Three American lawmakers have introduced a resolution in the US House of Representatives, encouraging India to pursue an independent investigation into the arrest, incarceration and death of Father Stan, a human rights activist who died in custody on July 5, 2021.
Introduced by Congressman Juan Vargas along with lawmakers Jim McGovern and Andre Carson, the resolution expresses concern at the alleged misuse of anti-terror laws to target human rights defenders and political opponents, applauds a recent ruling by the Supreme Court of India to suspend a controversial colonial-era sedition law and urges India's Parliament to make the suspension permanent.
The resolution "makes it clear to the Indian government and all governments around the world that freedom of expression is a fundamental human right, as written in Article 19 of the Universal Declaration of Human Rights and adopted by the United Nations General Assembly in 1948, that enshrines the rights and freedoms of all human beings".
"Father Stan dedicated his life to giving a voice to the voiceless. He was a tireless advocate for the rights of the indigenous Adivasi people, trained young community leaders, and worked for justice for many communities in India," Vargas said.
"As a former Jesuit, I am horrified that Father Stan faced relentless abuse and was denied medical care while in custody. I introduced this resolution to make sure Father Stan and his lifelong commitment to the greater good is never forgotten," he added.
Father Stanislaus Lourduswamy, known as Father Stan, was born on April 26, 1937 in a village called Viragalur in Tiruchirappalli district in the southern Indian state of Tamil Nadu, and inspired by the work of Jesuit priests from an early age, studied theology starting in 1957, the resolution said.
According to the resolution, Father Stan played a key role in one of the most significant Adivasi movements in contemporary India, the Pathalgadi movement, which used Adivasi traditions of stone carving (for instance, for gravestones) to spread information among Adivasi communities regarding rights guaranteed to them under the Indian Constitution.
"During these decades in Jharkhand, Father Stan advocated for and raised awareness regarding the implementation of provisions of the Indian Constitution like the Panchayat (Extension to Scheduled Areas) or the PESA Act, which instituted self-governance for people dwelling in Adivasi lands," the resolution said.

A US-based forensic firm on Tuesday claimed that digital evidence used to arrest Jesuit priest Father Stan Swamy in the Bhima-Koregaon case was "planted" on his computer's hard drive, similar to two other cases involving human rights defenders Rona Wilson and Surendra Gadling.
Swamy, 84, who was an accused in the Elgar Parishad-Maoist links case, died in July 2021, while waiting for interim bail on medical grounds.
An examination of an electronic copy of his computer by Arsenal Consulting, a Massachusetts-based digital forensics firm, concluded that a hacker infiltrated his device and "planted" evidence, The Washington Post reported, citing a new report by the company.
This follows previous reports which documented digital evidence planting on the devices of other human rights activists Rona Wilson and Surendra Gadling, the firm said in its report.
"Over 50 files were created on Swamy's hard drive, including incriminating documents that fabricated links between him and the Maoist insurgency," the report said.
"The final incriminating document was planted on his computer on June 5, 2019, a week before the raid on Swamy," the report said.
It was on the basis of these documents that he was first arrested in the Bhima Koregaon case, despite experts raising doubts about the authenticity of the documents, it added.
The Elgar case relates to alleged inflammatory speeches delivered at the 'Elgar Parishad' conclave, held at Shaniwarwada in Pune on December 31, 2017, which the police claimed triggered violence the next day near the Koregaon-Bhima war memorial located on the city's outskirts.
The Pune Police claimed the conclave was backed by Maoists.
After Swamy's death, a spokesperson for the Ministry of External Affairs had said that his detention followed due process of law.
In response to the media queries on the demise of Father Swamy last year, the MEA spokesperson said that his bail applications were rejected by the courts because of the specific nature of charges against him.
"India's democratic and constitutional polity is complemented by an independent judiciary, a range of national and state level Human Rights Commissions that monitor violations, a free media and a vibrant and vocal civil society. India remains committed to promotion and protection of human rights of all its citizens,&rdquo; he had said.&nbsp;

