In a late-night relief, the Punjab and Haryana High Court stayed a fresh arrest warrant against BJP leader Tajinder Pal Singh Bagga whose dramatic arrest by the Punjab Police and subsequent release triggered an intense political slugfest between the AAP and the BJP on Saturday.
Justice Anoop Chitkara took up Bagga's petition in an urgent hearing at his residence just before midnight and directed that no coercive steps be taken against him till May 10, hours after a Mohali court issued the non-bailable arrest warrant, the BJP leader's counsel Chetan Mittal said.
In the political arena, the slugfest between the AAP and the BJP escalated into protests and name-calling.
Back home in the early hours of Saturday, Bagga, surrounded by family members and friends at his Janakpuri residence, tore into the Aam Aadmi Party and its chief Arvind Kejriwal over his arrest, accusing him of pursuing political vendetta through police in Punjab.
"No matter one or 100 FIRs are registered against me, I will keep raising issues of dishonouring of the Guru Granth Sahib and Kejriwal's insult to Kashmiri Pandits," he said.
"They (the AAP) are attacking me because I am raising my voice against the AAP and its chief Kejriwal," he said.
BJP leaders also protested outside the residence of the Delhi Chief Minister, calling him a "dictator".
The AAP accused the BJP and its governments of protecting its "goon" who incited riots in Punjab.
Bagga's arrest in the case filed by AAP leader Sunny Ahluwalia at Mohali on April 1 witnessed the Punjab Police pitted against their counterparts from Haryana and Delhi.
The Delhi Police has filed a case of kidnapping over his arrest. As Punjab Police was taking him to AAP-ruled state, they were stopped by their Haryana counterparts. Bagga was later brought to the national capital by the Delhi Police, taken to the DDU hospital as a Medico-Legal-Case (MLC) before being produced in front of a Dwarka court magistrate.
"The medical examination revealed injury marks on his body,” the Delhi Police said on Saturday. "Bagga expressed apprehension over his safety and security. We will do necessary security arrangements," a senior officer said.
Bagga claimed that while he was being taken to Punjab after his arrest, the police tried to persuade him not to raise issues pertaining to dishonouring of Guru Granth Sahib and 'The Kashmir Files' movie. "They told me why I was getting myself involved with matters of other state when I lived in Delhi." Delhi BJP chief Adesh Gupta alleged that with Bagga's arrest, it was clear that the Aam Aadmi Party's national convener had "misused" the Punjab Police for personal benefit.
"Kejriwal is a dictator. What was Bagga's crime? He just asked for Kejriwal's clarification on his remarks on '(The) Kashmir Files'. He was not allowed to wear a turban during the arrest," he said. "The BJP will not tolerate the insult to the turban." The National Commission for Minorities (NCM) also sought a report from Punjab chief secretary within seven days on allegations that Bagga was not allowed to wear a turban while being arrested by Punjab police.
Delhi Deputy Chief Minister Manish Sisodia alleged the entire BJP and its governments are engaged in saving one of their "goons who spoke against the brotherhood in Punjab and incited riots".
"The BJP is a party of goons which makes even its government do the job of goons. Never even by mistake, these people talk about education, health, inflation and unemployment," he tweeted in Hindi.
But even as Bagga and the BJP launched tirades against the AAP, a court in Mohali issued a non-bailable arrest warrant against Bagga for allegedly promoting enmity between different groups on grounds of religion and criminal intimidation), among other charges.
The arrest warrant was issued by the court of Judicial Magistrate Ravtesh Inderjit Singh.
In its order, the court said, "Keeping in view the contents of the application and the fact that sufficient opportunities have already been granted to the accused to join the investigation and despite that accused has failed to join the investigation, it is necessary in the interest of justice, to issue non-bailable warrants of accused Tajinder Pal Singh Bagga for 23.05.2022, who is evading arrest, in order to facilitate the investigation." Soon after, Bagga moved the high court and secured relief.
Also, the Punjab government Saturday moved two applications before the Punjab and Haryana High Court, seeking the Centre and the Delhi Police chief be made parties to the arrest case, and that the May 6 CCTV footage of Janakpuri and Kurukshetra police stations be preserved.
