A bench consisting of Justices Vikram Nath, Sanjay Karol, and Sandeep Mehta ordered Hussain's release from jail under the jail manual timing upon the deposit of approximately 2 lakh per day (12 hours).&nbsp;
Hussain is facing charges in the murder case of Intelligence Bureau (IB) officer Ankit Sharma during the 2020 North-East Delhi riots, which led to 53 deaths and many injuries. Hussain has been named in 11 FIRs related to the riots.
Tahir Hussain is contesting the Delhi Assembly elections against BJP's Mohan Singh Bisht, an incumbent MLA from the neighboring Karawal Nagar, AAP's Adil Ahmad Khan, and Congress' Ali Mehdi, the son of former MLA Hasan Mehdi.&nbsp;
The elections will be held on February 5, with the vote counting taking place on February 8. The Congress party, which had been in power for 15 years, has faced setbacks in the last two assembly elections, failing to secure any seats.&nbsp;
Meanwhile, AAP emerged victorious in the 2020 elections, winning 62 out of 70 seats, while BJP secured only eight seats.

In a significant move, the Supreme Court allowed former AAP councillor and February 2020 riots accused Tahir Hussain to campaign for the Delhi assembly elections. Hussain was granted six-day custody parole with strict conditions.

The Supreme Court on Tuesday granted six-day custody parole to former AAP councillor and February 2020 riots accused Tahir Hussain, who is contesting on a AIMIM ticket, to campaign for Delhi assembly polls.
Custody parole entails a prisoner being escorted by armed police personnel to the place of visit.
A full bench comprising Justices Vikram Nath, Sanjay Karol and Sandeep Mehta allowed Hussain's plea to campaign in police custody from January 29 to February 3.
The court said he would only be allowed to leave jail along with security for 12 hours, according to the jail manual.
The top court said the former councillor could walk out of jail at around 6 am and return by 6 pm.
The bench said Hussain's custody parole would be subject to the deposit of Rs 2.47 lakh per day as part of security expenses, including the police escort.
Hussain, said the court, should not visit his Karawal Nagar home, an alleged site of the riots, while restraining him from making any public comments over the case's merits.
It clarified the order will not be treated as a precedent as it was passed in the "peculiar facts and circumstances" of the case.
The court said Hussain's bail application in the Delhi High Court should be decided on its own merits without being influenced by the bench's order.
Senior advocate Siddharth Aggarwal, appearing for Hussain, argued only four-five days were left to campaign.
Aggarwal said his client was contesting from the Mustafabad seat and he won't visit his house and stay at a hotel aside from sharing the details.
Additional solicitor general S V Raju opposed the plea, saying his role in the riots was serious. If granted the relief, said Raju, everybody would fill nominations in jail.
The court asked Raju to seek instructions on the expenses and security would be required and told Aggarwal to inform the undertakings Hussain proposed to give.
The order was passed on Hussain's plea to allow him to campaign in custody for the upcoming Delhi assembly polls.
The former councillor failed to secure interim bail on January 22, after a two-judge bench of the apex court gave a split verdict.
The Delhi High Court granted custody parole to Hussain on January 14 to file his nomination papers from the Mustafabad constituency.
It , however, declined his plea for interim bail from January 14 to February 9 to contest the February 5 election, saying the gravity of the allegations against Hussain, being the main perpetrator in the violence that resulted in the death of several people, could not be overlooked.
The high court said 11 FIRs were lodged against Hussain in connection with the riots and he was admittedly in custody in a related money-laundering case and a case registered under the stringent Unlawful Activities (Prevention) Act (UAPA).
Violence broke out in northeast Delhi on February 24, 2020, leaving 53 people dead and several injured.
Hussain is an accused in a case connected to the death of Intelligence Bureau staffer Ankit Sharma.
According to the prosecution, on February 26, 2020, complainant Ravinder Kumar informed the Dayalpur police station that his son Sharma was missing since the previous day.
His body was reportedly found from the Khajuri Khas nullah in the riot-affected area and it bore 51 injuries.
On January 22, an apex court bench comprising Justices Pankaj Mithal and Ahsanuddin Amanullah delivered a split verdict on Hussain's plea.
While Justice Mithal dismissed Hussain's plea saying no case was made out, Justice Amanullah opined that he could be released on interim bail.
The judges asked the top court registry to place the matter before Chief Justice Sanjiv Khanna for a new bench to decide the issue.

