The Supreme Court on Tuesday adjourned to October 15 the hearing on a plea filed by Sonam Wangchuk's wife Gitanjali J Angmo challenging the climate activist's detention under the National Security Act, and seeking his immediate release.
A bench of Justices Aravind Kumar and N V Anjaria posted the matter for hearing on Wednesday due to paucity of time.
The top court on October 6 had issues notices to the Centre and the Union Territory of Ladakh. It, however, refused to pass any order on her plea for providing her the grounds of detention and posted the matter for hearing on October 14.
Wangchuk was detained under the stringent National Security Act (NSA) on September 26, two days after violent protests demanding statehood and Sixth Schedule status for Ladakh left four people dead and 90 injured in the Union territory. The government had accused him of inciting the violence.
The NSA empowers the Centre and states to detain individuals to prevent them from acting in a manner "prejudicial to the defence of India". The maximum detention period is 12 months, though it can be revoked earlier.
Wangchuk is lodged in Jodhpur jail in Rajasthan.
In her plea, Angmo has also questioned the decision to invoke the NSA against Wangchuk.
Filing the habeas corpus (bring the person) writ, the spouse of the detained activist sought urgent listing of the plea and a direction to the Ladakh administration to "produce Sonam Wangchuk before this court forthwith".
It also sought immediate access to the detenue, and quashing of the preventive detention order.

The Supreme Court on Monday sought response from the Centre and Union Territory of Ladakh on a plea filed by Sonam Wangchuk's wife Gitanjali J Angmo challenging the climate activist's detention under the National Security Act, and seeking his immediate release.
However, a bench of Justices Aravind Kumar and N V Anjaria refused to pass any order on providing grounds of detention to Wangchuk's wife and posted the matter for hearing on October 14.
Wangchuk was detained under the stringent National Security Act (NSA) on September 26, two days after protests demanding statehood and Sixth Schedule status for Ladakh left four people dead and 90 injured in the Union territory.
Wangchuk is lodged in Jodhpur jail in Rajasthan.
Senior advocate Kapil Sibal, appearing for Wangchuk's wife, sought directions from the apex court that the grounds of detention should be served on her.
Solicitor General Tushar Mehta submitted that the grounds of detention have been served on the detenue (Wangchuk).
Mehta stated that there is no legal requirement for the grounds of detention to be given to the wife.
Sibal pressed for an interim order for the supply of grounds, saying detention order cannot be challenged without a copy.
Justice Kumar then said, "At this stage, we will not say anything." The bench, however, noted the submission of the Solicitor General that he would examine feasibility of supply of grounds of detention.
Mehta stated that the petitioner was trying to create a "hype" and an "emotive issue" that Wangchuk was denied medical relief and meetings with his wife.
In her plea filed through senior lawyer Vivek Tankha and lawyer Sarvam Ritam Khare, Angmo has also questioned the decision to invoke the NSA against Wangchuk, which allows detention without trial for up to 12 months.

The plea, which named the Ministry of Home Affairs, the Ladakh UT administration, deputy commissioner of Leh, and the Jodhpur jail superintendent as parties, also sought a direction to them to "allow immediate access of the petitioner to her husband, both telephonic and in person".
The plea alleged that Wangchuk's detention was "illegal, arbitrary, and unconstitutional", violating the fundamental rights guaranteed under Articles 14, 19, 21 and 22 of the Constitution.
"Wangchuk, who has been an internationally acclaimed innovator, environmentalist, and social reformer, has always espoused Gandhian and peaceful methods to highlight the ecological and democratic concerns of Ladakh," it said.
On September 26, Wangchuk was detained by the deputy commissioner of Leh under Section 3(2) of the NSA, as he was recovering from a prolonged fast to highlight Ladakh's demand for constitutional safeguards under the Sixth Schedule.
He was swiftly shifted to the Central Jail in Jodhpur without being provided medicines, personal belongings, or access to his family and counsel, the plea said.
No grounds of detention have been furnished till date, either to Wangchuk or to his family, the petition submitted.
His wife alleged that she has been kept under virtual house arrest in Leh, while students and staff of the Himalayan Institute of Alternatives, Ladakh (HIAL), founded by Wangchuk, are facing harassment, intimidation, and intrusive investigations.
"The arbitrary transfer of Wangchuk to Jodhpur, the harassment of students and staff of HIAL, the virtual house arrest of the petitioner herself, and the false propaganda linking Wangchuk to foreign entities clearly demonstrate mala fide state action intended to suppress democratic dissent and peaceful environmental activism," the plea submitted.
Wangchuk's detention has also inflicted severe mental pain and anguish on the people of Ladakh, who revere him as their leader, it stated.
"A recent tragic incident has been reported where a member of the Ladakh Buddhist Association committed suicide, allegedly depressed after his (Wangchuk's) detention, underscoring the devastating psychological impact on the community," it said.
"Direct respondents to ensure that Sonam Wangchuk is provided with his medicines, clothes, food and other basic necessities forthwith," the plea said.
It also sought a direction to the authorities to place before the top court "the order of detention along with grounds of detention and all records pertaining thereto".
It sought a direction to the respondents to produce a medical report of Wangchuk, after immediate doctor consultation, before the court.
"Stop immediate harassment of HIAL and its members/students who have done no harm and are tirelessly working for the benefit of the ecology," the plea said.