The Punjab government has alleged that its police personnel were "detained" at Janakpuri and Kurukshetra police stations when they had gone to arrest Bagga.
After the hearing, the Delhi Police counsel alleged the Punjab Police did not follow laid down procedure while arresting Bagga, a claim rejected by the Pujab government counsel.
"The Punjab Police did not consult us or inform us before taking Mr Bagga into custody. Those who had gone there (to Bagga's home in Delhi) they were also not in uniform, they were in plainclothes," said Additional Solicitor General of India Satya Pal Jain, who represented the Delhi Police.
Punjab government counsel Poneet Bali told reporters outside the high court on Saturday that Bagga was served notices on five occasions, but he did not respond.
"The Punjab police has every right to arrest an accused," he said.
The hearing in the case was adjourned for May 10.
While referring to the kidnapping complaint, the counsel claimed the Delhi Police obtained a search warrant from a court without disclosing the fact that Bagga is an accused in a case and he has been arrested.
"So, whatever is the future course of action as far as Mr Bagga is concerned will definitely be taken." The ruling AAP's chief spokesperson for Punjab Malvinder Singh Kang claimed Bagga was a habitual offender. Her alleged Bagga faced more than 20 cases in Delhi, West Bengal and Chattisgarh.
"Such anti-social elements should get punishment as per the law of the land, but unfortunately the country's government is coming out in his support," he alleged.
"...This country will run according to law, Constitution, and not in an autocratic manner," Kang said.
The Congress also entered the debate with its leader P Chidambaram saying police serving their political masters will lead to the "ultimate breakdown" of federalism.

Tajinder Bagga's father Pritpal Singh Bagga (64) told PTI that his son, accompanied by his friends and supporters, returned home around 1 am.

Earlier in the day, Pritpal Bagga had complained that some people came to his house in the morning and took away his son, a senior police officer said, adding that the case of kidnapping has been registered at Janakpuri police station.
The Punjab Police personnel did not inform the local police in Delhi before arresting Tajinder Bagga, a Delhi Police official said.
Deputy Commissioner of Police (West) Ghanshyam Bansal said they received information from Pritpal Bagga that his son Tajinder Bagga had been abducted around 8.30 am from his house by some unknown persons.
There were other allegations as well in his complaint, the police said.
The case was registered under sections 452 (house trespass after preparation for hurt, assault or wrong­ful restraint), 392 (robbery), 342 (wrongful confinement), 365 (kidnapping), 295A (deliberate and malicious acts, intended to outrage reli­gious feelings of any class by insulting its religion or reli­gious beliefs) and 34 (common intention) of the Indian Penal Code (IPC), according to a Delhi Police statement.
Thereafter, a wireless message was flashed and the said vehicle was intercepted in Kurukshetra by the Haryana Police, the DCP said.
A search warrant was obtained from a Dwarka court based on which the assistance of Kurukshetra district police was taken to trace and recover the abducted victim, Bansal said.
He was being brought to Delhi for production before a magistrate, the DCP said.
Tajinder Bagga was produced before a magistrate late at night, the police said.
Pritpal Bagga told PTI he was happy that his son had come back home.
"My son was produced before a magistrate in Gurugram and released by police. Later, he reached home accompanied by his friends and supporters," Pritpal Bagga said.
In his complaint, the BJP leader's father said, "I was present at my home along with my son on Friday. Around 8.30 am, someone knocked the door repeatedly. When I opened it, some persons entered my home and manhandled me. Some of them had weapons." "They started asking me where is Tajinder Singh Bagga. When I asked them what they wanted from Tajinder, they slapped me. Later, my son came there and they started beating him. When I tried to intervene, they pushed me," the FIR stated.
"When I took out my phone to record their video, they beat me up and snatched the mobile. Later, they forcefully took away my son who was not allowed to wear a turban and was dragged out of the house," it stated.
Pritpal Bagga was accompanied by Delhi BJP president Adesh Gupta when he went to file the FIR.
