2012 Chhawla gangrape case: SC agrees to set up new bench to hear review plea

CJI Chandrachud then said it will constitute a bench of himself and Justices S Ravindra Bhat and Bela M Trivedi to hear the review plea.

The Supreme Court on Wednesday agreed to constitute a three-judge bench to consider a plea of the Delhi Police for review of its verdict acquitting three death row convicts in the gang-rape and murder case of a 19-year-old girl in Delhi's Chhawla area in 2012.
A bench of Chief Justice DY Chandrachud and Justices PS Narasimha and JB Pardiwala was told by Solicitor General Tushar Mehta, appearing for the Delhi Police, that one of the accused acquitted by this court has recently slit a throat of a person.
"What I am saying is that all these accused, who were acquitted are hardened criminals. Therefore, we are seeking review of last year's verdict&rdquo;, Mehta said, adding that a three-judge bench headed by the then CJI had pronounced the verdict.
CJI Chandrachud then said it will constitute a bench of himself and Justices S Ravindra Bhat and Bela M Trivedi to hear the review plea.

Mehta then requested the court to accord open court hearing on the review plea. The bench said it is up to the new bench to decide upon an open court hearing plea. "We will see to it, when the new bench takes up the matter&rdquo;, the CJI said.
The three were acquitted by the court on November 7, last year.&nbsp;

MHA files review petition in SC on observations on Sikkimese Nepali

The MHA's move came amid protests in Sikkim over the Supreme Court observation referring to Sikkimese Nepalis as "immigrants" while extending income tax exemption to all old settlers of the state.

The Ministry of Home Affairs on Monday filed a review petition in the Supreme Court against some of its observations referring to Sikkimese Nepalis as "immigrants".
In a series of tweets, the Union Home Minister's office said the central government has submitted before the Supreme Court its position about the sanctity of Article 371F of the Constitution that safeguards the Sikkimese identity.
"Ministry of Home Affairs (MHA) files review petition in Supreme Court against some of the observations and directions in a recent judgement dated 13th January, 2023 in two petitions of 2013 and 2021 filed by Association of Old Settlers of Sikkim and Ors in Supreme Court.
"GoI (Government of India) reiterated its position about the sanctity of Article 371F of the Constitution that safeguards the Sikkimese identity, which should not be diluted. Further, the observation in the said order about persons of foreign origin settled in Sikkim like Nepalis should be reviewed as the said persons are Sikkimese of Nepali origin," the tweets said.

A new online petition has demanded an independent probe into a "serious breach" by the BBC in its duties as a public broadcaster in the UK over the controversial documentary series on Prime Minister Narendra Modi.
&lsquo;Call for an Independent Investigation into the BBC over Modi documentary&rsquo; on Change.Org, which &ldquo;strongly&rdquo; condemns the British Broadcasting Corporation (BBC) for failing to meet the &ldquo;highest standards of editorial impartiality&rdquo;, has attracted over 2,500 signatures since it went online on Sunday night.
The petition labels &lsquo;India: The Modi Question&rsquo;, the first part of which aired last week and the second is due to be aired on Tuesday, as a piece of &ldquo;sinister propaganda journalism that deliberately misinforms its viewers&rdquo;.

The petition also urges the UK&rsquo;s independent media watchdog &ndash; the Office of Communications (OFCOM) &ndash; to hold the BBC to account for what it calls &ldquo;repeated failures to secure content standards which command the trust of license-fee paying audiences&rdquo; and to discuss necessary corrections and clarifications with the broadcaster.

The judges said that the petitioners had also accepted that the matters had become infructuous.

The storm around one of India's most famous monuments is intensifying. Days after a petition on the Taj Mahal was filed in the Allahabad High Court, a BJP MP has made a big claim.
Diya Kumari said that the land on which the Taj Mahal is built was originally owned by the erstwhile Jaipur royal family. She claimed that Shah Jahan had acquired the land in exchange for some compensation, but the Jaipur royals couldn't challenge the Mughal emperor's decision.
Kumari said, "It's good that someone has raised their voice and filed a petition. If documents are needed in the proceedings, we can provide them if the court orders."
When asked whether the Taj Mahal should be demolished, she said, "I wouldn't say that. But there should be an inquiry regarding the parts of Taj Mahal which are sealed. They should be opened to check what's there."
On May 4, another BJP leader Rajneesh Singh, had filed a petition in the Allahabad High Court. The petition sought instructions to the Archaeological Survey of India, or ASI, to open 20 locked rooms in the Taj Mahal.
The petition said that there is speculation that the locked rooms house idols of Hindu gods, and Hindu scriptures.