In an interview with Humans of Bombay, the actor recalled that while people assumed that his family led a lavish life style since his father was a producer but the truth was that his family too faced financial struggles.
The actor teared up while talking about his father's struggle. He then took some time to compose himself in between the interview. &nbsp;
Aamir said, 'Thing that would trouble us most was Abba Jaan ko dekh ke (seeing our father). Because he was a very simple man. Maybe he didn&rsquo;t have enough sense that he should not have taken so much loan.'
Aamir further added that because of the movie tickets being sold in black, producers were even not able to recover their dues. 'Unko problem mein dekh ke takleef hoti thi kyuki un logon ke phone aate the jinse paise liye hain. Unka jhagda shuru hojata tha phone pe ki 'main kya karu, mere paas paise nahi hai. Khan recalled that despite financial issues his father made sure to return everyone's money. Aamir's school fee was also always paid on time. His mother used to get extra long pants for them so they can use it for a longer period of time.
He concluded by saying, 'My father was an above-average producer. His sensibilities were nice and he did choose good stories but he didn't understand business. We can only draw this conclusion because his films have worked well but he was always in debt.'

Northeast Delhi riots: SC refuses to stay criminal proceedings against Tahir Hussain

The bench said it is not inclined to interfere with the high court order and all remedies are open to the petitioner.

The Supreme Court on Monday refused to stay proceedings against former Aam Aadmi Party councillor Tahir Hussain in FIRs registered against him in connection with the 2020 northeast Delhi riots.
A bench of justices Ajay Rastogi and CT Ravi Kumar said it is not inclined to interfere with the September 16 order of the Delhi High Court as it is an interim order. Senior advocate Maneka Guruswamy, appearing for Hussain, said it is a settled law that there cannot be two FIRs for the same incident.
She said it has put Hussain in a peculiar situation that charges are framed against him for identical offences arising out of the same incident, and the same prosecution witnesses are relied upon by the investigating agency.
Hussain has moved the top court challenging the Delhi High Court's September 16 order.

The bench said it is not inclined to interfere with the high court order and all remedies are open to the petitioner.
It noted that the high court had issued notices on the applications moved by Hussain for quashing the FIR registered against him for rioting and under sections of the Arms Act at the Khajuri Khas police station, and the proceedings emanating from the FIR.
The top court said that the high court has posted the matter for further hearing on January 25 while refusing to stay proceedings on a separate application moved by Hussain saying multiple FIRs have been lodged for the same.
Hussain has been in judicial custody since March 16, 2020.

The court said that Khalid had been chargesheeted on insignificant material which is unwarranted, adding that there is no evidence of Khalid&rsquo;s presence at the scene of crime.
Opposing his bail, the prosecution had argued that many people related to the &lsquo;riotous mob&rsquo; are yet to be identified, but the Court said that Khalid cannot be incarcerated in jail for infinity just because others who were part of the mob have not yet been identified and arrested.
The charge sheet also accused Umar&nbsp;Khalid of &lsquo;criminal conspiracy&rsquo; in connection with former AAP counsellor&nbsp;Tahir Hussain and alleged that he had planned violence during the former US President Donald Trump's visit to Delhi. The court went on to say that it could not find any rationale in the act of the police involving Khalid in this isolated case for the offence of conspiracy.
The court, however gave him bail on several conditions - Khalid has been asked to furnish a personal bond of Rs 20,000, appear before the Court on every date of hearing, furnish his mobile number to the police upon his release from the jail and also install the &ldquo;Aarogya Setu App&rdquo;.

A Delhi court has rejected former AAP&nbsp;councillor Tahir&nbsp;Hussain's&nbsp;plea that he had no role to play in the Febraury riots in the capital because he did not participate in them physically. The court observed that it is prima&nbsp;facie apparent that Hussain&nbsp;used his muscle power and political clout&nbsp; to foment&nbsp;the violence.&nbsp;The judge said there was enough material on record to presume that Hussain was very well present at the spot of crime and exhorting the rioters of a particular community and as such, he did not use his hands and fists, but rioters as &ldquo;human weapons&rdquo;, who on his instigation could have killed anybody.&nbsp;
Tahir&nbsp;Hussain&nbsp;was arrested after videos emerged which allegedly show people gathered on his terrace during the riots and throwing petrol bombs. The police had also recovered petrol bombs during a raid on his house after the incident.&nbsp;
