.
"Therefore, it is my suggestion that the consent of mother and father of the bride and groom be made mandatory in love marriages because in large parts of the country marriage does not happen in the same 'gotra' and due to love marriages there are a lot of conflicts in the villages. Scores of families are destroyed in these conflicts, therefore the consent of both the families is important," he said.
Singh said a "new disease" has emerged and this social evil is called "live-in relationship".
Under this, two persons, man or woman, live together without marriage, the BJP MP said.
"Such relationships are very common in western nations but this evil is fast spreading in our society also and the consequences are horrible. Recently, the case of Shraddha (Walkar) and Aftab (Poonawala) had come to light in which both were in a live-in relationship," Singh said.
Such cases keep coming to the fore almost daily, he added while referring to the gruesome case in Delhi of a man allegedly killing his live-in partner and chopping her body to pieces.
"Not only this is ruining our culture but also hatred and evils are spreading in the society. If this continues our culture will die and there will be no difference between us and others," he said.
"I request the minister that a law be made against live-in relationships so that this dangerous disease can be eradicated from society," Singh said.&nbsp;

24 patients, including 12 newborns died at a govt hospital in Maharashtra's Nanded in the last 24 hours, according to its dean.&nbsp;

NCRB data: these 5 states reported most suicides in India in 2022

While these five states accounted for 49.3 per cent of all suicides, the remainder were in the rest of the 23 states and eight Union Territories.

Data from the National Crime Records Bureau (NCRB) for 2022 showed that Madhya Pradesh accounted for 15,386 of the 1,70,924 suicides that took place across the country.
While the national average was 468 suicides per day, for MP it was 42 people ending their lives every day, or almost two per hour, as per NCRB data.
The NCRB, which functions under the Ministry of Home Affairs, recently released its survey.
Maharashtra led with 22,746 suicides (13.3 per cent of total count), followed by 19,834 in Tamil Nadu (11.6 per cent), 15,386 in MP (9 per cent), 13,606 in Karnataka (8 per cent) and 12,669 in West Bengal (7.4 per cent), the NCRB data revealed.
While these states accounted for 49.3 per cent of all suicides, the remainder were in the rest of the 23 states and eight Union Territories.
Incidentally, Uttar Pradesh, with 17 per cent of the country's population, accounted for just 4.8 per cent of the suicides that took place in 2022.
It also showed that 59,087 people, comprising 38,259 men and 20,828 women, who ended their lives in the country were in the 18-30 age group, with 31.7 per cent people committing suicide due to family problems and 18.4 per cent due to illness.
In MP last year, Indore led with 746 suicides, followed by 527 in Bhopal, 307 in Gwalior and 213 in Jabalpur.
Pointing out that 31.7 per cent of the suicides took place due to family problems, Bhopal Police Commissioner HC Mishra told PTI this was mainly due to the weakening of the joint family system, lack of emotional bond and communication.
Youngsters, especially students were ending their lives due to lack of proper counselling as well as lack of communication in society, said Mishra, who has earlier served as commissioner of Indore, SP of Jabalpur and Gwalior.
Mishra, who as SP, Jabalpur started the suicide prevention helpline 'Sanjeevani' in 2014, said he found neglect of mental health was one of the reasons for the high number of suicides in the city, after which experts were asked to provide counselling and advice to people who contact the helpline.
Training police staff on issues of sensitivity and answering helpline calls properly resulted in the suicide numbers going down, he claimed.
Recalling an incident, Mishra, as SP in Jabalpur, received a call late at night from a station house officer who said he had a loaded pistol and was planning to end his life.
"I started talking to him, trying to tell him his act would have huge consequences. I recalled he had called me some time before and spoken about his jobless son, a daughter who had filed a domestic violence case against her husband, as well as his issues with his wife," Mishra said.
"The SHO told me he was considered worthless in the department, which was affecting his career prospect. I immediately gave him charge of a police station. I told him to prove people wrong. I continued to engage him in talks," he said.
In the meantime, Mishra said he asked the staff at his 'camp office' in his bungalow to alert the constables at the police station where this personnel was and asked them to cautiously take control of him when he walks out of his office since he had a loaded gun.
"I continued to talk to this personnel. Finally, he listened to me, opened the door, walked outside where waiting police staff took away his pistol. He was counselled by professionals later. I spoke to the then DGP and ensured his request for a transfer to Sagar, which is his hometown, at the fag end of his career was accepted," Mishra said.
The Sanjeevani helpline is now functional in Bhopal, Gwalior and Indore as well, he added.
Psychiatrist Dr Viabhav Dubey said communication gaps within the family as well as glorification of suicides in the media sometimes and incidents broadcast live on social media have also resulted in the numbers going up.
Citing the media coverage of the death of actor Sushant Singh Rajput, Dubey said it sometimes makes people think ending their lives is the easiest solution.
People are looking up to the digital world rather that talking to friends and family, he rued.
Seeing social media posts of people informing about purchasing homes, cars, of holidays abroad also increases frustration and despair among those who feel they are down and out, Dubey said.
"In my 25-year career, I am seeing a rise in the number of suicides in the last five years. If we don't take steps now, in 20 years we might see problems like loneliness etc which we are seeing in the west. This could take a heavy toll," he claimed.
People who rely on internet and social media for cure of illness instead of consulting doctors may also end their lives out of frustration if they don't get better for a long period, he added.&nbsp;

