A Mumbai court has refused anticipatory bail to actor Ajaz Khan in a rape case.
Additional sessions judge (Dindoshi court) Datta Dhoble on Thursday denied relief to Khan, ruling that "considering the nature and gravity of the allegations, there is need for custodial interrogation of the applicant".
The prosecution has alleged that the victim, also an actor, was induced into a relationship by Khan. He allegedly misused his position as a celebrity and host of a reality show to gain the victim's confidence, the prosecution said.
The FIR alleged that on the false pretext of marriage, promises of financial help and professional advancement, Khan established physical relations with the victim on multiple occasions "without her free and unequivocal consent".
Khan has been booked under relevant provisions of Bharatiya Nyaya Sanhita sections concerning rape and physical relationship obtained through deceitful means.
Pressing for anticipatory bail, Khan's advocate submitted that his client has been falsely implicated in the case.
"The informant (victim) was well aware that the actor was already married. Both are majors. That the relationship between him and the informant was consensual," he submitted.
The defence placed before court certain WhatsApp chats and audio recordings purportedly showing that the victim demanded money to withdraw the case and that the physical relationship was consensual.
The prosecution, on the other hand, contended that Khan's custodial interrogation was necessary for recovery of his mobile phone, verification of WhatsApp chats and call recording.
It submitted that the applicant has a prior criminal record and he may tamper with evidence or influence the victim and witnesses if granted anticipatory bail.
The court after hearing both the sides noted that the FIR discloses specific dates, locations and circumstances under which the incident occurred, including the assurances allegedly given by the applicant, not just of marriage, but also professional help and financial assistance for the victim's family.
"Prima facie, this cannot be brushed aside as a simple case of consensual relationship. The consent appears to be obtained by fraud or under misrepresentation of facts," the court noted.
Though the victim is a major but considering allegations it appears that consent is not free and unequivocally within the meaning of law, it said.
The court held that Khan's custodial interrogation was necessary for his medical examination and "collection of other digital evidence".
"The risk of tampering with evidence or influencing witnesses cannot be ruled out, if the pre-arrest bail is granted," the court said while rejecting his plea.
Earlier, Khan was named in a case along with many others for alleged obscene content in their web show 'House Arrest', which is streamed on Ullu app.

The conviction stems from charges of raping a woman from Zirakpur, Punjab, after allegedly luring her with promises of assistance in traveling abroad. The sentence will be declared on April 1, while six other individuals have been acquitted in the case.
Singh, who is no stranger to controversy, recently made headlines when a video emerged showing him assaulting a man and a woman in his office.
The footage displayed Singh throwing objects and repeatedly slapping the man, before turning his attention to a woman, ultimately hurling a book-like object and hitting her.
In another unsettling incident reported on February 28, a 22-year-old woman accused Singh of sexual harassment. According to her complaint, she and her family began attending Singh's church in October 2017.
She claimed that Singh took her phone number and started sending her text messages.
Out of fear, she kept this from her parents. From 2022, Singh allegedly began isolating her in a cabin at the church, where he would hug and touch her inappropriately.
He reportedly threatened her with harm to her and her family if she reported his actions.
In a separate case in 2022, Singh faced accusations from a family in Delhi after accepting money to treat their ill daughter, who unfortunately passed away.
Adding to his troubles, Singh's premises were raided by the income-tax department in 2023.
Singh, who was born into a Jat family in Haryana, claims to have converted to Christianity over a decade ago. He currently operates churches in Jalandhar and Mohali and maintains a substantial following on social media.

"It all started when the lover of the girl raped her in January and made a video of the incident. He started blackmailing her on the basis of that video. Later on, his friends and acquaintances gang-raped her at least on four to five occasions at different places, including Dombivili, Badlapur, Murbad and Rabale in the district," he said.
A special investigation team (SIT) has been formed under ACP Sonali Dhole to probe the case, he added.
"The victim has named 33 persons. Out of them, 24 persons have been arrested and two minors detained in this connection. The girl's condition is said to be stable," Karale said.
Search is on to nab the other accused involved in the crime, he added.

Sawant was responding to accusations by the Opposition, which alleged a breakdown in the law and order situation in Goa after two minor girls were allegedly raped at Colva beach.

Responding to the alleged rape of two minor girls, Goa&nbsp;Chief Minister Pramod Sawant told the state Assembly on Wednesday that the parents of teenagers need to introspect as to why their wards hang out on the beaches after nightfall.
Sawant was responding to accusations levelled by the Opposition MLAs, who had alleged a breakdown in the law and order situation in Goa after two minor girls were allegedly raped at the popular Colva beach in South Goa on the night of July 24.
The Chief Minister said that ten&nbsp;children went for a party on the beach and out of the 10, six returned home. He said when a 14-year old girl spends the night on the beach, the parents too have to introspect, they too should be taking care. He said just because children are not listening to their parents, the government cannot leave all the responsibility to the police.