The CBI has launched an inquiry into alleged violations of the Foreign Contribution (Regulation) Act by Sonam Wangchuk&rsquo;s Himalayan Institute of Alternatives Ladakh (HIAL).

The Central Bureau of Investigation has begun an inquiry into alleged violation of Foreign Contribution (Regulation) Act against an institution founded by Ladakh-based educationist and activist Sonam Wangchuk, officials said on Thursday.
There has been an inquiry going on for some time but no FIR has been registered yet, they said.
When contacted, Wangchuk told PTI that a CBI team came with "an order" about 10 days ago, saying that they are acting on a complaint from the Ministry of Home Affairs regarding alleged Foreign Contribution (Regulation) Act (FCRA) violations in the Himalayan Institute of Alternatives Ladakh (HIAL).
"The order said we have not taken clearance under FCRA to receive foreign funds. We don't want to be dependent on foreign funds, but we export our knowledge and raise revenue. In three such instances, they thought it was foreign contribution," Wangchuk claimed.
He said a CBI team visited HIAL and the Students' Educational and Cultural Movement of Ladakh (SECMOL) last week, seeking details of foreign funds received by them between 2022 and 2024.
The teams are still camping in Ladakh and going through accounts and statements of the organisations, he said.
Wangchuk said the matters the complaint refers to were service agreements with taxes duly paid to the government. They pertained to India exporting knowledge to the United Nations, Swiss University and an Italian organisation, he said.
"It was a very dignified assignment. They saw it and they were convinced. They understood it is not helping them, so they began asking for accounts outside that period. Their mandate was to check for accounts during 2022-24, but they started asking for accounts of 2021 and 2020. Then they went to our school asking for various documents outside their mandate period and a school outside the complaint's purview," Wangchuk alleged.
Both these schools give free education to needy young students. In HIAL, students are paid stipend for their work on various projects, he said.
"The CBI officers are still camping in Ladakh and rigorously going through records," Wangchuk said, adding that they have not questioned him.
The activist said first, the local police filed a sedition case against him. This was followed by an order taking back the land given for HIAL, citing that the lease amount was not paid.
"Everyone knows, we have documents to show. The government had almost been apologetic in saying that their lease policy is not formed and hence it cannot take fee. It said 'please bear with us and continue constructions'," he claimed.
Wangchuk alleged that this was followed by the CBI action and income tax summons.
"The funny part is, Ladakh is one place where there is no tax. Yet I voluntarily pay taxes, and I get summons. Then they resurrected a four-year-old complaint that labourers were not paid properly. It is guns blazing from all sides on us," he alleged.
Wangchuk had started a hunger strike on September 10, pressing for Ladakh's inclusion in the Sixth schedule and for statehood.
The cold desert region witnessed the worst violence since 1989 on Wednesday, when groups of youths indulged in arson and vandalism, targeting the BJP headquarters and the Hill Council, and set ablaze vehicles.
Police and paramilitary forces had to lob teargas shells to bring the situation under control, officials said.&nbsp;

