The Supreme Court on Wednesday granted regular bail to activist Teesta Setalvad in a case of alleged fabrication of evidence to frame innocent people in the 2002 post-Godhra riots cases.
A three-judge bench of Justices B R Gavai, A S Bopanna and Dipankar Datta set aside the order of the Gujarat High Court rejecting her plea for regular bail.
The top court said a charge sheet has been filed in the case against Setalvad and her custodial interrogation is not necessary.
"The passport of the appellant already surrendered will be in the custody of session court. The appellant shall not make any attempt to influence witnesses and shall stay away from them," the bench said.
Setalvad was taken into custody on June 25 last year along with former Gujarat Director General of Police R B Sreekumar and ex-IPS officer Sanjiv Bhatt in a case registered by the Ahmedabad crime branch police for allegedly fabricating evidence to frame innocent people in the post-Godhra riots cases.

The Gujarat high court had observed Setalvad made attempts to unsettle a democratically elected government and sully the image of the then chief minister and current Prime Minister Narendra Modi, and tried to send him to jail.

The Supreme Court on Wednesday extended interim protection from arrest till July 19 to activist Teesta Setalvad in a case linked to the 2002 post-Godhra riots.
A bench of Justices B R Gavai, A S Bopanna and Dipankar Datta issued notice to the Gujarat government on the appeal filed by Setalvad against the Gujarat High Court order.
"Issue notice returnable on July 19, 2023. Whatever documents parties want to place on record shall be filed prior to July 15 after exchanging with each other. Interim order to continue until further orders," the bench said.
At the outset, Additional Solicitor General S V Raju sought time from the top court, saying he needs time for the translation of documents. The bench agreed to his request and posted the matter for hearing on July 19.
Senior advocate Kapil Sibal, appearing for Setalvad, urged the bench to hear the matter urgently.
The apex court on July 1 protected Setalvad from arrest and stayed for a week the high court order rejecting her plea for regular bail and asking her to surrender immediately in a case of the alleged fabrication of evidence to frame innocent people in the post-Godhra riot cases.
During the late-night hearing on July 1, the three-judge bench had questioned the denial of time to Setalvad to appeal against the high court's order, saying even an ordinary criminal is entitled to some form of interim relief.
"In ordinary circumstances, we would not have considered such a request. However, it is to be noted that after the FIR was registered against the petitioner on June 25, 2022 and the petitioner was arrested.
"This court considering the application for grant of interim bail had granted the same on certain conditions, vide order dated September 2, 2022. One of the factors that weighed with this court was that the petitioner was a woman and as such entitled to special protection under Section 437 CrPC," the bench had noted in its order.
"We find that, taking into consideration this fact, the single judge ought to have granted at least some protection so that the petitioner has sufficient time to challenge the order passed by the single judge before this court," the top court had said.
"In that view of the matter, without considering anything on merits of the matter, finding that the single judge was not correct in granting even some protection, we grant a stay of the impugned order passed by the high court for a period of one week from today," it had said.
The three-judge bench had heard the matter in a special sitting on July 1 after a two-judge vacation bench on the same day had differed on granting interim protection from arrest to Setalvad.
Facing impending arrest, Setalvad promptly moved the apex court seeking protection from arrest but the two-judge vacation bench could not reach a consensus on granting her interim relief.
The vacation bench of justices Abhay S Oka and Prashant Kumar Mishra had referred the matter to CJI D Y Chandrachud, who swiftly put together a bench of three judges to hear Setalvad's petition challenging the high court order at 9:15 PM on July 1.
Earlier on July 1, Justice Nirzar Desai of the Gujarat High Court had directed her to surrender immediately.
Setalvad was out of jail after having secured interim bail from the apex court in September last year.
The court had observed Setalvad made attempts to unsettle a democratically elected government and sully the image of the then chief minister and current Prime Minister Narendra Modi, and tried to send him to jail.
Setalvad was arrested in June last year along with former Gujarat Director General of Police R B Sreekumar and ex-IPS officer Sanjiv Bhatt in an offence registered by Ahmedabad crime branch police for allegedly fabricating evidence to frame innocent people in the post-Godhra riots cases.
In its judgment, the high court had observed that prima facie Setalvad used her close associates and riot victims to file "false and fabricated affidavits before the Supreme Court with a view to unseat the establishment and to tarnish the image of establishment and the then chief minister (Modi)".&nbsp;

