Gujarat High Court on Monday took the state government to task over Rajkot gaming zone fire that killed 28 people questioning how the amusement centre had been operating for over 2 years without permits and clearance from the municipal body.&nbsp;
The development comes a day after a special bench of the Gujarat High Court on Sunday took suo motu cognizance of the fire incident at a game zone in Rajkot which left 28 persons dead and said it was prima facie a "man-made disaster".
The court has asked the advocate of the municipal corporation to appear before it on Monday.&nbsp;
The bench lost its cool when it was informed that the gaming zone had been operating for a long time, sans required permits or clearances, NDTV report said, adding that it said it could no longer trust the Gujarat government which is led by Bharatiya Janata Party.&nbsp;
Further, the court pulled up the body and questioned what it had been doing or did it turn a 'blind eye' or 'fall asleep'. The furious bench was at loss of words when it was told the fire safet certification hearing have been unresolved for couple of years.&nbsp;
The court's response was in Rajkot municipal body's answer that 'our approval was not taken...'

Earlier on Sunday, the court said, "We are shocked to read newspaper reports which indicate that the gaming zone at Rajkot appears to have taken advantage of the loopholes in the Gujarat Comprehensive General Development Control Regulations (GDCR). These entertainment zones, as newspapers suggest, have come up without the necessary approvals from the competent authorities," the court observed.
The HC also wanted to know from the state government and the municipal corporations "whether such licenses, including the licenses to its use and compliance of fire safety regulations" were given to these respective (entertainment) zones that are in territorial jurisdiction of these corporations.
Quoting newspaper reports, the high court said temporary structures were created at the TRP game zone in Rajkot in order to overcome the hurdles caused in taking necessary permissions, no-objection certificates, including the fire NOC and construction permission.
Not just Rajkot, such game zones have come up in Ahmedabad city as well and they "pose a significant threat to public safety, specially the innocent children," it said.
"Apart from having constructed such gaming zones/ recreational activities, they have been put to use apparently, according to our information through the newspaper reports, without permission," the court said.

Meanwhile, the Gujarat government on Monday ordered the suspension of five officials, including two police inspectors and civic staff, with immediate effect for negligence in connection with the Rajkot game zone fire.
The officials have been held responsible "for their gross negligence in allowing this game zone to operate without necessary approvals," stated a government release.
Notably, it has emerged the facility, where the blaze erupted on Saturday, was operated without the fire NOC (no objection certificate).
"The game zone had received permissions from the roads and buildings department. It had also submitted a proof of fire safety equipment to obtain the fire NOC which was under process and not yet completed," Rajkot Police Commissioner Raju Bhargava told reporters on Sunday.
The government's action of suspending five officials comes a day after Chief Minister Bhupendra Patel inspected the site where the fire erupted on Saturday and instructed the departments concerned to take strict and punitive action against those responsible for such a serious incident.
Those who have been suspended are Rajkot Municipal Corporation's town planning department assistant engineer Jaideep Chaudhary, assistant town planner for RMC Gautam Joshi, Rajkot Roads and Buildings department's deputy executive engineer MR Suma, and police inspectors VR Patel and NI Rathod, as per orders passed by the respective departments.
The fire at the TRP game zone in Nana-Mava locality of Rajkot on Saturday evening killed 27 persons including children.
The police have arrested two persons and registered an FIR against six partners of the game zone and another accused on various charges, including culpable homicide not amounting to murder, officials earlier said.

Officials stated that the bodies were charred beyond recognition, and DNA samples from the bodies and the victims' relatives had been collected for identification.

NDTV citing officials said, the amusement center was operating without a no-objection certificate (NOC) for fire clearance and had only one exit.
The report, citing sources further said that the gaming zone, named TRP, was crowded due to a weekend discount offer with tickets priced at just ₹99. While it is suspected that the fire might have started due to a short circuit, officials noted that the exact cause would only be determined after a thorough investigation.
A fire department official mentioned that the reason for the fire was yet to be ascertained. The official explained that efforts to extinguish the fire were ongoing but were complicated by the collapse of the temporary structure and high wind velocity.

According to sources, the gaming zone did not possess the necessary licenses to operate and lacked an NOC for fire clearance from the Rajkot Municipal Corporation. This failure in regulatory compliance has come under sharp scrutiny following the disaster. Rajkot Mayor Nayna Pedhadiya, who oversaw the rescue operations, confirmed the absence of a fire NOC, asserting that the issue would be thoroughly investigated.
Additionally, Rajkot fire officer Ilesh Kher informed reporters that the facility had only one emergency exit and that a temporary structure near the entrance collapsed, making it difficult for people to escape.
In the aftermath, the owner and manager of the TRP game zone were detained for questioning. The state director general of police has issued instructions to police commissioners and superintendents to inspect all gaming zones in Gujarat and shut down those operating without fire safety permission. This inspection is to be carried out in coordination with municipal fire officers.
