The Central Bureau of Investigation (CBI) on Friday filed an appeal before the Calcutta High Court, urging the imposition of the death penalty on Sanjay Roy, convicted in the RG Kar hospital rape-murder case.
A division bench comprising Justice Debangsu Basak and Justice Md Shabbar Rashidi scheduled the hearing for January 27. The appeal will also address a similar plea by the West Bengal government seeking to upgrade Roy's life sentence to capital punishment.
Deputy Solicitor General Rajdeep Majumdar, representing the CBI, argued that the central agency, as the primary investigating body, has the right to challenge the trial court's sentencing order on grounds of inadequacy.
On January 20, a Sealdah court sentenced Roy to life imprisonment until the end of his natural life for the rape and murder of a doctor on duty at RG Kar Medical College and Hospital on August 9, 2024.
The CBI's appeal contests the lower court's decision, asserting that the gravity of the crime warrants the maximum punishment. The West Bengal government, represented by Advocate General Kishore Dutta, has similarly argued that the life sentence is insufficient for the heinous crime and urged the court to award the death penalty to Roy.
The division bench has stated it will hear arguments from the CBI, the state government, the victim&rsquo;s family, and the convict&rsquo;s counsel before deciding on the appeal's admission. The CBI has also opposed the state&rsquo;s right to file an appeal, claiming it holds sole prosecutorial authority in the case.
The case has reignited debates on sentencing adequacy for heinous crimes, with both the CBI and the state pushing for the highest level of punishment for justice.

Speaking to ANI, one of the junior doctors stated that they would appeal to higher courts for a stricter sentence. "We wanted a strict and exemplary punishment; this is not enough. We will move to higher courts seeking a harsher judgement," the doctor said.

West Bengal Chief Minister Mamata Banerjee also expressed her dissatisfaction over the court's decision to sentence Roy to life imprisonment. She stated that had the case remained under Kolkata Police jurisdiction, they would have ensured a death penalty.&nbsp;
"I learned about the sentencing from the media. We have always demanded capital punishment, and we stand by it. However, this is the court's decision, and I can't say much about it. For three other cases, Kolkata police ensured capital punishment through thorough investigations concluded within 54-60 days. This was a serious case. Had it been under our purview, we would have ensured the death penalty long back," CM Mamata said while addressing the media in Malda. Congress leader Salman Khurshid, on the other hand, welcomed the judgment, stating it would send a strong message to potential offenders. "The biggest concern that people express is that many tragic incidents take place, and people wait for the Court, which leads to apathy. But in this case, the investigation was swift, and the Court pronounced its judgment in very little time. The judgment is apt, and it should be welcomed. Will it convey a message to those who commit such crimes?" Khurshid said.
Union Minister Sukanta Majumdar expressed his dissatisfaction with the verdict and called for a more in-depth investigation.&nbsp;
"We wanted the highest punishment for the convict Sanjay Roy. As an elected representative, I can't comment against the court's decision. The public of West Bengal doesn't believe that only one person is involved in the RG Kar rape-murder case. I think there should be more depth in this, as Sanjay is claiming that there were also police and other people involved," said Majumdar.
The case involves the rape and murder of a trainee doctor, whose body was found on August 9 in the seminar room of RG Kar Medical College and Hospital. The Sealdah Civil and Criminal Court handed down a life imprisonment sentence on Monday to Sanjay Roy, the accused in the RG Kar rape and murder case.&nbsp;
In addition to the prison term, the court imposed a fine of Rs 50,000. During the trial, the Central Bureau of Investigation (CBI) argued in favor of the death penalty for Roy.&nbsp;
Addressing the defendant, the court stated, &ldquo;I told you the previous day the charges you were convicted against and the charges that have been proven against you.&rdquo;
The court of Additional District and Sessions Judge Anirban Das in Sealdah had on Saturday held Roy guilty of the crime committed against the postgraduate trainee doctor at the hospital on August 9 last year, which sparked off unprecedented and prolonged nationwide protests.
Judge Das said the crime did not fall under the "rarest of the rare" category as justification for not giving death penalty to the convict.
When questioned about the allegations, Roy maintained his innocence. &ldquo;I have not done anything, neither rape nor murder. I am being falsely implicated. You have seen everything. I am innocent. I already told you that I was tortured. They made me sign whatever they wanted,&rdquo; he said.&nbsp;
His lawyer argued that even in extreme cases, the possibility of reform should remain. &ldquo;Even if it is a rarest of rare cases, there should be scope for reformation. The court has to show why the convict is not worth reformation or rehabilitation... The public prosecutor has to present evidence and give reasons why the person is not worth reformation and should be completely eliminated from society...&rdquo;
In contrast, the lawyer representing the victim&rsquo;s family called for the maximum penalty. &ldquo;I want the death sentence as maximum punishment...&rdquo; he stated. The victim&rsquo;s father echoed this demand, declaring that their fight for justice would continue both in the courts and on the streets.&nbsp;
&ldquo;On Saturday, the judge said that the harshest punishment would be given (to the accused). We have full faith in the judge. Our fight will continue in the courts and streets,&rdquo; he told ANI.
Meanwhile, West Bengal Chief Minister Mamata Banerjee highlighted her administration&rsquo;s cooperation with the investigation. Speaking before the court proceedings began, Banerjee said, &ldquo;We have cooperated with the investigation...we had demanded justice but judiciary had to run its course so that&rsquo;s why it took this much time but we always wanted the victim to get justice.&rdquo;
The guilty verdict against Sanjay Roy was delivered on Saturday. The court stated that Roy had been charged under sections 64, 66, and 103/1 of BNS, citing allegations that he assaulted and murdered the trainee doctor in a seminar room at RG Kar Medical College and Hospital.&nbsp;
The incident, which occurred on August 9, prompted widespread public protests. Roy, who worked as a civic volunteer at the hospital, was subsequently arrested.