After the Gujarat High Court rejected the regular bail plea of social activist Teesta Setalvad and directed her to surrender immediately on Saturday, Setalvad moved the top court hoping to get relief, however the SC referred her bail plea to a 3-judge bench after two judges of the top court differed on the ruling on Saturday.
The Gujarat High court passed quashed Setalvad's plea after observing she made attempts to unsettle a democratically elected government and sully the image of the then chief minister and current Prime Minister Narendra Modi and tried to send him to jail.
Setalvad was accused of fabricating evidence to implicate innocent people in the 2002 post-Godhra riots cases, the court of Justice Nirzar Desai said that enlarging her will send a false signal that everything in a democratic country is lenient.
The court directed Setalvad, who is currently out on interim bail, to surrender immediately. It also rejected her lawyer&rsquo;s request to give her 30 days to surrender.

The Supreme Court granted interim bail to social rights activist Teesta Setalvad in connection with the case for allegedly fabricating evidence to frame "innocent people" in the 2002 Gujarat riots cases. Setalvad was arrested on June 25, 2022.&nbsp;
The order passed by the bench of Chief Justice Uday Umesh Lalit and justices S Ravindra Bhat and Sudhanshu Dhulia directed Setalvad to surrender her passport with trial court till the time the Gujarat High Court decides her regular bail plea.
The top court also asked Setalvad to cooperate with the probe agency in investigation of alleged fabrication of evidence to frame people in riots cases.&nbsp;
The apex court made it clear that the order has been made from the standpoint of interim bail till the Gujarat High Court decide her bail plea independently and uninfluenced by any observations made by the supreme court.
Earlier on 1 September 2022, the top Court asked the reason for the delayed listing of activist Teesta Setalvad's bail plea by the Gujarat High Court, and asked whether "this lady has been made an exception".&nbsp;
It wondered why the high court listed the bail prayer for hearing on September 19, six weeks after it sent a notice to the state government seeking a response to her application.

It has alleged that Setalvad was paid Rs 30 lakh at Patel's behest soon after the Godhra train burning incident of 2002.
Sreekumar was a "disgruntled government officer" who "abused the process for damning the elected representatives, bureaucracy and police administration of the whole state of Gujarat for ulterior purposes", the SIT claimed.

The UN's Office of the High Commissioner for Human Rights (OHCHR) has voiced concern over the arrest and detention of social activist Setalvad and called for her immediate release.
"#India: We are very concerned by the arrest and detention of #WHRD @TeestaSetalvad and two ex-police officers and call for their immediate release. They must not be persecuted for their activism and solidarity with the victims of the 2002 #GujaratRiots," the UN Human Rights office said in a tweet on Tuesday.
Responding to media queries on the remarks, Ministry of External Affairs Spokesperson Arindam Bagchi said, "We have seen a comment by OHCHR regarding legal action against Teesta Setalvad and two other persons." "The remarks by OHCHR are completely unwarranted and constitute an interference in India's independent judicial system," he said.
Authorities in India act against violations of law strictly in accordance with established judicial processes, Bagchi asserted.
"Labelling such legal actions as persecution for activism is misleading and unacceptable," he said.
A court in Ahmedabad on Sunday remanded Setalvad and former state director general of police RB Sreekumar in police custody till July 2 in a case of fabricating evidence to frame innocent persons in connection with the 2002 Gujarat riots. Former IPS officer and accused Sanjiv Bhatt, who is serving a life sentence in a custodial death case and is lodged in a jail in Palanpur in Banaskantha district, will be brought to Ahmedabad on a transfer warrant.
Setalvad, Sreekumar and Bhatt are accused of abusing the process of law by conspiring to fabricate evidence with an attempt to frame innocent people for an offence punishable with capital punishment in connection with the 2002 Gujarat riots.