Dhankar expresses 'pain' after video shows him bowing & greeting PM Modi

Vice President Jagdeep Dhankhar on Thursday expressed &ldquo;pain and anguish&rdquo; over a viral video clip that showed him bowing and greeting Prime Minister Narendra Modi with folded hands, saying such a gesture is his nature and he does not see who is in front.
A day after the clip was shared on social media handles including by some Congress leaders, Dhankhar in Rajya Sabha asserted that the dignity of a constitutional position is only elevated by humility.
&ldquo;You never know who will put in on Instagram, who will put in on Twitter. You never know who will start measuring the strength of my backbone,&rdquo; he said.
 &ldquo;I want to say that bowing and greeting namaskar (with folded hands) is my nature. I dont see who is in front.&rdquo;
Standing in the House with folded hands, Dhankhar said it is &ldquo;sometimes very painful at the level to which some may stoop&rdquo;.
&ldquo;I can only express my pain, (and) my anguish if (this uploading is done) by an institution which has a high office in the country's politics,&rdquo; he said in oblique reference to Congress' social media handle.
 &ldquo;It is extremely hurtful when I thought of sharing my anguish, my sentiments with a senior leader... It resulted in a more challenging scenario by putting it on Twitter. I thought wisdom will dawn (and) they will reflect.&rdquo;
Dhankhar said he was &ldquo;a modest man; arrogance can never be part of my life.&rdquo;
&ldquo;By nature I am humble, if not I try to be more humble. But we should not make fun of institutions,&rdquo; he said.
&ldquo;It is our cultural heritage to bow while greeting someone. Dignity of the office is maintained when you bow more. And this pain has been given to me by those people who I respect a lot.&rdquo;

