The Supreme Court on 5 April 2023 struck down the Narendra Modi govt's decision to ban Malayalam news channel MediaOne on security grounds.
Making harsh observations, the top court reportedly said that "national security claims cannot be made out of thin air" and that there must be "material facts" backing the claims.
The bench headed by Chief Justice of India DY Chandrachud said that an independent press is necessary for robust democracy, and criticism of government policies cannot be termed as anti-establishment.

The Delhi high court had said the Agnipath scheme was formulated with national interest in mind and to ensure that the defence forces are better equipped.

The Supreme Court on Monday dismissed two pleas challenging a Delhi High Court judgment that upheld the Centre's Agnipath scheme for recruitment into the armed forces.
A bench of Chief Justice DY Chandrachud and Justices PS Narasimha and JB Pardiwala said candidates, who earlier got selected through recruitment processes like rallies, physical and medical tests for defence forces before the introduction of the Agnipath scheme, do not have a vested right to appointment.
"Sorry, we would not like to interfere with the high court verdict. The high court had dealt with all the aspects", it said, while dismissing separate pleas filed by Gopal Krishan and advocate ML Sharma against the high court verdict.
The bench, however, posted a third fresh plea related to recruitment in the Indian Air Force (IAF) prior to the launch of the Agnipath scheme for hearing on April 17.

It asked the Centre to file its response to the third plea related to recruitment in the IAF. On March 27, the top court had agreed to hear pleas filed against the Delhi High Court judgment that upheld the Centre's scheme for recruitment into the armed forces. The high court had on February 27 said the Agnipath scheme was formulated in national interest with a laudable objective of maintaining national security.&nbsp;

The petitioners argued that they do not want to face stigma in public, and marriage can be one step towards this as the institution is respected in Indian society.
The petitioners said that they want the right to marry as it is available to others, and even the hurdle of IPC Section 377 is gone now. They also cited examples like child marriage to show how the concept has evolved over the years.
Meanwhile, Chief Justice of India DY Chandrachud wondered what the court can do on the issue in the absence of legislation. He reportedly gave the examples of USA and UK to say that there, the legislature had intervened first by banning, then recognising same-sex marriage.