Battling Parkinsons and other age-related ailments,&nbsp;84-year-old&nbsp;Father&nbsp;Stan Swamy,&nbsp;who died in incarceration on Monday,&nbsp;was reportedly the oldest man to be charged with terrorism in India. The government accused&nbsp;the&nbsp;tribal rights activist Stan Swamy, who worked for the poor and downtrodden for decades,&nbsp;of being&nbsp;a member of the banned&nbsp;Communist Party of India&nbsp;(Maoist).&nbsp;&nbsp; &nbsp; In jail, in connection with the Bhima Koregaon case from&nbsp;over&nbsp;past&nbsp;nine&nbsp;months, the&nbsp;Roman Catholic priest, who was a member of the Jesuit order,&nbsp;had reportedly fainted&nbsp;many&nbsp;times in custody, particularly after recovering from Covid-19,&nbsp;but the government on several occasions opposed his bail pleas citing threat to the nation.&nbsp;&nbsp; &nbsp;&nbsp; Father&nbsp;Stan Swamy,&nbsp;was arrested on October of 2020 from his home in Ranchi and the National Investigation Agency had booked him under the&nbsp;Unlawful Activities (Prevention) Act for his alleged role in the 2018 Bhima Koregaon violence.&nbsp;&nbsp; &nbsp; The caste-clash in the small but historical village of Bhima Koregaon in Maharashtra had unfolded on the&nbsp;New Year&rsquo;s Day&nbsp;of 2018 when people were&nbsp;commemorating&nbsp;the 200th anniversary of the Battle of Bhima Koregaon.&nbsp;Lower caste communities had backed the British who won against the upper caste Peshwas, the resultant&nbsp;caste-tensions continue to prevail.&nbsp;&nbsp; &nbsp; The police first booked two members of an upper caste Hindu right wing&nbsp;group but days later claimed that there was a large conspiracy by Maoist groups to stoke violence and&nbsp;that&nbsp;clash&nbsp;took place due to an event held on&nbsp;last day of&nbsp;2017 called&nbsp;the&nbsp;Elgar Parishad.&nbsp;&nbsp; &nbsp; The NIA&nbsp;soon took over the probe and in its&nbsp;charge-sheet named&nbsp;eight people, including Father Stan Swamy, for their alleged involvement in inciting a mob to violence in Bhima Koregaon.&nbsp; Swamy&nbsp;was&nbsp;questioned multiple times by the NIA&nbsp;which also alleged that Swamy was a convenor of Persecuted Prisoners Solidarity Committee that the government claims is a&nbsp;frontal&nbsp;organisation&nbsp;of CPI (Maoists).&nbsp;&nbsp; &nbsp; Swamy was born on April 26, 1937 in Tamil Nadu's&nbsp;Trichy&nbsp;and was inspired by the work of the Jesuit priests. Swamy&rsquo;s lawyers had moved the Bombay High Court on Monday morning, seeking an urgent hearing on his medical bail plea after the 84-year-old's health took a turn for the worse on Sunday and he was put on ventilator support. Swamy had sought interim bail on grounds of the pandemic citing his various health issues, including Parkinson&rsquo;s disease.
Swamy, who has been hospitalised since May, was in the Intensive Care Unit and was put on a ventilator on Sunday after he had difficulty breathing and his oxygen levels were fluctuating.

NIA files charge-sheet against 8 in Bhima Koregaon case

After arresting 83-year-old Jesuit priest in connection with the Bhima-Koregaon case, the National Investigation Agency (NIA) has now filed a charge-sheet against 8 people. The investigating agency has filed chargesheet against&nbsp;Anand Teltumbde, Gautam Navlakha, Hany Babu, Sagar Gorkhe, Ramesh Gaichor, Jyoti Jagtap, Stan Swamy &amp; Milind Teltumbde.
The case relates to an event of December 31, 2017 in Pune which was followed by violence and arson in Maharashtra that left one person dead. Investigators have alleged the activists at the Elgar Parishad meet had made inflammatory speeches and provocative statements, which it said triggered violence the next day.

83-year-old human rights activist, Father Stan Swamy, was arrested by the NIA on Friday in connection with the violence in Bhima Koregaon near Pune in 2017. The Father, in a video,said he had been questioned for over 15 hours in 5 days in connection with the case. He was arrested for links with the banned CPI(Maoist) and being actively involved with the group. NIA claims to have found enough documents and propaganda material to link him. NIA officials alleged that Swamy received funds through an associate for furthering the agenda. The Father said that this is not something unique happening to him alone and has happened to anyone who has raised their voice against the ruling power. " I am ready to pay the price whatever be it", he said. Swamy will be moved to Mumbai where the agency will ask for his remand before a court.