Roy, a former civic volunteer with Kolkata Police, was arrested on August 10, a day after the 31-year-old doctor&rsquo;s body was discovered in the hospital seminar room. He was convicted of both rape and murder under Sections 64, 66, and 103(1) of the Bharatiya Nyaya Sanhita (BNS).
Section 64 prescribes a minimum sentence of 10 years for rape, which can extend to life imprisonment. The Sealdah court on Friday granted bail to former officer-in-charge of Tala police station Abhijit Mondal and RG Kar hospital ex-principal Sandip Ghosh in the rape and murder case of an on-duty doctor at the medical facility.
The additional chief judicial magistrate (ACJM) granted bail to the two accused persons as the chargesheet against them was not filed within the mandatory 90-day period, a lawyer representing Ghosh said.
The court granted bail to Ghosh and Mondal on bail bonds of Rs 2,000 each and directed them to cooperate with the investigation.
While Mondal was accused of alleged delay in filing of FIR in the case, Ghosh was charged with tampering with evidence.
The post-graduate trainee was raped and murdered, and her body was found in the seminar room of the state-run RG Kar Medical College and Hospital on August 9.
Ghosh and Mondal were arrested by the Central Bureau of Investigation (CBI), which is investigating the case on an order of the Calcutta High Court.
Mondal&rsquo;s lawyer told reporters outside the court that he would walk out of the correctional home where he is incarcerated on judicial remand.
Ghosh, who is on judicial remand in another case of alleged financial irregularities at RG Kar hospital, will, however, remain behind bars despite being granted bail in the rape-murder case.
Earlier in the day, they were produced before the court of ACJM Arijit Mondal under heavy police security.
During the hearing, lawyers for the two accused prayed before the judge that they be granted bail, as the CBI could not submit a chargesheet against them within the statutory period of 90 days.
The CBI submitted that an investigation into the case was in progress.
The central probe agency has, however, filed a chargesheet against the prime accused, Sanjay Roy, in the rape-murder case.
In the chargesheet filed before a special CBI court here, it said that Roy, who was working as a civic volunteer with the local police, allegedly committed the crime on August 9 when the medic had gone to sleep in the hospital&rsquo;s seminar room during a break.