At least 50 people were detained as police and paramilitary forces strictly implemented curfew on Thursday in the violence-hit Leh, where four people were killed and over 80 others were injured when widespread clashes broke out a day before.
A shutdown called by the Leh Apex Body (LAB) -- to advance talks with the Centre on demand for statehood and extension of Sixth Schedule to Ladakh -- had descended into violence, arson and street clashes on Wednesday.
Strict prohibitory restrictions banning assembly of five or more persons have been placed in other major towns as well, including Kargil where a shutdown was called by the Kargil Democratic Alliance (KDA) in support of climate activist Sonam Wangchuk, who was leading a hunger strike.
Wangchuk's fortnight-long hunger strike was called off after intense clashes broke out in Leh town. The protesters had set ablaze the BJP office and several vehicles, besides vandalising the Hill Council headquarters, prompting promulgation of an indefinite curfew in the town.
"The situation in the curfew-bound areas is well under control. There are no untoward incidents reported from anywhere," a police official told PTI.
He said around 50 people were detained overnight for their involvement in the violence.
The official said three among the injured were citizens of Nepal and police are probing if there are foreign hands behind the violence.
The LAB and KDA have been spearheading an agitation in the last four years pressing for their demands on statehood and extension of Sixth Schedule. They have held several rounds of talks with the Central government in the past. The next round of talks is scheduled on October 6.
Officials said heavy deployment of police and paramilitary personnel in riot gear was made in Kargil, Zanskar, Nubra, Padam, Changtang, Drass and Lamayuru.
Kargil District Magistrate Rakesh Kumar issued prohibitory orders under Section 163 of the Bharatiya Nagarik Suraksha Sanhita in the entire district, banning assembly of five or more persons, taking out processions or holding demonstrations without prior written permission of the competent authority.
Restrictions were also imposed on the use of loudspeakers, sound amplifying devices, or vehicle-mounted public address systems without authorisation. Besides, no person shall make any public statement, speech, or declaration -- whether verbal, written, or through electronic means -- which is likely to disturb public peace, provoke enmity, or cause a breach of law and order in the district, the official order said.
Trouble began brewing in Leh when two out of 15 people, who were on a 35-day hunger strike since September 10, were shifted to hospital after their condition deteriorated on Tuesday evening, and the LAB youth wing gave a call for protest.
The Centre had alleged that the mob violence was guided by the "provocative statements" of activist Wangchuk. It said certain "politically motivated" individuals were not happy with the progress made in the ongoing talks between the representatives of the government and Ladakhi groups.
"The government stands committed to aspirations of the people of Ladakh by providing adequate constitutional safeguards," the home ministry said in a statement on Wednesday night.
Terming the events heart-wrenching, Lt Gov Kavinder Gupta had said everyone has the right to speak up in a peaceful manner in a democratic system, but what happened was not spontaneous and was the result of a conspiracy.
"Curfew has been imposed as a precautionary measure to prevent more casualties," Gupta said.
In an online press conference, Wangchuk said the fact that Tsering Angchuk (72) and Tashi Dolma (60) hospitalised was most likely the immediate trigger for the protest.
With the situation worsening rapidly, he stepped in with an appeal and an announcement that he was cutting short the fast.
"I request the youth of Ladakh to stop the violence forthwith as it only causes harm to our cause and further deteriorates the situation. We do not want instability in Ladakh and the country," he told his supporters.
"This is the saddest day for Ladakh and for myself personally because the path we are treading for the last five years was peaceful... We held hunger strikes on five occasions and walked from Leh to Delhi, but today we are seeing our message of peace failing because of the incidents of violence and arson," Wangchuk said.&nbsp;

He alleged that by not agreeing to their demand for statehood and safeguards for the tribal people under the Sixth Schedule of the Constitution, the government is endangering India's national security in a strategic border region.

Educationist, reformer, and innovator Sonam Wangchuk appealed to the Narendra Modi government to help protect Ladakh and its natural features which are at risk from industrialisation.
Wangchuk, who inspired one of the characters in the movie '3 Idiots', plans to sit on a 5-day fast from 26 January at Khardung La pass at an altitude of 18,000 ft with temperatures as low as (-)40 degrees Celsius.
He told news agency ANI on 22 January 2023 that unchecked rise of industries, tourism, and commerce will "finish" Ladakh.