Police Inspector Masroor Ahmad Wani, who was critically injured when he was shot at by a Lashkar-e-Taiba terrorist while playing cricket in Srinagar in October, died at AIIMS here Thursday leaving behind his wife who is expecting her first child.
Officials said despite best efforts of the medical team, Wani succumbed to injuries this afternoon.
Son of a retired police sub-inspector, Wani was playing cricket at the Eidgah ground when the lone terrorist fired three shots in the eye, abdomen and neck from close range on October 29, a Sunday when a number of youngsters were playing the game.
Wani's teammates ran after the terrorist but he fired in the air and fled.
Wani was rushed to a hospital in Soura where he was undergoing treatment. However, he was airlifted and brought to AIIMS Delhi Wednesday and was on life support.
Besides his wife, he is survived by his father and a brother.
Wani's death has left a deep sense of loss among his colleagues and loved ones, said Director General of Jammu and Kashmir Police R R Swain.
"You see Jammu and Kashmir Police personnel are always on duty and here the martyred police inspector has made a supreme sacrifice of his life. On behalf of the Jammu and Kashmir Police family, we stand behind his family in this hour of grief," he said.
Additional Director General of Police (operations) Vijay Kumar, who had immediately rushed to the scene on that day, condoled his loss and said every attempt was made to save him. "But unfortunately, we lost him today," he said.
Kumar, who was officiating as Inspector General of Kashmir range when the attack took place, had said the police had identified the terrorist as Basit Dar, who hails from Kulgam in South Kashmir and was active for quite some time.
Former chief minister and vice president of National Conference Omar Abdullah condoled the death of Wani saying this was the unfortunate truth of the valley where targeted killings were continuing.
CPI-M leader Mohammed Yusuf Tarigami said this incident punctures the tall claims of the Centre and the Jammu and Kashmir administration about the situation being normal in Kashmir.
"Losing such a young, daring and vibrant cop is too difficult to compensate for! May his soul rest in peace and solace and may the bereaved family be granted with forbearance to endure this irreparable loss," JK Apni Party chief Altaf Bukhari said.

J-K Reorganisation Act should not be amended: Omar cites two reasons

The former Jammu and Kashmir chief minister said that the J-K Reorganisation Act should not be amended as the case was pending in the Supreme Court.&nbsp;

National Conference (NC) vice president Omar Abdullah Thursday said the government should not make amendments to the Jammu and Kashmir Reorganisation Act as the law is pending adjudication before the Supreme Court.
Abdullah's remarks came after the Lok Sabha passed the Jammu and Kashmir Reorganisation (Amendment) Bill, which seeks to nominate two members from the Kashmiri migrant community and one representing the displaced persons from PoK to the legislative assembly.
&ldquo;Our objections to the bill are on two issues. The first is that the Supreme Court has not announced its decision on the reorganisation and they (government) are bringing changes after changes,&rdquo; the NC leader told reporters in Pulwama.
He said the second objection the party has is on the filling of assembly seats through nomination.
&ldquo;That should be left for the elected government. The bill gives the right of nomination to the LG. It clearly raises a doubt that this is being done to help the BJP because the BJP cannot win the elections and so, they are trying to increase the number of seats for themselves,&rdquo; he said.
The former chief minister, however, said when the assembly elections take place in J-K, the elected government may undo the changes.
&ldquo;If there is no change in it, then after elections, when there is an elected government, we will see to it,&rdquo; he added.
To a question about the Peoples Democratic Party (PDP) contemplating to approach the court over the amendment bill, Abdullah said the NC has already challenged the Jammu and Kashmir Reorganisation Act in the apex court.
&ldquo;The whole issue is in the court, the whole issue of reorganisation of J-K is in the court. Now, perhaps there is some compulsion for the PDP to go to the court, because they did not approach the Supreme Court when we filed a case in the apex court against August 5, 2019 (decisions), the PDP was silent then.
&ldquo;As of now, there is no need for us to go to the court because our case is already in the court,&rdquo; he added.
Asked why the NC and PDP were conducting party functions separately, and not coming together for the benefit of the people of J-K, Abdullah said both the parties have come together for a &ldquo;bigger cause&rdquo;.
&ldquo;Why should we not hold separate functions? We have different ideologies, but, as far as the bigger cause is concerned, as far as August 5 and a betrayal which was done with us is concerned, we talk about it together. We are trying to find solution to that together,&rdquo; he said.
He said the aim of the party workers&rsquo; conventions was to talk to the people and make the party stronger. &ldquo;There will be a test next year and we are preparing for that.&rdquo; To a question whether NC president and Lok Sabha MP Farooq Abdullah would recontest from Srinagar constituency, Omar Abdullah said, &ldquo;If he wants to contest the election, then we will not have a better candidate than him. Because of his health or any other reason if he decides against fighting election, then we will choose a suitable candidate after consulting him and colleagues.&rdquo;
