Student who accused Chinmayanand of rape turns hostile in court

A 23-year-old law student, who had last year accused former BJP MP Chinmayanand of rape, turned hostile at a hearing in a special court in Lucknow on Tuesday. The LLM student categorically denied that she had levelled any allegation against the former Union minister. The student now faces a perjury charge. 72-year-old Chinmayanand was arrested last year in the rape case, and was granted bail in February. Earlier in her statement to cops and then before a magistrate the woman had accused Chinmayanand&nbsp;of sexually abusing and threatening her.&nbsp;

Lucknow, PTI: In a courtroom twist Tuesday to the high-profile case, a law student who had accused former Union minister Chinmayanand of sexually exploiting her disowned her statements to police and now faces a perjury charge.
Appearing before an MP-MLA court in Lucknow, the LLM student categorically denied that she had levelled any allegation against the former Union minister as the prosecution had charged.
At this, the prosecution immediately moved an application under Section 340 of the CrPC, seeking action against her for perjury.
Judge P K Rai directed his office to register the application and asked the prosecution to furnish a copy of the application to the victim and the accused.
The court fixed October 15 for hearing on the application.
The Allahabad High Court in February this year granted bail to Chinmayanand, whose trust runs the Shahjahanpur law college where the woman studied. He was arrested in September last year.
The case was registered under Section 376-C of the IPC, an offence pertaining to the abuse of one's position by a person in authority to "induce or seduce" a woman under his charge to have "sexual intercourse not amounting to the offence of rape".
Chinmayanand (72) also faced charges under Sections 342 (wrongful confinement), 354-D (stalking) and 506 (criminal intimidation) of the IPC.
According to government lawyer Abhay Tripathi, the victim had lodged an FIR in this regard with the Lodhi Colony police station of New Delhi on September 5, 2019.
Her father lodged another complaint in Shahjahanpur and both FIRs were merged.
An SIT had recorded her statement. Later, her statement under Section 164 of the CrPC was recorded in Shahjahanpur.
In both statements, she had supported the FIR version but now during the trial, she changed her statement and denied the facts mentioned in the complaint.
&ldquo;Since she has turned hostile, I have moved an application under Section 340 of the CrPC,&rdquo; Tripathi said.
Earlier, the investigation officer had cited 33 witnesses and 29 documentary evidence in the 13-page charge sheet.
The Allahabad high court had on February 3, 2020 transferred the trial from Shahjahanpur to the Lucknow's MP-MLA court.
The case first came to light after the woman went missing on August 24, a day after she posted a video on social media alleging that a "senior leader of the sant community" was harassing and threatening to kill her.

Nine expelled Congress leaders have written to party president Sonia Gandhi, asking her to "rise above the affinity for the family " and run the organisation by establishing mutual trust and restoring the constitutional and democratic values. The letter from the UP veterans comes days after 23 senior Congress leaders wrote to Gandhi, saying uncertainty over the party leadership has "demoralised Congress workers". In the letter, the nine Congress leaders, including former MP Santosh Singh and former minister Satyadev Tripathi, have urged Gandhi to "restore the expression of thoughts, constitutional and democratic values, and run the organisation by establishing communication and mutual trust".

The letter from the UP veterans comes days after 23 senior Congress leaders wrote to Gandhi, saying uncertainty over the party leadership has "demoralised Congress workers". They also said over-centralisation and micro-management have always proven counter-productive.
In the letter dated September 2 and addressed to Gandhi, the nine Congress leaders, including former MP Santosh Singh and former minister Satyadev Tripathi, said Jawaharlal Nehru, Indira Gandhi and Rajiv Gandhi built the Congress and the country with democratic values.
But it's ironical that for sometime, the way in which the party is being run, there is confusion ("asmanjas") and depression ("avsaad") among the ordinary Congress worker, they added.
"At a time, when the country's democratic values and social fabric is lying scattered, the need of the country is that Congress remain alive, dynamic and strong. You please rise above the affinity for the family, and as per traditions, restore the expression of thoughts, constitutional and democratic values, and run the organisation by establishing communication and mutual trust," the leaders urged Gandhi.
"If you deviate from your responsibility, then Congress will become a thing of the past," they said. "Today, the Congress is facing uncertainty, indecisiveness, lack of communication, and lack of expression of thoughts, and is passing through a difficult phase of existential crisis." They also said the "height of insensitivity" can be gauged from the fact that the party president does not know about the incidents taking place in the organisation or is keeping the eyes shut "despite knowing everything".
Referring to their expulsion, the leaders said in the letter, "It is almost one year (since expulsion), but despite requests we were not given time by the (state unit of the) party. The party's central disciplinary committee is also not listening to anything. It seems the Congress office is locked." They claimed the disciplinary committee of the party's UP unit cannot expel them since they are members of the AICC.
Singh and Tripathi were among the 10 senior leaders who were expelled from the primary membership of the Congress on November 24 last year for six years for allegedly tarnishing the party's image and opposing its leadership's decisions at public forums.
The other expelled leaders who signed the letter are Siraj Mehdi (former MLC), Bhoodhar Narayan Mishra (former MLA), Vinod Chaudhary (former MLA), Nek Chandra Pandey (former MLA), Swayam Prakash Goswami (former chairman of Youth Congress), Rajendra Singh Solanki and Sanjeev Singh.