The Punjab Police team was stopped in Kurukshetra's Pipli, with a Haryana Police official saying they had received information that Bagga was "forcibly" picked up from his residence.
A team of Delhi Police personnel, including senior officials, went to Kurukshetra, took Bagga's custody and left for the national capital, a Kurukshetra police official said.
Pipli Sadar police station SHO Malkiat Singh said, "The Delhi Police took him (Tajinder Bagga) with them in view of an FIR registered in Delhi about his kidnapping." Meanwhile, Delhi BJP workers staged a protest outside Janakpuri police station and raised slogans against the Punjab Police.
Last month, the Punjab Police booked Tajinder Bagga on the charges of making provocative statements, promoting enmity and criminal intimidation. The case was registered on a complaint of AAP leader Sunny Ahluwalia, a resident of Mohali.

Delhi BJP leader Tajinder Pal Singh Bagga was arrested by Punjab Police from his home, stopped in Haryana while being taken to Punjab and brought back to the national capital by Delhi Police hours later, a Friday of dramatic developments that drew in the police of three states and led to a BJP-AAP slugfest.
The BJP accused Punjab Police of "abducting" its leader, who has been vocal in his criticism of Arvind Kejriwal, and accused the AAP chief and Delhi chief minister of pursuing vendetta through the state police. The Aam Aadmi Party rejected the charge and said the Delhi BJP spokesperson was arrested for allegedly stoking communal tension in Punjab.
Delhi Police registered a case of kidnapping based on a complaint by Bagga's father Preetpal Singh. The Punjab government, on its part, moved the high court against the "detention" of its police team in Kurukshetra, Haryana.
The AAP rules Delhi and Punjab while the BJP governs Haryana. However, Delhi Police comes under the Union Home ministry and not the AAP-led Delhi government.
As tempers ran high with multiple claims and counter-claims coming in with dizzying rapidity, Preetpal Singh alleged that a team of 15-20 Punjab Police personnel barged into their Janakpuri home around 8 am, punched him in the face and did not allow his son to put on his turban while they were arresting him.
Recounting the events of the morning, he said the family, including Bagga, had finished breakfast when two Punjab Police personnel entered their west Delhi home. The two policemen had visited the family earlier as well.
"We offered them tea… A few minutes later, 10-15 Punjab Police personnel broke in. They dragged Tajinder out and did not allow him to cover his head.
"When I tried to make a video of the incident, my mobile phone was snatched and I was punched in the face and forced to sit down," Bagga’s elderly father told reporters. Soon after, the cavalcade of vehicles with Bagga was on its way from Delhi to Mohali in Punjab, about 250 km away, when it was held up in Kurukshetra, about halfway between the two cities.
Asked why the Punjab Police team was stopped, a Haryana Police official said there was information that Bagga had been "forcibly" picked up from his residence. "We have to verify and crosscheck these things," he said.
In the high-voltage drama that followed, a Delhi Police team reached Kurukshetra and took ‘custody’ of 36-year-old Bagga from Punjab Police.
The exact reasons for Bagga’s arrest and the legality of it were not clear.
Addressing a press conference, Delhi BJP leader Nupur Sharma cited a court ruling to say that police from another state must inform the local police before making any arrest. Punjab Police's action, she said, was illegal as it did not inform its Delhi counterparts.
The Punjab cops had not informed the local police in Delhi before arresting Bagga, a Delhi Police official said.
Though AAP chief spokesperson Saurabh Bharadwaj referred to the clashes in Patiala on April 29, Punjab Police said it arrested Bagga in connection with a case registered in Mohali on April 1.
The April 1 FIR referred to Bagga's remarks on March 30, when he was part of a BJP youth wing protest outside Kejriwal’s residence.

Defending the Punjab Police's action, Bharadwaj told reporters that the state police registered a case against Bagga last month after the BJP leader, through his social media posts, "tried to create communal tension and incite violence in the state".
"Because of such statements, the Punjab Police lodged an FIR and now arrested Bagga. His statements were communal in nature. A lot of BJP-linked people were instigating the violence in Patiala," Bhardwaj alleged.
Delhi BJP leaders, including state unit president Adesh Gupta, held their own press conference and slammed Kejriwal, saying their leader had been picked up for "unmasking" his lies.
"It is said that if you want to see someone's real face, give that person power. The real character and face of Kejriwal has now come to the fore," Gupta said.
BJP leader Manjinder Singh Sirsa added that a Sikh, a reference to Bagga, has been "insulted" despite Punjab having a Sikh chief minister in Bhagwant Mann.
Following the arrest, Punjab Police said in a statement that Bagga had been served five notices “under Sections 41 A CrPC to come and join the investigation. The notices dated April 9, 11, 15, 22 and 28 were duly served upon. Despite that, the accused deliberately did not join the investigation".
It said due process of law had been followed.
In a letter to the Kurukshetra superintendent of police, Mohali senior superintendent of police Vivek Sheel Soni said the Haryana Police stopping Punjab cops returning from Delhi with the arrested BJP leader was tantamount to "illegal detention".
Soni also referred to the FIR registered against Bagga last month and that five notices were served to him to join the probe. "But he did not appear before the investigating team".
"That in accordance with the law, a police party was sent to arrest the accused Bagga. The said police party arrested the accused from his Delhi residence in the morning... it has come to my notice that the police party has been stopped by the Haryana Police on the Karnal-Kurukshetra highway.
"This is tantamount to illegal detention and interference in the administration of the criminal justice system," the Mohali SSP said.

The BJP accused Punjab Police of "abducting" its leader, who has been vocal in his criticism of Arvind Kejriwal, and accused the AAP chief and Delhi chief minister of pursuing vendetta through the state police. The Aam Aadmi Party rejected the charge and said the Delhi BJP spokesperson was arrested for allegedly stoking communal tension in Punjab.
Delhi Police registered a case of kidnapping based on a complaint by Bagga's father Preetpal Singh. The Punjab government, on its part, moved the high court against the "detention" of its police team in Kurukshetra, Haryana.
The AAP rules Delhi and Punjab while the BJP governs Haryana. However, Delhi Police comes under the Union Home ministry and not the AAP-led Delhi government.
As tempers ran high with multiple claims and counter-claims coming in with dizzying rapidity, Preetpal Singh alleged that a team of 15-20 Punjab Police personnel barged into their Janakpuri home around 8 am, punched him in the face and did not allow his son to put on his turban while they were arresting him.
Recounting the events of the morning, he said the family, including Bagga, had finished breakfast when two Punjab Police personnel entered their west Delhi home. The two policemen had visited the family earlier as well.

"We offered them tea&hellip; A few minutes later, 10-15 Punjab Police personnel broke in. They dragged Tajinder out and did not allow him to cover his head.
"When I tried to make a video of the incident, my mobile phone was snatched and I was punched in the face and forced to sit down," Bagga&rsquo;s elderly father told reporters. Soon after, the cavalcade of vehicles with Bagga was on its way from Delhi to Mohali in Punjab, about 250 km away, when it was held up in Kurukshetra, about halfway between the two cities.
Asked why the Punjab Police team was stopped, a Haryana Police official said there was information that Bagga had been "forcibly" picked up from his residence. "We have to verify and crosscheck these things," he said.
In the high-voltage drama that followed, a Delhi Police team reached Kurukshetra and took &lsquo;custody&rsquo; of 36-year-old Bagga from Punjab Police.
The exact reasons for Bagga&rsquo;s arrest and the legality of it were not clear.
Addressing a press conference, Delhi BJP leader Nupur Sharma cited a court ruling to say that police from another state must inform the local police before making any arrest. Punjab Police's action, she said, was illegal as it did not inform its Delhi counterparts.
The Punjab cops had not informed the local police in Delhi before arresting Bagga, a Delhi Police official said.
Though AAP chief spokesperson Saurabh Bharadwaj referred to the clashes in Patiala on April 29, Punjab Police said it arrested Bagga in connection with a case registered in Mohali on April 1.
The April 1 FIR referred to Bagga's remarks on March 30, when he was part of a BJP youth wing protest outside Kejriwal&rsquo;s residence.
